## THE SUMMER VILLAGE OF SANDY BEACH BYLAW 05-2019
## GARBAGE, ORGANICS & RECYCLING BYLAW

BEING A BYLAW OF THE SUMMER VILLAGE OF SANDY BEACH, IN THE PROVINCE OF ALBERTA, TO REGULATE and CONTROL THE COLLECTION, REMOVAL and DISPOSAL of RESIDENTIAL HOUSEHOLD GARBAGE, AND ORGANICS IN THE SUMMER VILLAGE OF SANDY BEACH.
WHEREAS Division 1, Section 7 of the Municipal Government Act, being Chapter M-26, 2000 and amendments thereto, give Council authority to pass a Bylaw respecting the services provided by or on behalf of the municipality, and
WHEREAS the Council of the Summer Village of Sandy Beach deems it necessary to pass a Bylaw for the collection and disposal of household waste, garbage and organics, as well as the collection of recyclables within the Summer Village, and
NOW THEREFORE the Municipal Council of the Summer Village of Sandy Beach duly assembled enacts the following:
This Bylaw may be cited as the "Garbage Bylaw".
## DEFINITIONS
- In this bylaw:
- (a) "Designated Officers" shall mean each and every member
- (b) "Council" shall mean the duly elected Council for the Summer Village of Sandy Beach.
- (c) "Collection Day" shall mean the day or days during each week on which household waste/garbage and organics is regularly collected from a specific premise i.e. Mondays except Stat. Holidays.
- (d) "Dwelling" shall mean a building occupied for residential purposes, other than a multiple family dwelling.
- (e) "Garbage" shall mean discarded ashes, crockery, cloth, wrappings, plastics and other items of household refuse, but does not include human or animal excrement, medical wastes such as hypodermic syringes or industrial waste, or animal carcasses.
- (f) "Garbage can" shall mean a receptacle constructed of noncorrosive durable metal or plastic which shall not exceed 77 liters in volume and which is intended to hold plastic garbage bags.
- (g) "Garbage Collection Agent" shall mean the person or firm appointed by the municipality for the purpose of collecting and disposing of garbage and refuse.
- (h) "Garbage stand" shall mean a wooden or metal stand or enclosure designed to hold all garbage cans required by the premises for which the stand is provided, and which shall be so designed as to keep all garbage cans in an upright position at all times, protected from interference from dogs or other animals, and provide for convenient removal of garbage cans or bags.
- (i) "Householder" shall mean any person occupying any dwelling or place of residence, but shall not include any person who is merely a boarder, roomer, or lodger therein.
- (i) "Industrial waste" shall mean materials from excavations, materials from lot clearing and building construction, repairs, alterations, or maintenance, debris from any building removed or destroyed by fire or any other cause, dead animals, waste from garages.
- (k) "Municipality" shall mean the Summer Village of Sandy Beach.
## REGULATIONS
- No person, firm or corporation shall deposit, leave, dispose, or abandon any waste material within the corporate limits of the Summer Village of Sandy Beach, in any location other than at designated disposal places. The Council may at their discretion employ any person or persons or may contract with any person or persons for regular pick-up or removal of garbage or refuse or recyclables within the Summer Village of Sandy
Beach and pay the cost of this service from the general revenue of the Summer Village.
2. Any person transporting waste material may deposit the same in the Highway 43 Regional Landfill Site and doing so, they should not allow any of the waste material to fall off the vehicle while transporting it to the grounds. All loads must be tarped or enclosed.
3. No hazardous waste will be picked up.
4. The owner, lessee, or tenant of a single-family residence, which is considered a household from which household garbage or refuse is collected on a weekly basis, shall only be allowed to put out 5 bags of household waste ONLY safely secured and tied in durable black bags of no more than thirty (30) Ib. (11.2 kg) in weight each and five (5) bags of organic material ONLY (grass clippings and leaves only) secured and tied in durable clear bags of no more than thirty (30) Ib. (11.2 kg) in weight each.
5. Garbage that is not contained in the appropriate bags, scavenged, torn, not containing the designated material, exceeds the limit of five (5), and weighs more than thirty (30) Ib. (11.2 kg) each will not be collected.
6. No garbage carts will be emptied unless garbage is contained in bags and tied.
7. All garbage must be at curb by 7:00 a.m. on the day of collection. Additional garbage bags must be placed beside the garbage cart for collection. The weight of each additional bag (within 5 bags limit) shall not exceed thirty 30) Ib. (11.2 kg)
8. Garbage bags or carts should not be placed at the curb more than 12 hours before collection.
9. After collection, garbage carts (if in use) must be removed from the curb and back onto the property within the property boundaries. If in use, any late carts being collected the second time, and subsequently in any one year, will be subject to a penalty of $15.00 payable at the Village Office before being released to owner/renter - Council authorize all penalties to be accrued against any offending property roll.
10. This Bylaw and Council as a matter of environmental responsibility support all recycling efforts and suggest that all recycling should be disposed of at the Highway 43 site in Gunn, Alberta and is the responsibility of the owner/tenant of any particular property within the municipal boundaries regardless of designation and or zoning.
11. The following Items that may be recycled at the Highway 43 site in Gunn Alberta include:
## Paper - excluding cardboard;
- Newspapers and inserts, magazines, catalogues
- White writing and computer paper
- Christmas cards, no-foil gift wrap
- Junk mail, flyers, paper bags, envelopes, paper and hard cover books (remove hard cover), phone books
Metals (no loose lids, trap inside can or discard, labels removed)
- Clean tin cans (soup, juice, etc.)
- Aluminum cans (beverages)
Plastics (discard caps and lids; empty and rinse)
## OTHER Items
- Household cleaner bottles
- Shampoo and conditioner bottles (including similar personal care products)
- Vinegar bottles
- Plastic bags (all types including bread and dry cleaner bags
- Pop and beverage bottles
- Milk jugs
- Detergent or fabric softener bottles
- Margarine and yogurt containers
- Ice cream pails (remove metal handle)
- Vitamin bottles
- Windshield washer containers

13. If the plastic item does not have a number on it or is not one of the numbers above, it should be placed in the garbage not the recycling.
14. All residents are encouraged to deposit and claim their drink deposits from an appropriate depot. These items like milk jugs, juice cartons, pop cans and other beverage containers like liquor and alcohol can be contained in durable bags at you home and when convenient be taken to a depot and exchanged for monies. Remember you pay a deposit on these items and should claim the money back. Do not dispose of these items in your household garbage, this practice is discouraged by this Bylaw.
## ADMINISTRATION
1. The full cost of garbage collection from dwellings, multiple family dwellings and commercial premises within the areas of the municipality shall be paid out of the general residential tax revenue of the municipality as collected through general tax revenue.
## PENALTIES
1. Council reserves the right to amend operational changes to this Bylaw as required.
2. Any person failing to comply with any section of the aforementioned bylaw shall be guilty of an offence and liable to the Village for any expense, loss or damage occasioned to the Summer Village of Sandy Beach by reason of such violation and failure to comply authorize Council to recover costs against a property roll number.
Where any of the provisions of this bylaw have been deemed to be contravened and an offence ticket has been issued for that contravention, the accused may avoid appearing in court to answer the said charge by submitting to the Village a tax roll payment as follows:

This Bylaw shall come into effect at the final passing thereof.
Bylaw No. 77 is hereby rescinded as is all other bylaws and readings of any subsequent bylaws that deal with the disposal of household waste, garbage or organics within the municipality.
READ a first time this 19 th day of September, 2019. READ a second time this 19 th day of December, 2019. READ a third and final time on this 19 t h day of December, 2019.
