BYLAW NO. 470-01
BEING A BYLAW OF THE VILLAGE OF VETERAN IN THE PROVINCE OF
ALBERTA FOR THE REGULATION AND CONTROL OF PARKING IN
RESIDENTIAL AREAS OF THE VILLAGE OF VETERAN.
WHEREAS: The Municipal Government Act, Chapter M-26.1 of the Revised Statutes
of Alberta 1994 and amendments thereto give power to municipal councils
to pass bylaws respecting the safety, health and welfare of people and the
protection of people and property; and
WHEREAS: The Council of the Village of Veteran deem that the presence in
residential areas of the Village of Veteran of vehicles which are placarded
for the transport of hazardous or dangerous goods, present a potential risk
to the health and safety of the residents of the Village of Veteran;
NOW THEREFORE: The Council of the Village of Veteran, duly assembled, enacts as
follows:
PART 1:
This bylaw may be cited as the Village of Veteran Dangerous Goods
Bylaw.
PART 2:
Definitions: In this bylaw, except where otherwise defined:
1. Council - means the Municipal Council of the Village of Veteran.
2. Officer - means a member of the Royal Canadian Mounted Police or a
Bylaw Enforcement Officer appointed by the Village of Veteran.
3. Village - means the Village of Veteran in the Province of Alberta.
4. Vehicle - means a device in, upon or by which a person or thing may
be transported or drawn upon a highway.
PART 3:
Regulations:
1. No person shall park any vehicle which bears a placard indicating that
it may be transporting hazardous or dangerous goods within any area
of the Village which is designated as a residential area in Schedule A,
attached to and forming part of this bylaw.
2. Where a vehicle is parked or left in contravention of any provision of
this bylaw, the owner of the vehicle is responsible for the
contravention and liable to the penalty provided herein, unless he
proves to the satisfaction of the judge trying the case that at the time of
the contravention, the vehicle was not parked or left by him or any
other person with his consent, express or implied.
3. Any person who commits a breach of this bylaw shall, on conviction
for such breach, be liable to a fine as specified in Schedule B, attached
to and forming part of this bylaw. The amount of the fines set out in
Schedule B may be amended from time-to-time by resolution of
Council.
This bylaw shall come into full force and effect upon final reading.
