TRAFFIC CONTROL BYLAW WHEATLAND COUNTY 2019-20 Traffic Control Bylaw I Bylaw 2019-20 v 8 CW060 TRAFFIC CONTROL BYLAW WHEATLAND COUNTY 2019-20 1 Taaffe control sylaw[ Bylaw 2019-20 Traffic Control Bylaw [ Bylaw 2019-20 BYLAW 2019-20 WHEATLAND COUNTY PROVINCE OF ALBERTA BEING A BYLAW OF WHEATLAND COUNTY TO REGULATE AND CONTROL TRAFFIC AND PARKING ON ALL HIGHWAYS WITHIN WHEATLAND COUNTY WHEREAS the Traffic Safety Act, R.S.A. Chapter T-6 authorizes a municipality to regulate and control vehicle traffic, parking and the use of all highways under the direction, control and management of the municipality; AND WHEREAS the Municipal Government Act, R.S.A. 2000 Chapter M-26 authorizes a municipality to pass bylaws and delegate authority with respect to highways under the direction, control and direction of the municipality; AND WHEREAS Council of Wheatland County deems it desirable and appropriate to pass a bylaw regulating and controlling vehicle traffic , parking and use of all highways under the direction, control and management of the County; NOW, THEREFORE the Council of Wheatland County, duly assembled, enacts as follows: SECTION 1 -- Name of the Bylaw 1.1 This Bylaw may be cited as the "Traffic Control Bylaw". SECTION 2 - Definitions 2.1 In this Bylaw: (a) "Alley" means a narrow highway intended chiefly to give access to the rear of buildings and parcels of land; (b) "Chief Administrative Officer" means that individual appointed by Council as Chief Administrative Officer for the County in accordance with the Municipal Government Act, R.S.A. 2000 Chapter M-26, or his/her designate; (c) "County" means the municipal corporation of Wheatland County and includes the geographical area contained within the boundaries of the County, as the context requires; ( d) "Driver" or "Operator" means a person who drives or who is in actual physical control of a motor vehicle; (e) "Gross Weight" means (a) in respect of a single axle of a vehicle, the total weight that a single axle transmits to a highway; (b) in respect of an axle group of a vehicle, the sum of the weights transmitted to a highways by all of the axles within the axle group; (c) in respect of a tire of a vehicle, the total weight that the tire transmits to a highway; (d) in respect of a vehicle, the total weight of a vehicle or combination of vehicles calculated as the sum of the weights transmitted to a highway through each of the axles; (f) "Hamlet" means any unincorporated community designated as a "Hamlet" by Council from time to time in accordance with the Municipal Government Act, R.S.A. 2000 2 v m CW060 Traffic Control Bylaw] Bylaw 2019.20 BYLAW 2019-20 WHEATLAND COUNTY PROVINCE OF ALBERTA BEING A BYLAW OF WHEATLAND COUNTY TO REGULA TE AND CONTROL TRAFFIC ANO PARKING ON ALL HIGHWAYS WITHIN WHEATLAND COUNTY WHEREAS the Traffic Safety Act, R.S.A. Chapter T-6 authorizes a municipality to regulate and control vehicle traffic, parking and the use of all highways under the direction, control and management of the municipality, AND WHEREAS the Municipal Government Act, R.S.A. 2000 Chapter M-26 authorizes a municipality to pass bylaws and delegate authority with respect to highways under the direction, control and direction of the municipality; AND WHEREAS Council of Wheatland County deems it desirable and appropriate to pass a bylaw regulating and controlling vehicle traffic, parking and use of all highways under the direction, control and management of the County; NOW, THEREFORE the Council of Wheatland County, duly assembled, enacts as follows: SECTION 1 - Name of the Bylaw 11 This Bylaw may be cited as the Traffic Control Bylaw" SECTION 2 - Definitions 2.1 In this Bylaw. (a) "Alley" means a narrow highway intended chiefly to give access to the rear of buildings and parcels of land; (b) Chief Administrative Officer" means that individual appointed by Council as Chief Administrative Officer for the County in accordance with the Municipal Government Act, R.S.A. 2000 Chapter M-26, or his/her designate; (c) "County" means the municipal corporation of Wheatland County and includes the geographical area contained within the boundaries of the County, as the context requires; (d) "Driver" or "Operator" means a person who drives or who is in actual physical control of a motor vehicle; (e) "Gross Weight" means (a) in respect of a single axle of a vehicle, the total weight that a single axle transmits to a highway; (b) in respect of an axle group of a vehicle, the sum of the weights transmitted to a highways by all of the axles within the axle group; (c) in respect of a tire of a vehicle, the total weight that the tire transmits to a highway; (d) in respect of a vehicle, the total weight of a vehicle or combination of vehicles calculated as the sum of the weights transmitted to a highway through each of the axles; (f) "Hamlet" means any unincorporated community designated as a "Hamlet" by Council from time to time in accordance with the Municipal Government Act R.S A, 2000 2 Traffic Control Bylaw I Bylaw 2019-20 Chapter M-26 and includes the hamlets of Ardenode, Baintree, Crowfoot, Carseland, Chancellor, Cheadle, Cluny, Dalum, Gleichen, Lyalta, Makepeace, Namaka, Nightingale, Redland, Rosebud, Speargrass, Strangmuir and Stobart; (g) "Heavy Vehicle" means a commercial or recreational/passenger plated vehicle, with or without a load that exceeds any one of the following: A gross weight in excess of 11,000 kilograms, or an overall length, inclusive of any attached trailer, of 10 metres, an overall height of 4.15 metres or an overall width of 2.6 metres; (h) "Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestle way or other place whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles, and subject to the direction, management and control of County and (a) includes (i) a sidewalk (including the boulevard portion of the sidewalk), (ii) if a ditch lies adjacent to and parallel with the roadway, the ditch, and (iii) if a Highway right of way is contained between property line or between a property line and one side of the roadway, all the land between the property lines, or all the land between the property line and the edge of the roadway, as the case may be, but (b) does not include a place declared by the Lieutenant Governor in Council not to be a Highway; (i) "Implement of Husbandry" means: (a) A tractor designed and used for agricultural purposes, or (b) A vehicle designed and adapted exclusively for agricultural, horticultural, aquacultural or livestock operations; (j) "Manager" means the individual employed by the County in the position of General Manager in Charge of Transportation or his/her designate; (k) "Mobility Aid" means a device used to facilitate the transport, in a normal seated orientation, of a person with a physical disability; (I) "Motor Vehicle" means (a) a vehicle propelled by any power other than muscular power, or (b) a moped, but does not include a bicycle, an aircraft, a tractor, whether equipped with rubber tires or not, an implement of husbandry or a motor vehicle that runs only on rails; (m) "Officer" means a Bylaw Enforcement Officer (a Person appointed by the County pursuant to the Bylaw Enforcement Officer Bylaw, as amended or replaced from time to time), member of the RCMP or Peace Officer (as appointed pursuant to the Peace Officer Act, S.A. 2006 Chapter P-3.5, as amended); (n) "Owner" means the registered owner of a vehicle, recreational vehicle or trailer; ( o) "Park" means to allow a vehicle whether occupied or not, to remain standing in one place except: (a) When standing temporarily for the purpose of and while actually engaged in loading or unloading passengers, or (b) When standing in obedience to a Bylaw Enforcement Officer, Peace Officer or Traffic Control Device; (p) "Person" means any individual, firm, partnership, association or corporation; 3 v }Y CW060 Traffic Control Bylaw I Bylaw 2019-20 Chapter M-26 and includes the hamlets of Ardenode, Baintree, Crowfoot, Carseland, Chancellor, Cheadle, Cluny, Dalum, Gleichen, Lyalta, Makepeace, Namaka, Nightingale, Redland, Rosebud, Speargrass, Strangmuir and Stobart; (g) "Heavy Vehicle" means a commercial or recreational/passenger plated vehicle, with or without a load that exceeds any one of the following: A gross weight in excess of 11,000 kilograms, or an overall length, inclusive of any attached trailer, of 10 metres, an overall height of 4.15 metres or an overall width of 2.6 metres; (h) "Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestle way or other place whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles, and subject to the direction, management and control of County and (a) includes (i) a sidewalk (including the boulevard portion of the sidewalk), (ii) if a ditch lies adjacent to and parallel with the roadway, the ditch, and (iii) if a Highway right of way is contained between property line or between a property line and one side of the roadway, all the land between the property lines, or all the land between the property line and the edge of the roadway, as the case may be, but (b) does not include a place declared by the Lieutenant Governor in Council not to be a Highway; (i) "Implement of Husbandry" means: (a) A tractor designed and used for agricultural purposes, or (b) A vehicle designed and adapted exclusively for agricultural, horticultural, aquacultural or livestock operations; (j) "Manager" means the individual employed by the County in the position of General Manager in Charge of Transportation or his/her designate; (k) "Mobility Aid" means a device used to facilitate the transport, in a normal seated orientation, of a person with a physical disability; (I) "Motor Vehicle" means (a) a vehicle propelled by any power other than muscular power, or (b) a moped, but does not include a bicycle, an aircraft, a tractor, whether equipped with rubber tires or not, an implement of husbandry or a motor vehicle that runs only on rails; (m) "Officer" means a Bylaw Enforcement Officer (a Person appointed by the County pursuant to the Bylaw Enforcement Officer Bylaw, as amended or replaced from time to time), member of the RCMP or Peace Officer (as appointed pursuant to the Peace Officer Act, S.A. 2006 Chapter P-3.5, as amended); (n) "Owner" means the registered owner of a vehicle, recreational vehicle or trailer; ( o) "Park" means to allow a vehicle whether occupied or not, to remain standing in one place except: (a) When standing temporarily for the purpose of and while actually engaged in loading or unloading passengers, or (b) When standing in obedience to a Bylaw Enforcement Officer, Peace Officer or Traffic Control Device; (p) "Person" means any individual, firm, partnership, association or corporation; 3 v }Y CW060 Traffic Control Bylaw I Bylaw 2019-20 (q) "Playground Zone" means that portion of a Highway identified as a playground zone by a traffic control device; (r) "Recreation Vehicle" means a vehicle or combination of a vehicle and trailer designed for vacation, camping or similar recreation purposes and shall include but not be limited to light trailers designed for hauling watercraft, snowmobiles and all-terrain vehicles; (s) "School Zone" means that portion of Highway identified as a school zone by a traffic control device; (t) "Traffic Control Device" means any sign, signal, marking or device placed, marked or erected under the authority of the Traffic Safety Act, R.S.A. 2000, Chapter T-6, as amended, for the purpose of regulating, warning or guiding traffic; (u) "Traffic Safety Act" means the Traffic Safety Act, R.S.A. 2000 Chapter T-6 together with all regulations passed thereunder, all as may be amended or replaced from time to time; (v) "Trailer" means a vehicle so designed that it (a) may be attached to or drawn by a motor vehicle or tractor, and (b) is intended to transport property or persons; (w) "Truck" means a vehicle designed primarily for the transportation of property or equipment but does not include a chassis-cab, crawler mounted vehicle, Trailer, machinery or equipment used in the construction or maintenance of Highways or an off- highway vehicle as defined in the Off-Highway Vehicle Act, R.S.A. Revised Statutes of Alberta, 2000, Chapter T-6, as amended; (x) "Vehicle" means a device in, on or by which a person or thing may be transported or drawn on a highway and includes a combination of vehicles but does not include a Mobility Aid; (y) "Violation Tag" means a tag or similar document issued by the County pursuant to the Municipal Government Act; (z) "Violation Ticket" means a ticket issued pursuant to Part 2 of the Provincial Offences Procedures Act, R.S.A. 2000 Chapter P-34 and any amendments; SECTION 3- General 3.1 Notwithstanding anything in this Bylaw, all Persons operating a Motor Vehicle, bicycle, tractor, Implement of Husbandry or any other type of Vehicle on a Highway in the County shall comply with all applicable provisions of the Traffic Safety Act including but not limited to the rules of the road as set out in the Use of Highway and Rules of the Road Regulation R.S.A. 304/2002. SECTION 4-- Speed Limits 4.1 Unless otherwise posted and hereinafter specifically provided, the maximum rate of speed at which a Driver may operate a Motor Vehicle upon any Highway outside a Hamlet shall be eighty (80) kilometres per hour. 4.2 Unless otherwise posted and hereinafter specifically provided, the maximum rate of speed at which a Driver may operate a Motor Vehicle upon a Highway within a Hamlet shall be fifty (50) kilometres per hour. 4.3 The maximum rate of speed at which a Driver may operate a motor Vehicle in an Alley located within the County shall be twenty (20) kilometres per hour. 4 v $v CW060 Traffic Control Bylaw I Bylaw 2019-20 (q) "Playground Zone" means that portion of a Highway identified as a playground zone by a traffic control device; (r) "Recreation Vehicle" means a vehicle or combination of a vehicle and trailer designed for vacation, camping or similar recreation purposes and shall include but not be limited to light trailers designed for hauling watercraft, snowmobiles and all-terrain vehicles; (s) "School Zone" means that portion of Highway identified as a school zone by a traffic control device; (t) "Traffic Control Device" means any sign, signal, marking or device placed, marked or erected under the authority of the Traffic Safety Act, R.S.A. 2000, Chapter T-6, as amended, for the purpose of regulating, warning or guiding traffic; (u) "Traffic Safety Act" means the Traffic Safety Act, R.S.A. 2000 Chapter T-6 together with all regulations passed thereunder, all as may be amended or replaced from time to time; (v) "Trailer" means a vehicle so designed that it (a) may be attached to or drawn by a motor vehicle or tractor, and (b) is intended to transport property or persons; (w) "Truck" means a vehicle designed primarily for the transportation of property or equipment but does not include a chassis-cab, crawler mounted vehicle, Trailer, machinery or equipment used in the construction or maintenance of Highways or an off- highway vehicle as defined in the Off-Highway Vehicle Act, R.S.A. Revised Statutes of Alberta, 2000, Chapter T-6, as amended; (x) "Vehicle" means a device in, on or by which a person or thing may be transported or drawn on a highway and includes a combination of vehicles but does not include a Mobility Aid; (y) "Violation Tag" means a tag or similar document issued by the County pursuant to the Municipal Government Act; (z) "Violation Ticket" means a ticket issued pursuant to Part 2 of the Provincial Offences Procedures Act, R.S.A. 2000 Chapter P-34 and any amendments; SECTION 3- General 3.1 Notwithstanding anything in this Bylaw, all Persons operating a Motor Vehicle, bicycle, tractor, Implement of Husbandry or any other type of Vehicle on a Highway in the County shall comply with all applicable provisions of the Traffic Safety Act including but not limited to the rules of the road as set out in the Use of Highway and Rules of the Road Regulation R.S.A. 304/2002. SECTION 4-- Speed Limits 4.1 Unless otherwise posted and hereinafter specifically provided, the maximum rate of speed at which a Driver may operate a Motor Vehicle upon any Highway outside a Hamlet shall be eighty (80) kilometres per hour. 4.2 Unless otherwise posted and hereinafter specifically provided, the maximum rate of speed at which a Driver may operate a Motor Vehicle upon a Highway within a Hamlet shall be fifty (50) kilometres per hour. 4.3 The maximum rate of speed at which a Driver may operate a motor Vehicle in an Alley located within the County shall be twenty (20) kilometres per hour. 4 v $v CW060 Traffic Control Bylaw I Bylaw 2019-20 4.4 On any day on which school is held, the maximum rate of speed at which a Driver may operate a Motor Vehicle upon a Highway located within all school zones shall be thirty (30) kilometres per hour at any time between (a) 8:00 A.M. and 9:30 A.M., (b) 11:30 A.M. and 1:30A.M., or (c) 3:00 P.M. and 4:30 P.M. 4.5 The maximum rate of speed at which a Driver may operate a Motor Vehicle upon a Highway located within all playground zones throughout the County shall be thirty (30) kilometres per hour between the hours of 8:30 A.M. and one hour after sunset. 4.6 Notwithstanding any other provision of this Bylaw, the maximum rate of speed at which a Driver may operate a Motor Vehicle shall be: (a) thirty (30) kilometres per hour on any Highway referred to in Schedule "A" attached hereto and forming part of this Bylaw; (b) forty (40) kilometres per hour on any Highway referred to in Schedule B" attached hereto and forming part of this Bylaw; (c) fifty (50) kilometres per hour on any Highway referred to in Schedule "C" attached hereto and forming part of this Bylaw; (d) sixty (60) kilometres per hour on any Highway referred to in Schedule "D" attached hereto and forming part of this Byfaw; (e) eighty (80) kilometres per hour on any Highway referred to in Schedule "E" attached hereto and forming part of this Bylaw; (f) ninety (90) kilometres per hour on any Highway referred to in Schedule "F" attached hereto and forming part of this Bylaw (g) one hundred (100) kilometres per hour on any Highway referred to in Schedule "G" attached hereto and forming part of this Bylaw. SECTION 5-Traffic Control Devices 5.1 The Manager is hereby delegated the authority to prescribe where Traffic Control Devices are to be located upon any and all Highways, including Traffic Control Devices restricting the speed of Vehicles, stop signs and yield signs and the Manager shall provide a record of all locations where Traffic Control Devices have been erected which shall be open to the public for inspection during normal business hours. 5.2 The Manager is hereby delegated the authority to temporarily amend a maximum speed in respect of any part of a Highway under construction or repair or in a state of disrepair applicable to all Motor Vehicles or to any classes of Motor Vehicles while travelling on that part of the Highway and the Manager shall cause to be posted on the Highway or part of the Highway so designated, such Traffic Control Devices as he deems necessary to indicate the maximum speed so fixed. 5.3 The Manager is hereby delegated the authority to post Traffic Control Devices at any location on a Highway where the technical limitations of the Highway warrant a reduction in the speed of Vehicles travelling on that portion of the Highway. 5.4 The Manager may cause movable signs to be placed on or near a Highway to indicate "No Parking", "Street Cleaning", "Snow Removal", "Parade Route" or "Emergency Repairs", and when so marked, such signs shall take precedence over all other Traffic Control Devices. 5 Traffic Control Bylaw I Bylaw 2019-20 4.4 On any day on which school is held, the maximum rate of speed at which a Driver may operate a Motor Vehicle upon a Highway located within all school zones shall be thirty (30) kilometres per hour at any time between (a) 8:00 A.M. and 9:30 A.M., (b) 11:30 A.M. and 1:30A.M., or (c) 3:00 P.M. and 4:30 P.M. 4.5 The maximum rate of speed at which a Driver may operate a Motor Vehicle upon a Highway located within all playground zones throughout the County shall be thirty (30) kilometres per hour between the hours of 8:30 A.M. and one hour after sunset. 4.6 Notwithstanding any other provision of this Bylaw, the maximum rate of speed at which a Driver may operate a Motor Vehicle shall be: (a) thirty (30) kilometres per hour on any Highway referred to in Schedule "A" attached hereto and forming part of this Bylaw; (b) forty (40) kilometres per hour on any Highway referred to in Schedule B" attached hereto and forming part of this Bylaw; (c) fifty (50) kilometres per hour on any Highway referred to in Schedule "C" attached hereto and forming part of this Bylaw; (d) sixty (60) kilometres per hour on any Highway referred to in Schedule "D" attached hereto and forming part of this Byfaw; (e) eighty (80) kilometres per hour on any Highway referred to in Schedule "E" attached hereto and forming part of this Bylaw; (f) ninety (90) kilometres per hour on any Highway referred to in Schedule "F" attached hereto and forming part of this Bylaw (g) one hundred (100) kilometres per hour on any Highway referred to in Schedule "G" attached hereto and forming part of this Bylaw. SECTION 5-Traffic Control Devices 5.1 The Manager is hereby delegated the authority to prescribe where Traffic Control Devices are to be located upon any and all Highways, including Traffic Control Devices restricting the speed of Vehicles, stop signs and yield signs and the Manager shall provide a record of all locations where Traffic Control Devices have been erected which shall be open to the public for inspection during normal business hours. 5.2 The Manager is hereby delegated the authority to temporarily amend a maximum speed in respect of any part of a Highway under construction or repair or in a state of disrepair applicable to all Motor Vehicles or to any classes of Motor Vehicles while travelling on that part of the Highway and the Manager shall cause to be posted on the Highway or part of the Highway so designated, such Traffic Control Devices as he deems necessary to indicate the maximum speed so fixed. 5.3 The Manager is hereby delegated the authority to post Traffic Control Devices at any location on a Highway where the technical limitations of the Highway warrant a reduction in the speed of Vehicles travelling on that portion of the Highway. 5.4 The Manager may cause movable signs to be placed on or near a Highway to indicate "No Parking", "Street Cleaning", "Snow Removal", "Parade Route" or "Emergency Repairs", and when so marked, such signs shall take precedence over all other Traffic Control Devices. 5 Traffic Control Bylaw I Bylaw 2019-20 5.5 The Manager may temporarily close the whole or any part of a highway at any time that a construction or maintenance project on or adjacent to the road may create a hazard and for Community events and shall cause such highway or area to be marked with the appropriate Traffic Control Devices SECTION 6 Road Use & Parking Control Prohibitions 6.1 No Person shall Park any Heavy Vehicle upon any Highway, within a Hamlet except where such parking is expressly permitted or except for the purposes of loading and/or unloading such Vehicle. 6.2 No Person shall Park any Trailer upon any Highway unless the said Trailer is attached to a Vehicle by which it can be propelled or drawn and when so attached the Trailer shall be deemed part of the Vehicle and subject to the regulations pertaining to Vehicles. 6.3 No Person shall drive, stop or Park, or allow to parked, a Vehicle upon a Highway in such a manner as to block, obscure, impede or hinder traffic. Where the obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this section provided he/she promptly takes measures to provide adequate warning indications to other road users and clears the faulty Vehicle as soon as practicable from the Highway. 6.4 No Person shall Park a Vehicle on any land, whether public or private property, without the consent of the owner, tenant or their agent. A Person shall be presumed to have such consent to park a Vehicle in a parking lot that is accessible to the public, unless the Person who owns or occupies the land gives notice to the contrary, whether verbally, in writing or by signs. Such consent shall not be presumed in any other case. 6.5 No Person shall live in a Recreational Vehicle that is parked on a Highway. 6.6 No Person shall deposit and/or displace or permit the deposit and/or displacement of any materials on a Highway without having prior written authorization to do so by the Manager. 6.7 (a) No Person shall deface/damage a Traffic Control Device. (b) No Person shall add/remove a Traffic Control Device unless authorization has been issued by the Chief Administrative Officer or his/her designate. 6.8 No occupier of any premises shall permit the unrestricted flow of any water from such premises over any Highway, sidewalk or boulevard. 6.9 Unless permitted by a Traffic Control Device, a Person shall not Park or permit a Vehicle to be parked in any of the following areas: a) on a sidewalk or boulevard; b) on a crosswalk or any part of a crosswalk; c) within an intersection or at an intersection nearer than 5 metres to the projection of the corner property line immediately ahead or immediately behind; d) within 5 meters of the approach to any stop sign, yield sign or crosswalk; e) within five (5) metres of any fire hydrant, or when the fire hydrant is not located at the curb, within five (5) metres of the point on the curb nearest the hydrant; f) within one and a half (1.5) meters of an access to a garage, private road or driveway; g) on any bridge or culvert; or (h) on a Highway contrary to a Traffic Control Device. 6 V (flf CW060 Traffic Control Bylaw I Bylaw 2019-20 5.5 The Manager may temporarily close the whole or any part of a highway at any time that a construction or maintenance project on or adjacent to the road may create a hazard and for Community events and shall cause such highway or area to be marked with the appropriate Traffic Control Devices SECTION 6 Road Use & Parking Control Prohibitions 6.1 No Person shall Park any Heavy Vehicle upon any Highway, within a Hamlet except where such parking is expressly permitted or except for the purposes of loading and/or unloading such Vehicle. 6.2 No Person shall Park any Trailer upon any Highway unless the said Trailer is attached to a Vehicle by which it can be propelled or drawn and when so attached the Trailer shall be deemed part of the Vehicle and subject to the regulations pertaining to Vehicles. 6.3 No Person shall drive, stop or Park, or allow to parked, a Vehicle upon a Highway in such a manner as to block, obscure, impede or hinder traffic. Where the obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this section provided he/she promptly takes measures to provide adequate warning indications to other road users and clears the faulty Vehicle as soon as practicable from the Highway. 6.4 No Person shall Park a Vehicle on any land, whether public or private property, without the consent of the owner, tenant or their agent. A Person shall be presumed to have such consent to park a Vehicle in a parking lot that is accessible to the public, unless the Person who owns or occupies the land gives notice to the contrary, whether verbally, in writing or by signs. Such consent shall not be presumed in any other case. 6.5 No Person shall live in a Recreational Vehicle that is parked on a Highway. 6.6 No Person shall deposit and/or displace or permit the deposit and/or displacement of any materials on a Highway without having prior written authorization to do so by the Manager. 6.7 (a) No Person shall deface/damage a Traffic Control Device. (b) No Person shall add/remove a Traffic Control Device unless authorization has been issued by the Chief Administrative Officer or his/her designate. 6.8 No occupier of any premises shall permit the unrestricted flow of any water from such premises over any Highway, sidewalk or boulevard. 6.9 Unless permitted by a Traffic Control Device, a Person shall not Park or permit a Vehicle to be parked in any of the following areas: a) on a sidewalk or boulevard; b) on a crosswalk or any part of a crosswalk; c) within an intersection or at an intersection nearer than 5 metres to the projection of the corner property line immediately ahead or immediately behind; d) within 5 meters of the approach to any stop sign, yield sign or crosswalk; e) within five (5) metres of any fire hydrant, or when the fire hydrant is not located at the curb, within five (5) metres of the point on the curb nearest the hydrant; f) within one and a half (1.5) meters of an access to a garage, private road or driveway; g) on any bridge or culvert; or (h) on a Highway contrary to a Traffic Control Device. 6 V (flf CW060 Traffic Control Bylaw I Bylaw 2019-20 6.1 0 When parallel parking on a Highway, a Driver of a Vehicle shall Park that Vehicle with the sides of it parallel to the curb or edge of the Highway and shall ensure that: (a) The right hand wheels of the Vehicle are not more than five hundred (500) millimeters from the right hand curb or edge of the Highway; and (b) The Vehicle is parked facing the direction of travel authorized for that side of the Highway. 6.11 No Person shall Park a Vehicle including but not limited to a Motor Vehicle, Heavy Vehicle and Recreational Vehicle on any Highway for any period in excess of seventy-two (72) consecutive hours. 6.12 Every Person shall comply with any traffic signal or direction of an Officer. 6.13 Notwithstanding sections 6.1 through 6.11, the following service vehicles (County and Province) are exempt from parking restrictions where the vehicle is being used for work requiring that it be stopped or parked at that location; emergency vehicles, service vehicles, towing vehicles and public works vehicles. SECTION 7 - Penalties & Enforcement 7.1 Any Person who contravenes any of the provisions of this Bylaw is guilty of an offence and liable on summary conviction to a fine not less than $75.00 and not more than $10,000.00 dollars and if in default of payment of any fine imposed, to imprisonment for not more than six (6) months. The specific fines for an offence committed pursuant to this Bylaw are set out in the attached schedule "H". 7.2 An Officer may cause any Vehicle parked on a Highway contrary to the provisions of this Bylaw to be towed and impounded in an impound lot designated by the Chief Administrative Officer. By delivering it personally to such Person, or ii. SECTION 9- Owner Liable 9.1 If a Vehicle is involved in an offence referred to in this bylaw, the owner of that vehicle is guilty of an offence 9.2 Subsection 8.1 does not apply if the owner of the vehicle satisfies the court the owner did not park the vehicle or was not driving the vehicle at the time of the offence and that the person who parked the vehicle or was driving the vehicle at the time of offence did so without the owner's express or implied consent. SECTION 10-- Repeal of Bylaws 10.1 Bylaw 2016-32 is hereby rescinded upon the passing and signing of Bylaw 2019-20. SECTION 11 -- Effective Date of Bylaw 11.1 This Bylaw shall come into force and effect as of the passing of the third and final reading and signing thereof.
