CONSOLIDATED VERSION OF TOWN OF ROCKY MOUNTAIN HOUSE BYLAW NO. 2023/07 As Amended By: Bylaw 2025/08 BEING A BYLAW OF THE TOWN OF ROCKY MOUNTAIN HOUSE, IN THE PROVINCE OF ALBERTA, TO CONTROL AND REGULATE TRAFFIC IN THE TOWN OF ROCKY MOUNTAIN HOUSE. WHEREAS Section 7 of the Municipal Government Act, R.S.A. 2000, c. M-26, authorizes Council to pass bylaws respecting the safety, health and welfare of people and the protection of people and property and respecting people, activities, and things in on or near public places and to enforce bylaws. AND WHEREAS Section 13 and 14 of the Traffic Safety Act, R.S.A. 2000, c. T-6, authorizes Council to pass bylaws with respect to highways under its direction, control and management and their regulation. NOW THEREFORE, the Council of the Town of Rocky Mountain House enacts as follows: 1. TITLE 1.1. This Bylaw may be called the "Traffic Bylaw". 2. DEFINITIONS 2.1. The definitions contained in the Traffic Safety Act, R.S.A. 2000, c.T-6 and regulations thereunder shall apply to this Bylaw unless a contrary intention is specifically stated in this Bylaw. In this Bylaw, the following terms shall have the meanings shown below: a. "ALLEY" means a narrow highway intended chiefly to give access to the rear of buildings and parcels of land. b. "BICYCLE" includes any cycle propelled by human power upon which a person may ride, regardless of the number of wheels it may have. c. "BOULEVARD" means, in an urban area, that part of a highway that i. is not a roadway, and ii. is that part of the sidewalk that is not especially adapted to the use of or ordinarily used by pedestrians. d. TRMH Traffic Bylaw 2023/07 Page 2 of 23 i. the centre of a roadway measured from the curbs, or in the absence of curbs, from the edges of the roadway, or ii. in the case of a highway designated by traffic control devices: (1) as an offset centre highway, or (2) as a highway having a certain number of traffic lanes moving in a certain direction at all times or at specified times; iii. the line dividing the lanes for traffic moving in opposite directions, or iv. in the case of a divided highway, that portion of the highway separating the roadways for traffic moving in opposite directions. e. "COUNCIL" means the Council of the Town of Rocky Mountain House duly assembled and acting as such. f. "COURT" means the Provincial Court of Alberta; g. "CROSSWALK" means i. that part of a roadway at an intersection included within the connection of the lateral line of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway, or ii. any part of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by other marking on the road surface. h. "DISABLED PARKING SPACE" means a portion of the Highway set aside for the exclusive use of Motor Vehicles displaying a disabled parking placard. i. "DISABLED PLACARD" means a placard or license plate that is issued or recognized by the registrar, for the Province of Alberta, for persons with disabilities. j. "EMERGENCY" means a present or imminent event that requires prompt, coordinated action or special regulation of persons or property, to protect the health, safety, and welfare of people and to limit damage to property. k. "EMERGENCY VEHICLE" means i. a vehicle operated by a police service as defined in the Police Act, ii. a firefighting or other type of vehicle operated by the fire protection service of a municipality, The text shown in parentheses in various locations throughout this document identifies the corresponding amending bylaw which authorized the change to this bylaw. TRMH Traffic Bylaw 2023/07 Page 3 of 23 iii. an ambulance operated by a person or organization providing ambulance services, iv. a vehicle operated as a gas disconnection unit of a public utility, or v. a vehicle designated as an emergency response unit; pursuant to the definition in the Traffic Safety Act, RSA 2000 Chapter T-6. l. "FIRE LANE" means any part of the highway marked by signage as a fire lane. m. "HIGHWAY" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestleway or other place or any other place or part of any of them, whether publicly or privately owned, that the public is ordinarily entitled or permitted to use for the passage or parking of vehicles, and includes: i. a sidewalk, including a boulevard adjacent to the sidewalk, ii. if a ditch lies adjacent to and parallel with the roadway, the ditch, and iii. if a highway right of way is contained between fences or between a fence and one side of the roadway, all the land between the fences, or all the land between the fence and the edge of the roadway, as the case may be, but does not include a place declared by regulation not to be a highway; n. "INTERSECTION" means the area embraced within the prolongation or connection of: i. the lateral curb lines, or if none, ii. the exterior edges of the roadways, of two or more highways which join one another at an angle whether or not one highway crosses the other. o. "LOADING ZONE" means a space on a highway marked with a Parking Sign permitting parking for the period necessary to load and unload passengers or goods, during the time period indicated on the sign. p. "MINIATURE VEHICLE" means a go cart, a 3 or 4-wheeled vehicle of less than standard size, a golf cart, a 3 or 4-wheeled vehicle that the Registrar considers would present a hazard to other highway users because of its novel size or operating characteristics or a vehicle referred to in subsection i. or ii. i. An off-highway vehicle is a miniature vehicle if it has 3 or 4 wheels and is less than standard size. ii. TRMH Traffic Bylaw 2023/07 Page 4 of 23 (1) a seat height of less than 70 centimeters when there is no load; (2) a wheel rim diameter of less than 25 centimeters; (3) a wheelbase of less than 100 centimeters when measured from the centre of one axle to the centre of the other axle. q. "MOTORCYCLE" means a motor vehicle, other than a moped, that is mounted on 2-3 wheels and includes those motor vehicles known in the automotive trade as motorcycles and scooters, pursuant to the definition in the Traffic Safety Act, RSA 2000 Chapter T-6. r. "MOTOR VEHICLE" means i. vehicle propelled by any power other than muscular power, or ii. a moped, but does not include a bicycle, a power bicycle, an aircraft, an implement of husbandry or a motor vehicle that runs only on rails. s. "OFF-HIGHWAY VEHICLE" means any motorized mode of transportation built for cross-country travel on land, water, snow, ice or marsh or swamp land or on other natural terrain and, without limiting the generality of the foregoing, includes, when specifically designed for such travel, i. 4-wheel drive vehicles, ii. low pressure tire vehicles, iii. motorcycles and related 2-wheel vehicles, iv. amphibious machines, v. all terrain vehicles, vi. miniature motor vehicles, vii. snow vehicles, viii. minibikes, and ix. any other means of transportation that is propelled by any power other than muscular power or wind, but does not include: x. motorboats, or xi. any other vehicle exempted from being an off-highway vehicle by regulation. TRMH Traffic Bylaw 2023/07 Page 5 of 23 t. "OPERATOR'S LICENCE" means a licence to operate a motor vehicle issued pursuant to the Traffic Safety Act, RSA 2000 Chapter T-6. u. "OWNER" includes: i. a Person who is shown as the owner of the property on the subject Land Title; ii. a Person who is recorded as the Owner of the property on the tax assessment roll for the Town of Rocky Mountain House; iii. a Person who is an occupant of the property or Premises pursuant to a rental or lease agreement, license, or permit, or who otherwise occupies the property or Premises with the permission or consent of the legal owner; iv. a Person who has purchased or otherwise acquired the land, whether they have purchased or otherwise acquired the land directly from the owner or from another purchaser, and who has not yet become the registered owner thereof; v. a Person or business controlling or managing the property or Premises, vi. a Person who is the owner of a registered motor vehicle, whether active or not, as per Alberta Motor Vehicle registries and includes any person renting a motor vehicle or having the exclusive use thereof under a lease. v. "PARADE, PROCESSION, OR SPECIAL EVENT" shall mean any group of pedestrians (excepting a wedding or funeral procession) numbering more than ten (10) and marching, walking, jogging, running or racing in the street or on the sidewalk or any group of Vehicles (excepting a funeral procession) numbering five (5) or more, where traffic flow is impeded; AND may also mean, but is not limited to, any community group or organization that is hosting a community event, sporting event, or sidewalk event. w. "PARK" when prohibited, means to allow a vehicle, whether occupied or not, and whether or not the engine is running, to remain standing in one place, except: i. when standing temporarily for the purpose of, and while actually engaged in, loading or unloading of passengers, or ii. when standing in obedience to a peace officer or traffic control device. x. "PARKING SIGN" means a sign erected by the Town regulating the control of parking for the Town. y. TRMH Traffic Bylaw 2023/07 Page 6 of 23 i. a member of the Royal Canadian Mounted Police, while the member is in the exercise or discharge of the member's powers or duties, ii. a member of a municipal police service, while the member is in the exercise or discharge of the member's powers or duties, iii. a Peace Officer appointed under the Peace Officer Act, while the Peace Officer is in the exercise or discharge of the Peace Officer's powers or duties, and iv. a Bylaw Enforcement Officer appointed by the Council, while the officer is in the exercise or discharge of the officer's powers or duties. z. "PEDESTRIAN" means a person on foot or a person in or on a mobility aid. aa. "PREMISES" means any property contained within the property lines as registered with Alberta Land Titles and within the Town of Rocky Mountain House and includes but is not limited to fences, sheds, workshops, storage bins, buildings, and other structures, landscaped areas, gardens and trees; bb. "RECREATION VEHICLE" means a vehicle used or intended for use as a shelter living space including but not limited to any motorhome (Class A, B or C), bus conversion, holiday trailer, camper or tent trailer. cc. "REGISTRAR" means the Registrar of Motor Vehicle Services and includes any person who, on the directions of the Registrar, is acting on behalf of the Registrar of Motor Vehicle Services; dd. "SIDEWALK" means that part of a highway especially adapted to the use of or ordinarily used by pedestrians, and includes that part of a highway between i. the curb line, or ii. where there is no curb line, the edge of the roadway, and the adjacent property line, whether or not it is paved or improved. ee. "TOWN MANAGER" means the Chief Administrative Officer (CAO) appointed by the Town of Rocky Mountain House or designate. ff. "TOWN" means the Town of Rocky Mountain House, in the Province of Alberta. gg. "TRAFFIC CONTROL DEVICE" means any sign, signal, marking, or device placed, marked or erected under the authority of the Traffic Safety Act RSA 2000, Chapter T-6 and amendments thereto for the purpose of regulating, warning or guiding traffic. hh. "TRAFFIC TAG" means a traffic ticket issued by the Town. ii. TRMH Traffic Bylaw 2023/07 Page 7 of 23 i. may be attached to or drawn by a motor vehicle or tractor, and ii. is intended to transport property or persons, (1) and includes any vehicle defined by regulation as a trailer but does not include machinery or equipment solely used in the construction or maintenance of highways. jj. "VIOLATION TICKET" means a provincial ticket issued pursuant to the provisions of the Provincial Offences Procedures Act, R.S.A. 2000, c. P-34. 3. PEDESTRIANS 3.1. A pedestrian shall not cross a highway between blocks where no crosswalk exists so as to impede traffic. 3.2. No person shall get on or off any vehicle that is in motion. 4. PARKING/TIMED LIMITED AREAS 4.1. Unless specifically permitted by other provisions of this Bylaw, no person shall park any vehicle on any highway for any period longer than is permitted by the applicable Parking Sign. After the issuance of a Traffic Tag or a Violation Ticket concerning a vehicle for a first violation of Section 4(1), and the vehicle remains parked more than the time permitted on the applicable parking sign for a further period, then a second offence shall be deemed to have occurred and a subsequent Traffic Tag or Violation Ticket may be issued for such offence. 4.2. In order to determine the time which a vehicle has been parked in a location where parking has been restricted to a specific time, a Peace Officer may place an erasable chalk mark on the tread face of the tire of the parked or stopped vehicle without such Peace Officer incurring any liability for doing so. 4.3. No person shall remove an erasable chalk mark placed under Section 4.2 while the vehicle remains parked in the location where it was marked. 5. VEHICLES BEING REPAIRED 5.1. No person shall park any vehicle on any highway for the purpose of servicing or repairing the vehicle. 5.2. No person shall cause or permit a vehicle which is not in operable condition to be parked or left on any highway. 5.3. TRMH Traffic Bylaw 2023/07 Page 8 of 23 establish that he has taken immediate action or arranged for the removal of the vehicle forthwith. 5.4. No person being in charge or control of a car dealership, garage, service station, radio shop, or other premises where vehicles are sold or repairs or installations are made to vehicles, shall leave, cause, or permit any vehicle left in his/her possession to be parked or left on any public street within the Town. 5.5. No person shall leave a vehicle unattended on a highway if the vehicle has been placed on a jack or a similar device. 6. TRAILER/RECREATIONAL VEHICLE 6.1. No person shall park any recreational vehicle / trailer upon a highway unless the said trailer is attached to a vehicle by which it may be propelled or drawn, and when so attached the trailer shall be deemed part of the vehicle and subject to the regulations pertaining to vehicles. 6.2. No person shall operate or park any trailer or other recreation vehicle upon any land owned by the Town which has been designated to be used as a playground, boulevard, recreation, or public park, unless a Parking Sign permits operation or parking of such vehicles. 6.3. A recreational vehicle located on a highway: a. shall not be parked for more than 72 consecutive hours; and b. shall be removed to an off-highway location for at least 48 consecutive hours before it may be parked again on a highway. 6.4. A recreational vehicle parked on a highway shall not be occupied as a shelter or living space for any period of time. 6.5. A vehicle, or a vehicle with a trailer attached, with a total length exceeding 12.5 meters shall not be parked on a highway in a location adjoining residential property at any time. 6.6. Section 5 does not apply if the vehicle: a. is a recreational vehicle; or b. is a commercial vehicle with hazard warning lamps alight and in the process of loading or unloading goods. 7. PARKING IN ALLEY 7.1. No person shall stop or park a vehicle in an alley, unless a Parking Sign permits parking, but alleys may be used for parking during the process of loading or unloading of passengers or goods for a period not exceeding 30 minutes, if the vehicle's four-way The text shown in parentheses in various locations throughout this document identifies the corresponding amending bylaw which authorized the change to this bylaw. TRMH Traffic Bylaw 2023/07 Page 9 of 23 flashers are operating and it is not obstructing pedestrians or vehicles from using the alley. 8. PARKING RESTRICTIONS 8.1. Except as required or permitted by this Bylaw, no person shall stop or park any vehicle: a. on a sidewalk or boulevard; b. on a crosswalk or on any part of a crosswalk; c. within an intersection other than immediately next to the curb in a "T" intersection; d. at an intersection nearer than 5 meters to the projection of the lateral curb line of the highway at right angles to the direction of the travel of the vehicle; e. within 5 meters of the approach to a stop sign or yield sign; f. within 5 meters of any fire hydrant, or when the hydrant is not located at the curb, within 5 meters from the point on the curb nearest the hydrant; g. within 1.5 meters of an access to a garage, private road or driveway, or a vehicle crossway over a sidewalk; h. within 5 meters from the near side of a marked crosswalk; i. alongside or opposite any highway excavation or obstruction when the stopping or parking would obstruct traffic; j. on any bridge or on the approach to any bridge; k. at any place where a traffic control device prohibits stopping or parking; l. on the roadway side of a vehicle that is parked or stopped at the curb or edge of the roadway; m. at or near the site of any fire, accident, or other emergency, if stopping or parking would obstruct traffic or hinder emergency vehicles. n. in any location marked as a Fire Lane; o. within 1.5 meters of a marked fire door; p. within a fire hall or ambulance entrance way; The text shown in parentheses in various locations throughout this document identifies the corresponding amending bylaw which authorized the change to this bylaw. TRMH Traffic Bylaw 2023/07 Page 10 of 23 q. in any Loading Zone marked with a Parking Sign, except when actively loading or unloading people or goods within the permitted time frame; r. in such a manner as to obstruct passage on any sidewalk or walkway or on a ramp or access designed to accommodate persons with mobility challenges; s. in such a manner as to block, obstruct, impede or hinder traffic on a highway. This prohibition does not apply where the obstruction is unavoidable due to mechanical failure of the vehicle provided that the person takes measures to remove, or arrange for the removal of, the vehicle from the highway forthwith; t. within 1 meter of a refuse or waste receptacle located in a residential district or on private commercial property; u. within 1 meter of an electrical transformer. 9. PARALLEL PARKING 9.1. Parking on highways within the Town shall be parallel parking, except as permitted by Section 10.2. or where a sign indicates that angle parking is permitted or required. 9.2. When parking a vehicle on a highway, a person shall park any vehicle facing the direction of travel authorized for that portion of the highway, with its sides parallel to and its right front wheels not more 500 millimeters from the curb or edge of the roadway. 10. ANGLE PARKING 10.1. Where angle parking is permitted or required, a person shall park any vehicle with one front wheel not more than 500 millimeters from the curb or edge of the roadway and with its sides between and parallel to any two of the visible parking guidelines, or at an angle of between 30 and 60 degrees to the curb or edge of the roadway where no parking guidelines are visible. 10.2. No vehicle shall angle park pursuant to Section 10.1. if they are greater than 6 meters in length. 10.3. No person shall park a vehicle at an angle to the curb in a cul-de-sac in a residential district unless that vehicle is parked in a manner that avoids interference with the free flow of traffic in the cul-de-sac. 11. PARKING ON HILLS 11.1. No person shall park or leave a vehicle unattended on any grade or slope without: a. turning the front wheels of the vehicle towards the nearest curb or edge of the roadway in such a manner so as to impede any movement of the vehicle, and The text shown in parentheses in various locations throughout this document identifies the corresponding amending bylaw which authorized the change to this bylaw. TRMH Traffic Bylaw 2023/07 Page 11 of 23 b. effectively setting the vehicle's parking brake or other mechanism with which the vehicle is equipped that is designed to hold the vehicle in a stationary position while the vehicle is unattended. 12. UNAUTHORIZED PARKING 12.1. No person shall park a vehicle or trailer on any property, private or Town property, that has been clearly marked by a sign containing the words "No Parking. Unauthorized vehicles will be towed at the Owner's expense." or words to the like effect, erected at the entrance or within the boundaries of the property, unless such person has obtained prior permission of the owner or tenant, occupant, or person in control of the property. 12.2. No person shall park in any leased parking stall without the expressed permission of the lessee thereof. 12.3. A person owning or occupying or in charge of property who observes that any person is violating the provisions of Section 12.1. or 12.2. may report the violation to a Peace Officer, by giving: a. the name and address of the person reporting the violation; b. the address of the land where the vehicle is parked; and c. the license number of the illegally parked vehicle. 12.4. A Peace Officer may cause any vehicle parked contrary to Section 12.1. or 12.2. to be removed and impounded by the Peace Officer. 12.5. In lieu of, or in addition to, the removal and impounding of the vehicle a Peace Officer may issue a Traffic Tag or Violation Ticket to the Owner of the vehicle parked in contravention of Section 12.1. or 12.2. 13. DISABLED PARKING 13.1. No person shall park a vehicle on a highway in any location identified as being for the use of persons with disabilities, unless the vehicle: a. displays a valid disabled placard or license plate issued or recognized by the Registrar; and b. is being used for the transportation of a person with a disability. 14. PARADES/PROCESSIONS OR SPECIAL EVENTS 14.1. No person shall participate in or conduct any Parade, Procession or Special Event on a highway within the Town unless prior permission has been obtained from the Town. Application forms and procedures can be accessed through Protective Services. When permission has been obtained for a Parade, Procession or Special Event: a. notwithstanding any provisions of this Bylaw, persons may congregate on the sidewalks for the purpose of viewing the Parade, Procession, Special Event; b. the Town Manager or their designate may close all, or any portion, of a highway along the route for the anticipated time of the Parade, Procession or Special Event and for such additional time as necessary to again clear the highway for normal traffic; c. the Town Manager or their designate may temporarily suspend parking and loading privileges on all, or any portion, of a highway on the proposed route. d. if any vehicle is parked on the designated route, a Peace Officer may remove such vehicle and impound such vehicle at the Owner's expense. e. This section will not pertain to those who have obtained or been designated a Town permit / temporary business license for public property use. 15. EXEMPTIONS FROM PARKING PROVISIONS 15.1. Nothing in this Bylaw prohibits: a. police vehicles; b. ambulance, fire trucks or other emergency vehicles; c. bylaw enforcement vehicles; d. service vehicles used in conjunction with the servicing of public utilities including telephone systems, electric systems and natural gas systems; e. municipal and other Government Public Works vehicles and trailers; f. towing services vehicles; g. vehicles engaged in highway repair, maintenance or inspection; from stopping or parking on any roadway by their operators while in the performance of their duties. 16. CYCLIST / SCOOTER / SKATEBOARD 16.1. No person shall ride a bicycle, scooter, skateboard or in-line skates on a sidewalk where prohibited from doing so by a sign. 16.2. No person shall ride a bicycle, scooter, skateboard or in-line skates on a sidewalk so as to interfere with pedestrians on or using such sidewalk. A Peace Officer may seize and impound for a period of up to 14 days any bicycle, scooter, skateboard, or in-line skates which is used or operated in contravention of this Bylaw. 16.4. Where a bicycle, scooter, skateboard or in-line skates has been seized and impounded by a Peace Officer as provided for in Section 16(3), the owner or operator of such bicycle, scooter, skateboard or in-line skates shall, aside from any fine or penalty to which he may be subject, be liable for all reasonable costs incidental to the seizure and impounding of the bicycle, scooter, skateboard or in-line skates. 17. SPEED LIMITS 17.1. Unless otherwise posted or provided for in this Bylaw, the maximum speed limit within the Town is as follows: a. All highways east of Highway 11 are a maximum of 50 kilometres per hour with the exception of: i. Allan Avenue (55 Avenue), Kennor Street (38 Street), Laurnan Lane (39 Street), Ranwall Avenue (56 Avenue), 40 Street, and 53 Avenue east of 40 Street, all within the McNutt Subdivision, which shall be a maximum of 40 kilometres per hour. ii. 44A Street from 50 Avenue to 51 Avenue, which shall be a maximum of 30 kilometres per hour. b. All highways west of Highway 11 are a maximum of 40 kilometres per hour with the exception of: i. 60 Street and 71 Avenue from Highway 11A to Highway 11 shall be a maximum of 50 kilometres per hour. ii. 57 Street from 53 Avenue to 57 Avenue shall be a maximum of 30 kilometres per hour. iii. 55A Street from 52A Avenue to 53 Avenue shall be a maximum of 30 kilometres per hour. iv. 54 Street from 57 Avenue to 60 Avenue shall be a maximum of 30 kilometres per hour. v. 53 Street Close shall be a maximum of 30 kilometres an hour. vi. 50 Street from 48 Avenue to 54 Avenue shall be a maximum of 30 kilometres per hour. TRMH Traffic Bylaw 2023/07 Page 14 of 23 vii. 48 Street from Highway 11A to 53 Avenue and Highway 11 shall be a maximum of 30 kilometres an hour. viii. 46 Street from 60 metres either side of railway crossing shall be maximum 30 kilometres an hour. ix. 57 Avenue from 56 Street to 60 Street shall be a maximum of 30 kilometres an hour. x. 57 Avenue from 53 Street Close to 54 Street shall be a maximum of 30 kilometres an hour. xi. 53 Avenue from 55A Street to 57 Street shall be a maximum of 30 kilometres an hour. xii. 53 Avenue from 48 Street to 50 Street shall be a maximum of 30 kilometres an hour. (Bylaw 2025/08, May 6, 2025) 17.2. No person shall operate a vehicle in a parking lot or alley within the Town at a speed greater than 20 kilometers per hour. 17.3. The speed limit for all School Zones and Playground Zones will be the speed limit in effect 24 hours a day. (Bylaw 2025/08, May 6, 2025) 18. USE OF SIDEWALKS 18.1. No person shall permit any livestock, horse drawn vehicle or sleigh to stand or be upon any sidewalk. 18.2. No person shall operate, pull, or push any motor vehicle on any sidewalk. 19. SNOW REMOVAL/STREET CLEANING/SIDEWALK CLEARING 19.1. No person shall park, or leave parked, a vehicle on a block of the Town where signs have been posted indicating "No Parking - Street Cleaning / Snow Removal", during the times prescribed on the sign, after the expiration of 12 hours from the time the signs have been placed until such sign is removed. 19.2. Notwithstanding anything contained in this Bylaw, during snow removal or street cleaning operations carried on by the Town or their contractors, the Town may have vehicles towed and impounded at the registered owner's expense. 19.3. All persons owning or occupying premises in the Town, shall clear away and remove all snow, ice, slush, dirt or other obstructions from the sidewalk situated on land adjoining the property owned or occupied by them within 48 hours of the time that such snow, ice, slush and dirt or other obstructions were deposited. The Town may after the expiration of the 48-hour time limit in Section 19.3., or if it be deemed necessary at any time, remove and clear away all snow, ice, slush, dirt or other obstructions required to be removed by Section 19.3. and the owner of the property is liable for such removal costs. In addition to the removal costs, the owner will be subjected to an administration fee. 19.5. Where the owner or occupant fails to pay the administration fee and costs of removal referred to in Subsection (4), such costs may be added to the tax roll of the property. 19.6. Only snow, ice, slush, dirt or other obstructions that have accumulated naturally on a sidewalk referred to in Section 19(4) may be deposited on a street. MISCELLANEOUS 20. Where an unprotected hose of a Fire Department has been laid down on a highway, no person shall drive a vehicle over such hose unless an official of the Fire Department at the scene has specifically allowed them to do so. 21. No person shall pass beyond a point designated by a Peace Officer or a member of a Fire Department near the location of an emergency scene unless otherwise directed to do so. 22. No person shall fail to obey: a. a person who is giving directions, or b. a barricade or sign that is erected on a highway for the purpose of directing traffic in connection with an accident, an emergency or any construction, repair or other work on the highway or land adjacent to the highway. 23. SPECIFIC REGULATIONS 23.1. No person shall operate on any highway within the Town: a. any vehicle or other type of equipment or thing, which does cause, or is likely to cause, damage to such highway; b. any vehicle or other type of equipment having metal spikes, lugs, cleats, skids, or bands projecting from the surface of the wheel, tire or track of such vehicle. 23.2. No person shall deposit or place sand, gravel, cement, or any other material on a highway. 23.3. No person shall tear down, remove, or interfere with any plaques, signs, signals, barricades, flares or other things placed with the authority of the Town. No person driving a motor vehicle shall make a left turn across the center line of any highway between intersections unless directed by a Peace Officer or a traffic control device to do so. 24. NOISE EMISSIONS 24.1. A person shall not create or cause the emission of any loud noise; a. from a vehicle or any part of it, or b. from anything or substance that the vehicle or part of the vehicle comes into contact with. 25. OFF-HIGHWAY VEHICLES / PROHIBITED OPERATION 25.1. No person shall operate an off-highway vehicle within the Town except as provided in this section. 25.2. Off-highway vehicles are permitted to operate on a highway solely for the purpose of loading or unloading an off-highway vehicle from an adjacent property onto another vehicle / trailer. 25.3. Peace Officers or employees of the Town are authorized to operate off-highway vehicles on any highway within the Town while performing their official duties. 25.4. A person or persons may be granted permission by the Town Manager to operate off- highway vehicles within a specific route and time designated for a Parade, Procession or Special Event. 25.5. No person shall operate any vehicle that is defined as a "miniature vehicle" on a highway. This may include, but is not limited to, a personal transporter, pocket bike, go carts, electric two wheeled scooters, golf carts and riding lawn mowers. 26. POWERS OF A PEACE OFFICER 26.1. Where a Peace Officer has reasonable grounds to believe a person has contravened any provision of this Bylaw, he/she may issue such person a Traffic Tag allowing the payment of the specified penalty to the Town which shall be accepted by the Town in lieu of prosecution for the offence. 26.2. Service of a Traffic Tag shall be sufficient if it is: a. personally served; or b. attached to the vehicle in respect of which an offence is alleged to have been committed; or The text shown in parentheses in various locations throughout this document identifies the corresponding amending bylaw which authorized the change to this bylaw. TRMH Traffic Bylaw 2023/07 Page 17 of 23 c. mailed to the address of the registered Owner of the vehicle or to the person in possession of said vehicle. 26.3. Notwithstanding Section 26.1. herein, a Peace Officer is hereby authorized and empowered to issue a Violation Ticket, without first issuing a Traffic Tag, to any person who the Peace Officer has reasonable grounds to believe has contravened any provision of this Bylaw. 26.4. If a Violation Ticket is issued in respect of an offence, the Violation Ticket may: a. specify the fine amount established by this Bylaw for the offence; or b. require a person to appear in Court without the alternative of making a voluntary payment. 26.5. A person who commits an offence may: a. If a Violation Ticket is issued in respect of the offence; and b. If the Violation Ticket specifies the fine amount established by this Bylaw for the offence, make a voluntary payment equal to the specified fine by delivering the Violation Ticket and the specified fine to the Provincial Court Office specified on the Violation Ticket. 27. No person, other than the Owner or operator of said vehicle, shall remove any Traffic Tag placed on or affixed to the vehicle by a Peace Officer in the course of his duties. 28. No person other than a Peace Officer shall place a Traffic Tag on a vehicle. 29. A Peace Officer may authorize any person, as deemed necessary, to direct or regulate traffic. 30. OFFENCES AND PENALTIES 30.1. Any person who contravenes any provision of this Bylaw is guilty of an offence and subject to the penalties provided herein. Offences are subject to increased fines, per offence. Fines will increase per offence and are calculated one year from the first offence. 30.2. If a vehicle is involved in an offence under this bylaw, the Owner of that vehicle is guilty of that offence. 30.3. TRMH Traffic Bylaw 2023/07 Page 18 of 23 sum of $10.00, which reduced amount shall be accepted in satisfaction of the Traffic Tag. 30.4. The specified penalty amount on a Traffic Tag, if paid to the Town cashier at the Town Office within the period of 8 to 15 days of the date of service of the Traffic Tag, may be reduced by the sum of $5.00, which reduced amount shall be accepted in satisfaction of the Traffic Tag. 30.5. After the expiry of 15 days from the date of service of the Traffic Tag, the full specified penalty amount must be paid, and may be paid to the Town cashier at the Town Office at any time before a Violation Ticket is issued under the Provincial Offences Procedures Act. 31. REMOVAL AND IMPOUNDMENT OF VEHICLES 31.1. A Peace Officer is hereby authorized to remove or cause to be removed any vehicle or trailer: a. operated or parked in contravention of any provision of this Bylaw; or b. where emergency conditions may require such removal from a highway. 31.2. Such vehicle may be removed to a place designated by the Peace Officer, where it will remain until claimed by the Owner thereof or his / her agent. 31.3. No impounded vehicle shall be released to its Owner or his / her agent until the impounding charge and removal charge and removal charge on the vehicle have been paid, such charges shall be in addition to any fine or penalty imposed in respect of any such violation, or to any payment made in lieu of prosecution as provided herein. The Town is not responsible for impounding, towing or removal costs. 32. AUTHORITY OF TOWN MANAGER 32.1. The Town Manager is hereby authorized to designate: a. any highway for through traffic purposes; b. the location of crosswalks upon highways; c. any intersection, highway, or place on a highway, as a place where U-turns are permitted; d. any highway as one which is closed temporarily in whole, or in part, to traffic; e. any areas as one in which parking privileges are temporarily suspended; f. any highway as one to be divided into traffic lanes of such number as the Town Manager considers proper; g. the location of school zones and playground zones; h. any boulevard upon which parking is permitted; i. the location of loading zones; j. the location of bus stops; The text shown in parentheses in various locations throughout this document identifies the corresponding amending bylaw which authorized the change to this bylaw. TRMH Traffic Bylaw 2023/07 Page 19 of 23 k. the distance from any intersection within no parking is permitted; l. portions of the highway where parking is limited to a period of time; m. portions of the highway where parking or stopping is prohibited entirely, or for a period of time; n. location of metered zones, meter locations and metered spaces; o. areas for angle or parallel parking; p. the maximum load permitted on any bridge; q. parking spaces upon a highway for the use of taxi parking; and r. parking spaces designated for disabled parking. 32.2. Council hereby delegates the power to direct where traffic control devices are to be installed or removed to the Town Manager or their designate. 32.3. The Town Manager or their designate shall keep a record of the location of all traffic control devices. 33. TRANSITION SECTION 33.1. All traffic control devices which are in place on the effective date of this Bylaw shall be deemed to be valid traffic control devices for the purposes of this Bylaw. 33.2. All School Zones, Playground Zones, Loading Zones, Bus Zones in effect immediately prior to the coming into force of this Bylaw shall continue to be in effect until removed. This Bylaw comes into full force and effect upon third and final Reading. Bylaw 12/02V and all amendments thereto are hereby repealed.
