Wastewater Holding Tank Bylaw No. 94 BYLAW NO. 94 DISTRICT OF BARRIERE A BYLAW TO REGULATE AND MANAGE THE USE OF WASTEWATER HOLDING TANKS WHEREAS under section 8 (3) (i) & (j) of the Community Charter, Council may, by bylaw, regulate, prohibit and impose requirements in relation to the District's public health and the protection of the natural environment; and, WHEREAS the District is in the process of providing municipal wastewater connections for a specified area of the downtown core; and, WHEREAS Interior Health has a policy requiring a municipal Council to pass a bylaw regarding the ongoing maintenance, pumping and repair of Holding Tanks and, the recovery of any associated costs incurred by the District due to noncompliance, before they will consider issuing a permit for a Holding Tank; NOW, THEREFORE, the Council of the District of Barriere in open meeting assembled, ENACTS AS FOLLOWS: 1. Definitions Definitions for the terms used in this bylaw shall be as found in the current BC Public Health Act, Sewerage System Regulation. 2. Interpretation The Municipality has no jurisdiction over the issuance of holding tank permits. The purpose of this Bylaw is to assist Interior Health to ensure those who are issued a Holding Tank Permit within the District of Barriere, maintain and use their tanks in accordance with their Interior Health permit. 3. Requirements i. Should it be reported that the tank is in noncompliance and the owner cannot be contacted, or does not rectify the noncompliance in an expedient manner, the District has the right to contract the work required to rectify the noncompliance and charge any associated costs to the property owner's utility billing. ii. It will be mandatory to connect to the Municipal Wastewater system once available. 4. This Bylaw may be cited as "Wastewater Holding Tank Bylaw No. 94".
