## BY-LAW NO. 400-05
## A BY-LAW OF THE VILLAGE OF STIRLING TO CONTROL THE DRIVING AND/OR PARKING OF LARGE VEHICLES WITHIN THE VILLAGE LIMITS
WHEREAS the Municipal Council of the Village of Stirling, in the Province of Alberta, has the authority to implement a Traffic By-Law in accordance with the Highway Traffic Act, being Chapter H7 of the Revised Statutes of Alberta, 2001 and amendments thereto, and the Municipal Government Act being Chapter M-26 respectively of the Revised Statutes of Alberta, 2000 and amendments thereto, and
WHEREAS, the Municipal Council deems it necessary to provide such a by-law to regulate and control vehicles having a gross weight of 9600 kilograms (21,164lbs.) or more within Village limits;
## DEFINITIONS:
- (a) "Vehicle" (for the purpose of this by-law) includes any vehicle having a gross vehicle weight of 9,600 kgm (21,164 Ibs) or more. Vehicle, therefore will include truck tractor, semi-trailer, or any other vehicle exceeding the aforementioned weight. Trade vehicles with the express purpose of delivery of goods within the Village shall be considered exempt from the weight restriction.
- (b) "Village" shall mean the Municipal Corporation of the Village of Stirling in the Province of Alberta or the lands lying within the corporate limits of the Village, as the context requires.
- (c) "Peace Officer" means a member of the Royal Canadian Mounted Police or a Bylaw Enforcement Officer appointed by the Village of Stirling, or D.O.T.
NOW THEREFORE; the Council of the Village of Stirling, in the Province of Alberta, duly assembled enacts the following:
- (a) No person or persons shall park and/or drive a vehicle within the corporate limits of the Village of Stirling.
- (b) The Peace Officer is hereby empowered with the authority and charged with the duty of enforcing the provisions of this By-Law.
## FINES:
Any person contravening the By-Law may avoid prosecution by way of summary conviction procedure by the voluntary payment of a specified penalty within the time stated thereon the issued tag:
