Village of Rosemary

Bylaw No. 529-26
Consolidation of Bylaws
WHEREAS Section 69 of the MGA Chapter 26 as amended from time to time allows that a Council may
authorize a designated officer to consolidate one or more of the bylaws of a municipality.
WHEREAS the Council of the Village of Rosemary wishes to have the consolidation of bylaws as an option
for future use.
NOW THEREFORE the Council of the Village of Rosemary enacts that the Chief Administrative Officer (CAO)
or designate is hereby authorized to consolidate one or more bylaws.
This bylaw shall be known as the "Consolidation of Bylaws Bylaw".
Purpose
From time to time, when a minor change to a bylaw is required, it is expedient to pass an amending or
revising bylaw and consolidate the amending or revising bylaw with the original bylaw. This bylaw grants
approval to the CAO or designate to make that consolidation.
Procedures
In alignment with Section 69(1) of the MGA, in the consolidation of a bylaw, the CAO must:
(1) incorporate all amendments and/or revisions into one bylaw,
(2) omit any provision that has been repealed or that has expired,
(3) prepare a printed copy of the bylaw consolidated under this section that has been endorsed for
printing by the CAO; and
(4) include a provision in the bylaw stating that it has been consolidated under the authority of this
bylaw.
Each separate provision of this bylaw shall be deemed independent of all other provisions, and if any
provisions of this bylaw be declared invalid; all other provisions shall remain valid and enforceable.
This bylaw comes into effect on the date of the third and final reading.
