## SUMMER VILLAGE OF WHITE SANDS BYLAW NO. 210-24 ## Golf Cart Pilot Project Bylaw A BYLAW OF THE SUMMER VILLAGE OF WHITE SANDS, IN THE PROVINCE OF ALBERTA, TO REGULATE THE PILOT TESTING OF GOLF CARTS ON SELECT PUBLIC ROADS. WHEREAS, the Council of the Summer Village of White Sands, duly assembled, deems it advisable to set forth the terms and conditions to regulate the pilot testing of golf carts on select public roads in and through the Summer Village of White Sands. NOW THEREFORE, the Council of the Summer Village of White Sands, under the authority vested in it by the Pilot Project (Golf Carts) Regulation under the Traffic Safety Act, R.S.A. 2000, c. T-6 as well as its general bylaw-making powers under the Municipal Government Act, R.S.A. 2000, c. M26 and the Traffic Safety Act, R.S.A. 2000 c. T-6, hereby enacts as follows: ## 1) TITLE This bylaw shall be known as the "Golf Cart Pilot Project Bylaw". ## 2) APPLICATION This bylaw applies to all golf carts operated on highways within the Summer Village of White Sands. ## 3) DEFINITIONS Definitions in the Pilot Project (Golf Carts) Regulation, and definitions in the Traffic Safety Act and its regulations, as applicable, are adopted for the purposes of the interpretation and the application of this bylaw. In this bylaw: - (a) "Act" means the Traffic Safety Act, RSA 2000, T-6; - (b) "CAO means the Chief Administrative Officer of the Summer Village, or designate; - (c) "Council" refers to the Council of the Summer Village of White Sands, and as defined in the Municipal Government Act, RSA 2000, M-26; - (d) "Designated Highway" means a roadway or highway authorized for golf car operations as identified by the Summer Village and approved by the Registrar - (e) "Golf cart" means a 4-wheel motor vehicle that, - i. is designed by a manufacturer primarily for use on golf courses or paved surfaces, - ili. cannot attain a speed of more than 40 km/h on a paved level surface, - ii. is not home built or modified, - iv. has a structure that - a. partially or fully encloses its operator and passengers, and - v. has a gross vehicle weight rating of less than 1361 kg; - b. is not less than 1.2 m above the ground, and - (f) "Nighttime" means the period commencing one hour after sunset and ending one hour before the following sunrise; - (g) "Operator's licence" or "driver's licence" means an operator's licence or a driver's licence that is issued under this Act and includes a document or information and other data contained in an electronic form that is recognized under this Act as an operator's licence or a driver's licence; - i. Operator's licence under the ACT includes a licence or permit issued in another jurisdiction that permits a person to operate a motor vehicle. - (h) "Owner" has the same meaning within the Act and further includes a person who is identified in a Permit issued under Section 7 of this bylaw; - (i) "Peace Officer" means: - i. a Police Officer, - ili. a person appointed as a Bylaw Enforcement Officer pursuant to the Municipal Government Act, RSA 2000, M-26. - ii. a person appointed as a Peace Officer pursuant to the Peace Officer Act, S.A.2006, c. P-3.5, or - "Permit" means a permit issued in accordance with this Bylaw under Section 7. - (k) "Registrar" means the Registrar of Motor Vehicle Services and includes any person who, on the direction of the Registrar, is acting on behalf of the Registrar of Motor Vehicle Services. - (I) "Regulation" means the Pilot Project (Golf Carts) Regulation which establishes a five-year pilot project to evaluate the use of golf carts on select highways within participating municipalities whose councils pass bylaws to authorize golf cart use on designated highways, and that are approved by the Registrar of Motor Vehicle Services. (The Regulation may be updated from time to time and is available on the Alberta Government website or the Summer Village of White Sands website. - (m) "Summer Village" means the Summer Village of White Sands. ## 4) OPERATION RESTRICTIONS FOR GOLF CARTS No person shall operate a golf cart: - (a) in a manner contrary to the Act, its regulations, or this bylaw. - (b) on any highway unless they are on a designated highway. - (C) on a highway, unless they are in possession of a subsisting permit issued in respect of that golf cart by the Summer Village. - (d) On a designated highway if they are less than 14 years old. - (e) without being the holder of a Class 1 to Class 7 valid operator's license on a designated highway, pursuant to the act. - (f) on a designated highway during nighttime. - (g) without exercising due care and attention. - (h) without reasonable consideration for other persons in the area or who might reasonably be expected to be in the area. - if the number of passengers in the golf cart exceeds the number of passenger seats available. - (i) to tow vehicles, equipment, or any person using any type of equipment on a designated highway. ## 5) OPERATOR RESPONSIBILITIES FOR GOLF CARTS Every operator of a golf cart shall: - (a) When approaching an oncoming vehicle, pass the vehicle on the right, - Yield the right of way to vehicles approaching from their right, - (c) When overtaking another vehicle, pass that vehicle on the left, - (d) Yield the right of way to all pedestrians that are approaching so close as to present a hazard, and - (e) Except when overtaking another vehicle, maintain a safe following distance behind any other vehicle. - (f) Ensure the golf cart is operated in accordance with the rules of the road, unless specified in the Regulation. Golf carts are subject to all other rules, terms and conditions as if they were a motor vehicle and must be operated as such. ## 6) DESIGNATED HIGHWAYS Council hereby designates those highways included in Schedule "B" as designated highways for the purposes of this bylaw. - (a) Any changes to designated highways shall be submitted to the Registrar for approval. - (b) Designated highways shall be posted at a speed of no more than 30km/h. (c) The CAO shall ensure signs are erected on designated highways. - i. Signs shall be in the form and manner set out in Schedule "C". ## 7) PERMITS Council hereby authorizes the CAO to issue permits, attach conditions, and to charge a fee to regulate and control of golf carts within the Summer Village. - (a) Permits at a minimum shall include: - i. The owners name and operator's license information, - iii. Make, model, serial number of golf cart, - ii. Proof of Liability insurance in the amount of $2,000,000.00, - iv. Conditions and responsibilities of golf cart operators and owners, and - v. Any other information as required by the Registrar. - (b) Permits shall only be valid from January 1 - December 31 of any one calendar year. - (c) Permit fees are identified in the Summer "Village's Fees for Service Bylaw". - (d) Permits issued will include a numbered Registration Placard which must be affixed to the golf cart in a clear legible location designated in the permit that is visible from a distance of 10 meters. ## 8) COLLISION REPORTS - (a) A person operating a golf cart shall forthwith report to the Municipality a collision resulting in property damage of any amount, or an injury or fatality in the form and manner specified by the Summer Village. - (b) If the operator is incapable of making the report required by subsection (a) and there is a passenger of the golf cart capable of making the report, the passenger shall make the report forthwith. - (c) If a report has not been made under subsection (a) or (b) and the operator or passenger is not the owner of the golf cart, the owner shall make the report forthwith after learning of the collision. - (d) Failure to report a collision may result in the suspension of golf cart privileges. ## 9) COMPLIANCE &amp; ENFORCEMENT ## Stopping for Peace Officer - (a) For the purposes of administering and enforcing this bylaw, a Peace Officer may: - i. Signal or direct a driver of a golf cart to stop the vehicle, and - Request information from the driver of the golf cart and any passengers on or in the vehicle. - (b) When signaled or directed to stop by a Peace Officer, a driver of a golf cart shall: - i. Forthwith bring the vehicle to a stop, - a. Their operator's license issued pursuant to the Act, - ji. Forthwith furnish to the Peace Officer: - b. Any permit issued pursuant to this bylaw, and - ili. Remain stopped until permitted by the Peace Officer to leave. - c. Any other information respecting the driver or the vehicle that the Peace Officer requires, and - (c) Any impound or towing fees incurred due to the golf cart being impounded, towed, or moved by order of a Peace Officer shall be the sole responsibility of the registered owner of the golf cart. The registered owner must pay any applicable impound or towing fees directly to the service provider or relevant authority at the time of the tow or as specified by the towing or impoundment agency. ## 10) OFFENCES - (a) The operator of a golf cart that is involved in a contravention of this bylaw is guilty of an offence and liable upon summary conviction to a fine specified in Schedule "A" of this bylaw. - 10) The near ofable up art invard in a contrade tine sperited in cheuity of an this bylaw. ## 11) VIOLATION TAG - a) A Peace Officer is hereby authorized and empowered to issue a Violation Tag to iny person who the Peace Officer has reasonable and probable grounds to believe has contravened any provision of this bylaw. ## 12) VIOLATION TICKET - (a) A Peace Officer is hereby authorized and empowered to issue a violation ticket, pursuant to Part Il of the Provincial Offences Procedure Act (Alberta), to any person who the Peace Officer has reasonable and probable grounds to believe has contravened any provision of this bylaw. ## 13) SEVERABILITY - a) Should any section or part of this bylaw be found to have been impropert enacted, such section shall be deemed to be severable from all other sections o this bylaw. ## 14) GENERAL - (a) This bylaw shall come into force when the following is enacted: - i. The date of the final passing thereof, and - ili. Installation of signs as required by section 13 of the Regulation. - ii.
