## THE TOWN OF SWAN HILLS BYLAW No. 2012-11 PROVINCE OF ALBERTA
A BYLAW OF THE TOWN OF SWAN HILLS IN THE PROVINCE OF ALBERTA TO PROVIDE FOR THE CONTROL AND OPERATION OF CAMPGROUNDS AND RECREATIONAL AREAS UNDER THE JURISDICTION OF THE TOWN OF SWAN HILLS.
WHEREAS under the authority and pursuant to the provisions of Section 7 of the Municipal Government Act, RSA 2000. Chapter M-26 and amendments thereto, Council may pass bylaws respecting the safety, health, and welfare of people and the protection of people and property; and people, activities, and things in, on or near a public place or place that is open to the public; and may in a bylaw regulate or prohibit;
WHEREAS Council wishes to establish rules and regulations for the control and operation of its campgrounds and recreational park areas;
WHEREAS Council deems it desirable and expedient to regulate certain activities in a campground and recreational park areas within the jurisdiction of The Town of Swan Hills for the health, safety, and welfare of its people and property;
NOW THEREFORE under the authority and pursuant to the provisions of the Municipal Government Act the Council of The Town of Swan Hills, duly assembled, enacts as follows:
## PART 1 - TITLE:
1. This Bylaw may be referred to as the "Parks and Campground Bylaw"
## PART 2 - DEFINITIONS:
2. In this Bylaw:
- (1) AIRCRAFT - includes any type of device designed to carry persons or objects through the air in powered or powerless flight;
- (2) ANIMAL - means a domestic animal and includes an animal that is wild by nature but has been domesticated;
- (3) CAMPGROUND - means any campground operated under the control and authority of the Town of Swan Hills
- (4) CAMPING ACCOMODATION UNIT - means:
- a) a tent
- b) a trailer
- c) a tent trailer
- d) a motor home
10. a van
- f) a truck camper
- g) any other object or thing used for camping or accommodation purposes that is erected, placed or constructed within a park or a campground
- (5) CAMP - means locating of, erecting of or use of a camping accommodation unit for the provision of sleeping accommodation and includes sleeping overnight or any portion thereof in the open air;
- (6) CAMPSITE - means a designated/assigned/allotted campsite in a park or campground designated as an individual campsite under this bylaw;
- (7) COUNCIL - means the Council of The Town of Swan Hills;
- (8) DAY USE AREA - means a park or portion thereof, designated by Council for use by park patrons between the hours of 7:00 a.m. and 11:00 p.m., unless otherwise posted; and not intended for sleeping.
- (9) ENCROACH - means to intrude gradually, stealthily, or insidiously upon the rights, property, parks or campgrounds of the Town of Swan Hills
- (10) FIRE BAN - means a general fire prohibition as authorized by the Chief Administrative Officer or designates;
19. FIREARM - means any device that propels a projectile by means of explosion, spring, air, gas, string, wire or elastic material or any combination of things; Any of the fore mentioned must exceed 550 feet per second.
- (12) HIGHWAY - means a highway as defined in the Traffic Safety Act;
- (13) MOTOR VEHICLE - means a motor vehicle as defined in the Traffic Safety Act;
- (14) LIQUOR - means liquor as defined in the Gaming & Liquor Act;
- (15) MUNICIPAL RESERVE - means land designated as municipal reserve by reason of any subdivision approval or by Council, pursuant to the Municipal Government Act;
- (16) MUNICIPAL VIOLATION TICKET - means a document that is a Municipal Violation Ticket issued on behalf of the Town of Swan Hills pursuant to the Municipal Government Act, R.S.A. 2000, c-M-26
- (17) OFF HIGHWAY VEHICLE - means an off highway vehicles as defined in the Traffic Safety Act;
- (18) PARK - means land designated as park, campground, day use area, recreation area, municipal reserve or playground, by Council and located within Town of Swan Hills;
- (19) PARK OFFICER - means a Community Peace Officer as appointed under the authority of the Peace Officer Act RSA 2006, c. P-3.5, a Bylaw Enforcement Officer in the employ of The Town of Swan Hills or a member of the Royal Canadian Mounted Police;
- (20) PARK WARDEN - means the Chief Administrative Officer for the Town of Swan Hills and a Community Peace Officer as appointed under the authority of the Peace Officer Act RSA 2006, c. P-3.5, a Bylaw Enforcement Officer in the employ of The Town of Swan Hills or a member of the Royal Canadian Mounted Police;
- (21) SQUATTER - means an individual who settles on the land of another person without any legal authority to do so, or without acquiring a legal title
- (22) TOWN - means The Town of Swan Hills;
- (23) VIOLATION TICKET - means a violation ticket issued under provisions of the Provincial Offences Procedures Act, RSA 2000, c. P-34.
- (24) WATER BODY - means a location where water flows or is present, whether or not the flow or the presence of water is continuous, intermittent or occurs only during a flood, and includes but is not limited to wetlands and aquifers.
## PART 3 - CHIEF ADMINISTRATIVE OFFICER
3. The Chief Administrative Officer or designate may:
- (1) Subject to the Traffic Safety Act, control and prohibit the movement of vehicular, pedestrian and other traffic by means of signs and notices designated and erected by it; and
- (2) Designate and erect other signs and notices governing and prohibiting activities that are provided for in this bylaw.
- (3) The existence of a sign or notice referred to in Subsection (a) is prima facie proof that it was properly designated and erected under this bylaw.
4. The Chief Administrative Officer or designate may
- (1) Close any part of any park for a specified period of time; or,
- (2) Subject to the Gaming and Liquor Act, prohibit the use of liquor in any part of any park for a specified period of time
5. The Chief Administrative Officer or designate may establish Day Use areas in any part of any park.
6. The Chief Administrative Officer may delegate any or all of his authority, derived from this bylaw.
## PART 4 - PARK WARDEN
## Authorities:
7. The Park Warden may:
- (1) Prohibit any person from entering, or being in a campground for a specified period of time;
- (2) Order any person in a campground to cease or refrain from any action, omission, or conduct that in the opinion of the Park Warden is an offence, dangerous to life or property or detrimental to the use and enjoyment of the park by other persons;
- (3) Order to leave the campground any person;
5. Making an unauthorized use of the park;
6. (b) Failing to comply with any provision of this bylaw; or
7. Creating a nuisance or disturbance or committing a trespass or any undesirable act.
- (4) Prohibit the entry of a motor vehicle into any part of any park, and
9. (a) If a Park Officer prohibits the entry of a motor vehicle under Section (4) above, no person shall operate a motor vehicle in that part of the park unless authorized or for maintenance.
8. No person shall:
- (1) fail or refuse to comply with a lawful order or request of a Park Warden;
- (2) obstruct or hinder a Park Warden in the execution of his duties.
## PART 5 - PARK OFFICERS
## Authorities:
9. The Chief Administrative Officer may appoint additional Park Officers necessary for the administration of this bylaw. A Community Peace Officer as appointed under the authority of the Peace Officer Act RSA 2006, c. P-3.5, a Bylaw Enforcement Officer in the employ of The Town of Swan Hills and a member of the Royal Canadian Mounted Police are ex-officio Park Officers;
10. For the purpose of administering the bylaw, a Park Officer may:
- (1) enter on and inspect any land, road, structure or work in a park; and
- (2) order the repair, alteration, improvement, evacuation or removal of or addition to any unauthorized structure or work in a park; and
- (3) order any person in a park to cease or refrain from any action, omission or conduct that in the opinion of the park Officer is an offence, dangerous to life or property or detrimental to the use and enjoyment of the park by other persons; and
- (4) require any person in a park to inform a Park Officer of
- (5) remove from a park
- (a) his name, birth date, address and occupation; and
- (b) his intended use of the park; and
- (a) any person making an unauthorized use of the park; or
- (b) any person failing to comply with any provision of this bylaw; or
- (c) any person creating a nuisance or disturbance or committing a trespass or any undesirable act; or refuse to admit entry of any person to a park.
11. A Park Officer may
- (1) prohibit the entry of a motor vehicle into any part of any park, and
- (2) if a Park Officer prohibits the entry of a motor vehicle under Subsection (1) above, no person shall operate a motor vehicle in that part of the park unless authorized or for maintenance.
12. A Park Officer, in the exercise and discharge of his powers and duties, is a person employed for the preservation and maintenance of the public peace.
## PART 6 - ABONDONED VEHICLES:
13. If a motor vehicle, off highway vehicle, aircraft, boat, trailer, equipment, camping accommodation unit, appliance, article or object:
- (1) is abandoned; or
- (2) remains in a municipal reserve, park or campground after the authorization to be in the area has expired; or
- (3) is located in any prohibited area of a municipal reserve, environmental reserve, park or campground;
- (4). a Park Officer may remove, store and dispose of this item in accordance with this bylaw.
## PART 7 - SEIZURES
14. A Park Officer may seize any motor vehicle or camping accommodation unit parked in contravention of the provisions of this bylaw.
15. On seizing a motor vehicle or camping accommodation unit under Section 14, the Park Officer shall cause the vehicle or unit to be removed to a secure location.
16. The registered owner of a motor vehicle or camping accommodation unit seized or removed shall be liable for the costs of removing the vehicle.
17. In this Section;
5. (1)
"abandoned" means:
- (a) left standing at a location for more than Seventy-Two (72) consecutive hours other than pursuant to
- (i) a license, permit or other similar authorization; or
- (ii) prior authorization of a Park Officer; or
- (b) left situated unattended at a location or in a condition so that it constitutes a present or potential hazard to persons or property.
- (2) If a motor vehicle, off highway vehicle, aircraft, boat, trailer, equipment, camping accommodation unit, appliance, article or object
- (a) is abandoned, or
- (b) remains in an area after the authorization to be in that area expires, or
- (c) is located in a prohibited area, a Park Officer may move the item or cause it to be moved to a location determined by him and store it or cause it to be stored or order the owner, operator or person in charge of the item to move the item to a location determined by the Park Officer and within
the time determined by him.
- (3) If the owner, operator, or person in charge of the item fails to comply with the order or the Park Officer under Subsection (2) the Park Officer may move and store the item or cause it to be moved and stored
- (4) Where a Park Officer moves or stores an item or caused it to be moved or stored under this Section 17, the cost of doing so
3. (b) constitutes a lien on the item, and
4. (a) is the responsibility of the owner of the item, and
5. (c) may be recovered from the owner in an action for debt, and
6. (d) must be paid before the item is released to the owner operator or person in charge of it.
- (5) If any item stored pursuant to this section is not, within Thirty (30) days of its removal or a longer period as determined the Chief Administrative Officer or designate, claimed by the owner or someone on his behalf in return for full payment for the removal and storage costs incurred, the item and its contents if any, shall be disposed of in accordance with the provisions of the Municipal Government Act regarding disposal of cost or unclaimed property.
## PART 8 - PARK PATRONS
## Orders of Park Officers:
18. No person shall:
- (1) fail or refuse to comply with a lawful order or request of a Park Officer.
- (2) obstruct or hinder a Park Officer in the execution of his duties.
19. No person who has been:
- (1) removed from a park pursuant to Section 10 of this bylaw shall not, within the following Seventy-Two (72) hour period, enter or attempt to enter that park or any other park or Day-Use area.
6. prohibited from a park pursuant to Section 7 of this bylaw shall enter or attempt to enter that park without permission of the Park Warden or Park Officer.
20. A Park Officer may cancel a permit if the holder of the permit contravenes this bylaw and the holder of the permit and other persons associated with him shall vacate the park within one hour of being notified of such.
21. No person shall enter or remain in any park or portion of a park where travel or access restrictions have been imposed under this bylaw.
## PART 9 - QUIET AND PEACEFUL ENJOYMENT:
22. No person shall interfere with the quiet and peaceful enjoyment of a park by others.
## PART 10 - FIRES:
23. No person shall:
- (1) leave a fire unattended; or
- (2) deposit or dispose of hot coals, ashes, embers or any other burning or smoldering material in a place other than a stove, fire pit or other place provided for that purpose by The Town of Swan Hills; or
- (3) leave a fire, hot coals, or smoldering materials without extinguishing them prior to leaving them.
24. No person shall set, light or maintain a fire in a park except in a fireplace, pit or other facilities designed for that purpose.
25. Where the Park Warden is of the opinion that a fire hazard exists in a park, he may, erect signs and notices for the purpose, prohibit the setting, lighting or maintaining of fires in all or part of the park.
26. No person shall
- (1) set, light or maintain a fire in a park or part of a park, where signs or notices have been erected prohibiting such acts; or
- (2) allow a fire to spread.
27. No person shall remove firewood from a park.
## PART 11 - VEHICLES:
28. No person shall operate a motor vehicle within a park, except:
- (1) on a highway; or
- (2) with written authorization from the Park Warden, in the case of an area that is not a highway.
29. No person shall:
- (1) within a park, operate or ride an off highway vehicle or any other such specialized means of conveyance, whether motor driven or propelled by human power;
- (2) Subsection (1) above does not apply to bicycles.
30. No person shall park or leave a motor vehicle, boat, trailer or camping accommodation unit or permit a motor vehicle, boat, trailer or camping accommodation unit to be parked or left in a park other than in parking areas designated for that purpose by The Town of Swan Hills.
## PART 12 - PARK ENTRY
31. A person engaging in an activity under this bylaw shall pay the fee in respect to that activity that it required and set by The Town of Swan Hills.
32. A person who enters a park shall comply with:
- (1) any lawful order and instructions made or issued pursuant to this bylaw, and
- (2) the instructions, prohibitions and directions prescribed by all signs and notices.
## PART 13 - NUISANCES
33. Any person:
- (1) using a park shall keep the land and improvements in a condition satisfactory to a Park Officer.
3. vacating a park shall restore the land and improvements as nearly as possible, to a clean and tidy condition.
34. If, in the opinion of a Park Officer, a nuisance exists, the Park Officer may order the person causing the nuisance to abate the nuisance or clean the site, or both.
35. Where a person fails to comply with an order made pursuant to Section 34, the Park Officer may take whatever steps are necessary to address or abate the nuisance or clean the site, or both, and the cost of doing so is recoverable from the person who failed to comply with the Order as a debt.
36. No person shall:
- (1) display or post any signs or advertisements in the park other than signs and advertisements approved by The Town of Swan Hills.
- (2) remove, deface, damage or destroy any sign board, sign or notice posted or placed in any park under authority of this or any other bylaw or Act.
- (3) encroach upon or become a squatter in or on any park within or any land owned by the Town of Swan Hills
37. No person shall:
- (1) deposit liquid or solid waste matter in a park except in a receptacle provided for that purpose by The Town of Swan Hills.
- (2) shall bring commercial or residential waste matter into a park for disposal.
38. In areas in a park where waste disposal receptacles or areas are not provided, all park users shall carry any waste produced by them out of the area for disposal.
39. No person shall bath or clean clothing, fish, cooking or eating utensils, vehicles, camping accommodation unit or other equipment at or near a water body, drinking fountain, stand pipe, well or pump in any park.
40. No person shall remove water from a park except for the personal use of himself and his party in the camping accommodation unit he is using at the time.
## PART 14 - CAMPING
41. No person shall remain overnight in a park:
- (1) except in an area designated for overnight use, unless he is otherwise authorized by a Park Officer, and
- (2) unless he has a valid permit under this bylaw to do so.
42. Where a campground is developed with individual campsites, the maximum allowable combination of motor vehicles, camping accommodation units and pieces of towed equipment permitted on an individual campsite is three (3) and of the three (3), no more than two (2) may be camping accommodation units, unless a Park Officer gives written permission to the contrary.
43. No person who is visiting a person camped in an individual campsite, shall park his motor vehicle or remain at the campsite after 11:00 p.m.;
44. A person visiting a person camped in an individual campsite, shall park his motor vehicle in a designated area.
45. Not more than six (6) people may occupy an individual campsite unless they are all members of a single-family unit.
46. No person shall camp more than 30 consecutive days in the same campground without the written permission of a Park Officer.
## PART 15 - GROUP USE CAMPING
47. Group Use Sites will be determined by the Chief Administrative Officer or the Park Warden.
48. Reservations shall be made for group camping when there are individual campsites present and available, and the group requires four (4) or more campsites, except for the Victoria Day long weekend in May of the year.
49. A permit will be issued by the Park Warden or Park Officer to a person 18 years of age or older.
50. A permit can be applied for at the Town of Swan Hills Office no less that seven (7) days before arrival.
51. The permit holder will:
- (1) be present during the entire period stated on the permit, and
- (2) be responsible for all actions on the site(s) stated on the permit.
## PART 16 - LIQUOR
52. No person shall
- (1) contravene the provision of the Gaming & Liquor Act and regulations.
- (2) possess liquor in any portion of a park.
- (3) in a campground possess open liquor, other than at their campsite.
- (4) When a Park Officer encounters a person committing an offense under Subsections (1), (2) or (3) the Park Officer may direct the person to dispose of the liquor.
## PART 17 - FIREARMS/FIREWORK
53. No person shall discharge a firearm in a park.
54. A person who is in possession of a firearm in a park shall ensure that the firearm is unloaded and either disassembled or cased, and stored in compliance with the provisions of the Criminal Code of Canada and the Firearms Act.
- (1) Section 53 and 54 does not apply to Peace Officers engaged in the performance of their duties.
4. No person shall, unless authorized by a Park Warden, detonate explosives or other explosive devices or set off fireworks in a campground, park or day use area.
## PART 18 - DAMAGING PARKS
56. No person in any park shall:
- (1) remove, destroy, mutilate, deface, or climb upon any building, structure, fixture or chattel, and without restricting the foregoing, any monument, vase, foundation, wall, fence, wire netting, vehicle, tools, gate, seat, bench, exhibit, cage or ornament therein; or
3. plug, tamper with, or in any way damage any plumbing, electrical, heating, or other fixtures.
57. No person in any park shall:
- (1) cut, break, bend or any way injure or deface any turf, tree, shrub, hedge, plant, flower or park ornament; or
- (2) walk, stand, or sit on any flower bed; or
- (3) walk upon any lawn or garden where signs are posted prohibiting persons from so doing; or
- (4) dig in the earth or remove any tree, plant, shrub, or any equipment or any kind that is fixed or growing thereon.
58. No person shall deface, injure or destroy any object in a park, whether created by natural means or otherwise.
59. No person in any park shall construct piers, permanent barbecues, fences, obstructions or buildings.
## PART 19 - BUSINESS OPERATIONS
60. No person shall carry on a business in a park unless he has received permission from the Park Warden for that purpose
## PART 20 - PERMITS
61. The Town of Swan Hills requires individual campsite permits, day-use permits and group camping permits under this bylaw. A receipt showing that payment has been made to the Town of Swan Hills for camping is considered a permit for the purposes of this by-law.
62. The Town of Swan Hills may provide designated areas within its parks for camping and day-use purposes.
63. The Park Warden, when required, will provide a sign or notice at or near the entrance to the park requiring persons to obtain a permit as prescribed.
64. No person shall enter an area or occupy any campsite without first possessing a permit under section 61 of this by-law, when permits are required by the Town.
65. Permits shall be issued on a first come, first served basis except in the portion of a park in which a campsite reservation system may be in effect.
66. No person shall:
- (1) alter a permit; or
- (2) transfer a permit to another person;
67. The holder of a permit shall keep it available for inspection at any time and shall produce it for inspection on the request of a Park Officer.
68. At the time of issue of a group permit, the Park Warden may make the permit subject to any conditions the Park Warden considers appropriate.
69. On the expiry or cancellation of a camping permit, the permit holder shall ensure that the campsite is vacated and that all camping accommodation units, equipment and other property belonging to him or persons in his group are removed.
## PART 21 - ANIMAL CONTROL
70. No person, having the custody or control of an animal, shall bring the animal into a park or allow the animal to enter or remain in a park unless it in a cage or is restrained by a leash.
71. No person having custody or control of an animal shall bring into or allow an animal to enter or remain in or on any area in a park that is:
- (1) a designated swimming area; or
- (2) a beach area adjacent to a designed swimming area; or
- (3) a public washroom, change house, concession, public shelter, or other public building or structure; or
- (4) an area where signs are posted prohibiting animals.
72. An owner whose animal defecates on park property shall remove forthwith any defecated matter.
73. A Park Officer may refuse to admit to a park or require to be removed from a park any animal if in his opinion, it is not under the control of a responsible person or may be a nuisance or damage to the life, safety, health, property or comfort of any person in the park.
74. A Peace Officer, as defined in The Town of Swan Hills's Animal Control Bylaw, or any other person acting under a Park Officer's supervision may capture an animal running at large in a park.
75. When an animal is captured, a Park Officer shall:
- (1) impound the animal, and
- (2) make a reasonable attempt to contact the owner or person having custody of the animal, and
- (3) turn custody of an impounded dog over to an Animal Control Officer, appointed under the provisions of the Animal Control Bylaw, who will impound the animal, if it is not claimed by the owner or person having custody; or.
- (4) turn custody of all other impounded animals over to a person authorized under the law for the impoundment of that animal, if it not claimed by the owner or person having custody.
76. Where the owner or person having custody claims a captured animal from a Park officer, he shall pay impoundment and subsistence fees charged for the impoundment of the animal
## PART 22 - DAY USE AREAS
77. No person shall occupy a day use area between the hours of 11:00 p.m. and 7:00 a.m., or as otherwise posted.
## PART 23 - PENALTIES
78. Any Person who contravenes any provisions of this Bylaw is guilty of an offence and liable upon summary conviction;
- (1) For the first offence, to a specified penalty as set out in Schedule "A" attached hereto and forming part of this Bylaw;
3. For the second offence, to a specified penalty of two times the original penalty as set out in Schedule "A" attached hereto and forming part of this Bylaw; or,
- (3) For the third offence, to a specified penalty of three times the original penalty as set out in Schedule "A" attached hereto and forming part of this Bylaw; or,
- (4) where no specific penalty is specified, a penalty to be imposed in the discretion of the Court having jurisdiction, having regard to s. 7(i) of the Act.
6. A Peace Officer is hereby authorized and empowered to issue a Municipal Violation Ticket to any person who the Peace Officer has reasonable grounds to believe has contravened any provisions of this Bylaw.
- (2) Where a Municipal Violation Ticket is issued pursuant to this Bylaw, the Person whom the Municipal Violation Ticket is issued may, in lieu of being prosecuted for the offence, pay The Town of Swan Hills the penalty specified on the Municipal Violation Ticket.
- (3) If the penalty specified on the Municipal Violation Ticket is not paid within the prescribed time period then a Peace Officer is hereby authorized and empowered to issue a Violation Ticket pursuant to the Provincial Offences Procedure Act.
- (4) Notwithstanding anything else in this Bylaw, a Peace Officer is hereby authorized and empowered to immediately issue a Violation Ticket pursuant to the Provincial Offences Procedure Act, as amended, to any Person who the Peace Officer has reasonable grounds to believe has contravened any provisions of this Bylaw.
- (5) Where any person contravenes the same section of this Bylaw twice within one TWELVE (12) month period, the specified penalty payable in respect of the second contravention shall double in the amount as shown in accordance with Schedule "A".
80. If a motor vehicle, off highway vehicle, aircraft, boat or trailer or camping accommodation unit is involved in a contravention of this bylaw, the owner of that motor vehicle, off highway vehicle, aircraft, boat or trailer or camping accommodation unit is guilty of an offense unless he proves to the satisfaction of the court that at the time of the offense the motor vehicle, off highway vehicle, aircraft, boat or trailer or camping accommodation unit was not being operated or used by him.
## PART 24 - GENERAL
81. No action shall be taken against any person acting under the authority of this Bylaw for damages for destruction or other disposal of any animal.
## PART 25 - SEVERABILITY
82. If at any time, any provision of this Bylaw is declared or held to be illegal, invalid, or ultra vires, in whole or in part, then the provision shall not apply and the remainder of this Bylaw shall continue in full force and effect and be construed as if it had been enacted without the illegal, invalid or ultra vires provision.
## PART 26 - EFFECTIVE DATE

84. This By-law shall come into effect upon passing of the third reading by the Council of the Town of Swan Hills.
