<!-- image --> Bylaw: 01-2019 ## Unauthorized Use of County Property Bylaw ## BEING A BYLAW OF THORHILD COUNTY IN THE PROVINCE OF ALBERTA FOR THE PUROPSE TO REGULATE THE UNAUTHORIZED USE OF COUNTY PROPERTY. WHEREAS, pursuant to section 7 of the Municipal Government Act give the Municipalities the power to enact Bylaws and impose fines and penalties for infractions of their Bylaws; WHEREAS, the Council of The County of Thorhild is of the opinion that it would be in the best interests of residents of the County that a bylaw be passed to impose fines and penalties to any person responsible for vandalism or damage to county property. NOW THEREFORE, the Municipal Council for the County of Thorhild, Alberta, duly assembled, hereby enacts as follows. ## PART 1. INTERPRETATION ## 1.01 PURPOSE: The purpose of this bylaw is to regulate the conduct and activities of people on publicly owned property and immediately adjacent areas in order to promote the safe, enjoyable and reasonable use of such property for the benefit of all citizens of the County. In this bylaw, unless the context otherwise requires: ## 1.02 DEFINITIONS: "Chief Administration Officer" means the chief administrative officer of the County or his delegate; "Council" means the municipal council of Thorhild County; "Damage" means physical harm caused to something in such a way as to impair its value, usefulness or normal function. "Facility" means any municipal owned or operated building. <!-- image --> "Municipal Right-of-ways" including but not limited to highways, roads, roadways, sidewalks, walkways, road allowances, street lanes, road diversions, bridges, titled rightof-way, undeveloped road right-of-way, public space, water bodies, public utility lots, and storm management facilities. "Municipal tag" means a ticket alleging an offence issued pursuant to the authority of a bylaw of the County; "Own" or "Owns" means: in the case of land, to be registered under the Land Titles Act as the owner of the fee simple estate in a parcel of land; or in the case of personal property, to be in lawful possession or have the right to exercise control over it or to be the registered owner of it; "Person" means any individual, firm, partnership, association, corporation, trustee, executor, administrator or other legal representative; "Property" means a parcel of land including any buildings; "Structure" means any structure, including but not limited to a building, fence, retaining wall, scaffolding, shed, portable shack, or other similar types of construction. "Vandalism" means the action of involving deliberate destruction of or damage to public property. "Violation ticket" has the same meaning as in the Provincial Offences Procedure Act; ## PART 2. VANDALISM OR DAMAGE TO COUNTY PROPERTY - 2.1 No person shall willfully commit vandalism or damage to county property by; - a) rendering property dangerous, useless, inoperative or ineffective, - b) obstructs, interrupts or interferes with county services, - c) destroys or alters county property without permission, this includes but not limited to municipal right-of-ways, municipal property, municipal roads, public facilities, sidewalks, and municipal utility services.
