A Bylaw to authorize the imposition of fees and charges and the letting of
leases at the West Kootenay Regional Airport.
WHEREAS, pursuant to Section 194(1) of the Community Charter, Council may, by bylaw, impose a fee
payable in respect of all or part of a service of the municipality,
NOW THEREFORE, the Council of the City of Castlegar, in open meeting assembled, enacts as follows:
1.
This Bylaw may be cited for all purposes as West Kootenay Regional Airport Fees Bylaw 1384,
2022.
2.
For the purposes of this Bylaw the Airport Manager shall mean the person appointed as such
by the Council of the City and any person delegated to assist him in carrying out his duties
under this Bylaw.
3.
The fees for use of the West Kootenay Regional Airport terminal building or West Kootenay
Regional Airport property shall be shown on Schedule "A" which is attached to and forms part
of this Bylaw.
4.
The West Kootenay Regional Airport Parking Enforcement shall be Schedule "B" which is
attached to and forms part of this Bylaw.
5.
The agreement for Air Carrier Use shall be Schedule "C" which is attached to and forms part of
this Bylaw.
6.
This Bylaw shall come into full force and take effect and be binding on all persons as and from
June 4, 2022.
Repeal
Castlegar Airport Fees Bylaw No. 789, 1996 and all amendments there to is hereby repealed.

3.2
Long-Term Parking
Long-term parking must be arranged through the Airport Manager's office.

AIRPORT PASSENGER FACILITY FEE
Each departing enplaned passenger (DEPAX passenger) shall be required to pay a Passenger
Facility Fee (PFF) in the amount of $25.00, not including GST. The PFF will be applied under
the terms and conditions of the Memorandum of Agreement between the Air Transport
Association of Canada and Signatory Air Carriers and West Kootenay Regional Airport.

AFTER HOURS SERVICES
5.1
Security Services
The charges for security services provided outside the airport's normal published
operating hours are as follows:
First two hours:

LAND LEASE RATES AND TENANT RENTAL & LICENCING FEES
Lease rates and tenant rental fees shall be established by an appraisal of current market value
as determined by the Airport Manager for the initial year of the term, plus annual
increases thereafter at a negotiated rate. Land lease and tenant rental fees shall be charged,
but not limited to the following:

- Airport Groundside Leases
- Airport Ramp Handling & De-icing License
- Airport Maintenance Fees
- Airside Ground Lease

SCHEDULE "B"
WEST KOOTENAY REGIONAL AIRPORT PARKING ENFORCEMENT
1.
PARKING REGULATIONS
1.1.
No person shall park a motor vehicle in any area designated by a sign or signs as an area
in which parking is prohibited, reserved, or restricted.
1.2.
No person shall, without the written permission of the Airport Manager or a Parking
Attendant, park a motor vehicle on any portion of the West Kootenay Regional Airport
that is not intended for the use of motor vehicles or in any place designated by a sign or
signs as a loading area.
1.3.
Where an area is designated by a sign or signs as an area in which parking is reserved
for rental motor vehicles, no person shall park a motor vehicle in that area unless it is a
rental motor vehicle owned or controlled by a rental agency authorized by Council to
carry on business at the West Kootenay Regional Airport.
1.4.
Where an area is designated by a sign or signs as an area in which parking is permitted
for a time, no person shall park a motor vehicle in that area for any greater period of
time than that indicated on the sign or signs.
1.5.
Subject to Section 1.6 of this Bylaw, where an area is designated by a sign or signs as an
area in which parking is permitted in parking spaces, no person shall park in that area
except within a parking space.
1.6.
When a motor vehicle is too large for one (1) parking space, the parking fee for that
motor vehicle will be calculated by multiplying the number of parking spaces wholly or
partially occupied by that motor vehicle by the parking fee for one (1) space.
1.7.
No person shall cause, suffer, or permit any motor vehicle to be parked adjacent to a
curb painted yellow.
1.8.
No person shall cause, suffer, or permit any motor vehicle to be parked at a place where
a sign or signs indicate that parallel parking is permitted, unless the curb-side wheels
are within twelve (12) inches of the curb.
1.9.
No person shall cause, suffer, or permit any motor vehicle to be parked on or over a
crosswalk.
1.10.
No person shall cause, suffer, or permit any motor vehicle to be parked within 5.0 m of
a fire hydrant measured from a point on the curb or edge of the roadway which is
closest to the fire hydrant.
1.11.
No person shall:
1.11.1. make a false statement in an application for a Parking Permit [for people with
disabilities];

1.11.2. stop, leave standing or park in a disabled zone a motor vehicle displaying a permit
unless the motor vehicle is stopped, left standing or parked for the purpose of
transporting a disabled person;
1.11.3. mutilate, deface, or alter a permit;
1.11.4. stop, leave standing or park in a disabled zone, a motor vehicle that does not
display either a permit issued by the Social Planning and Review Council of British
Columbia (S.P.A.R.C.) or a permit of similar nature issued by another jurisdiction;
or
1.11.5. lend or transfer a permit to another person, whether or not that person is
disabled.
2.
PARKING VIOLATIONS
2.1.
Every person that operates a motor vehicle and that permits such vehicle to be, or
remain, in a parking space without payment of the appropriate parking fees processed
through the Ticket Dispenser or the Parking System outlined in Section 4 of this Bylaw ,
shall be deemed to be overparked and in violation of the Bylaw and shall be in violation
of this Bylaw for every hour or fraction thereof they permit such vehicle to be, or remain,
in such parking space including the first hour.
2.2.
Any motor vehicle parked contrary to the provisions of this Bylaw may be removed by
any person designated by the Airport Manager or by any person contracted to do so
under the authority of the Airport Manager or a Parking Attendant and may be
impounded in a garage or storage place contracted by the Airport Manager or a Parking
Attendant, there to be kept at the expense and risk of the owner of the motor vehicle.
2.3.
A motor vehicle will be detained or impounded until the owner thereof shall have paid
to the contractor all fees for impoundment including charges for storage. The said
payment shall be in addition to any penalties imposed by Section 5 of this Bylaw.
3.
RESPONSIBILITY OF OWNER OR OPERATOR
3.1.
The owner or operator of a motor vehicle shall incur the penalties provided for in
violation of this Bylaw with respect to any motor vehicle owned or operated by them
unless at the time of such violation the motor vehicle was in possession of some person
other than the owner or operator without the consent of the owner or operator; but
nothing in this Section shall relieve a person in possession of the motor vehicle, not
being the owner or operator, from incurring the penalties provided for such violation.
3.2.
The onus of establishing that the motor vehicle was in possession of some person other
than the owner rests with the owner.
4.
FEES AND CHARGES
4.1.
The motor vehicle parking fees outlined in Section 4.2, shall be prepaid to the West
Kootenay Regional Airport.

4.2.
West Kootenay Regional Airport Motor Vehicle Parking Fees (Includes GST).
5.
PENALTIES
5.1.
Any person who:
5.1.1.
contravenes any provision of this Bylaw;
5.1.2. suffers or permits any act to be done in contravention of this Bylaw; or
5.1.3. neglects to do anything required to be done under this Bylaw, commits an
offence and each day that the contravention continues shall constitute a separate
offence.
5.2.
A person who is guilty of an offence under this Bylaw is liable:
5.2.1. to pay a fine up to $10,000 if proceedings are brought under the Offence Act and
the costs of prosecution; and
5.2.2. compensation for damage or loss sustained by the City or another person
resulting from the offence; or
5.2.3. to pay a fine of up to $1,000 if the Bylaw is enforced by means of a municipal
ticket information system under Division 3 of the Community Charter.
