## BYLAW 2000-12
## OF THE MUNICIPAL DISTRICT OF LESSER SLAVE RIVER NO. 124
Being a Bylaw of the Municipal District of Lesser Slave River No. 124 in the Province of Alberta to establish waste disposal, and landfill site regulations and enforcement
WHEREAS, Section 7(a) of the Municipal Government Act, Chapter M-26.1, 1994 empowers a Council to pass bylaws for the safety, health, and welfare of people and protection of people and property; and
WHEREAS, Section 7(i) of the Municipal Government Act, Chapter M-26.1, 1994 empowers a Council to provide for the enforcement of bylaws.
NOW THEREFORE, the Council of the Municipal District of Lesser Slave River No. 124, duly assembled, hereby adopts the waste disposal and landfill site regulation and enforcement bylaw.
## 1. Definitions
- a. "Council" means the elected council of the Municipal District of Lesser Slave River No. 124.
2. "Commission" means the Athabasca Regional Waste Commission or the Lesser Slave Regional Waste Commission. Management servic managemen Services
- C. "Landfill sites" means the Athabasca Regional Waste Management Facility or the Lesser Slave Regional Waste Management Facility and their respective transfer stations located within the Municipal District.
- d. "Manager" means the Municipal Manager or his delegate for the Municipal District of Lesser Slave River No. 124.
- e. "Municipal District" means the Municipal District of Lesser Slave River No. 124.
- f. "Person" means any individual, firm, partnership, corporation, company or organization of any kind.
- g. "Refuse" means all domestic waste and other material as stated in the Alberta Environmental Protection and Enhancement Act - Activities Designation Regulation as being suitable for disposal in a Class I landfill and is deemed non-hazardous by the Waste Control Regulation.
## 2. General Prohibitions
- a. All persons using the landfill sites in the Municipal District must dispose their refuse in the designated areas as determined or directed by the respective Commission and or their designate.
- b. Only the refuse permitted by the Alberta Environmental Protection Enhancement Act - Activities Designation Regulation can be disposed of at the landfill sites.
- C. No person shall light any fires at the landfill sites except authorized Commission personnel and only then in the approved designated burn areas.
4. d.. No person shall conduct salvage or scavenging activities without prior approval of the respective Commission.
- e. The following will not be allowed:
- i. Waste defined as hazardous by the Alberta Environmental Protection and Enhancement Act and the Waste Control Regulation;
- il. Biomedical waste that is not rendered inert;
iii. Radioactive waste;
iv. Explosives;and
V. Bulk liquids.
- f. Any person transporting refuse in the Municipal District shall secure the materials in a manner which will ensure that all of the materials will reach the designated landfill site. Any person failing to comply shall be deemed to be in breach of this bylaw and shall be fined in accordance with Section 4. This will require that all refuse shall be secured in a closed container or by a tarping method.
## 3. Schedule of Fees
All landfill site disposal fees shall be determined by the respective Commission.
## 4. Violation Ticket Contravention Fees
Any person who contravenes this Bylaw without written permission of the Manager or his designatee may:
- a. be charged for any cost incurred in correcting the infraction; and or
- b. be charged a minimum fee of:
i. $100.00 for a first offense;
- ii. $250.00 for a second offense; and
iii. $1,000.00 for a third offense.
## 5. Enforcement
The Bylaw Enforcement Officer/Special Constable are hereby empowered to issue a Violation Ticket to any person who contravenes any provision of the Landfill Site and Enforcement Bylaw.
Bylaw 95-65 is herby rescinded.
This Bylaw shall come into force and effect upon signing.
