BYLAW N0. 1786 A BYLAW OF THE MUNICIPAL DISTRICT OF BONNYVILLE NO. 87, IN THE PROVINCE OF ALBERTA TO ESTABLISH RATES, FEES AND CHARGES FOR INFORMATION AND SERVICES PROVIDED HEREBY CITED AS THE MASTER RATES BYLAW. WHEREAS, under the provisions of the Municipal Government Act, RS.A 2000, Chapter M-26, Section 191 ( 1) a Council's power to pass a bylaw includes a power to amend or repeal a bylaw; WHEREAS, under the provisions of the Municipal Government Act, RS.A 2000, Chapter M-26, Section 63( 1) ( c) a Council may create a bylaw from provisions of one or more other bylaws; WHEREAS, under the provisions of the Municipal Government Act, RS.A 2000, Chapter M-26, a Council, may pass a bylaw for the establishment of fees for licenses, permits and approvals provided by the municipality; WHEREAS, the Freedom of Information and Protection of Privacy Act, as amended, states that a municipality must make certain information available to the public and that the Council may pass a bylaw to establish fees for the provision of information; WHEREAS, the Council of the Municipal District of Bonnyville No. 87 deems it to be in the public interest to consolidate the fees, rates and charges for various municipal services; NOW THEREFORE, the Council of the Municipal District of Bonnyville No. 87, duly assembled in the Province of Alberta, hereby enacts the following: 1 RATES, FEES AND CHARGES 1.1 The Municipal District of Bonnyville No. 87 establishes the rates, fees and charges set out in Schedule "A" attached to and forming part of this Bylaw. 1.2 Such fees may be subject to G.S.T. 1.3 Council may consider reducing or permitting special rates for particular circumstances, special items, or individual agreements with outside parties, or for any items not covered in Schedule "A", by way of Council resolution. 1.4 The Chief Administrative Officer (CAO) at their discretion, may waive or excuse an individual from paying all or part of a rate or fee set out in Schedule "A" of this bylaw, if in the opinion of the CAO: (a) Facts were not disclosed which should have been disclosed at the time the fee was considered; or (b) Extenuating circumstances warrant a waiver or excusal. 1.5 That in the event this Bylaw conflicts with another existing bylaw, this Bylaw shall take precedence. Page 1 of 36 BYLAW NO. 1786 2 BYLAW AMENDMENTS 2.1 Bylaw No. 1200 to establish the administrative structure for the Municipal District of Bonnyville No. 87 in relation to the Freedom of Information and Protection of Privacy Act, and to set fees thereunder is amended as follows: (a) Schedule of Fees is deleted. (b) Part Ill - Fees, Section 1 is deleted and replaced with "Fees relating to Freedom of Information and Protection of Privacy requests will be set as outlined in Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". 2.2 Bylaw No. 1325 to establish a fee structure in the Municipal District of Bonnyville No. 87 is amended as follows: (a) Section 1 is deleted and replaced with "All assessment appeal applications must be accompanied by the appropriate fee as set out in Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". 2.3 Bylaw No. 1371 Dog Control Bylaw is amended as follows: (a) Schedule "A" Fees is deleted. (b) Section 2 - Definitions, Subsection 2.8 "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (c) Section 3 - Licensing Provisions, Subsection 3.1 (a) "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (d) Section 3 - Licensing Provisions, Subsection 3.1 (b) "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (e) Section 3 - Licensing Provisions, Subsection 3.1 (c) "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (f) Section 3 - Licensing Provisions, Subsection 3.1 (d) "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (g) Section 3 - Licensing Provisions, Subsection 3.10 "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (h) Section 6 - Powers of an Animal Control Officer, Subsection 6.2 (a) "Schedule A of this Bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (j) Schedule "B" - "and fees" is deleted. 2.4 Bylaw No. 1627 Waste and Resource Recovery Management Bylaw is amended as follows: (a) Schedule "f ' is deleted. (b) Part Two - Household Waste and Recycling Collection, Section 2, Subsection 2.2.15 is deleted. (c) Part Three - Landfills and Transfer Stations, Section 3, Subsection 3.3 "Schedule "G" of this bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (d) Schedule "B" Waste Collection Fees, Section 2 "$75 each" is deleted and replaced with "in accordance with Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (e) Schedule "B" Waste Collection Fees, Section 3 "$15.00 per month" is deleted and replaced with "in accordance with Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (f) Schedule "B" Waste Collection Fees, Section 4 "$10.00 per month" is deleted and replaced with "in accordance with Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". 2.5 Bylaw No. 1666 Water and Sewer Bylaw is amended as follows: (a) Schedule "A" is deleted. (b) Schedule "C" is deleted. (c) Section 5 - Water Service, Subsection 5.01 "Schedule "A" to this bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". {d) Section 5- Water Service, Subsection 5.03 "Schedule "A" to this bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (e) Section 5-Water Service, Subsection 5.07 "Schedule "A"" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (f) Section 5 - Water Service, Subsection 5.10 "Schedule "A"" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (k) Section 10 - Changes to Schedules is deleted. 2.6 Bylaw No. 1668 Fire Services Bylaw is amended as follows: (a) Section 8 - Procedure to Obtain Open Fire Permit, Subsection 8.5 "Appendix "A"" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (b) Section 10 - Recovery of Costs, Subsection 10.1 "Appendix "A"" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time". (c) Section 10 - Recovery of Costs, Subsection 10.3 "Appendix "A", an appendix to this bylaw" is deleted and replaced with "Schedule "A" of the Municipal District of Bonnyville No. 87's Master Rates Bylaw as revised from time to time." and "set out in Appendix "A"" is deleted. (d) Appendix "A" Fire Services i. "Schedule of Fees" is deleted and replaced with "Violations ". ii. Sections "Response Fee", "Standby Fee", "Manpower Fee", and "Response fees may apply for the following types of responses" and any respective subsections are deleted. iii. "Other Fees" is deleted and Subsections 2 through to 13 are deleted. 2.7 Bylaw No. 1717 Safety Codes Permit Bylaw is amended as follows: (a) Fees - Section 29 "Fee Schedule" is removed and replaced with "Master Rates". 3 REPEAL 3.1 Upon third reading of Bylaw No. 1786, Bylaw No. 1422 and all amendments thereto are hereby repealed.
