Vulcan - Alberta
BYLAW 2013-010
Being a Bylaw of Vulcan County in the Province
of Alberta to establish a utility for door to door
household garbage collection in the Hamlet of
Brant.
WHEREAS the Vulcan County (hereinafter referred to as "the County")
is governed by the Municipal Government Act, Chapter M26, Revised
Statues of Alberta, 2000 and amendments;
AND WHEREAS pursuant to section 7 of the Municipal Government Act,
being Chapter M-26 of the Revised Statutes of Alberta, 2000, and
amendments thereto, whereby a municipality may by Bylaw establish a
public utility.;
NOW THEREFORE the Council of Vulcan County, in the Province of
Alberta, duly assembled enacts as follows:

Application
This Bylaw applies only to the residences within the boundaries
of the Hamlet of Brant.
2.
Definitions
2.1 "Household Garbage" is all normal waste which results from
the operation of a household and without restricting the
generality of the foregoing will include; paper, rags, lawn and
hedge clippings, packing materials, waste from the preparation
of food, wood (not over six feet in length and not treated).
Household garbage does not include rubble and other refuse
from construction or demolition, dead animals, human and
animal excreta, automobiles or other machinery or any
flammable fuel containers.
2.2 "Residence" is any single family dwelling unit in the Hamlet of
Brant.
3.
Authority
3.1 The County shall supervise the collection of household garbage
and direct the days and times that collection shall be made.

3.2 It is the decision of the County as to the amount and type of
household garbage which is to be removed from any premises,
and the amount and type of household garbage which the
County is obliged to remove from any premises shall be final
and conclusive subject only to the superior statutory authority
of another entity.
4.
Garbage Collection
The County shall cause household garbage to be collected
from each residence in the Hamlet of Brant each week in
accordance with the rates specified in Schedule "A".
5.
Charges for Collection
5.1 Accounts for household garbage collection service shall be
forwarded yearly on June 30 to the owner of the residence and
shall be payable by September 30. If the account is not cleared
by December 31, the sum payable is a preferential lien and
charge on the personal property of the debtor and will be
levied and collected as municipal rates and taxes are
recoverable. The payment of any charges provided by this
Bylaw may be enforced by action in any court of competent
jurisdiction.
5.2 The rates levied pursuant to this Bylaw shall be applied to each
residence in the Hamlet of Brant with no option for the use of
service.
5.3 Non-receipt of a utility bill will not exempt the owner from
payment for the service received.
6.
Bylaw 2008-011 is hereby rescinded.
This Bylaw shall come into effect on the final date of passing thereof.
