## BYLAW NO. 05-2022 ## MUNICIPAL DISTRICT OF SPIRIT RIVER NO. 133 IN THE PROVINCE OF ALBERTA ## AGRICULTURAL APPEAL COMMITTEE BYLAW A Bylaw of the Municipal District of Spirit River No. 133 in the Province of Alberta, for the purpose of establishing an Agricultural Appeal Committee. WHEREAS the Agricultural Pests Act Statutes of Alberta, 1984 Chapter A-8.1, states that the local authority shall at the beginning of each calendar year appoint a committee to hear and determine appeals under this Act; and WHEREAS the Weed Control Act, Chapter W-6, RSA 1980 and amendments thereto, states that the local authority shall at least once a year appoint an independent committee to hear and determine appeals under this Act. NOW THEREFORE the Council of the Municipal District of Spirit River No. 133 in the Province of Alberta, being the local authority, duly assembled hereby enacts as follows: 1. An Agricultural Appeal Committee is hereby established and is referred to herein as "The Committee". 2. The members of The Committee will be appointed by the Council of the Municipal District of Spirit River No. 133 by resolution for the Agricultural Pest Control Act and the Weed Control Act and will hold office for a term of one (1) year following their appointments unless terminated or otherwise vacated. 3. When a member's position on The Committee is terminated or becomes vacant for any reason the Council may appoint a new member to fulfil the unexpired portion of the term of the position. 4. Remuneration shall be paid to appointed members, at a rate established by resolution of the Council. 5. The functions and duties of The Committee shall be to hear and render decisions in respect to appeals under the Agricultural Pests Act and Weed Control Act. 6. The CAO is authorized to select active agricultural appeal committee members from Saddle Hills County, Birch Hills County and/or the Municipal District of Spirit River No. 133 to hear appeals and to ensure unbiased procedure. 7. Three members will constitute a quorum at a meeting of The Committee. 8. A minimum of three and a maximum of five appointed members are to hear an appeal, with quorum being three members. 9. A decision of the majority of members of The Committee quorum shall be a decision of the Committee. 10. The Committee may adopt such other procedures and rules of conduct which in their opinion allows them to adequately fulfill their functions and duties in accordance with the Agricultural Pests Act or Weed Control Act. 11. That Bylaw No. 4-96 is hereby rescinded upon the passing of Bylaw No. 05-2022. 12. This Bylaw is effective upon the third and final reading and signing of the Bylaw and comes into force.
