SUMMER VILLAGE OF WEST BAPTISTE
BYLAW NO. 136-2026
A BYLAW TO PROHIBIT TOURIST HOMES WITHIN THE BOUNDARIES OF THE SUMMER VILLAGE OF WEST
BAPTISTE
WHEREAS pursuant to the authority granted under the Municipal Government Act, RSA 2000, c. M-26,
and amendments thereto, a council may pass bylaws respecting the safety, health and welfare of people
and the protection of people and property.
AND WHEREAS Council wishes to regulate land use and protect the residential character, quiet
enjoyment, and community standards within the Summer Village.
NOW THEREFORE, the Council of the Summer Village of West Baptiste, duly assembled, enacts as
follows:
1. TITLE
This Bylaw may be cited as the "Tourist Home Prohibition Bylaw."
2. DEFINITIONS
In this Bylaw:
a) "Council" means the Council of the Summer Village of West Baptiste.
b) "Municipality" means the Summer Village of West Baptiste.
c) "Tourist Home" means a dwelling or any portion thereof used to provide temporary accommodation
for compensation, whether directly or indirectly, for periods of less than thirty (30) consecutive days, and
includes accommodation advertised through online or digital platforms.
d) "Operate" includes to advertise, offer for rent, rent, lease, license, or otherwise provide occupancy of
a Tourist Home.
e) "Written Incident" means a documented contravention of this Bylaw as determined by a Designated
Officer.
3. PROHIBITION
3.1 No person shall operate a Tourist Home within the municipal boundaries of the Summer Village of
West Baptiste.
3.2 No owner of property within the Municipality shall permit or allow a Tourist Home to be operated on
their property.
4. OFFENCE AND PENALTY
4.1 Any person who contravenes any provision of this Bylaw is guilty of an offence.
4.2 A person who contravenes this Bylaw is guilty of an offence and liable upon summary conviction to a
fine of up to $10,000.00, in accordance with the Municipal Government Act.
4.3 A contravention of this Bylaw that continues for more than one day constitutes a separate offence for
each day the contravention continues.
4.4 Payment of the fee does not exempt the offender from compliance with this Bylaw.
5. RECOVERY OF UNPAID FEES
5.1 Any fee or charge levied under this Bylaw that remains unpaid by the due date may be added to the
tax roll of the property associated with the person liable for the fee, and shall be collected in the same
manner as property taxes in accordance with Section 553 of the Municipal Government Act, RSA 2000, c.
M-26.
5.2 Any amount added to the tax roll pursuant to this section shall be deemed to be taxes in arrears and
shall be recoverable in the same manner as property taxes pursuant to the Municipal Government Act.
6. ENFORCEMENT
6.1 This Bylaw may be enforced by a Designated Officer appointed by the Municipality.
6.2 A Designated Officer is authorized to issue written notices and take any steps necessary to enforce
this Bylaw in accordance with applicable legislation.
7. SEVERABILITY
7.1 If any provision of this Bylaw is declared invalid by a court of competent jurisdiction, the remaining
provisions shall remain in full force and effect.
8. EFFECTIVE DATE
8.1 This Bylaw comes into force and effect upon third and final reading and signing in accordance with
the Municipal Government Act.
