Bylaw 3707/2025
Being a bylaw of the City of Red Deer, in the Province of Alberta, to regulate traffic and the use of
Highways, Sidewalks and public places within the City of Red Deer.
WHEREAS pursuant to sections 13 and 14 of the Traffic Safety Act (the "Act"), a Council may pass bylaws
with respect to Highways under its direction, control and management;
WHEREAS, pursuant to section 7 of the Municipal Government Act, a council may pass bylaws for municipal
purposes respecting:
(a) the safety, health and welfare of people and the protection of people and property;
(b) people, activities and things in, on or near a public place or place that is open to the public;
(c) transport and transportation systems; and
(d) the enforcement of bylaws.
NOW THEREFORE COUNCIL OF THE CITY OF RED DEER ENACTS AS FOLLOWS:
Part 1 - Title and Definitions
Short Title
1
This Bylaw may be referred to as the "Traffic Bylaw".

The purpose of this Bylaw is to regulate the use of Highways under the direction, control and
management of the City and the use of Highways, Sidewalks and public places within the City of
Red Deer.
Definitions

In this Bylaw the following definitions shall apply:
(a)
"Alignment Permit" means a permit issued by the City Manager that approves the
location in which a person may install new equipment within a ROW;
(b)
"Alley" means a narrow Highway intended chiefly to give access to the rear of buildings
and parcels of land;
(c)
"Boulevard" means that part of a Highway in an urban area that:
(i) is not a Roadway; and
(ii) is that part of the Sidewalk that is not especially adapted to the use of, or ordinarily
used by, pedestrians.
(d)
"City" means the City of Red Deer municipal corporation;
(e)
"Commercial Vehicle" means a Vehicle operated on a Highway by or on behalf of a
person for the purpose of providing transportation but does not include a private
passenger vehicle;
(f)
"E-Scooter" means a Motor Vehicle that:

(i) has a permit to operate granted by the province of Alberta;
(ii) has steering handlebars;
(iii) consists of a footboard mounted on two or three wheels; and
(iv) while capable of being propelled by muscular power, may be propelled by one or
more electric motors.
(g)
"Emergency Vehicle" means:
(i) a Vehicle operated by the RCMP, a police service or a Peace Officer;
(ii) a fire-fighting or other type of Vehicle operated by the fire protection service;
(iii) an ambulance operated by a person or organization providing ambulance services;
(iv) a Vehicle operated as a gas disconnection unit of a public utility; or
(v) a Vehicle designated as an emergency response unit by the City Manager.
(h)
"Excavation Permit" means a permit issued by the City Manager that authorizes a
person to break-up, disturb, alter or remove any surface of a ROW;
(i)
"Heavy Vehicle" means a Vehicle exceeding:
(i) 2 axels;
(ii) 12.5 metres in length; or
(iii) 8,000 kilograms, actual or registered weight.
but does not include a Recreation Vehicle;
(j)
"Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway,
viaduct, lane, Alley, square, bridge, causeway, trestleway or other place or any part of any
of them, whether publicly or privately owned, that the public is ordinarily entitled or
permitted to use for the passage or parking of Vehicles and includes:
(i) a Sidewalk or Boulevard;
(ii) if a ditch lies adjacent to and parallel with the Roadway, the ditch; and
(iii) if a Highway Right-of-way is contained between fences or between a fence and one
side of the Roadway, all the land between the fences, or all the land between the fence
and the edge of the Roadway, as the case may be.
(k)
"Hoarding" means a protective fence erected around a construction site designed to
contain construction activities and limit the escape of construction debris;
(l)
"Leisure Vehicle" means a bicycle, an electric bicycle, roller skates, in-line skates, a
skateboard, a scooter, an E-Scooter, or other similar Vehicle;
(m)
"Loading Zone" means a portion of a Highway marked with a Traffic Control Device
for parking Vehicles while actively loading and unloading;
(n)
"Motor Vehicle" has the same meaning as in the Act but does not include an E-Scooter,
electric bicycle, or electric personal assistive mobility device;
(o)
"Municipal Tag" means a document alleging an offence issued pursuant to the authority
of this Bylaw;

(p)
"Off-Highway Vehicle" has the same meaning as in the Act;
(q)
"Over-Dimensional Vehicle" means any Vehicle requiring an over-dimensional permit
as defined in Alberta Regulation 315/2002 the Commercial Vehicle Dimension and Weight
Regulation;
(r)
"park", where prohibited, means allowing a Vehicle to remain stationary in one place,
except:
(i) while actually engaged in loading or unloading; or
(ii) when complying with a direction given by a Peace Officer or Traffic Control Device.
(s)
"Parking Zone" means the areas marked by a specified parking time restriction;
(t)
"Parking Subzone" means the identified sections within a Parking Zone on a Roadway
or City block;
(u)
"Peace Officer" means a bylaw enforcement officer, community peace officer or a
member of the Royal Canadian Mounted Police;
(v)
"Permit" means written authorization from the City Manager allowing an activity that
would otherwise contravene this Bylaw and includes terms and conditions that the permit
holder is required to adhere to;
(w)
"Playground Zone" means that portion of a Highway identified as a Playground Zone
by a Traffic Control Device;
(x)
"Public Passenger Vehicle" means a Commercial Vehicle used for transporting
passengers;
(y)
"Recreation Vehicle" means:
(i) a Motor Vehicle or Trailer designated, constructed, modified, or equipped as a
permanent or temporary dwelling, living abode, or sleeping place; or
(ii) any structure designated, constructed and equipped as a permanent or temporary
dwelling or sleeping place and intended or capable of being loaded onto or carried
upon a Motor Vehicle or Trailer,
but does not include a truck tractor unit;
(z)
"Registrar" means the Registrar of Motor Vehicle Services and includes any person who,
on the directions of the registrar, is acting on behalf of the Registrar of Motor Vehicle
Services;
(aa)
"Residential Parking Program" means an approved area or areas within a residential
neighborhood where residents require a Permit, allowing them an exemption from the
posted time restriction;

(bb)
"Rights-of-way" or "ROW" means a Highway, road allowance, Roadway, Alley,
Sidewalk, Boulevard or bridge that is under the jurisdiction of the City, excluding fee
simple titled property;
(cc)
"RPP Zone" means a Residential Parking Program zone requiring a Permit to overstay
the posted time restriction;
(dd)
"Roadway" means that part of a Highway intended for use by vehicular traffic;
(ee)
"Rules of Use" means regulations, terms or conditions governing the use of a public
area or public transit Vehicle, as prescribed by the City Manager;
(ff)
"School Zone" means that portion of a Highway identified as a School Zone by a Traffic
Control Device;
(gg)
"Short-Term Parking" means parking provided on a Highway or City parkade or
parking lot, where payment is required on an hourly or daily basis;
(hh)
"Sidewalk" means that part of a Highway especially adapted to the use of, or ordinarily
used by, pedestrians and that part of a Highway between:
(i) the curb line; or
(ii) where there is no curb line, the edge of the Roadway,
and the adjacent property line, whether or not it is paved or improved.
(ii)
"Special Event" means an event for which a Special Event Permit is granted pursuant
to the Special Events Permit Bylaw but does not include military or funeral processions;
(jj)
"stop" means:
(i) when required, a complete cessation from vehicular movement; and
(ii) when prohibited, any halting even momentarily of a Vehicle, whether occupied or not,
except when necessary to avoid conflict with other traffic or in compliance with a
direction given by a Peace Officer or Traffic Control Device;
(kk)
"Traffic Control Device" means any sign, signal, marking or device placed, marked or
erected under the authority of the Act for the purpose of regulating, warning or guiding
traffic;
(ll)
"Trailer" means a Vehicle so designed that it:
(i) may be attached to or drawn by a Motor Vehicle or tractor; and
(ii) is intended to transport property or persons and includes any Vehicle defined by
regulation as a trailer but does not include machinery or equipment solely used in the
construction or maintenance of Highways;
(mm) "Transit Terminal" means an area intended exclusively for use by public transit
Vehicles to allow passengers to embark and disembark and for use by passengers awaiting
rides on public transit;

(nn)
"Use of Streets Permit" means a permit issued by the City Manager authorizing a
person to park, leave, stand, store or station any Vehicle, material, equipment, object,
Hoarding or construction device of whatever nature on a portion of a ROW;
(oo)
"Vehicle" means a device in, on or by which a person or thing may be transported or
drawn on a Highway and includes a combination of Vehicles but does not include a
mobility aid;
(pp)
"Vehicle for Hire" means a Vehicle used or offered for the transportation of at least
one passenger in return for compensation from any place within the City to a destination
either within or outside of the City, pursuant to the Vehicle for Hire Bylaw; and
(qq)
"Windrow" means the linear ridge or pile of snow left behind on a Highway after snow
plowing equipment passes by.
Part 2 - Vehicle Operation
Traffic Control Devices

A person operating a Vehicle on a Highway must comply with direction from a Traffic Control
Device.

No person other than a City employee, a Peace Officer, or an agent of the City performing the
duties of that role, shall tear down, remove or interfere with any Traffic Control Device,
barricade, flare or other thing placed in accordance with the Act or this Bylaw.
Speed Limits

No Vehicle shall exceed the maximum speed indicated on a Traffic Control Device.

The maximum speed limit for all Vehicles on a Highway is 50 kilometers per hour unless otherwise
indicated by a Traffic Control Device or as specifically set out in this Bylaw.

Except as otherwise indicated by a Traffic Control Device, the maximum speed limit for all
Vehicles is:
(a) 20 kilometers per hour in an Alley;
(b) 30 kilometers per hour on a Highway within a School Zone between the hours of 7:00 am
and 4:30 pm on a day when school is in session; and
(c) 30 kilometers per hour on a Highway within a Playground Zone between the hours of 7:00
am and 9:00 pm.

The City Manager is delegated the authority to prescribe maximum or minimum speed limits by
the posting of Traffic Control Devices.
Restricted Highway

A Highway, or portion of it, may be restricted to a particular class of Vehicle including, but not
limited to:

(a) buses;
(b) school buses;
(c) Vehicles for Hire;
(d) bicycles; or
(e) a combination of Vehicle classes.

When a Highway, or portion of it, is designated as restricted for use only by a particular class of
Vehicle, a person must not operate a Vehicle of a class other than the particular class permitted
on that Highway or portion of it.

Despite section 11, a Vehicle may cross a Highway restricted to another Vehicle class in order to
enter or exit from it from an adjacent driveway or intersecting Highway.
School Bus Lights
13
A person must not activate the flashing red lights or stop arms of a school bus on a Highway with
curbs and gutters.
Right Turning Bus

When a City transit bus is signaling a right-hand turn, whether the bus is in motion or stopped, a
person operating a Vehicle on the Highway must not overtake or pass on the right-hand side of
the bus.
Tracked Vehicles
15
A person must not operate a Vehicle having metal spikes, lugs, cleats, skids, or bands projecting
from the surface of the wheel, tire, or track, except for studded tires or tire chains, on a Highway.
Road Bans
16
A person must not operate a Vehicle on a Highway that is subject to a road ban if the weight of
the carrying axle or axle group of the Vehicle exceeds the specified percentage axle weight
imposed by a Traffic Control Device.

Despite section 16, a Heavy Vehicle may operate on a Highway subject to a road ban if the Vehicle
is authorized by a Heavy Vehicle Permit.
Truck Routes
18
A person must not operate, park or stop a Heavy Vehicle on a Highway unless the Highway is
designated as a truck route, or the operator is authorized by a Heavy Vehicle Permit.

Despite section 18, a Heavy Vehicle may travel, but not park or stop, on a Highway not designated
as a truck route where the operator can show the Heavy Vehicle travelled the most direct and
practical route between a location and the nearest truck route and is:
(a) providing services to, delivering goods to, or collecting goods from a customer;
(b) traveling to, or from, the business premises of the Heavy Vehicle owner;

(c) moving a building from one location to another, for which all necessary Permits or approvals,
under this Bylaw or other bylaws, have been issued by the City;
(d) traveling to, or from, non-residential premises for the servicing or repair of the Heavy Vehicle;
(e) removing a disabled Vehicle from a Highway not designated as a truck route;
(f) traveling to, or from, a hotel or motel;
(g) traveling to, or from, performing work on a Highway not designated as a truck route; or
(h) a Public Passenger Vehicle.

When operating a Heavy Vehicle, a Heavy Vehicle Permit must be:
(a) in the possession of the person operating the Heavy Vehicle; and
(b) produced immediately to a Peace Officer on demand.
Over-Dimensional Vehicles
21
A person must not park or stop an Over-Dimensional Vehicle, including any load carried on the
Vehicle, on a Highway.

A person must not operate an Over-Dimensional Vehicle on a Highway unless authorized by an
Over-Dimensional Vehicle Permit.

When operating an Over-Dimensional Vehicle, an Over-Dimensional Vehicle Permit must be:
(a) in the possession of the person operating the Over-Dimensional Vehicle; and
(b) produced immediately to a Peace Officer on demand.
Weight Restrictions
24
A person must not operate a Vehicle:
(a) on a bridge where such Vehicle, with or without a load, exceeds the weight designated by a
Traffic Control Device at or near the bridge as the maximum load permitted on such bridge;
or
(b) on a Highway in an overloaded condition and contrary to the axle loadings as set out in the
regulations under the Act.
Height Restrictions
25
A person must not operate a Vehicle on a Highway under any structure identified as having a
maximum height limit for clearance indicated by a Traffic Control Device if the maximum height
of the Vehicle exceeds that limit.
Off-Highway Vehicles
26
Other than a Peace Officer, City employee, or agent of the City performing employment
obligations, a person must not operate an Off-Highway Vehicle on a Highway.

Part 3 - Parking
Prohibited Parking and Stopping
27
A person driving a Vehicle must not, unless:
(a) required or permitted by the Act, the Use of Highways and Rules of the Road Regulation, this
Bylaw, or by a Traffic Control device;
(b) in compliance with a direction given by a Peace Officer; or
(c) to avoid conflict with other traffic;
stop or park a Vehicle at the following locations:
(d) on a Sidewalk or Boulevard, or any part of a Sidewalk or Boulevard, except if the Vehicle is
an E-Scooter;
(e) on a crosswalk or any part of a crosswalk;
(f) within an intersection other than immediately next to the curb in a "T" intersection;
(g) at an intersection nearer than 5 metres to the projection of the curb or edge of the Roadway,
except when the Vehicle is parked in a space where a Traffic Control Device indicates parking
is permitted;
(h) in the case of an approach to a stop sign or yield sign, within 5 metres from the stop sign or
yield sign;
(i) within 5 metres from any fire hydrant, or when the hydrant is not located at the curb,
within 5 metres from the point on the curb nearest the hydrant;
(j) within 1.5 metres from an access to a garage, private road or driveway or a Vehicle
crossway over a Sidewalk;
(k) within 5 metres from the near side of a marked crosswalk;
(l) alongside or opposite any ROW excavation or obstruction when the stopping or parking
would obstruct traffic;
(m) on any bridge or on the approach to it;
(n) at any place where a Traffic Control Device prohibits stopping or parking, during the times
stopping or parking is so prohibited;
(o) on the Roadway side of a Vehicle that is parked or stopped at the curb or edge of the
Roadway;

(p) at or near the site of any fire, accident or other emergency, if stopping or parking would
obstruct traffic or hinder Emergency Vehicles or Peace Officers, firefighters, ambulance
drivers or assistants or rescue officers or volunteers;
(q) if a Highway is divided into 2 or more Roadways by a Boulevard, ditch or other physical
barrier, on that portion of the Highway that is to the left of the yellow line except in an
emergency situation where the Vehicle is disabled and it is not practicable to move the
Vehicle to the far right side of the Highway;
(r) in a manner that blocks, obstructs, hinders, or impedes the movement of traffic on the
Highway;
(s) at any area marked as a construction area by a Traffic Control Device, except when the
person is performing employment obligations at that location;
(t) at any area marked as a bus zone by a Traffic Control Device;
(u) adjacent to, or impeding access from, a doorway intended as a fire or emergency exit from a
building;
(v) adjacent to, or impeding access from, an entrance to any fire station, police station, hospital,
or other place where Emergency Vehicles require regular access;
(w) at any area marked for use only by a particular class of Vehicle by a Traffic Control Device if
the Vehicle is not a permitted class;
(x) at any area marked as a fire lane by a Traffic Control Device; and
(y) at any area marked as a Loading Zone by a Traffic Control Device, unless actively engaged in
loading or unloading a Vehicle and adhering to the time limit specified by any Traffic Control
Device.
28
A person must not allow a Vehicle to park:
(a) in an Alley unless:
(i) permitted by a Traffic Control Device;
(ii) in the process of unloading or loading goods from a Vehicle, other than a passenger
Vehicle, and for less than 30 minutes;
(iii) in the process of unloading or loading goods from a passenger Vehicle and for less than 5
minutes; or
(iv) within Terrace Park, in those areas where parking is permitted as illustrated in Schedule
"A";
(b) in any location identified as being for the use of persons with disabilities unless the Vehicle:
(i) displays a valid disabled parking placard or licence plate issued or recognized by the
Registrar; and
(ii) is being used for the transportation of a person with a disability;

(c) on a Highway in excess of a time limit specified for the location by a Traffic Control Device;
(d) on a Highway in any area identified as a Short-Term Parking stall when that stall is closed by
a Traffic Control Device; or
(e) obstructing passage on any Sidewalk, trail, bicycle path, or on a ramp or access designated to
accommodate persons with mobility challenges;
unless authorized by a Permit.

Section 28(c) does not apply on a statutory holiday, Saturday, Sunday, or such other day excepted
by the City Manager.
Weight Restrictions
30
A person must not park a Vehicle, or a Vehicle with a Trailer attached, weighing or registered
with a gross Vehicle weight exceeding 4,500 kilograms, on a Highway in a location adjoining
residential property except if it is a:
(a) Recreation Vehicle; or
(b) Commercial Vehicle with hazard warning lamps lit and in the process of loading or unloading
goods.

Absent evidence to the contrary, a school bus is presumed to have a gross Vehicle weight
exceeding 4,500 kilograms.
Length and Trailer Restrictions
32
A person must not angle park, or load or unload any Vehicle exceeding 6 metres in length on a
Highway, except at locations designated by the City Manager either by a Traffic Control Device
or authorized by the City Manager in writing.
33
A person must not park a Vehicle exceeding 8 metres in length, or a truck tractor unit, with or
without a semi-trailer or Trailer attached, on a Highway in front of, across from, or adjacent to
residential property, unless the Vehicle is:
(a) in the process of loading or unloading goods, and has its hazard lights on;
(b) being temporarily used for construction, demolition, or landscaping and is only present during
the hours of 7:00 am to 10:00 pm; or
(c) a Recreation Vehicle.

A person must not park an unattached Trailer on a Highway in front of, across from, or adjacent
to residential property.
Marked Stalls
35
A Vehicle parked in a parking stall marked by lines or otherwise on a Highway or in a City parking
lot or parkade must be parked entirely within the markings.

Parallel Parking
36
A person may only park a Vehicle:
(a) with its sides parallel to the curb or edge of the Roadway, the wheels closest to a curb or
edge of the Roadway are not more than 500 mm from that curb or edge, and the Vehicle is
aligned with the direction of traffic flow authorized for the closest lane; or
(b) that is a motorcycle, at an angle to the curb or edge of the Roadway, other than perpendicular,
with a wheel of the motorcycle not more than 500 mm from the curb or edge of the Roadway,
and the motorcycle is angled in the direction of travel authorized for the closest lane.
Angle Parking
37
Despite section 36, when a Traffic Control Device indicates that angle parking is permitted or
required, a person may only park a Vehicle, with the exception of a motorcycle, with one front
wheel not more than 500 mm from the curb or edge of the Roadway, angled in the direction of
travel authorized for the closest lane and, if there are no parking stall markings, with the Vehicle's
sides at an angle of between 30 and 60 degrees to the curb or edge of the Roadway.
Abandoned & Unattended Vehicles
38
A person must not leave a Vehicle on a Highway in one location more than 72 consecutive hours.
39
A person must not allow a Vehicle to be parked and left unattended on a Highway:
(a) on a jack or a similar device; or
(b) with one or more wheels removed or not touching the ground.
Private Property with Public Access
40
A Vehicle must not be parked on privately owned property to which Vehicles driven by members
of the public generally have access, unless the permission or authorization of the owner of the
property or person having possession or control of the property has been given for such parking,
if the property has been clearly identified as having restrictions on parking.
41
A Vehicle on privately owned property to which Vehicles driven by members of the public
generally have access parked in contravention of any specific restrictions on parking identified for
the location is presumed to be:
(a) parked without the permission or authorization in section 42040; and
(b) despite the contravention of section 40, is subject to any higher penalty for the particular
contravention specified in this part.
Private Property without Public Access
42
A Vehicle must not be parked on privately owned property to which Vehicles driven by members
of the public generally do not have access, but on which the owner of the property or a person
having possession or control of the property may park or otherwise keep the Vehicles, unless the
permission or authorization of a party described above has been given for such parking.
43
A person, other than a lessee, must not park in a leased parking stall without the express
permission of the lessor.

City Property
44
A person must not operate or park a Vehicle on a Boulevard, utility right-of-way, or other City
lands, except in a City parking lot or parkade, or where permitted by a Traffic Control Device.
45
A person must not park a Vehicle in a City parking lot or parkade for more than 48 consecutive
hours.
Short-Term Parking
46
When a person parks in Short-Term Parking:
(a) payment is required for the time the Vehicle is present in a parking stall from 8:00 am to 4:30
pm, Monday to Friday, except statutory holidays;
(b) the Vehicle must not exceed the time restriction for the applicable zone or Parking Subzone
where the Vehicle is parked; and
(c) the Vehicle must comply with the directions from any Traffic Control Device applicable to
where the Vehicle is parked.
Vehicles for Hire
47
A Vehicle for Hire:
(a) may only be parked on a Highway while in the process of loading or unloading and for a
maximum of 10 minutes;
(b) may not park in any City parking lot or parkade to load or unload; and
(c) must not exceed 6 metres in length when parking in an angled parking stall on a Highway.
Recreation Vehicles
48
A person must not park an unattached Recreation Vehicle on a Highway in front of, across from,
or adjacent to residential property.
49
When attached to a Motor Vehicle, a Trailer or Recreation Vehicle is deemed to be part of the
Motor Vehicle.
50
In a residential area, a person must not park a Recreation Vehicle on a Highway immediately
adjacent to, or directly in front of, a residence without the consent of the owner or occupant of
that residence.
51
A Recreation Vehicle parked on a Highway must not be used for sleeping or living quarters.
Snow Removal, Street Cleaning or Maintenance
52
When a moveable Traffic Control Device is placed by the City to suspend parking in an area:
(a) the movable Traffic Control Device shall take precedence over any other Traffic Control
Device in the event of a conflict;
(b) a person is guilty of an offence who allows a Vehicle to park contrary to the moveable Traffic
Control Device; and

(c) where a person allows a Vehicle to park contrary to section 52(b), a person commits an
additional offence if the Vehicle is parked in a place obstructing Highway maintenance, street-
cleaning or snow-removal operations, such that the Vehicle must be removed before those
operations can proceed.

It is a defense to a charge under section 52 if the person satisfies the court, on a balance of
probabilities, that the movable Traffic Control Device was placed less than 12 hours before the
Vehicle was parked in contravention of the Traffic Control Device.
Towing During Snow Removal, Street Cleaning, or Maintenance

The City Manager may remove, or cause to be removed, a Vehicle parked in contravention of
section 52 of this Bylaw and place the Vehicle on an adjacent Roadway or other area designated
by the City Manager.
Part 4 - Parking Permits
Monthly Parking Permit
55
A person must not park a Vehicle in a City parking lot or parkade where a monthly parking Permit
is required unless the Vehicle is authorized by a monthly parking Permit.
56
When a person with a monthly parking Permit parks a Vehicle in a City parking lot or parkade,
the person must comply with the directions from any Traffic Control Device erected at the
entrance or within the boundaries of the parking lot.
Residential Parking Program
57
A person must not park a Vehicle in a RPP Zone for any period of time exceeding the time limit
so designated, other than a Vehicle authorized by a Permit under the Residential Parking Program.
Courier Service Permit
58
A Vehicle used for courier service may park in a parking stall on a Highway where payment is
required on an hourly or daily basis provided that the Vehicle:
(a) is authorized by a courier service Permit; and
(b) is parked in the stall no longer than 15 minutes per stop.
Compliance with Permit
59
A person must not park a Vehicle in violation of the terms and conditions of any applicable Permit.
Part 5 - Sidewalks and Boulevards
Motor Vehicles on Sidewalks
60
A person must not operate or park a Motor Vehicle on any Sidewalk, trail, pedestrian overpass,
bicycle path, or public lands owned by the City.
Leisure Vehicles
61
A person must not operate or park a Leisure Vehicle:
(a) on a Sidewalk where prohibited by a Traffic Control Device; or

(b) in any Transit Terminal or City parkade.
62
A person operating a Leisure Vehicle on a Highway must:
(a) yield the right of way to slower moving people;
(b) alert anyone about to be overtaken by sounding a bell or calling out a reasonable amount of
time before overtaking;
(c) use reasonable care when overtaking another person; and
(d) travel under control and at a reasonable rate of speed given the nature, condition and use of
the Highway, including consideration for other persons using the area being traveled.
63
A person must not operate an E-Scooter on a Highway, except on a:
(a) designated bicycle lane;
(b) Sidewalk;
(c) trail;
(d) bicycle path;
(e) Boulevard;
(f) crosswalk;
(g) pedestrian overpass; or
(h) Alley.

A person operating an E-Scooter must not use the E-Scooter to carry a passenger.
65
A person less than 16 years old must not operate an E-Scooter.
Snow and Ice Removal from Sidewalks
66
A person must clear snow, slush, or ice from a Sidewalk adjacent to property the person owns
or occupies within 48 hours of when it is deposited or formed.
Lights and Signs
67
A person must not place a light, sign, or any object emitting or reflecting light that may distract
or interfere with the vision of a person operating a Vehicle on a Highway.
68
A person must not place a sign of any type on a Highway unless authorized by a Permit.
69
For the purpose of section 67 and 68, a person referred to on a sign, whether directly or indirectly,
is presumed to have placed the sign or caused or permitted the sign to be placed.

Despite section 68, signs advertising a garage sale do not require a Permit if:
(a) placed no more than 48 hours prior to the start of the garage sale;
(b) removed within 24 hours after the conclusion of the garage sale; and
(c) placed for no more than 72 consecutive hours.

A person must not place a sign on a Highway:
(a) obstructing, or attached to, a Traffic Control Device;
(b) with a position, shape, colour, format, or illumination similar to a Traffic Control Device;
(c) presenting a hazard, obstructing, or posing danger to vehicular or pedestrian traffic;
(d) attached to or within 2 metres of a fire hydrant;
(e) that is lit or electrified;
(f) that is inflatable;
(g) supported by string, rope, metal guidewire or similar device to add stability to the freestanding
structure;
(h) attached to or obstructing any traffic signal pole or street light;
(i) attached to any City transit sign, sign pole, or structure; or
(j) causing or posing a risk of damage to City property.
Loading and Unloading Goods
72
A person must not load or unload goods across a Sidewalk or Boulevard where other loading and
unloading facilities exist on the property.
Private Property Obstructions
73
A person must not allow any tree, hedge, shrub, fence, or structure on property that the person
owns or occupies to:
(a) obstruct a Traffic Control Device;
(b) obstruct a Boulevard adjacent to the property;
(c) interfere with any tree on a Boulevard adjacent to the property;
(d) interfere with any public utility; or
(e) impair the visibility required for safe traffic flow at any intersection adjacent to the property.

A person must not allow any trees, hedges, or shrubs growing on property the person owns or
occupies to have any branches that project:
(a) over a Sidewalk or trail at an elevation of less than 2.25 metres; or
(b) over a Roadway, including an Alley, at an elevation of less than 4.12 metres.
Boulevard Modifications
75
A person must not do the following on a Boulevard without written authorization from the City
Manager:
(a) remove, damage or plant any tree, hedge, shrub or other plant;
(b) prune, cut, repair, or perform any other work on any tree, hedge, shrub or other plant;
(c) place a surface, other than grass, except on a driveway or Sidewalk;
(d) modify the construction of the Boulevard; or
(e) move any house or other building across the Boulevard.
Part 6 - Activities on Highways
Obstruction
76
A person must not stand or be in any other position on a Highway so as to obstruct the
entrance to a building or to obstruct pedestrians or Vehicles using the Highway.
Hitch Hiking
77
A person must not hitchhike, stand on, or walk along a Highway for the purpose of soliciting a
ride from the driver of a Vehicle.
Hitching a Ride
78
A person must not be pulled by a Motor Vehicle while on a sled, toboggan, skateboard, skis, or
other conveyance.
Prohibited Crossings
79
A person must not cross a Highway where prohibited by a Traffic Control Device.
Windrow Removal
80
A person must not remove Windrows from Highways using a motorized Vehicle without a
windrow removal Permit.
81
Except when deposited at a provincially approved snow-collection site, snow collected during:
(a) Windrow removal from a Highway must not be deposited on City property; and
(b) parking lot plowing must not result in snow being deposited on City property or a Highway.

Street Vending
82
A person must not sell, or display for sale, any goods or services on a Highway without a Use of
Streets Permit.
Special Events
83
A person must not organize, hold, or participate in any Special Event, including parades, on a
Highway unless authorized to do so by a Special Events Permit.
Funeral Procession
84
A person driving a Vehicle in a funeral procession, other than the lead Vehicle, may, during daytime
hours, drive the Vehicle into an intersection without stopping if:
(a) the Vehicle's headlamps and hazard warning lamps are alight;
(b) the Vehicle is travelling immediately behind the Vehicle in front of it in the funeral procession
so as to form a continuous line of traffic;
(c) the lead Vehicle in the funeral procession is showing a purple flashing light; and
(d) the passage into the intersection can be made in safety.
Highway Damage
85
A person must not operate a Heavy Vehicle on or across any Sidewalk, except at a curb cut or
approved crossing, without first planking the Sidewalk to ensure the Sidewalk is not damaged.
Vehicle Access
86
No person shall construct or otherwise allow for Vehicle access to a parcel of land, such as a
driveway or parking pad, from a Highway without a driveway crossing Permit.
Dangerous Goods
87
A person must not dump or spill any dangerous goods for which placards are required by the
Alberta Dangerous Goods Transportation and Handling Act, on any City lands or Highway.
Right of Way
88
A person must not occupy or otherwise use or build or place any permanent structure, or any
portion of it, on a Highway without authorization form the City Manager.
Use of Streets Permit
89
A person must not:
(a) erect, any Hoarding on a ROW;
(b) place any snow, slush, ice, dirt, mud, oil, gravel, grass, leaves or other materials on a ROW;
(c) use Vehicles, materials, equipment or other objects that obstruct a ROW;
(d) carry out any construction activities on a ROW; or

(e) use any equipment, such as a crane, or conduct work on or over a ROW,
without a Use of Streets Permit.

Despite section 89, a person may place snow from the immediate adjacent Sidewalk on a ROW
if the snow is deposited in a manner that does not impede pedestrian or Vehicle mobility or traffic
flow.

A person must not leave any equipment, materials, or obstructions on a Highway after the expiry
of a Use of Streets Permit.
Alignment Permit
92
A person must not install new electrical, gas, or communication equipment in a ROW without an
Alignment Permit.
Excavation Permit
93
A person must not break-up, disturb, alter, or remove any surface of a ROW or the construction
of any Highway without an Excavation Permit.
Part 7 - City Transit Terminal & Parkades
Loitering Within a Transit Terminal
94
A person must not enter or be present in a Transit Terminal or City parkade outside its normal
operating hours, other than Peace Officers, emergency personnel, municipal employees, or
contractors with the express permission of the City Manager.
Walking Within a Transit Terminal
95
A person not in a Motor Vehicle, must not be present in a Transit Terminal or City parkade area
restricted to Motor Vehicles by a Traffic Control Device, unless the person is a Peace Officer,
emergency personnel, a municipal employee, or a contractor with the express permission of the
City Manager.
Animals Within a Transit Terminal
96
A person must not bring an animal into a Transit Terminal or City parkade, unless the animal is a
registered medical service animal, a police service animal, or another animal specifically authorized
by the City Manager.
Vehicles Within a Transit Terminal
97
A person must not operate a Vehicle in a Transit Terminal or other property where the operation
of Vehicles is restricted to City transit bus use only.
Rules of Use
98
A person in a City transit bus, Transit Terminal, or City parkade must observe and obey any
applicable Rules of Use.
99
A Peace Officer, transit operator, or other person in charge of a City transit bus, Transit Terminal,
or City parkade may evict a person breaching the Rules of Use.

Part 8 - Exemptions
100
Despite any other provision in this Bylaw:
(a) Emergency Vehicles;
(b) service Vehicles of public utilities including telecommunications, electric systems, and natural
gas systems engaged in repair, maintenance, or inspection of the utility in emergency
situations;
(c) Vehicles engaged in Highway repair, maintenance, or inspection; or
(d) towing service Vehicles;
may operate, park, or stop on a Highway.
Part 9 - Enforcement
Offence
101
A person who contravenes this Bylaw is guilty of an offence and is liable on summary conviction
to:
(a) a penalty in the amount specified in Schedule "B" or twice that amount for a second or
subsequent offence within a 12-month time period; or
(b) when a penalty is not specified under this bylaw, a person who is guilty of an offence is liable
to a fine not exceeding $10,000.00, and in default of payment of the fine, to imprisonment for
up to six months.
Vicarious Liability
102
For the purposes of this Bylaw, an act or omission by an employee or agent of a person is deemed
also to be an act or omission of the person if the act or omission occurred in the course of the
employee's employment with the person, or in the course of the agent's exercising the powers
or performing the duties on behalf of the person.
Corporations
103
When a corporation commits an offence under this Bylaw, every principal, director of the
corporation who authorized the act or omission that constitutes the offence or assented to or
acquiesced or participated in the act or omission that constitutes the offence is guilty of the
offence whether or not the corporation has been prosecuted for the offence.
Continuing Offence
104
In the case of an offence that is of a continuing nature, each day or part of a day on which it
continues constitutes a separate offence.
Municipal Tag
105
A Municipal Tag may be issued to any person where there are reasonable and probable grounds
to believe the person contravened a provision of this Bylaw.
106
If a Municipal Tag is issued in respect of an offence, the Municipal Tag must specify:

(a) the name of the person or the Vehicle's license plate number;
(b) the offence;
(c) the fine amount;
(d) that the fine amount must be paid within 10 days of the issuance of the Municipal Tag; and
(e) any other information as may be required.

Where a Municipal Tag is issued in respect of an offence, the person to whom the Municipal Tag
is issued may, in lieu of being prosecuted for the offence, pay the fine specified within the time
period indicated on the Municipal Tag.
108
With the exception of section 52(c), where a Municipal Tag is issued for an offence listed in Part
3 or Part 4 of this Bylaw, the penalty may be reduced by $35.00 if paid to the City of Red Deer
within 10 days of the date the Municipal Tag was issued, and payment of the reduced amount will
be accepted by the City in full satisfaction of the Municipal Tag.
Violation Ticket
109
If a Municipal Tag is issued and the specified fine is not paid within the prescribed time, a violation
ticket may be issued pursuant to the Provincial Offences Procedure Act.
110
Despite section 109, a violation ticket may be immediately issued to a person where there are
reasonable and probable grounds to believe the person contravened a provision of this Bylaw.
111
If a violation ticket is issued in respect of an offence, the violation ticket may:
(a) impose the specified penalty established by this Bylaw for the offence and permit a person to
make a voluntary payment; or
(b) require a person to appear in court without the alternative of making a voluntary payment.

A person who commits an offence and who wishes to plead guilty may:
(a) if a violation ticket has been issued in respect of the offence; and
(b) if the violation ticket includes a specified penalty as established by this Bylaw for the offence;
plead guilty to the offence by making a voluntary payment by submitting to a Clerk of the Provincial
Court, on or before the initial appearance date indicated on the violation ticket, the specified
penalty set out on the violation ticket.

When a violation ticket is issued for parking in a time-limited stall, if a Vehicle exceeds the time
limit for a second or subsequent time, a further offence is deemed to occur and a second or
subsequent violation ticket may be issued.
Service
114
A Municipal Tag may be served:

(a) personally;
(b) by attaching it to the Vehicle in respect of which an offence is alleged to have been committed;
or
(c) by mail to the address of the registered owner of the Vehicle.
Refusing to Stop for Peace Officer
115
An operator of a Vehicle who, when directed by a Peace Officer, fails or refuses to stop:
(a) and permit the Vehicle to be inspected;
(b) and permit the weighing of a Vehicle; or
(c) the Vehicle in a suitable place designated by a Peace Officer pending removal of excess weight,
is guilty of an offence.
Obstruction
116
No person shall obstruct or hinder a Peace Officer in the exercise or performance of their
duties or powers pursuant to this Bylaw or other applicable legislation.
Owner Liable
117
Except for offenses where the driver is identified during a traffic stop, the owner of a Vehicle,
including the registered owner of that Vehicle, involved in an offence under this Bylaw is deemed
to be guilty of that offence.
118
Sections 117 and 102 do not apply if the owner of the Vehicle satisfies the court that at the time
that the Vehicle was involved in the offence:
(a) in the case of a Vehicle that was in motion:
(i) the owner of the Vehicle was not driving the Vehicle; and
(ii) no other person was driving the Vehicle with the owner's expressed or implied consent;
and
(b) in the case of a Vehicle that was parked:
(i) the owner did not park the Vehicle; and
(ii) no other person parked the Vehicle with the owner's expressed or implied consent.
119
The owner of an E-Scooter, including any person issued a business licence for E-Scooter
operations connected to the E-Scooter, involved in an offence under this Bylaw is deemed to be
the person responsible for the offence, except where the owner satisfies the court, at the time
that the E-Scooter was involved in the offence, it was not operated or parked with the owner's
express or implied consent.
Certified Copy of Record
120
A copy of a record of the City, certified by the City Manager as a true copy of the original, shall
be admitted in evidence as prima facie proof of the facts stated in the record without proof of the
appointment or signature of the person who signed the certificate.

Bills of Lading
121
A person must, when requested by a Peace Officer, produce for inspection the bills of lading
showing the origin and destination of the trip and the description of the load.
Permits
122
Any person who:
(a) fails to obtain a Permit as required under this Bylaw; or
(b) contravenes a condition of any Permit issued under this Bylaw;
is guilty of an offence.
123
A person must not make any false or misleading statement or provide any false or misleading
information to obtain a Permit.
124
Where a Permit is required under this Bylaw, the Permit must be valid and subsiding to authorize
the activity that would otherwise contravene this bylaw.
125
A Permit issued pursuant to this Bylaw expires at the end of the time specified in the Permit.
126
The City Manager may revoke a Permit issued under this Bylaw if:
(a) false or misleading information was provided to obtain it;
(b) the Permit holder breaches or fails to comply with any regulation, term or condition forming
part of the Permit;
(c) the Permit holder fails to pay to the City any costs payable under this Bylaw; or
(d) when it is in the public interest.
Removal and Impound of Vehicles
127
If a Peace Officer:
(a) forms the opinion, on reasonable and probable grounds, that a Vehicle is parked in
contravention of this Bylaw; or
(b) forms the opinion that emergency conditions require the removal of a Vehicle from a Highway,
the Peace Officer may remove the Vehicle to a place of impoundment designated for that purpose
by the City Manager and the Vehicle shall remain there until it is claimed by the owner or the
owner's agent.
128
No Vehicle removed or impounded under section 127 of this Bylaw will be released to its owner
or an agent until the towing and impound fees charged by the impound lot are paid.

Tire Marking
129
To determine the time which a Vehicle has been parked in a location where parking is restricted
to a specific time, a Peace Officer may place an erasable chalk mark on the tread face of the tire
of the parked Vehicle without such Peace Officer or the City incurring any liability for so doing.

No person shall remove an erasable chalk mark placed under section 129129 while the Vehicle
remains parked in the location where it was marked.
Part 10 - General
Fees
131
The fees payable pursuant to this Bylaw are set out in Schedule "C".
132
The City Manager may adjust the fees marked with an asterisk (*) in Schedule "C" on January 1
of each year by the change in the Alberta average consumer price index.
133
If any activity that requires a Permit is commenced prior to a Permit being issued under this Bylaw,
the fees payable for the Permit are double the Permit fees set out in Schedule "C".
Authority of City Manager
134
Without restricting any other power, duty or function granted by this Bylaw the City Manager
may:
(a) restrict a Highway, or portion of it, to a particular class of Vehicle;
(b) establish forms for the purposes of this Bylaw;
(c) establish the information required to be included with an application for a Permit or written
authorization;
(d) issue Permits or other written authorization with such terms and conditions the City Manager
determines are reasonably required, including that the applicant enter into an agreement with
the City including but not limited to a license to occupy agreement, a Hoarding agreement,
an indemnity agreement, or an encroachment agreement, if deemed necessary;
(e) in addition to what is specified in this Bylaw, establish other reasonable criteria to be met for
a Permit;
(f) refuse to issue a Permit or other written authorization provided that the reasons for the
refusal are provided to the applicant;
(g) designate Highways as truck routes;
(h) establish the days and times of operation for Short-Term Parking stalls and monthly parking
Permits;
(i) establish, modify, or remove RPP Zones;
(j) designate any portion of a Highway as a Short-Term Parking stall and prescribe payment
requirements and other restrictions for Vehicles parked in such stalls;

(k) designate periods of time when a suspension of parking in an area is in effect;
(l) designate certain parking locations for the exclusive use of persons with disabilities;
(m) designate crosswalks upon any Highway and cause them to be marked;
(n) designate where Traffic Control Devices are to be erected;
(o) designate an intersection or place on a Highway as a place at which no left-hand turn or no
right-hand turn or both shall be made;
(p) designate an intersection or place on a Highway as a place at which only a left-hand turn or
a right-hand turn shall be made;
(q) restrict the speed of Vehicles;
(r) prescribe maximum speed limits in respect of any part of a Highway under construction or
repair, or in a state of disrepair, by posting Traffic Control Devices applicable to all Vehicles
or to any class or classes or Vehicles travelling over that part of the Highway;
(s) designate any intersection or place on a Highway as a place where u-turns are prohibited;
(t) designate any Highway or portion of it for one-way traffic;
(u) designate any Roadway as one to be divided into traffic lanes of such number as the City
Manager deems appropriate;
(v) designate School Zones and Playground Zones;
(w) designate any Highway or portion of it as public or Commercial Vehicle loading and unloading
spaces for such time limits as appropriate;
(x) designate transit bus zones and school bus loading or unloading zones;
(y) designate portions of any Highway as no parking or restricted parking;
(z) prohibit parking at any Short-Term Parking stall or monthly parking stall;
(aa) designate angle parking on any Highway or portion of it;
(bb) designate maximum loads for any bridge;
(cc) designate parking stalls on land owned by the City for the exclusive use of persons with
disabilities and shall cause any such parking stall to be marked with a Traffic Control Device;
(dd) prohibit or restrict the movement of Vehicles from a private driveway onto a Highway or
from a Highway onto a private driveway where such prohibition or restriction is in the public
interest for the regulation of traffic;

(ee) close any existing median or divider on a Highway;
(ff) designate portions of any Highway where the use of Leisure Vehicles is prohibited;
(gg) impose road bans restricting the maximum weight allowed on any Highway based on a
percentage of axel carrying allowance, and designate the period of time road bans are in
effect;
(hh) designate portions of any Highway where a school bus is permitted to use flashing lights or
a stop arm;
(ii) establish Rules of Use for City buses, Transit Terminals, and City parking lots and parkades;
(jj) temporarily close any Highway, in whole or in part, for the purpose of construction,
rehabilitation, repairs, maintenance, parades, processions, Special Events, emergencies or
other valid reason the City Manager deems advisable;
(kk) waive or refund any or all of a fee set out in this Bylaw; and
(ll) delegate any powers, duties or functions under this Bylaw to an employee of the City.
Severability
135
The invalidity of any provision of this Bylaw does not affect the validity of the remainder.
Part 11 - Transitional Provisions
136
Traffic Bylaw 3701/2023 is hereby repealed.

Despite the repeal of Bylaw 3701/2023, the provisions of Bylaw 3701/2023 and Bylaw 3186/97
remain in full force and effect for the purposes of any traffic tags, offence tickets, or prosecutions
pending or entered for contravention of Bylaw 3701/2023 or Bylaw 3186/97 prior to third reading
of this Bylaw.
138
Any permits issued pursuant to Bylaw 3161/96, Bylaw 3186/97 and Bylaw 3701/2023 shall for all
purposes be deemed to be issued by the City Manager under this Bylaw and remain in full force
and effect, unless expired by their terms.
