## BYLAW #202 - 1995
A BYLAW OF THE SUMMER VILLAGE OF SANDY BEACH IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF REGULATING NOISE IN THE SUMMER VILLAGE OF SANDY BEACH.
WHEREAS the Municipal Governient Act, Revised Statues of Alberta 1994, Chapter M26.1 and amendments thereto permits the Council of the Summer Village of Sandy Beach, by bylaw, to prohibit, eliminate or abate noise and establish permissible noise levels for all or varying periods of the day;
AND WHEREAS, the Council of the Suminer Village of Sandy Beach, deems it advisable to adopt such a by-law;
NOW THEREFORE, the Council of the Summer Village of Sandy Beach, duly assembled, enacts as follows:
## 1. In this Bylaw
- (a) "Summer Village" means the Summer Village of Sandy Beach;
- (b) "Person" includes public bodies, bodies corporate, societies, partnerships, firms, and individual, companies;
- (c) "Property" means real property and includes land together with all improvements which have been so affixed to the land as to make them in fact and in law a part thereof.
- (a) No person shall make, cause or permit to be made or caused, any noise which disturbs or tends to disturb the quiet, peace, rest, enjoyment, comfort or convenience of any person or persons within the corporate limits of the Summer Village.
- (b) No person being the owner, tenant or occupant of property shall allow or permit such property to be used so that noise which occurs thereon or emanates therefrom, disturbs or tends to disturb the quiet, peace, rest, enjoyment comfort or convenience of any persons or persons within the corporate limits of the Summer Village.
- (c) No person shall own, keep or harbour any animal or bird which makes or causes to be made, any noise which disturbs or tends to disturb the quiet, peace, rest, enjoyment, comfort or convenience of any person or persons within the corporate limits of the Summer Village.
- Nothing herein shall render any person liable to a fine, penalty or punishment for performing work of an emergency nature for the preservation or protection of life, health or property.
4. Any person who contravenes any provision of the Bylaw is guilty of an offense and shall be liable on summary conviction to a fine of not less than $100.00 (One Hundred Dollars) and not more than $500.00 (Five Hundred Dollars), exclusive of costs, or in default of payment of the fine and costs, judgment.
