## MUNICIPAL DISTRICT OF SPIRIT RIVER NO. 133 BYLAW NO. 02-2023 A BYLAW OF THE MUNICIPAL DISTRICT OF SPIRIT RIVER NO. 133, IN THE PROVINCE OF ALBERTA, TO ESTABLISH THE SUBDIVISION AUTHORITY OF THE MUNICIPAL DISTRICT OF SPIRIT RIVER NO. 133 AND AUTHORIZE THE DELEGATION OF SUBDIVISION AUTHORITY TO THE MACKENZIE MUNICIPAL SERVICES AGENCY WHEREAS WHEREAS WHEREAS NOW THEREFORE, section 623 of the Municipal Government Act, RSA 2000 Chapter M-26, as amended, requires that a Municipal Council must by bylaw provide for a subdivision authority to exercise subdivision powers and duties on behalf of the municipality; and pursuant to Section 625 of the Municipal Government Act, RSA 2000 Chapter M-26, as amended, a municipality may by bylaw to delegate its subdivision authority powers, duties and functions to an intermunicipal service agency; and Council of the Municipal District of Spirit River No. 133 deems it beneficial to delegate its subdivision authority to an inter-municipal service agency; The Council of the Municipal District of Spirit River No. 133, in the Province of Alberta, duly assembled hereby enacts as follows: ## TITLE 1. This bylaw may be cited as the "Subdivision Authority Bylaw". ## PURPOSE 2. The purpose of this bylaw is to establish and delegate the Subdivision Authority for the Municipal District of Spirit River No. 133 to the Mackenzie Municipal Services Agency. ## DEFINITIONS 3. In this Bylaw, - a) "Act" means the Municipal Government Act, being Chapter M-26, RSA 2000, as amended from time to time. - b) "Council" means the duly elected Council of the Municipal District of Spirit River No. 133. - c) "Subdivision Authority" means the persons established under this bylaw to exercise the powers, duties and functions of the Subdivision Authority on behalf of the Municipal District of Spirit River No. 133. - d) "Land Use Bylaw" means the Municipal District of Spirit River No. 133 Land Use Bylaw, as established in accordance with the Act. - e) "Municipality" means the corporation of the Municipal District of Spirit River No. 133. ## ESTABLISHMENT AND DELEGATION 4. The Subdivision Authority for the Municipal District of Spirit River No. 133 is hereby established. 5. The Subdivision Authority for the Municipal District of Spirit River No. 133, including accepting, processing, decisions and endorsement of applications for subdivision, is hereby delegated to the Mackenzie Municipal Services Agency. ## POWERS, DUTIES AND FUNCTIONS 6. The Subdivision Authority shall exercise the powers, duties and functions as set out in the Act and any regulations made thereunder. ## SEVERABILITY 7. If any portion of this bylaw is declared invalid by a court of competent jurisdiction, then the invalid portion shall be severed and the remainder of the bylaw is deemed valid. ## ENACTMENT 8. This Bylaw shall come into full force and effect upon the date of its final passing thereof. 9. Bylaw 05-2001 and any amendments thereto are hereby repealed.
