Village of Veteran Traffic Control Bylaw #519-15 Page 1 ______________________________________________________________________________ VILLAGE OF VETERAN BYLAW 519-15 TRAFFIC CONTROL BYLAW A BYLAW OF THE VILLAGE OF VETERAN IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF REGULATING AND CONTROLLING PEDESTRIAN, ANIMAL AND MOTOR VEHICLE TRAFFIC. WHEREAS, the Municipal Government Act, R.S.A. 2000, Chapter M-26, as amended, and the Traffic Safety Act, R.S.A. 2000, Chapter T-6, as amended, provides that a council may adopt bylaws in relation to the use of highways under direction, control and management of the municipality; and AND WHEREAS, the Council of the Village of Veteran deems it advisable to pass a bylaw for the purpose of regulating, controlling and managing highways within the Village of Veteran; NOW THEREFORE, the Council of the Village of Veteran duly assembled, enacts as follows: 1. TITLE This Bylaw may be cited as the "Traffic Control Bylaw" 2. DEFINITIONS In this Bylaw unless the context otherwise requires, all terms and definitions shall be those which are defined in the current Traffic Safety Act (Alberta), Regulations and subsequent amendments, the Municipal Government Act (Alberta) and subsequent amendments, and the Dangerous Goods Transportation and Handling Act (Alberta), Regulations and subsequent amendments are those in this bylaw. For clarification: "Alley" shall mean a narrow highway intended chiefly to give access to the rear of buildings and parcels of land. "Boulevard" shall mean that portion of a Highway which is located on either side of the actual driving surface of the highway and is that portion of the edge of the driving surface to the property line. "Chief Administrative Officer" shall mean the Chief Administrative Officer, (C.A.O.) of the Village of Veteran "Council" shall mean the Municipal Council of the Village of Veteran. "Crosswalk" shall mean that part of a roadway ordinarily included within the prolongation of curb and property lines at intersections, or any other part of a roadway indicated as a pedestrian crossing by lines or other markings on the surface thereof. "Curb" shall mean the actual curb, if there is one, and if there is no curb in existence, shall mean the division of a highway between the roadway and the sidewalk or boulevard as the case may be. "Heavy Vehicle" means a vehicle, or a vehicle with a trailer attached, with or without a load of 4,504 kg. (10,006.16lbs) gross vehicle weight or more, or exceeding 6.5 m (21.3') in overall length, recreation vehicles exempt. "Highway" or "Highways" means any thoroughfare, street, road, trail, avenue, parkway, viaduct, lane, alley, square, bridge, causeway, trestleway, or any other place, or any part of any of them, whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles, and includes: a) The sidewalks and the boulevard adjacent to the sidewalk, b) The ditch, if any, lying adjacent to, and parallel with, the roadway, the ditch, and c) If the highway right of way is fenced, all the land between the fences or between the fence and the roadway as the case may be. Village of Veteran Traffic Bylaw #519-15 Page 2 "Lane" or "Laneway" means a highway used to provide access to properties in addition to the access provided by a frontage and/or flankage highway, including alleys and any Village utility lot to which the public is permitted access. "Municipal Tag" means a tag or similar document issued by the Village pursuant to the Municipal Government Act that alleges a bylaw offence and provided a person with the opportunity to pay an amount to the Village in lieu of prosecution for the offence. "Off-Highway Vehicle" means an off-highway vehicle as defined in he Traffic Safety Act. "Parade" or "Procession", with the exception of a military parade or funeral procession, means any group numbering more than twenty (20) people marching or walking in the street or any group of vehicles or combination of pedestrians and vehicles which together exceed more than ten (10). "Park", "Parked", and "Parking" or any word or expression of similar connotation, meaning or import, shall mean the standing of a vehicle, whether occupied or not, upon a highway other than temporarily in obedience to traffic regulations or traffic signals or signs. "Peace Officer" shall mean a member of the Royal Canadian Mounted Police, a Special Constable, or a Bylaw Enforcement Officer appointed for or by the Village, or an authorized employee of the Village. "Pedestrian" shall mean a person standing or walking or a foot passenger. "Person" shall include a corporation, partnership, firm or organization. "Recreation Trailer" includes any trailer that is designed, constructed and equipped as a dwelling place, either permanently or temporarily, but does not include machinery or equipment used in the construction or maintenance of highways. "Roadway" shall include that portion of the street intended for vehicular traffic within the Village. "Sidewalk" shall mean that part of a highway primarily intended for the use of pedestrians and shall include the space lying between an established curb line and the production thereof and the nearest lot line. "Street Intersection" or "Intersections" shall be and mean the whole area situated between the prelongation of the boundary lines of two or more highways which join one another at an angle and whether such highways cross each other or not. "Tractor" means a truck with a short chassis and no body used in a motor vehicle and intended to transport property, persons or animals. "Trailer" means a vehicle so designed that it may be attached or drawn by a motor vehicle and intended to transport property, persons or animals. "Vehicle" means any device in, or on by which a person or thing may be transported or drawn on a highway, including a combination of vehicles, but excluding a mobility aid being used to facilitate the transport, in a normal seated orientation, or a person with a physical disability. "Village" means the Village of Veteran, in the Province of Alberta 3. RULES FOR OPERATION OF VEHICLES 3.1 Any vehicle parked on a highway must be registered and insured, as Uninsured Vehicles required pursuant to the Traffic Safety Act. 3.2 A vehicle in a funeral procession except the lead vehicle, may during Funeral Processions daytime hours, enter an intersection without stopping if: Village of Veteran Traffic Bylaw #519-15 Page 3 a. The headlamps and hazard warning lights are alight, and b. The vehicle is travelling immediately behind the vehicle in front of it so as to form a continuous line of traffic. c. The passage into the intersection can be made in safety. 3.3 1. No person shall hold or take part in any parade or procession without Rules for Parades etc. first obtaining permission from the C.A.O., subject to such terms and conditions as the C.A.O. deems advisable. 2. Every member of a parade or procession and the organization and leaders thereof shall be guilty of an offence for each and every violation of this section. 3. Any person desiring to hold a parade or procession within the Village shall require permission from the C.A.O or Village Council prior to holding the event and shall provide the following information: a. The name and address of the applicant, if such applicant is an organization, the names, addresses and occupation of the executive thereof, b. The nature and object of such parade or procession, c. The day, date and hours during which same will be held, d. The intended route thereof, e. The approximate number of persons and vehicles taking part therein. 4. The provision of this part does not apply to any person participating in a military or funeral procession. Pedestrians 5. During such parade or procession, all pedestrians not taking part Watching therein shall be restricted to the use of the sidewalk area. Not to Obstruct 6. No parade or procession shall obstruct any highway for a longer period than is reasonably necessary. 3.4 No person shall drive a vehicle upon any part of the lands, parking lots Speed on Village and driving areas owned by the Village at a speed in excess of (40) Owned Land and kilometers per hour or in excess of any speed limit sign posed upon the Roadways properties. 3.5 No person shall operate a heavy traffic vehicle on any highway in the Truck Route Village, except on a highway designated as a truck route, as enumerated in Schedule "B", attached thereto. 3.6 1. Despite Part 3.5, the following heavy vehicles are authorized to be Exceptions operated on highways in residential areas: a. Public Passengers Vehicle being operated for the purpose of receiving or delivery passengers. b. Any emergency vehicles being operated in the service of public interest, or during an emergency. c. Any public utility vehicles being operated for the purpose of installing, servicing, or repairing public utilities. d. Village owned vehicles being operated in the service of the Village. e. Commercial vehicles delivering or collecting good, provided that the most direct route, from the truck route, is used and such deliveries or collections are made between the hours of 7:00am and 11:00pm on any one day. 3.7 No person shall operate engine retarder brakes on diesel powered Engine Retarder vehicles within the Village of Veteran Limits. PARKING 4.1 Every person who parks a vehicle upon any highway, where parking Parking Within spaces are marked for angle or perpendicular parking, shall park Spaces wholly within the marked parking space. 4.2 1. Unless required or permitted by this Bylaw, the Traffic Safety Act, by Parking a traffic control device, in compliance with the directions of a peace Restrictions officer or other authorized person, or to avoid conflict with other traffic, a driver shall not stop or park his vehicle: Painted Curb a. On a highway adjacent to a curb or sidewalk that has been marked by being painted a solid color; Sidewalk b. On a sidewalk or boulevard; Crosswalk c. On a crosswalk or any part of a crosswalk; Ambulance and Fire d. In any driveway designated for use by ambulances or fire fighting Driveways vehicles, emergency vehicles excepted; Emergency Exit e. Where such vehicle will obstruct, or in any way interfere with the use of any doorway intended to be used as a fire or emergency exit from any building. Intersections f. Within an intersection other than immediately next to the curb in a "T" intersection; g. At an intersection nearer than five (5) metres (16.4 feet) to the projections of the corner line immediately ahead or immediately to the rear except when the vehicle is parked in a space where a traffic control device indicates parking is permitted; Stop/Yield h. Within five (5) metres (16.4 feet) upon any approach to any stop or yield sign; Fire Hydrant i. Within five (5) metres (16.4 feet) of any fire hydrant, or when the hydant is not located at the curb, within five (5) metres, (16.4 feet) of the point on the curb nearest to the hydrant; Crosswalk j. Within five (5) metres (16.4 feet) of the near side of a marked crosswalk; Street Excavation k. Alongside or opposite any street excavation or obstruction when stopping or parking would obstruct traffic; No Park Zone l. At any other place where a traffic control device prohibits stopping or parking, during such times as stopping or parking is so prohibited; Edge or Curb m. On the roadway side of a vehicle parked or stopped at the curb or edge of a highway; Obstructions n. In such a manner as to obstruct access to a garage, private road or driveway or obstruct the free and safe passage of any vehicle along a highway; Cul-De-Sac o. At any angle to the curb in a cul-de-sac unless that vehicle is parked in such a manner as not to interfere with the free flow of traffic in the cul-de-sac. Village of Veteran Traffic Bylaw #519-15 Page 5 Storing Vehicles q. No person shall use any of the highways in the Village for storing any registered or unregistered motor vehicle or implement between the months of November 1st and April 1st. 4.3 No person shall park a vehicle in a parking space where a sign, curb Handicap Parking painting or pavement painting indicating that is for the exclusive use of persons with disabilities who display on their vehicles a handicap placards or license plate that is issued or recognized by the Province of Alberta . 4.4 No driver shall park in any alley, except a commercial vehicle engaged in Parking in an Alley loading or unloading goods or passengers. 4.5 1. No person may park a tractor with or without a trailer or any Heavy Parking Heavy Vehicles Vehicle in a residential area. In Residential Areas Exceptions 2. This section shall not apply: a. Commercial Vehicles, recreational vehicles, or trailers while actually loading or unloading goods, or; b. Construction equipment being used during construction or improvement of property provided that such equipment is parked adjacent to the property where such work is being done. 4.6 1. When parking on a highway, a driver shall park the vehicle with the Parking on a Highway sides parallel to the curb edge or edge of the highway, and a. With the right hand wheel thereof not more than 500mm (19.7 inches) from the right hand curb or edge of the highway, or; b. This section does not apply where angle parking is permitted or required. 4.7 1. No person shall abandon a vehicle on a highway. Abandoning a Vehicle 2. No person shall abandon a vehicle on public or private property without the express or implied consent of the owner or person in lawful possession or control of the property. 72 Hour Limit 3. A vehicle left standing, at a location referred to in subsection 1 or 2, for more than 72 consecutive hours shall be deemed to have been abandoned. Exceptions 4. Where the abandonment or obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this section provided they take measures to clear the faulty vehicle from the highway. 5. Nothing in this section shall be construed as to allow parking contrary to other provisions of this Bylaw. 4.8 No person shall park or drive any vehicle upon any land owned by the Parking at Playground Village of Veteran which the Village uses or permits to be used as a Or Recreation Area playground, recreation area, utility or public park, buffer strip, land held fore resale, or any land in reserve, or on any boulevard unless permission has been obtained from the C.A.O. or Village Council. 4.9 The C.A.O., Peace Officer, or authorized employee of the Village is Prohibited Parking authorized to designate those portions of highways within the Village of Veteran upon which parking is prohibited, and if applicable, the hours during parking is prohibited and such area shall be plainly indicated by signs or other appropriate means. 4.10 1. Despite any other provision in the Bylaw, the C.A.O., or authorized Village of Veteran Traffic Bylaw #519-15 Page 6 No Parking employee of the Village, may cause "No Parking" signs to be placed Street Maintenance on or near a roadway for roadway maintenance or construction purposes. 2. When emergency snow removal, street cleaning or other work commences on the signed portion of the highway, the owner of any vehicle parked after the placement of the appropriate signs shall be in contravention of this section and the vehicle maybe be towed at the owner expense. 4.11 1. For the purpose of this section, "trailer" shall include: Trailers a. Any recreation trailer, house trailer, horse trailer, motor home or relocatable trailer, or, b. Any structure, whether ordinarily equipped with wheels or not, that is constructed or manufactured to be moved from one point to another by being towed or carried and to provide living accommodations for or other use by one or more persons. 2. No person shall park a recreation vehicle or trailer, whether attached or unattached, upon any highway between the months of November 1st and April 30th. 3. No person may park a recreation trailer so that it is wholly or partly on or 4. No trailer parked on any highway shall be used for occupancy at any time. 5. No person shall park any attached or unattached trailer with the trailer pull-outs or slides extended on a highway except for the purpose of loading or unloading during daylight hours only, and only if it is located on that portion of highway that lies immediately adjacent to the property it is being loaded from or unloaded to. Exceptions 6. Recreation trailers may be parked on highways only if there is ample room on either side of the street for two way traffic, and the said trailer is not blocking or restricting access to private or public property between the months of May 1st to October 31st. 4.12 1. No person shall leave a vehicle unattended on a highway if the vehicle Unattended Vehicles has been placed on a jack or similar device; and a. One or more of the wheels have been removed from the vehicle, or; b. Part of the vehicle is raised. 4.13 1. The operation of a vehicle or trailer used in conveyance of dangerous Dangerous Goods goods shall be restricted to designated highways, as enumerated in Schedule "B", attached thereto. 2. Parking of vehicles or trailers carrying dangerous goods will be restricted to designated highways. a. Nothing in the foregoing shall be construed to allow the parking, stopping or operation of a vehicle or trailer within any residential area, or district as defined in the Land Use Bylaw of the Village of Veteran. b. No person shall park a vehicle or a trailer used for the conveyance of dangerous goods nearer than twenty (20) metres (65 feet) to a building likely to contain persons or valuable goods. Village of Veteran Traffic Bylaw #519-15 Page 7 Exceptions 3. This section shall not apply where a vehicle is obliged to be parked for the purposes of loading its cargo and such vehicle is clearly marked with a warning notice identifying the nature of the cargo. 4.14 No person being in charge or control of a garage, service station, radio Servicing stop or other premises where repairs or installations are made on vehicles for compensation shall leave or cause or permit to be left on any street a vehicles which is left in their possession for carrying out the repairs or making installations or for any other purposes whatsoever. 4.15 1. For purposes of this Part, it shall be lawful for any person authorized Chalking Tires to enforce this Bylaw to place an erasable chalk mark on the tread face of a tire on any vehicle found parked on any highway or Village owned parking lot. 2. The Bylaw Enforcement Officer, or authorized employee of the Village, shall cause an erasable mark to be placed across the tread face of the tire in order to establish the amount of time the vehicle has remained stationary. 4.16 1. The Bylaw Enforcement Officer, or authorized employee of the Towing Village, is hereby authorized to remove or cause to be removed any vehicle; a. Parked in contravention of a provision of the Bylaw; or b. Where emergency conditions may require such removal from a highway. 2. Any vehicle removed under this section may remain impounded until claimed by the owner. a. No impounded vehicle shall be released to its owner until all impounding charges and any fine or penalty imposed in respect of the Bylaw, have been paid to the Village; 3. This section shall not apply where an exemption has been given in writing by the C.A.O. PART 5 USE OF STREETS AND PUBLIC PLACES 5.1 No person shall place, permit to be placed, or throw any substance or Littering thing of any kind, including cement from construction sites, on any highway, boulevard or sidewalk. 5.2 1. Any sign, notice or other object placed on or beside a Village highway Signage or upon abutting public lands, including boulevards and sidewalks shall be liable to a fine, removal and immediate disposal by the Village without notice or warning to the owner thereof, with the exception of real estate signs being used for the purposes of selling residential and commercial properties. Exemption 2. Anyone placing a "Garage Sale Signs" upon Village boulevards must remove the signs after the event has taken place. 5.3 1. No person shall drain lubricating oils or any other fluids associated Vehicle Fluids with the operation of a motor vehicle upon a highway. 2. No person shall wash a vehicle on any highway so as to result in mud, slush, or ice forming or being deposited on the highway. 5.4 No person shall place, or permit to be placed an electrical extension Electrical Extension cord across a sidewalk or boulevard, unless it is clearly marked. Village of Veteran Traffic Bylaw #519-15 Page 8 Cords 5.5 1. All persons within the Village shall remove or cause to be removed Snow, Ice & Debris any snow, ice, debris or other materials from any sidewalk adjoining the property owned or occupied by them; such removal is to be completed within 48 hours of the time when the snow, ice, dirt or other obstruction was formed or deposited thereon. 2. No person, except a Village employee, shall throw, or cause or allow to be thrown, any snow, ice, dirt, rocks on a highway, sidewalk, boulevard, or any publicly owned, operated or controlled land or property within the Village. 3. No person, except a Village employee, shall use, or cause or allow to be used, any mechanical device to propel projectiles onto a highway, boulevard or sidewalk or any publicly owned, operated or controlled land or property within the Village. Ice Build-Up 4. If water drips from an awning, eaves trough, or any other area of a building and is depositing upon any highway or sidewalk, the owner or occupier of the premises shall clean the sidewalk or highway portion thereof to prevent ice from forming. 5.6 The Village may, after the 48 hours, remove and clear away all snow, Expenses Charged dirt, debris and other material required to be removed pursuant to this Bylaw and the expenses and costs thereof shall be paid to the Village upon demand. Failure to make payment of the expenses and costs may result in the Village adding the unpaid amount to the tax roll for the property. 5.7 No person shall pass beyond a point designated by a Peace Officer or a At a Fire member of the Fire Department near the location of a fire. 5.8 1. No person shall place any goods, wares, merchandise, or any other Sidewalk articles upon a sidewalk or highway outside of a shop, warehouse or Obstructions building so as to obstruct pedestrian or vehicular traffic without prior permission of the C.A.O. or Village Council. Exemptions 2. The provisions of this Section shall not be construed to interfere with a moderate use of a portion of such highway or sidewalk for a reasonable time, during taking in or delivering of goods, wares, merchandise or articles or with permission from the C.A.O. or Village Council. 5.9 1. No person shall stand in a group of 3 or more persons or so near to Pedestrians each other on a highway as to obstruct the entrance to buildings or to obstruct or prevent other persons using such highway. 2. No person shall conduct himself or otherwise position himself on a highway in such a manner as to obstruct vehicular or pedestrian traffic or inconvenience another person upon the highway. Hitch Hiking 3. No person shall stand upon or walk along a roadway for the purpose of soliciting a ride from the driver of any vehicle. 5.10 1. No person shall operate an off-highway vehicle within the Village, Off-Highway except as provided in this section. Vehicles 2. Off-highway vehicles are permitted to operate on a highway solely for the purpose of loading or unloading an off-highway vehicle from or onto a trailer or vehicle or into a building or property. Village of Veteran Traffic Bylaw #519-15 Page 9 3. Peace Officers or employees of the Village are authorized to operate off-highway vehicles on any highway within the Village while performing their official duties. 4. A person who is granted permission by the C.A.O. or Village Council is authorized to operate an off-highway vehicle within a specified route and time period. 5.11 1. No person shall operate a heavy vehicle on or across any sidewalk Damage to Sidewalks except at a curb or approved crossing without first planking the sidewalk to ensure the sidewalk will not be damaged. 2. No person shall cause any damage to any Village sidewalk by striking, picking or cutting, whether or not such person is engaged in removing snow or ice from the sidewalk. 3. Where damage is caused by a person's actions as described in subsections (1) and (2), the Village may repair such damage and charge all associated costs to that person. 5.12 1. No person shall drive or drag any vehicle or thing on a highway in Damage to Highways any way that may cause damage to the highway or any improvements thereon. 2. No person shall damage or remove any earth, gravel, concrete, pavement or other roadway appurtenance or make any excavation within or under any highway within the Village without having first obtained permission from the C.A.O, or Village Council. a. Where permission has been granted to excavate under subsection (2), any person engaged in the subsequent work shall take adequate precautions to protect the public from the work, including the placement of barricades, fences, lighting and any other measures deemed necessary by the C.A.O. or Village Council. b. Where permission has been granted under subsection (2), any person engaged in the subsequent work shall assume all responsibility for any and all accidents or damages that may occur as a result of the work. c. Where damage is caused by a person's actions as described in this section, the Village may repair such damage and charge all associated costs to that person. 3. No person shall drive through or over or break down any snow berms piled on Village Streets. 6. MISCELLANEOUS 6.1 1. No person shall place or cause to be placed any hand bill or other Hand Bills advertising matter on or in a vehicle without permission of the owner or the person in charge of the vehicle. 2. Subsection (1) applies whether the vehicle is on a highway or on any public or privately owned property. 6.2 No persons shall climb or interfere with any street furniture, trees, Park Benches protection system or any other utility system of the Village of Veteran. 6.3 No person shall willfully remove, throw down, deface of alter, Damage to Signs damage or destroy a traffic control device placed, marked or erected on a highway. 6.4 No person shall erect, build, or allow the growth of trees, shrubs or Village of Veteran Traffic Bylaw #519-15 Page 10 Obstruction of any other thing to in any way obstruct the visibility of a traffic Traffic Control control devices or signs. Devices or Signs 6.5 The owner, tenant or occupier of any land adjoining any highway Obstruction Trees or public place in the Village of Veteran shall cause all trees, & Shrubs shrubs and bushes which overhang on the sidewalk of the street, lane or public place to be properly trimmed and cut back, so as to prevent obstruction on the sidewalk, highway or public place to pedestrians or vehicles. 6.6 1. Every person operating a bicycle on a highway, shall, in so far as Bicycles they are applicable, comply with the provisions and requirements of the Traffic Safety Act, except: a. When otherwise instructed by any applicable traffic control device or, b. When otherwise directed by a Peace Officer. 6.7 No person shall ride a bicycle with a wheel diameter greater than 50 Bicycle on centimeters on any sidewalk within the Village of Veteran. Sidewalks 6.8 No person shall ride, coast or propel any cart, sled, toboggan, skis, Restricted Areas skates, roller blades or skate boards or any other similar device in an unsafe manner on any sidewalk within the Village of Veteran. 6.9 A Peace Office, or authorized employee of the Village may seize Seize/Impound any bicycle or skateboard that is operated, parked or left in contravention of this Bylaw and such bicycle or skateboard may be impounded for a period not exceeding 60 days. 6.10 1. A bicycle or skateboard that has been impounded may be Storage Fee redeemed by the owner at the end of the impound period upon payment to the Village of a storage fee of $20.00. 2. Subsection (1) shall not apply when a bicycle or skateboard has been stolen and is being claimed by the owner. 6.11 Any bicycle which has been impounded and not redeemed by the Unclaimed Bicycles owner within 30 days of the date of the expiration of the period of impoundment shall become the property of the Village of Veteran. 7. AUTHORITY OF MUNICIPAL OFFICIALS 7.1 The C.A.O. or authorized employee of the Village is hereby Traffic Control authorized to: Devices 1. Prescribe the location and placement of every traffic control device and traffic signal in the Village and shall keep a record of such locations and placement and such records shall be available to the public for inspection during regular business hours. 2. Designate crosswalks upon any highway and to cause same to be marked with signs, or lines painted on the surface of the highway. 3. Designate any highway intersection or other place on a highway as a place at which no left hand turn, or right hand turn, or both, shall be made, and shall cause the said place to be signed, barricaded or otherwise restricted. Village of Veteran Traffic Bylaw #519-15 Page 11 4. Designate any intersection or place on a highway as a place where U- turns are prohibited and shall cause such area to be marked with signs prohibiting U-turns. 5. Designate any area as one in which parking privileges are temporarily suspended in whole or in part to traffic and shall cause such area to be marked with signs. 6. Designate the temporarily closing of such highway for emergency or special circumstances and place barricades and/or post appropriate notices on or near the highway concerned. 7. Designate School Zones and Playground Zones and shall cause such zones to be marked with signs posted along the highway, or by markings on the pavement or both, posted or suspended over the highway. 8. Designate any boulevard upon which parking is permitted and shall cause signs permitting such parking to be erected thereon. 9. Determine the format of the municipal tags, notices and other forms required to administer this bylaw. 7.2 Where Council has approved of any highways, or part of a highway One Way Traffic being designated for one way traffic, the C.A.O. may cause the same to be marked with signs. 7.3 Despite any other provision in this Bylaw, the C.A.O. may cause Moveable Signs moveable signs to be placed on or near a highway. 8. AUTHORITY OF PEACE OFFICERS 8.1 1. Any Peace Officer, or authorized employee of the Village, is hereby Towing authorized to remove and impound, or cause to be removed and impounded, any vehicle or trailer, parked on any highway when in contravention of any provision of this Bylaw or when interfering with snow removal or other public works being carried out by the Village. 2. No person shall attempt to prevent or in any way interfere with the impounding of any vehicle. 3. An impounded vehicle may be removed to and stored at a place designated by the Village. The Village shall not be liable for any damages sustained by the vehicle or losses from the vehicle during the removal operation or while it is in storage. Impoundment and 4. Any vehicle impounded under this Section may be released to the Release of Vehicles owner or their agent upon proof that any municipal tag, charges or costs imposed for towing and/or storage have been paid. 8.2 A municipal tag may be issued by the Peace Officer to any person who Municipal Tag contravenes any provisions of this Bylaw, and served as per Section 8.3, and the tag shall require the payment to the Village for the specified amount for that particular breach of this Bylaw. 8.3 1. A municipal tag shall be deemed to be sufficiently served: Deemed Served a. If served personally on the accused, or b. If mailed to the address of the registered owner of the vehicle concerned, or the person concerned, or, Village of Veteran Traffic Bylaw #519-15 Page 12 c. If attached to or left upon the vehicle in respect of which the offence is alleged to have been committed. 8.4 1. In those cases where a municipal tag has been issued and the Violation Ticket penalties specified on the municipal tag have not been paid within the prescribed time, then a Peace Officer is hereby authorized and empowered to issue a Violation Ticket, pursuant to Part 2 of the Provincial Offense Procedure Act, R.S.A. 2000, c.P-34 as amended. 2. Notwithstanding Section 8.2 of this Bylaw, a Peace Officer is hereby authorized and empowered to immediately issue a Violation Ticket to any person whom the Peace Office has reasonable and probable grounds to believe has contravened any provision of this Bylaw. 9. PENALTIES 9.1 Except as otherwise provided herein, every person who contravenes any General Penalty provision of this Bylaw, is guilty of an offence, and shall be liable on conviction to a fine not less than One Hundred ($100) dollars or more than Five Hundred Dollars ($500) dollars. 9.2 Every person who contravenes any provision of this Bylaw, as enumerated Specified Penalties in Schedule "A", attached thereto, is guilty of an offence and shall be liable on conviction to the penalty specified therein for such offense. 9.3 When a voluntary penalty ticket is issued by a Peace Officer for an Voluntary Payment offence which is not enumerated in Schedule "A", attached thereto, the monetary penalty shall be the minimum fine that may be imposed under Section 9.1 of this Bylaw. 9.4 Any person who contravenes any section of this Bylaw for a second Second and and subsequent time within a twelve (12) month period is guilty of a Subsequent Offences second and subsequent offence and liable to the fines as outlined in Schedule "A". 10. GENERAL 10.1 It is the intention of the Council that each separate provision of this Bylaw Severability shall be deemed independent of all other provision, and if any provision of this Bylaw be declared invalid, all other provisions shall remain valid and enforceable. 10.2 The Village of Veteran's Bylaw #485-06 is hereby repealed. Repeal 10.3 This Bylaw shall come into full force and effect upon passing of the Effective Date third and final reading. Read a first time in Council this 13th day of October, 2015.
