## SUMMER VILLAGE OF VAL QUENTIN BYLAW NO. 300-25 DEVELOPMENT AUTHORITY - A Bylaw of the Summer Village of Val Quentin, in the Province of Alberta, to establish a Development Authority for the Municipality. - WHEREAS, Council wishes to establish Development Authorities as required under sections 624 and 641 of the Municipal Government Act, S.A. 2000, c. &lt;-26 and any amendments thereto. - NOW THEREFORE the Council of the Summer Village of Val Quentin duly assembled hereby enacts as follows: ## TITLE 1. This Bylaw may be cited as the "Development Authority Bylaw". ## DEFINITIONS 2. The following terms are defined below: - a. "Act" means the Municipal Government Act, S.A. 2000, c. M-26, as amended; - b. "Authority" means the Development Authority established pursuant to this Bylaw; - c. "Council" means the Council of the Summer Village of Val Quentin; - d. "Development Officer" means one of the persons appointed to the office of Development Officer pursuant to Paragraph 5 herein; - e. "Discretionary Use" means the use of land or a building provided for which a development permit may or may not be issued based upon the merits of the application being made; - f. "Land Use Bylaw" means Bylaw 218-08, as amended; 8. "Permitted Use" means the use of land or a building provided for in the Land Use Bylaw which a development permit shall be issued with or without conditions upon application having been made which conforms to the Land Use Bylaw; and - h. "Summer Village" means the Municipality of the Summer Village of Val Quentin. ## ESTABLISHMENT OF AUTHORITY 3. PERMITTED USES - The Development Authority of the Summer Village of Val Quentin is any one of the Development Officers appointed under Paragraph 5, in respect of any matter assigned to a Development Officer in the Land Use Bylaw which is a Permitted Use in any Land Use District. 4. DISCRETIONARY USES - The Development Authority of the Summer Village of Val Quentin is Council in respect of any matter assigned to Council in the Land Use Bylaw which is a Discretionary Use in any Land Use District. 5. The Chief Administrative Officer may appoint any individual to the position of Development Officer. ## POWERS AND DUTIES 6. The Authority has those powers and duties as set out in the Act and any regulations made thereunder and set out in the Land Use Bylaw. 7. The powers and duties of a Development Officer may be exercised by any one of the individuals referred to in Paragraph 5. THAT, Bylaw 285-22 is rescinded in its entirety upon passing of this Bylaw. - THAT, this Bylaw comes into full force and effect upon third and final reading and is duly signed.
