BYLAW 36-23
A BYLAW OF THE TOWN OF OKOTOKS
IN THE PROVINCE OF ALBERTA
TO ESTABLISH NATURAL GAS FRANCHISE FEES
WHEREAS pursuant to the provisions of the Municipal Government Act, Revised
Statutes of Alberta 2000, Chapter M-26 and amendments thereto, Council may pass a
bylaw for the purpose of establishing franchise fee rates to be levied by utility providers
operating within the Town of Okotoks; and
WHEREAS sections 45 and 360 of the Municipal Government Act authorize a council to
make a tax agreement with an operator of a public utility and that agreement may
provide for an annual payment to the municipality by the operator in the form of
franchise fees; and
WHEREAS the natural gas utility provider in the Town of Okotoks is ATCO Gas.
NOW THEREFORE the Council of the Town of Okotoks enacts as follows:
1.
SHORT TITLE
1.1.
This Bylaw shall be known as the "Natural Gas Franchise Fee Bylaw".
2.
ESTABLISHMENT OF NATURAL GAS FRANCHISE FEE RATES
2.1
Alberta Utilities Commission Disposition 24880-D01-2019 shall direct ATCO Gas
and Pipelines Ltd. South to collect franchise fees under ATCO Gas and Pipelines
Ltd. South - Method A at a rate of 35%, beginning January 1, 2024.
3.
SEVERABILITY
It is the intention of Council that each separate provision of this Bylaw shall be deemed
independent of all other provisions herein and it is the further intention of Council that if
any provision of this Bylaw is declared invalid, all other provisions hereof shall remain
valid and enforceable.
