## TRAFFIC CONTROL &amp; OFF-HIGHWAY VEHICLES BYLAW BYLAW NO. 2023-06 VILLAGE OF STANDARD A Bylaw to regulate the speed of highway traffic, prescribe the location of traffic control devices on highways, and parking control within the village of standard, in the Province of Alberta. WHEREAS the Council of the Village of Standard considers it desirable and expedient to regulate the speed and use of highway traffic on highways subject to its direction, control, and management in accordance with the Traffic Safety Act, Revised Statutes of Alberta, 2000, Chapter T-6, as amended; and WHEREAS the Council of the Village of Standard considers it desirable and expedient to authorize the placing, erecting, or making of traffic control devices at any location considered necessary for controlling highways within its direction, control and management including the erection of stop signs at railway crossings. AND WHEREAS the Council of the Village of Standard considers it desirable and expedient to delegate the power to prescribe where traffic control devices are to be located, including traffic control devices restricting the speed of vehicles; THEREFORE, the Council of the Village of Standard, in the Province of Alberta, duly assembled, enacts as follows this bylaw which shall be cited as the "Traffic Control Bylaw". ## DEFINITIONS: | Alley | A narrow highway intended chiefly to give access to rear of buildings and parcels of land; | |------------------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Village | Village of Standard | | Driver/ Operator | A person who drives or who is in actual physical control of a motor vehicle or off-highway vehicle | | Highway | Any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestle way or other olace, whether publicly or privately owned, any part of which the bublic is ordinarily entitled or permitted to use for the passage ol parking of vehicles, and subject to the direction, management and control of the Village of Standard and, includes: - a sidewalk (including the boulevard portion of the sidewalk), - if a ditch lies adjacent to and parallel with the highway, the ditch, - if a highway right of way is contained between fences or between a fence and one side of the highway, all the land between the fences, or all the land between the fence and the edge of the highway, as the case may be, but does not include a place declared by the Lieutenant Governor in Council not to be a highway | | Motor Vehicle | A vehicle propelled by any power other than muscular power, or - a moped, but does not include a bicycle, - an aircraft, - a tractor, whether equipped with rubber tires or not, - an implement of husbandry or a motor vehicle that runs only on rails; | | Off-highway vehicle | Any motorized vehicle designed for cross-country travel including ATVs, motorcycles, motorbikes, snow vehicles, and any other vehicle of transportation which is propelled by any power other than muscular with the exception of electric bicycles (e-bikes), electric wheelchairs, and mobility scooters. | |-----------------------------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Officer | A Bylaw Enforcement Officer appointed by the Village of Standard, a Peace Officer as defined and appointed pursuant to the Peace Officer Act (RSA, 2000), or a member of the RCMP. | | Owner | The registered owner of a Motor Vehicle, Recreational Vehicle, Off Highway Vehicle, or Trailer. | | Parkland | Every recreational area owned or controlled by the Village that lies within Village limits whether such parkland is improved in whole or in part or remains in its natural state, but shall include other neighborhood beautification areas and publicly maintained areas administer by the Village. | | Public Works Superintendent | Village of Standard employee official in the role of Public Works Supervisor | | Traffic Control Device | Any sign, signal, marking or device placed, marked or erected under the authority of the Traffic Safety Act, Revised Statutes of Alberta, 2000, Chapter T-6, as amended, for the purpose of regulating, warning, or guiding traffic and/or parking. | | Trailer | A vehicle so designed that it may be attached to or drawn by a motor vehicle and intended to transport property or persons and includes any trailer that is designed, constructed and equipped as a dwelling place, living abode, or sleeping place, either permanently or temporarily, but does not include machinery or equipment used in the construction or maintenance of highways | | Truck | a vehicle designed primarily for the transportation of property or equipment but does not include a chassis-cab, crawler mounter vehicle, trailer, machinery or equipment used in the construction o maintenance of highways or an off-highway vehicle as defined in the Off-Highway Vehicle Act, Revised Statutes of Alberta, 2000, Chapter | | Truck tractor | A truck that is designed primarily for drawing another vehicle and | | Vehicle | A device in, on or by which a person or thing may be transported or drawn on a highway | | Violation tag | A written notice, in a form approved by the Chief Administrative | ## 1. Rules for the Operation of Vehicles - a) No vehicle shall be left upon any Highway in such a manner as to block, obstruct, impede, or hinder traffic thereon. 2. Where the obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this Bylaw provided the operator takes measures to remove such vehicle from the highway as promptly as is reasonably possible and activate warning or hazard lights. - b) Off-Highway Vehicles 4. No person shall operate engine retarder brakes within the Village limits. 5. No person shall operate an off-highway vehicle upon any parkland within the Village of Standard. 6. No person shall operate an off-highway vehicle in the Village of Standard except upon the property of the operator or for the purpose of proceeding from operator residence to a permitted area using the alleys and roads that makes the most direct and shortest route of travel available. 7. No person shall operate an off-highway vehicle at a speed in excess of 15 km/hr. - V. No off-highway vehicle shall be operated within the Village limits between the hours of 10:00pm and 7:00am. - vi. Off-highway vehicles will be registered and operated under the regulations of the Alberta Traffic Safety Act RSA 2000. - vii. Off-highway vehicles are not permitted to be parked on Village highways for any purpose other than loading and/or unloading. 2. Speed limits - a) Unless otherwise hereinafter specifically posted, the maximum rate of speed at which a driver may operate a motor vehicle upon any highways within the Village shall be 40 (forty) kilometers per hour. - b) The maximum rate of speed at which a driver may operate a motor vehicle in an alley located with the Village shall be 30 (thirty) kilometers per hour. - c) The maximum rate of speed at which a driver may operate a motor vehicle upon a highway located within all playground zones throughout the Village shall be 30 (thirty) kilometers per hour between the hours of 8:00am and one hour after sunset. - d) The maximum rate of speed at which a driver may operate a motor vehicle within the designated park area and campground/recreation area shall be ten (10) kilometers per hour. 3. Traffic Control Devices - a) The Public Works Superintendent is hereby delegated the power to prescribe where traffic control devices are to be located upon any and all, highways including: - i. traffic control devices restricting the speed of vehicles - ii. stop signs 20. jii. yield signs - b) The Public Works Superintendent is hereby delegated the power to fix a maximum speed in respect of any part of a highway under construction or repair or in a state of disrepair applicable to all motor vehicles or to any classes of motor vehicles while traveling on that part of the highway so designated, such traffic control devices as he deems necessary to indicate the maximum speed so - c) The Public Works Superintendent is hereby delegated the power to post traffic control devices at any location on a highway where the technical limitations of the highway warrant a reduction in the speed of vehicles traveling on that portion of the highway. - d) No one shall deface, vandalize or otherwise damage any traffic control device within the Village. - e) No one shall add or remove traffic control devices without authorization. As per section 3 in this Bylaw, only the Public Works Superintendent has the authority to add or remove traffic control devices. ## 4. Parking Control - a) No vehicle shall be parked on Village property without consent of the Village. - b) Vehicles and Off-highway Vehicles are not permitted to park on sidewalks. - c) Residents are permitted to park on highways so long as the manner of parking does not obstruct the passage of other vehicles and so long as: - i. The parked vehicle complies with Traffic Control Devices posted. - ii. There are no Traffic Control Devices authorized by the Public Works Superintendent which supersede 3(a)(i). - iii. The parked vehicle is operational. - iv. The parked vehicle does not obstruct or impede access to alleys, sidewalks, pedestrian crossings, except for the purpose of loading and unloading. 8. The parked vehicle does not obstruct private driveways without expressed permission of the owner of that property serviced by the driveway. - vi. The parked vehicle in not parked on Village assets including bridges or culverts. ## d) Trucks, Truck Tractors, Trailers or Recreational Vehicles: - i. No person shall park any truck, truck tractor, trailer, or recreational vehicle with a maximum weight of 11,000 kg (11 tons), or the combined length of more than twenty (20) meters upon any, highway within the Village, except where such parking is expressly permitted or except for the purposes of loading and/or unloading such vehicle. - ii. No person shall park any trailer, designed for occupancy by persons upon any highway within the Village unless the said trailer is attached to a vehicle by which it may be propelled or drawn when so attached. As such, the trailer shall be deemed part of the vehicle and subject to the regulations pertaining to vehicles. - ili. No person shall park any trailer, designed for carrying property upon any highway within the Village unless the said trailer is attached to a vehicle by which it may be propelled or drawn when so attached. As such, the trailer shall be deemed part of the vehicle and subject to the regulations pertaining to vehicles. - iv. All trailers parked on any highway within the Village must be attached to a working vehicle by which it may be propelled or drawn when so attached. - e) No person shall stand or park any vehicle in any alley within the Village in such a manner as to obstruct the passage of other vehicles. - f) No person shall activate or operate a diesel engine retarder brake or other exhaust inhibiting device in a motor vehicle within the Village boundaries. - g) Section 4 does not apply to emergency service vehicles, public utility vehicles, government vehicles, funeral vehicles, or towing services during the performance of their duties. ## 5. Exception Procedures - a) The Public Works Superintendent has the authority to request removal of parked vehicles from highways within Village limits to perform duties that restore efficient use of the highways. 2. Whenever possible, one (1) week's (7 calendar days) notice will be provided to residents of properties of the Public Works Superintendent's request - ii. Whenever possible, duties pertaining to the request should not exceed one (1) working day. - iii. Special events requiring highway use/adjustments must have an approved Special Events Permit from the Village office that has been acquired through the proper Special Events Permit procedures. ## 6. General - a) Notwithstanding anything in this Bylaw, all Persons operating a Motor Vehicle, bicycle, tractor, implement of Husbandry, Off-Highway Vehicle or any other type of vehicle shall comply with all applicable provisions of the Traffic Safety Act including but not limited to the Rules of the Road as set out in the use of the Highway and Rules of the Road Regulation A/R 304/2002. - b) Nothing in this bylaw relieves a Person from complying with any other applicable Federal, Provincial, County or Municipal law regulation, bylaw, permit, order, consent or other direction. - c) Where this bylaw refers to another Act, Regulation or agency, it includes reference to any Act, Regulation or agency that may be substituted therefore. - d) Every provision of this Bylaw is independent from all other provisions. If any provision of this Bylaw is declared invalid for any reason by a Court having jurisdiction, that provision shall be severed from this Bylaw and all other provisions of this Bylaw shall remain valid and enforceable. - e) No person shall interfere, obstruct or hinder any Officer or other Person authorized by the Chief Administrative Officer in the exercise or performance of that Person's powers, duties or functions pursuant to this Bylaw. - f) Enforcement costs may be collected as a civil debt. - g) Any driver who loses his/her load on a Highway must notify the Municipality and clean up the materials as soon as possible and/or be responsible for the cost of clean-up. ## 7. Penalties &amp; Enforcement - a) Offenses will be reported to the local Bylaw Officers for enforcement. - b) Any person who contravenes any of the provisions of this Bylaw shall be guilty of an offence and liable on summary conviction to a fine not less than $75.00 and not more than $10,000.00 dollars and if in default of payment of any fine imposed, to imprisonment for not more than six (6) months. The specific fines for an offence committed pursuant to this Bylaw are set out in the attached Schedule A - c) An Officer may cause a Vehicle parked on a Highway contrary to the provisions of this Bylaw to be towed and impounded in an impound lot designated by the Chief Administrative Officer. All towing and impound charges shall be paid by the Owner of the Vehicle prior to the Vehicle being released. - d) Notwithstanding any other provisions of the Bylaw, the fines and penalties specified for Road Use and Parking Control shall be listed on Schedule A attached hereto and forming part of this Bylaw. - e) Notwithstanding section 7(d), where any person commits the same offence under this Bylaw two or more times within a twelve (12) month period, the fine payable in respect of the second and subsequent offences will double the first offence penalty shown in Schedule A to this Bylaw. - f) An Officer is hereby authorized and empowered to issue a Violation Tag to any Person whom the Officer has reasonable and probable ground to believe has contravened any provision of this Bylaw. - 1) A Violation Tag may be served by leaving it on the Vehicle associated with the offence as defined within the Bylaw and the Owner of the Vehicle shall be deemed to have been served with the Violation Tag for the purpose of this Bylaw from the date and time that such a Violation Tag was left on the - 2) The Violation Tag shall be in a form approved by the Chief Administrative Officer and shall state: - i. The Person's name - ii. The offence - ill. The appropriate fine payment for the offence as specified in Schedule A of this Bylaw 12. That the fine payment shall be submitted within ten (10) days of issuance of the Violation Tag in order to avoid further prosecution; and - v. Any other information as may be required by the Chief Administrative Officer. - g) Any person(s) in violation of this Bylaw is subject to comply with the direction of an Officer. Failure to do so will result in further fines. ## 8. Effective Date of Bylaw - a) This Bylaw shall come into force and effect as of the passing of the third and final reading and signing thereof. Read a first time this 14th day of June, 2023.
