## VILLAGE OF BELCARRA Firearms Control Bylaw Bylaw No. 498, 2016

A bylaw to regulate and prohibit the discharge of firearms
WHEREAS Council may, by bylaw, regulate and prohibit the discharge of firearms;
NOW THEREFORE the Council Village of Belcarra, in open meeting assembled, enacts as follows:
## Title
- This Bylaw may be cited as the "Village of Belcarra Firearms Control Bylaw No. 498, 2016".
## Definitions
2. In this Bylaw:
- a. "enforcement officer" means a person autorized to enforce this Bylaw.
- b. "firearm" means a barrelled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes any frame or receiver of such a barrelled weapon and anything that can be adapted for use as a firearm.
- c. "bow" means a bow as defined in the Wildlife Act.
## Prohibition
3. No person shall fire or discharge, or permit to be fired or discharged, any firearm within the Village of Belcarra.
2. No person shall fire or discharge, permit to be fired or discharged, a bow within the Village of Belcarra.
## Exemptions
- Section 3 does not apply to a person who is:
- a) a peace officer;
- b) an officer under the Wildlife Act;
- a fishery officer under the Fisheries Act; or,
- otherwise authorized by a provincial or federal enactment to possess and discharge firearms in the course of his or her duties, and who is engaged in, and acting in only accordance with, the lawful performance of his or her duties.
## Enforcement
- e) This Bylaw may be enforced by any police officer of the Royal Canadian Mounted Police or any other Peace Officer with jurisdiction in British Columbia.
- f) No person shall obstruct, or attempt to obstruct, an enforcement officer in the administration or enforcement of this Bylaw.
- g) Every person who contravenes a provision of this Bylaw commits an offense, and each contravention constitutes a separate offence.
4. Any person guilty of an offense under this Bylaw is liable on summary conviction to a fine of not less than five hundred dollars ($500.00) and not more than five thousand dollars ($5,000.00).
## Repeal
- i) Village of Belcarra Firearms Control Bylaw, 186, No. 98 is repealed.
