## BYLAW #1313-A Of The TOWN OF PINCHER CREEK, IN THE PROVINCE OF ALBERTA, FOR THE PURPOSE OF AMENDING THE NORTH HILL (Part of the NE ¼ 22-6-30-W4M) AREA STRUCTURE PLAN NUMBER ONE BYLAW #1313 WHEREAS the Council of the Town of Pincher Creek adopted the North Hill (Part of the NE ¼ 22-6-30-W4M) Area Structure Plan Number One through Bylaw #1313 lands within its corporate limits; AND WHEREAS Council believes that it is advisable to amend the North Hill (Part of the NE ¼ 22-6-30-W4M) Area Structure Plan Number One as a result of changes being made to the Land Use Bylaw that will be inconsistent with the Area Structure Plan conceptual plans; AND WHEREAS the said lands are illustrated on the map in Schedule "A" attached hereto; AND WHEREAS Council, having considered at a public hearing the concerns of persons claiming to be affected by this bylaw amendment believes that the amendment of the Area Structure Plan should be allowed in order to achieve the orderly, economical and beneficial use of land in the Town of Pincher Creek; NOW THEREFORE, under the authority and subject to the provisions of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26, as amended, the Council of the Town of Pincher Creek, in the Province of Alberta, duly assembled does hereby enact the following: 1. That this Bylaw #1313-A is to be cited as the "North Hill (Part of the NE ¼ 22-6-30W4M) Area Structure Plan Number One Amendment". 2. That "Schedule A" attached hereto is hereby adopted as part of this Bylaw. 3. If any portion of this bylaw is declared invalid by a court of competent jurisdiction, then the invalid portion must be severed and the remainder of the bylaw is deemed valid. 4. That this bylaw shall come into force and take effect upon the date of third and final reading and signing in accordance with Section 213 of the Municipal Government Act, Revised Statutes of Alberta 2000. 22nd READ A FIRST TIME THIS DAY OF August , 2016, A.D.
