## TOWN OF PICTURE BUTTE IN THE PROVINCE OF ALBERTA ## BYLAW NO. 975-26 A BYLAW OF THE TOWN OF PICTURE BUTTE IN THE PROVINCE OF ALBERTA, TO AMEND BYLAW NO. 841-15, BEING THE MUNICIPAL LAND USE BYLAW. WHEREAS the Council of the Town of Picture Butte is in receipt of a request to amend the Land Use Bylaw to allow secondary suites located within detached garages in the Residential (R1) land use district to be permitted on lots without lane access, subject to appropriate design, access, and parking considerations. AND WHEREAS a Public Hearing, as required by Sections 216.4 and 692 of the Municipal Government Act, will be held prior to second reading of this Bylaw; NOW THEREFORE, under the authority and subject to the provisions of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26, as amended, the Council of the Town of Picture Butte in the Province of Alberta, duly assembled does hereby enact the following: 1. That Part 2, Land Use Districts, Map and Regulations, Residential - R1, Section 12 - Secondar Suites (Detached Garage) Standards, subsection (4) be amended by removing the strikethrough text and replacing it with the underlined text as follows: (4) A secondary suite (detached garage) shall only be permitted on lots with lanes. The Municipal Planning Commission may consider a secondary suite (detached garage) on a lot without a lane where it is satisfied that: - (a) the proposed lot size is sufficient to support the secondary suite (detached garage); - (b) vehicle access and driveway design provides safe and functional access while minimizing impacts on traffic flow, pedestrians, and the streetscape; - (c) sufficient on-site parking can be provided without parking waivers; and - (d) the development remains subordinate to the principal dwelling. 2. Bylaw No. 841-15 being the Land Use Bylaw is hereby amended and consolidated 3.
