## BY-LAW NO. 006-07 OF THE TOWN OF SMOKY LAKE IN THE PROVINCE OF ALBERTA ## A BY-LAW OF THE TOWN OF SMOKY LAKE IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF TRAFFIC / PARKING UNDER authority of and subject to the provisions of the Municipal Government Act, Statutes of Alberta 2000, Chapter M-26 and amendments thereto and under the authority of the Highway Traffic Act R.S.A. Chapter H-8, the Council of the Town of Smoky Lake, duly assembled, enacts as follows: WHEREAS the Council of the Town of Smoky Lake deems it necessary and advisable to pass a Bylaw to regulate and control the parking of vehicles within the Town. THEREFORE, the Council of the Town of Smoky Lake, duly assembled, enacts as follows: - A. The definition of the word "HIGHWAY" shall mean any thoroughfare, street, road, tral, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestle way or other place, whether publicly or privately owned any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles. ## VEHICLE PARKING 1. No person shall leave a vehicle parked on any Town highway for more than 4 consecutive days. 2. No person shall park a vehicle except a vehicle equal to or less than 5400 kilograms on a Town highway designated as a residential area in the Land 3. The Chief Administrative Officer may waive the above two stipulations on an application to the town on an individual basis. This section shall not apply to: - a. vehicles actually loading or unloading goods - C. public service vehicles (i.e. fire truck, ambulance, school bus) - b. construction equipment being used during construction or improvements of property; and 3. No person shall park a recreation vehicle or trailer either attached or detached for more than 4 days on any Town highway unless authorized to do so by the Chief Administrative Officer. This shall include a vehicle used or intended foi use as a shelter, and without restricting the generality of the foregoing, includes any motor home, holiday trailer, camper, tent trailer or any bus or truck converted for use as a recreation vehicle. 4. Any peace officer or designated officer is hereby authorized to remove or cause to be removed, any vehicle or trailer: - a. parked in contravention of this bylaw or - b. where emergency conditions may require such removal The owner or his authorized agent of any vehicle removed and/or parked in contravention of this bylaw shall pay all storage and/or removal charges. Such charges shall be in addition to any fine or penalty imposed in respect of any such violation as per the Traffic Highway Act. ## BY-LAW NO. 006-07 OF THE TOWN OF SMOKY LAKE IN THE PROVINCE OF ALBERTA ## A BY-LAW OF THE TOWN OF SMOKY LAKE IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF TRAFFIC / PARKING It is the intention of the Town Council that each separate provision of this bylaw shall be deemed independent of all other provisions, and it is further the intention of the Town Council that if any provision of this bylaw be declared invalid, that provision shall be deemed to be severed and all other provisions of the Bylaw shall remain in force and effect. 6. This By-law shall come into effect on the date of the final passing.
