## Bylaw No. 1482-22 ## WEST SERVICE ROAD SEWER SERVICE CONNECTION FEE BYLAW BEING A BYLAW OF THE TOWN OF THREE HILLS IN THE PROVINCE OF ALBERTA, TO ESTABLISH A CONNECTION FEE FOR SEWER SERVICE CONNECTIONS ON THE WEST SERVICE ROAD. WHEREAS, under the authority and pursuant to the provisions of the Municipal Government Act, S.A. 2000, Chapter M-26, as amended, the municipality has the authority to issue service connection fees; AND WHEREAS, the Council of the Town of Three Hills in the Province of Alberta has deemed it advisable to charge a service connection fee to specific locations; AND WHEREAS, the Town has entered into an agreement with Golden Acres Honey Farm Ltd. to construct a sewer line at the developer's cost subject to potential repayment fees received from other users; AND WHEREAS, the Council of the Town of Three Hills has decided to issue a bylaw to authorize a Service Connection Fee to pay for Sewer Service Connections on the West Service Road from the parcel of land located at the corner of Range Road 241 and 2 Street NW Service Road, bearing the legal description Plan 0112827, Block 5, ATS Reference: 4: 24; 32; 1; SW (Seed Cleaning Plant), to the railroad tracks at 1s Ave NW and on 1st Ave NW from Highway 583 to South End of Lot 1, Block 1, Plan 1013378 (Kneehill County Shop Yard). NOW THEREFORE, the Council of the Town of Three Hills in the Province of Alberta, duly assembled, hereby enacts as follows: ## Part I: BYLAW TITLE 1. This Bylaw shall be known as the "West Service Road Sewer Service Connection Fee Bylaw" ## Part II: DEFINITIONS ## In this Bylaw: - a. "Council" shall mean the body of elected officers who govern the Town. - b. "Sewer" means the sanitary sewer system including all mains, treatment and storage facilities within the Town of Three Hills. - C. "Service Connection" shall mean the part of the system or works of a Utility that runs from the main lines of the Utility to a building or other place of land for the purpose of providing the utility service to the parcel and includes parts or works such as the pipes, wires, couplings, meters, and other apparatus. - e. "Service Connection Fee" shall mean the fee set out in Schedule A, charged by the Town for the connection of the Premises to the Wastewater System, as applicable. 5. "Utility Service" means the service provided by the system or works of a public utility. ## Part III: CONNECTION FEES - The owner of any lands identified in Schedule "A" to this Bylaw shall not be permitted to connect to the Town's sewer system until a connection fee in the amount of $20,000 per connection has been paid in full. All costs of connecting the owner's property to the sewer mainline will be at the cost of the benefitting owner. - The benefitting owner will be required to be in compliance with all Municipal, Provincial, and Federal Bylaws, Acts and Regulations, prior to connecting to the sewer mainline. ## Part V: ENACTMENT 4. This Bylaw shall come into force and effect upon the date of the passing of the third and final reading and signing thereof. READ A FIRST TIME in Council this 8'' day of August, 2022.
