Consolidated February 23, 2023 CONSOLIDATED FOR CONVENIENCE PURPOSES ONLY OF BYLAWS 3474, 3528, 3704, 3723, 3701, 3852, 3887 CITY OF CAMPBELL RIVER PROVINCE OF BRITISH COLUMBIA BYLAW NO. 3296 Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 1 of 18 A BYLAW TO AUTHORIZE THE ISSUANCE OF BUSINESS LICENCES AND TO REGULATE BUSINESS WITHIN THE BOUNDARIES OF THE CITY OF CAMPBELL RIVER IN THE PROVINCE OF BRITISH COLUMBIA. The Council of the City of Campbell River, in open meeting assembled, enacts as follows: This Bylaw may be cited for all purposes as "Business Licence Bylaw No. 3296, 2007". DIVISION 1 Definitions In this Bylaw and in any regulations passed pursuant to this Bylaw, unless the context otherwise requires, the following words or terms shall have the meaning assigned to them herein. Amd Bylaw 3528 Nov/13, Amd Bylaw 3704 Oct/18, Amd Bylaw 3723 Dec/18, Amd Bylaw 3887 Feb "Agent" includes a person who sells or offers for sale, solicits business, or takes orders on behalf of any person not doing business within the City. "Auctioneer" means any person licenced as such for the purpose of conducting auction sales. "Building Rentals" (i) Apartment Houses: includes any building or portion of any building containing four (4) or more rental units (not being a lodging house, hotel or motel as defined herein) designed, used or occupied as independent dwelling units, provided that the sharing of utilities, laundry facilities, parking and/or storage facilities shall not be deemed to affect the independence of dwelling units, and also includes a person who offers more than four (4) rental units held by him as a member of a strata corporation. (ii) Hotel-Motel: includes any building other than apartments or lodging houses as defined herein comprising four (4) or more sleeping or rental units intended or designed to be temporarily occupied by tourists or transients. (iii) Lodging Houses: includes boarding and rooming houses and any building or part thereof whether completely or partially furnished, used or designed for the purpose of accommodating for consideration boarders or lodgers, but does not include apartments houses, hotels, and motels as defined herein, nor the accommodating of not more than two (2) boarders or lodgers. "Building Inspector" means the person so appointed from time to time by Bylaw or resolution of Council and shall include any Acting or Assistant Building Inspector. "Business" means the carrying on of a commercial or industrial undertaking of any kind or nature or providing of Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 2 of 18 professional, personal, or other services for the purpose of gain or profit, but does not include an activity carried on by the government, its agencies or government owned corporations. "Cannabis Retail Store" means an establishment for the retail sale of cannabis permitted under license issued by the Province of British Columbia as a cannabis retail store. "Carrying on Business" without restricting the generality of the term shall include any person who advertises himself as carrying on business of any kind or nature, or who deals in or buys, sells, barters or displays, or offers by advertisement or otherwise, to buy, sell or barter commodities or other things of any kind, either on behalf of himself or of any other person, or who advertises himself as open to render professional or other services to any other person, or who provides professional or other services to any other person. "City" means the City of Campbell River. "Door-to-Door includes the carrying on of business by the display or and Direct Sales" demonstration of samples, the taking of orders, or the offering for sale of goods, wares or other merchandise directly to or from the public, either on highways or in any other public place, in commercial premises or in private premises occupied by the prospective purchaser. "Family & Group means a facility as defined in the Community Care Daycare" Facilities Act but does not include the provision of daycare to fewer than three (3) children not ordinarily resident in the family home. "Food Truck" means a food service business contained within any mobile food preparation vehicle, whether self-propelled or attached as, or transported by, a trailer, including kiosks or carts in which foods or non-alcoholic beverages are processed, prepared, stored, and dispensed to the consumer. "Home Based Business" means the carrying on of a business within the dwelling unit in a residential zone or in an accessory building as per Section 16.8 of the Zoning Bylaw. "Inter-Municipal Business" means a Business that performs a service or activity within more than one Participating Municipality by moving from client to client rather than having clients come to them. This includes but is not limited to trades, plumbers, electricians, cleaning services, pest control or other similar businesses. This does not include fruit stands, flea markets, trade shows or other similar businesses. "Inter-Municipal Business means a business licence which authorizes Inter-Municipal Licence" Business to be carried on within the boundaries of any or all of the Participating Municipalities in accordance with this Inter-Municipal Business Licence Bylaw 3523, 2013 and will be in addition to a Municipal Business Licence. Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 3 of 18 "Licence Inspector" means the person appointed as Licence Inspector by the Council of the City of Campbell River to administer and enforce the provisions of this Bylaw. "Liquor Licenced means an establishment where a full range of liquor Establishment" products are sold for consumption on the premised and also shall include any establishment where retail liquor sales are conducted. "Medical Health Officer" means the Medical Health Officer duly appointed from time to time for the Municipality and includes any Acting or Assistant Medical Health Officer. "Municipal Business means a licence or permit, other than an Inter-Municipal Licence" Business Licence, issued by a Participating Municipality that authorizes a Business to be carried on within the jurisdictional boundaries of that Participating Municipality. "Mobile Vendor" means a mobile business, other than a food truck, whether self-propelled or attached, or transported on, a trailer in which goods, wares, merchandise, or services are offered for sale to a consumer. "Participating Municipality" means the following local governments that have adopted an Inter-Municipal Business Licence Bylaw: City of Campbell River City of Courtenay City of Duncan City of Nanaimo City of Parksville City of Port Alberni District of North Cowichan District of Lantzville Town of Comox Town of Lake Cowichan Town of Ladysmith Town of Qualicum Beach Village of Cumberland "Person" in addition to its usual connotation, shall include a firm or partnership, association, company, society, body corporate and the singular shall mean and include the plural, masculine and feminine and converse. "Premises" includes a store, office, warehouse, factory, building, house, enclosure, yard or other place occupied, or capable of being occupied by any person for the purpose of any business, trade or occupation and shall also mean any area situated within any of the foregoing, where more than one separate and/or distinct class or classification of business is being carried on. Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 4 of 18 "Principal Municipality" means the Participating Municipality where a Business is physically located, or has a Premise, or, where the licencee does not maintain a Premise in any of the Participating Municipalities, the municipality that issues the Inter- Municipal Business Licence. "Professional Business" shall include the carrying on of a business of a personal service to the public that requires, as a condition precedent to carrying on the service, a licence or other statutory authorization with the exception of persons who require supervision. "Professional Fundraiser" means a person who directly or by use of agents, solicits donations for any purpose whether out-right, or in exchange for anything, where the overhead or administrative costs of the solicitations inclusive of all expenses, exceed 10%. "Second Hand Dealers" shall include junk dealers and operators of second hand stores, junk stores, junk yards, pawn shops and consignment shops. "Senior Police Officer" means a member of the R.C.M. Police stationed in the City of Campbell River and who is in charge of such police detachment. "Social Escort" means any person who, for a fee or other form of payment, escorts or accompanies another person, but does not mean a person providing assistance to another person because of that person's age or disability. "Escort/Dating Service" means any person carrying on a business of furnishing escorts or partners for social occasions. "Street Entertainers" means any person who entertains in a designated area as defined by the City. Shall include Acoustic Musicians, Actors, Mime's, Clowns, Jugglers and Visual Artists. DIVISION 2 General Regulations Amd Bylaw 3528 Nov/13 Sec. 2.1 (1), (2), (3) and 2.4 2.1 (1) No person shall carry on business within the City without first having obtained and paid for a Municipal Business Licence or an Inter-Municipal Business Licence, provided that this provision shall not apply to any business exempted from the requirement to hold a business licence by operation of any Provincial or Federal Statute or Regulation. (2) This Bylaw shall pertain to obtaining a Municipal Business Licence. (3) The Inter-municipal Business Licence Bylaw No. 3523, 2013 shall pertain to obtaining an Inter-Municipal Business Licence. 2.2 Notwithstanding Section 2.1, no licence fee is required with respect to any performance, concert, exhibition or entertainment, the entire proceeds of which, above actual bona fide expenses, are devoted to any charitable purpose. 2.3 Except as may be specifically provided herein, any person carrying on more than one business shall obtain and pay for a separate business licence for each and every such business. 2.4 The fees payable for a Municipal Business Licence are prescribed in Division 5. Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 5 of 18 2.5 (1) Every licence granted pursuant to this Bylaw shall state that the holder is licenced to carry on the business stipulated therein in a lawful manner for the period specified at the place therein stated. (2) Any person who carries on more than one business in or from any one premises shall obtain a separate licence for each business. (3) For the purpose of this Bylaw, where a business is carried on, in or from more than one premises in the City, the business carried on, from or in each premises, shall be deemed a separate and distinct business. (4) The licence holder or person in charge or control of premises wherein the business is carried on or practiced, shall at all times keep the licence or licences prominently displayed in the sales or reception area of the premises to which the public has access, or an area designated by the Licence Inspector. (5) Every holder of a licence shall notify the Licence Inspector of any change in the mailing and/or the business address, the classification of the business, or any alteration to the premises in which the business is carried out, and upon the termination of the carrying on of the business by the licence holder, he shall notify the Licence Inspector that the licence is no longer required. 2.6 (1) Every person applying for a licence shall complete the forms supplied by the City for such purpose, and shall tender the prescribed licence fee as set out herein with such application. (2) No licence shall be issued until the prescribed fee has been paid to the City. 2.7 (1) Except as hereinafter provided, licences shall be granted for a one-year period or a six month period, to commence on the date of issue. No licence fee paid hereunder shall be refundable. Licence renewal payments that are 30 days or more overdue will be subject to a $25 late payment charge. (2) The period for a licence with respect to a circus, horse show, dog show, pony show or exhibition, or other itinerant show or entertainment, elsewhere than in a licenced theatre or licenced place shall be for one (1) day. 2.8 (1) The licence so granted shall be deemed a personal licence to the licencee therein named. (2) In the event of a sale of a business for which a licence has been issued, the Purchaser shall be required to pay a transfer fee of $20.00 upon application. Such application to transfer must comply with the requirements of the Bylaws of the City regulating buildings, zoning, health, sanitation and business. 2.9 (1) The Licence Inspector may grant a licence where he is satisfied that the applicant therefore has complied with the requirements of the bylaws of the City regulating building, zoning, health, sanitation and business and may suspend for such period as he may determine any licence if the holder of the Licence: (i) is convicted of an offence indictable in Canada; (ii) is convicted of any offence under any Municipal Bylaw or Statute of the Province in respect of the business for which he is licenced or with respect to the premises named in his licence; (iii) has, in the opinion of the Official, been guilty of such gross misconduct in respect of the business or in or with respect to the premises named in his licence that it warrants the suspension of his licence; (iv) has ceased to meet the lawful requirements to carry on the business for which he is licenced or with respect to the premises named in the licence; Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 6 of 18 (v) has, in the opinion of the Official, conducted his business in a manner, performed a service in a manner, or sold, offered for sale, displayed for sale or distributed to a person actually or apparently under the age of 16 years any thing, that may be harmful or dangerous to the health or safety of a person actually or apparently under the age of 16 years. (2) The suspension of a licence by the Licence Inspector shall be made, in writing, signed by the Inspector and served on the person holding such licence or delivered to the holder of such licence by registered mail to the address given by the Licencee on the application for the licence. A notice of suspension of licence may be posted by the Licence Inspector upon the premises for which the licence was issued and such notice shall not be removed until the licence is reinstated, the former Licencee ceases to occupy the premises, or a new business other that the one carried on by the former Licencee is started in the premises. The Licencee must surrender the licence to the Licence Inspector upon a suspension being ordered. A licencee or applicant who has had their business licence suspended or not granted may apply to have Council reconsider the matter. (3) Council may revoke a licence for reasonable cause after giving notice to the Licencee and after giving him an opportunity to be heard. 2.10 (1) All premises in or upon which the applicant proposes to carry on any business, shall be approved by the City Building Inspector before a business licence is granted. (2) The applicant shall, upon request by the City Building or Licence Inspector, produce certification or letters of approval, as may be required by Federal, Provincial or local government authorities. (3) An applicant whose business is governed by Federal or Provincial Acts or Regulations shall, upon request, supply proof to the Licence Inspector of his or his employees' qualifications under those Acts or Regulations. (4) When the issuance of a licence requires insurance coverage, proof of that insurance coverage in a form acceptable to the Licence Inspector of the City shall be submitted prior to the issuance of the Licence. DIVISION 3 Regulations of Business 3.1 (1) All General Contractors shall supply a list to the Licence Inspector or Building Inspector or post a list of all sub-trades employed by them on the building site in a conspicuous place where construction is being carried on. (2) All General Contractor's shall use only sub-contractors who have a valid business licence with the City of Campbell River. 3.2 The Door to Door or Direct Salesperson when conducting or attempting to conduct business must: (i) advise the customer the full legal name consisting of all personal names, surname and the name of the business or other organization with whom the salesperson is associated, affiliated or representing. (ii) display a clearly visible identification card on which is printed, the salespersons' legal name and business affiliation. (iii) display a copy of the business licence issued hereunder. Amd Bylaw 3701 Feb/19 Sec. 3.3(i) added, Amd Bylaw 3887 Feb/23 Sec. 3.3(2) and 3.3(3) amended 3.3 (1) The driver of a vehicle used as a mobile vendor shall not park or stop more than is necessary to serve customers, and at no time shall the vehicle remain stopped or parked for longer than fifteen (15) minutes at one specific location unless in Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 7 of 18 receipt of a permit issued by the City for this purpose. When stopped for the serving of customers, the vehicle shall be legally parked at the street curb or pulled off the road or highway so as not to impede traffic. (i) A Mobile Vendor permit issued under part 3.3(1) above may, without limitation, contain restrictions or requirements, or both, on: a) The public locations in which a vendor may operate; b) Hours of operation; c) Duration of operation; d) Associated anciallary activities, including furniture, singage, advertising and facilities for garbage/recycling: e) Noise, pest and odor control; f) Size and type of vehicle used for mobile vending (2) A valid City-issued Food Truck permit must be obtained and maintained for each food truck unit operating in Campbell River. When stopped for serving customers, the vehicle shall be legally parked at the street curb or pulled off the road or highway so as not to impede traffic. (i) Provided that they are in possession of a permit issued by the City for this purpose, food trucks may operate in the following public locations: - Spirit Square - Rotary Park - Ken Forde Park - The Parking Lot at the base of Rockland Road - The Maritime Heritage Parking Lot - The boat launch overflow gravel parking lot (ii) Provided that they are in possession of a permit issued by the City, food trucks may operate between the hours of 7 a.m. and 10 p.m. from Monday to Saturday and between the hours of 8 a.m. and 10 p.m. on any Sunday and statutory holiday. (iii) The owner or operator of a food truck or mobile food vending business must provide proof that is satisfactory to the City that they have obtained the following permissions or met the following regulations: (iv) Approval from Island Health (v) Proof of Motor vehicle Insurance for food trucks and trailers (vi) Proof of Liability Insurance coverage with a minimum liability coverage of $3,000,000. (vii) Food truck owners or operators are required to use generators with silencing boxes if the locations at which they are operating do not have access to power. Food trucks must have their own water sources. (viii) Food trucks shall be operated such that they maintain clearance on all sides of the unit for pedestrians to pass safely and easily, and such that they do not interfere with or obstruct adjacent properties, access by emergency services, City services or sanitation vehicles. Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 8 of 18 (ix) A Food Truck Permit issued under part 3.3(2) may, without limitation, contain restrictions or requirements, or both, on: a) Associated ancillary activities, including furniture, signage, advertising and facilities for garbage/recycling b) Noise, pest and odor control . (3) Where mobile vendors and food trucks are permitted, the owner or operator shall keep the mobile vendor or food truck space and surrounding area clean and clear of all waste, discarded debris and food stains. 3.4 (1) Every person carrying on a business of or operating a Private Patrol Agency shall supply the Senior Police Officer of the R.C.M. Police, Campbell River Detachment with the name, address, age and description of all persons employed by him and shall inform him when such persons leave the employ of the Private Patrol Agency. In the event that automobiles are used by employees of a Private Agency, the licence number of those vehicles shall also be supplied. (2) All persons carrying on the business of or operating a Private Patrol Agency shall file with the Senior Police Officer of the R.C.M. Police, Campbell River Detachment, a list of the owners or occupants of all premises which he has agreed to guard or patrol and shall furnish a supplementary report each month of any addition to or deletions from any list. 3.5 No person or religious or charitable business shall use any highway or portion thereof for the purpose of soliciting aid unless they have obtained from the City a permit for the privilege of using such highway. Such permit shall specify the dates and hours during which such soliciting may be carried out. 3.6 (1) An applicant for a Taxicab or Limousine Licence shall produce to the Licence Inspector proof that a permit or licence has been or will be issued to the applicant by the Provincial Authority having jurisdiction. (2) Every applicant for a taxicab or limousine licence shall furnish proof in his application that he has sufficient off-street parking facilities to accommodate all of his taxicabs or limousines not in use. (3) No Licencee shall employ, engage or permit any person to operate or drive any taxicab or limousine unless such person holds a valid and subsisting Chauffeur's Licence issued under the provisions of the Motor Vehicle Act of the Province of British Columbia and a permit issued by the Senior Police Officer of the City of Campbell River under Chauffeur's Permit Bylaw No. 2742, 1999. (4) Every Licencee operating a taxi or limousine business from a residential area shall be permitted to park only one taxi or limousine at the said residential site. 3.7 (1) All persons carrying on the business of operating tow trucks or maintaining compounds for the storage of vehicles towed to those compounds by tow trucks shall, in each twenty-four (24) hour period, report to the Senior Police Officer of the R.C.M. Police, Campbell River Detachment and provide a list containing the following information: (i) the licence number, vehicle identification number, make, model, colour and year of every vehicle towed by that tow truck during the twenty-four (24) hour period; (ii) the place of origin of the tow; and (iii) the destination of the tow. Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 9 of 18 (2) All persons operating as a business a compound for the storage of towed vehicles shall, in each twenty-four (24) hour period, report to the Senior Police Officer of the R.C.M. Police, Campbell River Detachment: (i) the licence number or vehicle identification number, make, model, colour and year of every vehicle towed to that compound; and (ii) the towing company that towed the vehicle to the compound. (3) No driver of any tow truck: (i) who has been requested to tow a vehicle from the scene of an accident shall solicit or suggest a specific destination for the motor vehicle being towed; (ii) Shall offer his services at the scene of a motor vehicle accident whether his presence there is by coincidence or otherwise, unless he has been requested to do so by the owner or driver of the motor vehicle involved in that accident, or by an attending Peace Officer including Bylaw Enforcement Officers and members of the Royal Canadian Mounted Police. 3.8 All persons carrying on the business of motor vehicle repair or auto body and paint shop and motor vehicle wrecking for the purpose of restoration shall be restricted to two wrecked or non-operating vehicles stored on the site. Under no circumstances shall such a business offer for sale parts from said vehicles. 3.9 All persons carrying on the business as a Social Escort or operating a Social Escort Service shall: (i) operate said business from a staffed commercial premise; (ii) supply the Licence Inspector and R.C.M. Police with the name, age, address, and general description of every person proposed to be employed or engaged int he said business together with such additional information as the Licence Inspector may require; and (iii) notify the Licence Inspector and R.C.M. Police within 40 hours of any change in the personnel employed in the said business. Amd Bylaw 3704 Oct/18 section 3.10 added, Amd Bylaw 3723 Dec/18 section 3.10 replaced 3.10 All persons carrying on a business of Cannabis Retail Store shall: (i) ensure the transparency of store fronts and views into the store from the street; (ii) must not display items for sale within direct view from the street; (iii) may only have one sign per premise; (iv) supply the Licence Inspector with proof of a monitored alarm system; (v) supply the Licence Inspector with proof of 24/7 video surveillance systems; (vi) supply the Licence inspector with a CPTED review of the premises; (vii) supply the Licence Inspector and RCMP with the name, age, address, criminal records check and general description of every person proposed to be employed or engaged in the said business together with such additional information as the Licence Inspector may require; (viii) notify the Licence Inspector and RCMP within two business days of any change in the personnel employed in the said business. DIVISION 4 Duties and Administration Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 10 of 18 4.1 (1) The Council may, by resolution, appoint a person to be the Licence Inspector whose duty it shall be to carry out and administer the provisions of this Bylaw. (2) The Council may, by resolution from time to time, designate a person or persons as Assistant Licence Inspector to assist with the enforcement and administration of this Bylaw. 4.2 The Assistant Licence Inspector shall, in the absence of the Licence Inspector, have all of the powers and responsibilities of the Licence Inspector. 4.3 The Licence Inspector and Assistant Licence Inspector are hereby authorized and empowered to enter upon any property, between the hours of 8:00 a.m. to 9:00 p.m. Monday to Sunday, in order to ascertain whether the provisions of this Bylaw are being obeyed. DIVISION 5 Fees 5.1 The business classifications set out in this Division are deemed to be separate and distinct, and each business shall obtain a licence and pay the prescribed fees for each business classification. 5.2 The fees payable under this Division shall be those prescribed in Schedule "A", attached hereto and forming part of this Bylaw notwithstanding Section 2.3, 2.5(2) and 5.1 a person carrying on more than one business from the same premises shall pay the prescribed fee for the first business only. A six month licence shall be one-half of a yearly licence. DIVISION 6 Offences - Penalty 6.1 Any person who: (i) carries on a business for which a licence is required pursuant to this Bylaw without holding a valid and subsisting licence for the business, or (ii) tenders a cheque or other negotiable instrument in full or partial payment of any licence fee payable hereunder, if such cheque or negotiable instrument is dishonored upon presentation for payment, or (iii) fails to display a valid and subsisting licence as required by the provisions of this Bylaw, or (iv) fails to furnish any information or documentation as required by the provisions of this Bylaw, or (v) carries on or remains open for business after receiving notice that his licence has been suspended or revoked, or (vi) is governed by any regulation under the provisions of this Bylaw who fails to comply with these regulations, or (vii) violates or does any act or thing which violates any provision of this Bylaw, or (viii) suffers or permits any act or thing to be done in violation or contravention of any of the provisions of this Bylaw, or (ix) neglects or refrains from doing anything required to be done by any of the provisions of this Bylaw; commits an offence. Amd Bylaw 3474 Mar/12, Amd bylaw 3852 Mar/22 6.2 (1) Every person who: (a) violates or who causes or allows any of the provisions of this bylaw to be Business Licence Bylaw No. 3296, 2007 consolidated to Bylaw 3887, 2023 Page 11 of 18 violated; (b) fails to comply with any of the provisions of this bylaw; (c) neglects or refrains from doing anything required under this bylaw; or (d) who suffers or permits any act or thing to be done in contravention of any of the provisions of this bylaw; is deemed to have committed an infraction of, or an offence against, this bylaw and is liable on summary conviction to a fine not less than $5,000 and a maximum of $50,000, or to imprisonment for not more than six months, or to both. For continuing offences, each day that such violation is caused, or allowed to continue, constitutes a separate offence. (2) Where conviction is for failure to obtain and pay the prescribed licence fees required, then the amount which should have been paid for such licence fee shall be added to the said penalty and shall form part of this penalty. 7. This Bylaw shall come into full force and effect on the 30th day of April, 2007. 8. The Mayor and Clerk are hereby empowered to do all things necessary to give effect to this Bylaw. 9. Bylaw No. 2100 as amended, being "Business Licence Bylaw No. 2100, 1992" of the City of Campbell River, is hereby repealed. Read a first time on the 10th day of April , 2007 .
