Bylaw 2025-030 Page 1 of 4 VULCAN COUNTY BYLAW 2025-030 Being a bylaw of Vulcan County in the Province of Alberta to authorize the regulation and control of parking. WHEREAS Vulcan County Council has authority under the Municipal Government Act to regulate parking and traffic on roads under its jurisdiction; AND WHEREAS Vulcan County Council recognizes that parking on County roads and allowances should generally be permitted unless a restriction or ban is required and approved by council to address a demonstrated and substantiated public safety concern, infrastructure protection issue or a significant community need; NOW THEREFORE Vulcan County Council, in the Province of Alberta, duly assembled enacts as follows: 1. This bylaw may be called the "Parking Bylaw". 2. Definitions Unless otherwise provided, terms have the same meaning as in the Traffic Safety Act. a) "Council" - The municipal council of Vulcan County. b) "CAO" - The Chief Administrative Officer or designate. c) "Commercial Vehicle" - A vehicle with a gross weight of 4,500 kg or more, or over 6 meters in length, excluding recreational vehicles. d) "Peace Officer" - As defined in the Peace Officer Act, including RCMP, Community Peace Officers, or Bylaw Enforcement Officers appointed by the County. e) "Recreational Vehicle" - A motor home, trailer, camper, or similar unit designed for temporary accommodation. f) "Traffic Control Device" - Any authorized sign, signal, or marking regulating traffic or parking. Bylaw 2025-030 Page 2 of 4 3. Severability If any section is declared invalid, the remainder of the Bylaw remains in force. 4. Application This Bylaw does not apply to: - Emergency vehicles; - County vehicles or vehicles used for County business; - Utility or government vehicles engaged in approved work; - School or handicap buses while actively loading/unloading 5. General Parking Rules 5.1. Unless otherwise restricted by Council under this bylaw, parking on County roads, road allowances and other County infrastructure is permitted. Vehicles, however, must be parked in a manner that does not: 5.1.1. Block driveways, alleys, or access lanes; 5.1.2. Obstruct traffic or create a hazard; 5.1.3. Interfere with maintenance or emergency response; or 5.1.4. Violate a posted traffic control device. 6. Process for Establishing Parking Restrictions or Bans 6.1. Right to Apply, any individual, community group or business who lives or operates a business in Vulcan County may apply for the implementation of a parking restriction or ban on a county road, road allowance, or other County managed property. 6.2. Submission Requirements of the applicant are as follows; 6.2.1. A Written description of the location and nature of the request restriction or ban; 6.2.2. A written statement clearly identifying the problems and the risk that the request seeks to address; 6.2.3. An Impact Statement which addresses how the proposed restriction could affect nearby businesses, agricultural operations, residents as well a public access. a) The Impact Statement must include: i. The specific issues created by the unrestricted parking and why a parking restriction is necessary to address these concerns. ii. An outline of how the proposed parking ban is expected to improve conditions and identify the anticipated impacts of the restriction on surrounding businesses, agricultural operations, residents, and public access. iii. Potential positive and negative effects on the local community. b) The Impact Statement may include: Bylaw 2025-030 Page 3 of 4 i. Describe any measures proposed to minimize disruption or mitigate adverse impacts resulting from the parking restriction. 6.2.4. Any other relevant supporting evidence that would assist in the review process. 7. Review and Recommendation 7.1. The CAO shall review each application for completeness and may request additional information as needed. Once the application is considered complete, the CAO shall prepare a written recommendation or direct the Director of Protective Services to provide Council with the findings, stakeholder feedback, and potential impact 7.2. Council may direct administration to undertake site inspections, public notification, or traffic analysis where appropriate. 7.3. Public Notification (if directed): Administration shall advertise the proposed parking restriction in accordance with the County's Public Notification Bylaw. The notice period will allow affected stakeholders (including but not limited to, adjacent landowners and impacted businesses) the opportunity to raise concerns or provide input prior to a decision. 8. Council Decision 8.1. Following review, Council may: 8.1.1. Approve the restriction or ban, in whole or in part; 8.1.2. Approve the restriction on a trial or temporary basis for monitoring and impact evaluation. 8.1.3. Deny the application with reasons; or 8.1.4. Refer the matter back to Administration for further study. 9. Implementation 9.1. Where Council Approves a restriction: 9.1.1. The CAO shall authorize installation of appropriate traffic control devices or signage; and 9.1.2. Notice of the restriction shall be posted publicly and communicated to affected stakeholders. 10. Review of Restrictions 10.1. Council may review any parking restriction periodically or upon request to determine whether it remains necessary or should be amended or rescinded. 11. Commercial and Heavy Vehicles 11.1. Commercial vehicles may park on County roadways unless an approved restriction, separate bylaw or traffic control device prohibits it. Bylaw 2025-030 Page 4 of 4 11.2. Truck operators may stop for federally mandated rest breaks, provided engines are not idling unnecessarily and logbooks can be produced upon request. 11.3. All commercial vehicle parking must comply with the provisions of Section 5.1. 12. Private and Agricultural Land 12.1. This bylaw does not apply to privately owned or leased agricultural lands; 12.2. Temporary parking on road allowances for agricultural purposes is permitted unless otherwise restricted by Council. 13. Enforcement 13.1. Council shall determine the establishment, modification, or removal of parking restrictions or prohibitions. 13.2. The CAO may authorize the placement of traffic control devices or grant temporary exemptions as needed. 13.3. Peace officers may issue violation tickets for contraventions of this Bylaw. 13.4. Vehicle owners are responsible for offences unless proven otherwise. 14. Penalties 14.1. Unless otherwise set by Council resolution, penalties for contraventions are: 14.1.1. Parking contrary to this Bylaw - $100 14.1.2. Commercial vehicle parking contrary to this Bylaw - $250 14.1.3. Tampering with signs/traffic control devices - $500 15. Effective Date This Bylaw comes into effect upon third and final reading. READ a first time on this 14th day of January, 2026. READ a second time on this 11th day of March, 2026.
