## VILLAGE OF STIRLING IN THE PROVINCE OF ALBERTA Bylaw No. 487-20 ## Delegation of Subdivision Authority A BYLAW OF THE VILLAGE OF STIRLING IN THE PROVINCE Of ALBERTA FOR THE PURPOSE OF AUTHORIZING THE MUNICIPALITY TO ENTER INTO AN AGREEMENT WITH A REGIONAL SERVICES COMMISSION PURSUANT TO SECTION 625 THE MUNICIPAL GOVERNMENT ACT, REVISED STATUTES OF ALBERTA, CHAPTER M-26, 2000, AS AMENDED. WHEREAS section 625 of the Municipal Government Act, Revised Statutes of Alberta, Chapter M-26, 2000, as amended, allows a municipality, by bylaw, to enter into an agreement with a regional services commission to which the municipality may delegate any of its subdivision authority or development authority powers, duties, or functions; AND WHEREAS the Oldman River Regional Services Commission Regulation, Alberta Regulation 303/2003 identifies the Village of Stirling as a member municipality; AND WHEREAS the Oldman River Regional Services Commission is authorized by Alberta Regulation 303/2003 to provide services to member municipalities related to municipal planning services among other things; NOW THEREFORE under the authority and subject to the provisions of the Municipal Government Act, Revised Statutes of Alberta, Chapter M-26, 2000, as amended, the Council of the Village of Stirling in the Province of Alberta duly assembled does hereby enact the following: 1. The Village of Stirling is authorized to enter into an agreement with the Oldman River Regional Services Commission for the purposes of section 625 of the Municipal Government Act, Revised Statutes of Alberta, Chapter M-26, 2000, as amended, to which it may delegate any of its subdivision authority or development authority powers, duties or functions. 2. The Council of the Village of Stirling delegates the following subdivision powers, duties and functions to the Oldman River Regional Services Commission: 3. (a) providing advice to applicants for subdivision approval; 4. (b) processing applications for subdivision, including determining whether a subdivision application is complete; 5. (c) collecting all pertinent subdivision processing fees; 6. (d) conducting notification of applicants, pertinent agencies, government departments and adjacent landowners as required by the Municipal Government Act; 7. (e) preparing draft resolutions for consideration by the Subdivision Authority; 8. (f) appearing at meetings of the Subdivision Authority as requested to do so from time to time; 9. (g) compiling and documenting all pertinent comments of those persons and local authorities to which the notice of application was given; 10. (h) conducting a site inspection (where feasible to do so) at the location of the proposed application for subdivision approval; 11. finalizing and issuing endorsement of plans of survey or other instruments for registration purposes at Land Titles Office; 12. ) conveying notification of final subdivision approval to the registered owner and/or the authorized agent; 13. (k) maintaining a control registry and corresponding archival information relating to the application for subdivision approval on behalf of the municipality; 14. (I) providing pertinent information for consideration at a hearing of the appropriate subdivision appeal board; 15. (m) appearing, for the purpose of providing pertinent information, at a hearing of a subdivision appeal board; and 16. (n) performing any other duties or functions as requested, by resolution of council, by bylaw, or by agreement, as agreed to by the Oldman River Regional Services Commission. 3. The Council of the Village of Stirling delegates the following development powers, duties and functions to the Oldman River Regional Services Commission: 18. (a) providing advice to applicants for development approval; 19. (b) serving as development officer if appointed as such by council; 20. (c) performing any other duties or functions as requested, by resolution of council, by bylaw, or by agreement, as agreed to by the Oldman River Regional Services Commission. 4. This bylaw shall come into effect upon third and final reading hereof. 5. Bylaw No. 358-95 and any amendments thereto are hereby rescinded. READ a first time this 5* day of February 2020.
