BYLAW NO. 437-16
PROVINCE OF ALBERTA
SUMMER VILLAGE OF WEST COVE
Being a Bylaw of the Summer Village of West Cove to control and regulate the disposal
of sewage and waste water within certain areas and on certain properties within the
Summer Village.
WHEREAS, the Council of the Summer Village of West Cove may pass bylaws for
municipal purposes respecting the safety, health, welfare and the protection of people
and property; and
WHEREAS, the Council of the Summer Village of West Cove is concerned that outdoor
privies and the disposal of sewage and wastewater in certain areas and on certain
properties within the Summer Village may pose a threat to the safety, health and welfare
of the residents of the Summer Village of West Cove and the properties within the
Summer Village; and
WHEREAS, the Council of the Summer Village of West Cove, for the safety, health,
welfare and protection of the residents of the Summer Village and the property within the
Summer Village, wishes to pass a bylaw to regulate the disposal of sewage and
wastewater in certain areas and on certain properties within the Summer Village on the
terms set out in this bylaw;
NOW THEREFORE, the Municipal Council of the Summer Village of West Cove, in
Council, duly assembled, enacts as follows:
1. In this bylaw:
(a) "Approved System" shall mean a private sewage disposal system or private
sewage disposal and treatment system which is installed and maintained in
compliance with the provisions of the Safety Codes Act and the regulations
thereunder;
(b) "Owner shall mean the person or persons registered as the owner or owners of
a parcel of land within the Summer Village of West Cove;
2. An Approved System shall be installed and maintained on all those properties within
the Summer Village of West Cove which are being used for residential purposes.
3. Notwithstanding Section 2 of this bylaw an Approved System shall be installed and
maintained on all those properties within the Summer Village which have a Water
System on them.
4. No owner of a parcel of land which is within one of the areas described in Section 2 of
this bylaw or which is a property described in Section 3 of this bylaw shall have, permit
or allow an outdoor privy or any other system for the disposal of sewage or wastewater
on the parcel of land which results in the disposal of sewage and wastewater into the
ground.

5. A Bylaw Enforcement Officer or any designated officer of the Summer Village of West
Cove shall, subject to compliance with the requirements of the Municipal Government
Act, be entitled to enter any lands within the Summer Village for the purpose of
carrying out an inspection to determine compliance with this bylaw.
6. All wastewater shall be hauled by a registered commercial hauler as recognized by
the Summer Village. Private individuals are not allowed to haul wastewater within the
Summer Village.
7. Any Owner of a parcel of land which contravenes this bylaw is guilty of an offence
and liable on conviction:
(a) for the first offence, to a fine of $500.00
(b) for the second offence, to a fine of $1,000.00 and
(c) for the third and each subsequent offence, to a fine of $2,500.00 and
in addition to those fines, for each offence the owner of the parcel of land is
additionally liable to a fine of $100.00 per day for each day that the property remains
in contravention of this bylaw.
8. The Village is not required to enforce this Bylaw. In deciding whether to enforce this
Bylaw, the Village may take into account any practical concerns, including available
municipal budget and personnel resources.
9. This Bylaw takes effect on the final passing thereof and, on such final passing, Bylaw
217-99, is hereby repealed.
