Utility user fees and specified area taxes from previous years will be adjusted when the City determines that property owners have not been billed correctly. 2. Utility user fees will be adjusted as follows: (a) Property owners who have been undercharged utility user fees will have the utility user fees adjusted for up to six (6) billing periods (12 months). Property owners will have the option of prorating the payment owing to the City of Abbotsford over a period equal to the period of the adjustment. If the utility user fees remain outstanding after the period of adjustment, they will appear as arrears on the property tax notice. (b) Property owners who have been overcharged utility user fees will be refunded for up to twelve (12) billing periods (24 months) based on all prior existing records relating to the property. (c) Interest will not be paid or charged on any amounts owing to, or by, the City of Abbotsford as a result of utility adjustments. 3. Specified area taxes will be adjusted as follows: (a) Property owners who have been under charged specified area taxes will have the specified area taxes adjusted for the current year, and up to two (2) previous years. Property owners will have option of prorating the payment owing to the City of Abbotsford over a period equal to the period of the adjustment. BASIC ANNUAL FEES (B/L 3379-2023, 3491-2023, 3598-2025, 3715-2026) For the purpose of section 42 [fees for serviced properties] of the Solid Waste Management Bylaw, the basic annual fee is set out in Column 5 of Table 1, opposite the applicable sizes of collection carts supplied to the serviced property in columns 1 to 4. (2) The cart administration fee is non-refundable, unless subject to subjection (3). (3) The general manager may, at their discretion, waive or provide a refund of the cart administration fee. 7. ABBOTSFORD-MISSION RECYLCING DEPOT FEES (B/L 3598-2025) (1) For the purpose of section 47 [Abbotsford-Mission Recycling Depot fees] of the Solid Waste Management Bylaw, the fees payable by a person for the disposal of commercial recyclables at the Abbotsford-Mission Recycling Depot are as follows: (a) for loads of commercial recyclables with more than 50% old corrugated cardboard by volume, $95/tonne; (b) for loads of commercial recyclables with 50% old corrugated cardboard by volume, or less, $220/tonne. (2) The fees under subsection (1) do not apply to the following: (a) loads of more than 10 blue bags filled with curbside recyclables; (b) loads of sorted cardboard. 8. CART REPLACEMENT FEE [B/L3186-2021] (1) For the purpose of section 46 [cart administration fee] of the Solid Waste Management Bylaw, the cart administration fee is $80.00 per visit. (2) The cart administration fee is non-refundable, unless subject to subjection (3). (3) The general manager may, at their discretion, waive or provide a refund of the cart administration fee. (4) For the purpose of section 52 [costs of cleaning, repairs and replacements] of the Solid Waste Management Bylaw, the cart replacement fee is set out in Column 2 of Table 3, opposite the applicable size of the replacement collection cart supplied to the serviced property. Where a municipal fee is owed to the City pursuant to a City bylaw, the person who owes the fee must pay interest on the fee, calculated from the day the fee becomes overdue. 2. For the purposes of Section 1, the fee becomes overdue when the City issues an invoice or a written request for payment to the person who owes the fee, and the fee remains outstanding for more than 30 days. 3. This Schedule does not operate to require the payment of an amount of interest less than $10. 4. Interest under Sections 1-3 stops accruing on the earlier of the date: (a) payment of the fee is received by the City, and (b) unpaid amounts, to which Section 258 of the Community Charter applies, are transferred to property taxes. 5. The annual rate of interest payable under Sections 1-3 is 12%. 6. On a fee owed to the City, interest will be non-compounded and calculated on the number of days since the fee became overdue. 7. Payment of a fee received by the City pursuant to a City bylaw will be applied first to interest, calculated in accordance with Section 6, and then to the principal balance owing. 8. This Schedule does not apply to money owed to the City: (a) in the capacity of an agent or trustee; (b) by a municipality or regional district; (c) by the government of British Columbia or Canada; (d) by an employee of the City in respect of overpayment salary, wages, benefits or expenses; (e) under a contract where the contract specifically provides for payment of interest to the City; or (f) where another bylaw or enactment specifically provides for payment of interest to the City.
