## TOWN OF RAYMOND BYLAW NO. 1067-19 A BYLAW OF THE TOWN OF RAYMOND TO PROHIBIT BOTH THE SALE AND UNAUTHORIZED USE OF FIREWORKS IN THE CORPORATE LIMITS OF RAYMOND. WHEREAS, pursuant to Section 7(a) of the Municipal Government Act (MGA) S.A. 2000, cM26.1, the Council of the Town of Raymond may pass bylaws with respect to the safety, health and welfare of people and the protection of people and property, and WHEREAS, pursuant to Section 8(a) of the MGA S.A. 2000, cM-26.1, the Council may regulate and prohibit activities, and WHEREAS, the Council of the Town of Raymond considers firework safety to be a concern, based on: - The health and safety of Raymond citizens; - The unpredictable and dangerous nature of fireworks; - The danger to persons and property from fireworks that escape from the property where they are discharged; and - The control of nuisances, particularly the noise disturbance caused by the discharge of fireworks. NOW THEREFORE, the Council of the Town of Raymond, duly assembled, enacts as follows: ## Citation 1. This bylaw may be cited as the Fireworks Bylaw. ## Definitions 2. (1) In this bylaw: 2. (a) Administrator is defined as The Chief Administration Officer or designate. 3. (b) Fire Chief is defined as the practicing Fire Chief for the Town of Raymond. 4. (c) Fireworks is defined as both 5. (i) Low hazard fireworks: generally used for recreation, such as (but not limited to): showers, golden rain, "lawn lights", pinwheels, roman candles, volcanoes, sky or Chinese lanterns, or any other explosive with a 1.4G classification. 6. (ii) High hazard fireworks: generally used for recreation, such as (but not limited to): rockets, serpents, shells, bombshells, tourbillions, maroons, large wheels, bouquets, barrages, bombardos, waterfalls, ## Authorization - (1) No person shall sell or supply fireworks anywhere within the corporate limits of the Town of Raymond; - (2) No person shall discharge fireworks anywhere within the corporate limits of the Town of Raymond, unless authorized; - (3) The discharge of fireworks will only be permitted within the town corporate limits when authorization for a specified site, date and time is obtained from the Administrator and Fire Chief of the Town of Raymond, as well as the site Landowner. Authorization may be granted only for those whose licensing requirements are current. Appendix A, Application to Discharge must be completed for authorization. - (4) Authorized individuals shall be responsible for storing, handling, and discharging fireworks in accordance with provisions of the Explosives Act (Canada) and Alberta Fire Code A.R. 52/98 and their regulations, and in accordance with those conditions determined solely by the Town. ## Control of Nuisances 4. (1) Notice of firework displays must be posted on the town website and social media outlets at least three days prior to the event. Notices must contain the location, date and time of the event, and any other requirement specified by the fire chief or CAO. - (2) When firework display location is within 200m of a landowner who has obtained an Animal Permit, as outlined in Bylaw 970-10, (s)4,5 and 6, the CAO or designate will provide notice directly to the landowner at least 24 hrs prior to the event. Notice must provide the date, time and location of the event. - (3) Despite s(1), authorized individuals may provide 24 hr notice in instances when events have been scheduled on short notice, or events have been rescheduled due to inclement weather. - (1) Any person found selling or supplying fireworks anywhere within the corporate limits of the Town of Raymond shall be subject to a fine of $150 for a first offence; $500 for a second offence; and $1000 for each subsequent offence. - (2) Any person found discharging fireworks anywhere within the corporate limits of the Town of Raymond, unless authorized shall be subject to a fine of $150 for a first offence; $500 for a second offence; and $1000 for each subsequent offence. ## Penalties fountains, batteries, illumination, set pieces, pigeons, firecrackers, or any other explosive with a 1.3G classification. Violation tickets shall be administered by the town's bylaw officer or RCMP, who are hereby authorized and empowered to issue a Violation Ticket to any person who they have reasonable and probable grounds to believe has contravened any provision of this bylaw. A violation ticket may be issued to such person either personally, or by mailing a copy to such person the last known post office address. ## Severability Clause 6. If any portion of this bylaw is declared invalid by a court of competent jurisdiction, then the invalid portion must be severed, and the remainder of the bylaw is deemed valid. ## Repeal Clause 7. This Bylaw repeals bylaw 925-06. This bylaw will come into force on the date of third and final reading. READ a first time this 5th day of February, 2019.
