TITLE - 1.1. This Bylaw shall be cited as the "Central Saanich Traffic and Highways Regulation Bylaw No. 2241, 2026". ## PART 2 - APPLICATION, INTERPRETATION, DEFINITIONS - 2.1 The provisions of this Bylaw in relation to drivers of vehicles also apply to all of the following: ## 2. APPLICATION - a. persons riding a bicycle or an animal; - b. persons driving an animal drawn vehicle. - a. persons, vehicles or other equipment while lawfully engaged in highway or public utility construction, maintenance or repair work on, over or under the surface of a highway; 4. 2.2 The provisions of this Bylaw do not apply to any of the following: - b. the driver of an emergency vehicle that is: - i. responding to an emergency call, - ii. sounding an emergency siren (audible siren, signal bell or exhaust whistle), and - iii. showing an emergency light (flashing red or blue light); - c. the driver of an emergency vehicle that is: - i. at the scene of an emergency, and - ii. showing an emergency light (flashing red or blue light); - d. a police officer who is in the immediate pursuit of an actual or suspected violator of the law; - e. a police officer who is engaged in a police duty of a nature that the sounding of a siren or other audible signal would unduly hamper the performance of that duty. 14. 2.3 This Bylaw does not apply to the regulation, control or prohibition of traffic on Ministry ## THE CORPORATION OF THE DISTRICT OF CENTRAL SAANICH ## BYLAW NO. 2241, 2026 A bylaw to regulate highways, traffic, and the use of municipal property within the District of Central Saanich (Streets and Traffic Bylaw). The Council of the District of Central Saanich enacts as follows: ## PART 1 - TITLE of Transportation arterial highway. - 2.4 Where anything in this section conflicts with B.C. Reg. 133/98, the Emergency Vehicle Driving Regulation under the Motor Vehicle Act (the "Regulation", the Regulation prevails. ## 3. INTERPRETATION - 3.1 Words or phrases defined in the Community Charter, the Local Government Act, the Motor Vehicle Act, the Transportation of Dangerous Goods Act, the Commercial Transport Act, and the regulations thereto, have the same meaning in this bylaw unless otherwise defined in this bylaw. - 3.2 Where a paragraph, sentence, or graphic in this bylaw is written in italics and is preceded by the words "Information Notes", the contents of the paragraph, sentence, or graphic are provided only to assist in the understanding of the bylaw and do not form a part of it. ## 4. DEFINITIONS - 4.1 In this Bylaw: "Angle parking" | | means the parking of a vehicle other than parallel to a curb or lateral lines of the roadway. | |-----------------------------|----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Arterial highway" | has the same meaning as in the Transportation Act. | | "Accessible Parking Permit" | means a parking permit issued to a person with a disability pursuant to this bylaw and the Regulations. | | "Accessible Parking Space" | means a parking space set aside for the exclusive use of Persons with a Disability using a vehicle displaying an Accessible Parking Permit. | | "Bicycle" | means a device having any number of wheels that is propelled by human power and on which a person may ride and includes a motor assisted cycle, but does not include a skateboard, roller skates or in-line roller skates. | | "Bicycle lane" | means a portion of a highway that has been designated by striping, signing (traffic control device) and/or pavement markings for the preferential or exclusive use of bicycles. | | "Boulevard" | means that part of any highway, other than a sidewalk or driveway, between the adjacent property line and the curb of the | | | roadway, or where there is no curb, the edge of the shoulder. | |-----------------------------|----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Bus" | means every vehicle for the carriage of passengers for hire, other than taxi-cab, rented automobile or rideshare. | | "Business district" | means any area in the district designated as a "Business District" in Schedule "B" attached to this bylaw. | | "Bylaw enforcement officer" | means a (1) bylaw enforcement officer as appointed by the District of Central Saanich Council and currently employed with the District, and (2)a member of the Central Saanich Police Service and *3 any other person employed by the District for the preservation and maintenance of public bylaws, including Commissionaires. | | "Chattel" | means any item of moveable personal property but does not include a vehicle. | | "Chief Constable" | means the Chief of the Central Saanich Police Service, or any other person as appointed by the Chief Constable. | | "Commercial Vehicle" | means a motor vehicle having a gross vehicle weight in excess of 5500 kg, an overall height in excess of 2.4 metres or an overall length exceeding 7 metres; and means buses that carry 10 or more passengers; and means taxis, limousines, and some other vehicles that require a Passenger Transportation license. | | "Construction vehicle" | means a type of heavy-duty machinery specifically designed to perform a wide range of tasks such as excavation, grading, and demolition. | | "Continuously parked" | means a vehicle that is parked without being moved to a substantially different parking location. | | "Council" | means the Municipal Council of the Corporation of the District of Central Saanich. | | "Crosswalk" | means: | - (a) a portion of the roadway at an intersection or elsewhere distinctly designated for pedestrian crossing by signs or by lines or other markings on the surface; - (b) the portion of a highway at an intersection that is included within the connection of the lateral lines of the sidewalks on the opposite sides of the highway, or within the extension of the lateral lines of the sidewalk on one side of the highway, measured from the curbs, or in the absence of curbs, from the edges of the roadway; or - (c) the portion of the roadway at an intersection or elsewhere that is designated for bicycle crossing by signs or elephant feet markings or other markings on the road surface. | "District" | means the District of Central Saanich. | |-------------------------------------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Emergency Vehicle" | means any vehicle of any municipal or other Fire or Police department, any licenced ambulance, and such vehicles as are designated as emergency vehicles by the Chief Constable under the Motor Vehicle Act. | | "Electric assist device" | means designed to be propelled primarily by human power, but is equipped with an electric motor that provides assistance to the user; and is not classified as a motor vehicle under provincial or federal law. | | "Electric Vehicle" | means a vehicle that uses electricity for propulsion, and that can use an external source of electricity to charge the vehicle's batteries. | | "Electric Vehicle Charging Station" | means an area of a highway or a Central Saanich Municipal Facility designated by traffic control device for the stopping and charging of Electric Vehicles. | | "Elephant feet markings" | means a series of white painted squares that delineate a crosswalk where cycling is permitted. | | "Engineer" | means the Municipal Engineer for the District as appointed by Council (as the title of that person may be changed from time to time), and includes their authorized designate. | | "Fire Chief" | means the person duly appointed as such from time to time by the Council, or their delegate. | |---------------------------|------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Garbage" | means waste, rubbish or discarded items. | | "Garbage collection bins" | means a container, typically plastic or metal, for private household refuse collection purposes | | | "(Public) garbage receptable" means any garbage receptable placed in a public place by the District. | | "Garden waste" | means any clippings, prunings, leaves or other parts of plants, shrubs or trees. | | "Government vehicle" | means a vehicle operated by the District, the Province of British Columbia or the Government of Canada. | | "Highway" | means every highway within the meaning of the Transportation Act and every road, street, lane or right of way designed or intended for or used by the general public for the passage of vehicles, but does not include a private right of way. | | "Household waste" | means waste generated in a residentially zoned dwelling unit. | | "Human powered device" | means any device designed to be propelled solely by human muscular effort, whether through pedaling, pushing, pulling, rowing, or similar means, and not equipped with any motor or engine of any type. | | "Landscaping" | Means lawns, plants, edibles, shrubs, mulch, and other features that may be planted, installed or otherwise established in a boulevard in accordance with this Bylaw, but does not include trees, rains gardens or native vegetation. | | "Loading zone" | means the area or space on a roadway established for the exclusive use of vehicles during the loading or unloading of materials or passengers for up to 15 minutes | | "Multi use pathway" | means a highway or portion thereof reserved for use by pedestrians, bicycle and other non-motorized conveyances, and designated as such by a traffic control device. | | "Off-street parking facility" | means any real property owned, leased, possessed or otherwise held by the District for the purpose of providing off-street parking and designated as an "Off-Street Parking Facility" in Schedule "A" attached to this bylaw. | |---------------------------------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Real property" | means all land owned by persons other than the District. | | "Recreational Vehicle" | means a portable self-contained structure capable of being a temporary accommodation for travel, vacation or recreational use. Such structures include motor homes, truck trailers, and tent trailers. | | "Red curb" | means a curb painted in red and regulated as a no parking zone and shall be considered a traffic control device. | | "Regulations" | means the regulations under the Motor Vehicle Act. | | "Residential area" | means any area zoned residential in the Zoning Bylaw in force in the District from time to time, and includes the highways abutting such zones and where the zone is different on the two sides of the highway, the dividing line shall be the centre of the highway. | | "Sight Triangle" | means a corner of a lot located between abutting streets and a line connecting points on the property lines abutting the lot, each located 6 metres from the point of intersection of said property lines. | Information Note: The following graphic represents sight triangle:  | "Street" | means a highway. | |--------------------------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Special Events" | includes (but is not limited to) activities like parades, marathons, cycling events, walkathons, running events, car shows, charity events, markets, fairs. | | "Tour Bus" | means a commercially licensed passenger bus having a gross vehicle weight in excess of 20,000 kilograms or a seating capacity of more than 20 passengers, used to transport groups of tourists to and from local points of interest, but does not include a public transit motor vehicle, a school bus, or a bus providing scheduled passenger transportation service between public bus terminals. | | "Tour Bus Route" | means a highway or portion of a highway or a series of connected highways designated as a "Tour Bus Route" in Schedule "C". | | "Traffic control device" | means a sign, signal, line, meter, marking, space, barrier or device placed or erected by the authority of the Ministry responsible for administration of the Transportation Act, the Council, the Municipal Engineer, the Chief Constable, or a person authorized by any of them to exercise that authority. | | "Traffic patrol" | means an adult school crossing guard or a school pupil acting as a member of a school patrol where such guards or pupils are provided under the Public Schools Act or authorized by the Central Saanich Police Service. | | "Trailer" | means a vehicle without motive power designed to be drawn by a motor vehicle. | | "Truck Route" | means a highway or portion of a highway or a series of connected highways designated as a "Truck Route" in Schedule "C". | | "Wheel-lock" | means any device which can be placed on a wheel of a motor vehicle to immobilize the vehicle. | | "White curb" | Means a curb painted in white and regulated as a loading zone and shall be considered a traffic control device | | "Unlicensed vehicle" | means a vehicle which does not have valid motor vehicle license insurance issued under the provisions of the Motor Vehicle Act 1996 RSBC c. 318 or the motor licensing provision of another jurisdiction | |------------------------|------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | "Vehicle" | means a device in, upon or by which a person or thing is or may be transported or drawn upon a street but does not include | | "Yellow curb" | means a curb painted in yellow and regulated as a no parking zone and shall be considered a traffic control device. | ## PART 3 - TRAFFIC REGULATIONS ## 5. TRAFFIC REGULATIONS - 5.1. The Chief Constable and Municipal Engineer are each authorized to issue orders for the placing of traffic control devices at such places as they deem appropriate for the regulation, control, or prohibition of traffic, for the purposes of giving effect to the provisions of the Motor Vehicle Act, and for the purposes of giving effect to this Bylaw, including but not limited to the provisions in section 5.2., and by those orders, to exercise the following powers of the District under this bylaw, or to give effect to the provisions of this bylaw or the Motor Vehicle Act. - 5.2. For the purpose of regulating the movement of traffic within the District of Central Saanich, each of the Chief Constable and the Municipal Engineer may by order : 1. BUS STOP - designate bus stops, at locations where a bus stops to pick up passengers 2. CONSTRUCTION - On highways where construction, reconstruction, widening, repair, marking or other work is being carried out, order the placement of traffic control devices to indicate that persons or equipment are working on the highway, or to regulate or prohibit traffic in the vicinity of such work 3. CROSSWALK - designate crosswalks , which shall be marked by distinctive lines or markers upon the street surfaces and where signs indicating such portions of streets are crosswalks shall be placed 4. DISABLED ZONES - establish zones for accessible parking 5. DO NOT ENTER ZONES - designate "do not enter" zones at the end of one-way roadways, to prevent traffic entering the restricted area 6. DO NOT PASS ZONES - designate "do not pass zones" at the beginning of areas through which restricted sight distance makes overtaking and passing hazardous 7. FIRE ZONE - designate areas to be fire zones, in which parking and stopping of vehicles - is prohibited 8. KEEP RIGHT AREAS- designate keep right areas within and at the end of median strips and traffic islands 9. LOADING ZONES - designate loading zones or the loading and unloading of passengers and chattels, and establish restrictions on their use zones 10. MAXIMUM SPEED - designate lower maximum speed zones than those specified on existing traffic signs at locations where, due to limitations of sight distances, road surfaces, traffic flows or frequency of intersections, speeds in excess of those prescribed on the signs constitute a hazard to traffic or may cause excessive damage to the road, and to place traffic control devices for that purpose. - -order the erection, maintenance and operation of automatic or other mechanical meters for allotting and controlling vehicle parking spaces 11. MAXIMUM WEIGHT - designate lower maximum load zones than those specified on existing signs at locations where, due to seasonal weakening of road surfaces, obsolescence of bridges or pavements, or roadway repairs, loads in excess of those prescribed on the signs constitute a hazard to traffic or may cause excessive damage to the road, and to place traffic control devises for that purpose. 12. NO PASSING ZONES - designate areas at locations approaching crosswalks, school and playground zones indicating that passing is prohibited 13. ONE WAY STREETS- designate zones on highways upon which the traffic is required to travel in one direction only 14. PEDESTRIANS - make orders regarding the regulation or prohibition of pedestrian traffic on highways other than at crosswalks - 15.PROCESSIONS - make orders regarding the regulation and control of processions on highways in the District - 16.PUBLIC BUILDINGS - designate areas for the setting apart and allotting of portions of highways adjacent to government buildings for the exclusive use of officials and officers engaged therein for the parking of vehicles, and the regulation of such parking - 18.SIDEWALKS, BRIDGES, LANES -make orders regarding the control or prohibit pedestrian traffic, ridden or herded animals, vehicular traffic, and cycle traffic on sidewalks, bridges, walkways or boulevards - 17.SCHOOL - designate school crossings in the District and the regulate and control vehicle and pedestrian traffic with respect to them - 19.SIGNS - make orders for the regulation, control and prohibition of the stopping, standing or parking of vehicles - 20.TAXI ZONES - establish and make orders of the use of taxi stands 21. TEMPORARY CLOSING OF STREETS - order that on any street where construction, reconstruction, widening, repair, marking or other work is being carried out, traffic control devices shall be erected or placed to regulate or prohibit traffic in the vicinity of such work and/or limit the rate of speed of vehicles. 22. TRUCK ROUTES - On highways designated as truck routes for movement of truck traffic through the District - 23.TRUCK SIGNS - make orders regarding locations where truck traffic is prohibited or restricted - 24.TURN PROHIBITION - make orders regarding intersections and areas in advance of intersections where turns are to be prohibited 25. WARNING - order the placement of traffic control devices to warn traffic of hazardous conditions, either on or adjacent to the roadway or - 26.NO TRAFFIC order the prohibition of to traffic from using the roadways due to hazardous conditions, either on or adjacent to the roadway. 27. WORK IN STREETS - Each of the Chief Constable and Municipal Engineer shall be empowered to direct that on any street where construction, re-construction, widening, repair, marking or other work is being carried out, traffic-control devices shall be erected or placed indicating that men or equipment are working upon the street ## PART 4 - TRAFFIC CONTROL DEVICES ## 6. TRAFFIC CONTROL DEVICES - 6.1. The Municipal Engineer or Chief Constable may place or order traffic control devices to be placed or installed as necessity requires within the Municipality. - 6.2. The Chief Constable or the Municipal Engineer may order to be placed for temporary periods not exceeding thirty (30) days at any one time, signs prohibiting parking or stopping and indicating restricted parking, or detours: - a. Upon either or both sides of any street or portion of street along the route of a parade or procession or in the vicinity of a large public gathering; - b. In any other location where under special circumstances he/she deems it necessary in the public interest to do so. - 6.3. The Chief Constable, the Fire Chief, the Municipal Engineer or any bylaw officer may place or cause to be placed temporary traffic control devices on a highway: - a. along the route of any parade; - b. in the vicinity of a large gathering or during special circumstances; - c. to permit proper action in an emergency; - d. to facilitate the clearing of snow, cleaning, repairing, excavating, decorating or other work upon a highway; - e. in the interest of public safety ## 7. HIGHWAY SIGNS - Where traffic control devices have been authorized and placed or erected under the provisions of the Motor Vehicle Act by the Province of British Columbia, the same shall be deemed to have been properly placed or erected pursuant to the provisions of this Part. ## 8. MOTOR VEHICLE ACT - 8.1. Traffic control devices erected pursuant to this part shall, where applicable, comply with the sign regulations as set out in the Motor Vehicle Act. ## PART 5 - PARKING, STOPPING, AND STANDING ## 9. PARKING, STOPPING, AND STANDING - 9.1. Except when necessary to comply with the directions of a bylaw enforcement officer, no person shall stop, stand or park a vehicle: 1. PARKING IN EXCESS OF 72 HOURS - on a highway at or within substantially the same location for a continuous period of seventy-two (72) hours 2. SLEEP OVERNIGHT IN A VEHICLE - on a highway for the purpose of temporarily residing or sleeping between 9:00 PM and 6:00 AM; 3. ANGLE PARKING - no having an over-all length in excess of 6.1 metres in an "Angle Parking" zone. 4. ACCESSIBLE PARKING SPACE - In an parking stall marked as an accessible parking stall/space unless: - a. The vehicle displays an Accessible Parking Permit or a permit of a similar nature issued by another jurisdiction and, - b. The vehicle displaying an Accessible Parking Permit is stopped, left standing or park for the purpose of transporting a person with accessibility needs; - c. Vehicles engaged in providing service and transport to persons with special needs are permitted to park within reasonable proximity to the person as long as not obstructing free passage of the highway otherwise 5. ADVERTISE FOR SALE - Upon any highway for the principal purpose of displaying a. vehicle for sale; 6. BOULEVARD - On a boulevard where there are curbs; 7. BOULEVARD NO CURBS - On a boulevard where there are no curbs unless the distance between the vehicle and the roadway is at least 1.5 meters; 8. BRIDGE - upon a bridge 9. BUS STOP - in a bus stop 10. CROSSWALK - in a crosswalk or within 6 meters of the approach side of a crosswalk; 11. BICYCLE LANE - upon a bicycle lane unless loading or unloading a person with a disability 12. DISTANCE FROM CURB - More than thirty centimeters (30 cm) from the curb of a roadway if a curb has been constructed; 13. DOUBLE PARKING - on the roadway side of a vehicle stopped or parked parallel to the edge or curb of a roadway 14. DRIVEWAY - In front of a driveway or within two meters of a driveway; 15. ELECTRIC VEHICLE CHARGING STATION - At a public/municipal electric vehicle charging station for more than two consecutive hours; 16. EXIT - Within three meters of any entrance to or exit from a hotel, theater, public meeting place, fire hall or playground; 17. FIRE ZONE - In a fire lane or fire zone 18. FIRE HYDRANT - Within five meters of a fire hydrant; 19. IN CONTRAVENTION OF TRAFFIC CONTROL DEVICE - In contravention of any traffic control device 20. IN DESIGNATED AREA ONLY -- on any portion of a highway where parking spaces for vehicles are designated by lines painted upon the surface of the highway, except wholly within the lines designating the parking space 21. INTERSECTION - In an intersection or within six meters of an intersection; 22. LOADING ZONE -in excess of the permitted time noted in a posted loading zone and, where the permitted time is not posted, not longer than fifteen minutes, provided that the person is actively loading or unloading passengers or goods 23. METERED SPACE - in a parking space at which there is a meter, except upon deposit of the parking fee in the appropriate meter for parking in the manner and at the rate prescribed and as measured by the meter 24. NO STOPPING ZONE - in any area of a highway designated as a "no stopping" zone. 25. OBSTRUCT - In a manner which obstructs free passage of traffic on any roadway; 26. OBSTRUCT VISIBILITY OF TRAFFIC CONTROL DEVICE - In a manner which obstructs the visibility of any traffic control device; 27. OFF STREET PARKING FACILITY - - a. In any off street parking facility or other public parking lot operated by the 16. District, between the hours of 11:00 pm to 6:00 am; n any off street parking facility or other public parking lot operated by the District in contravention of the length of time allowed for parking as indicated on a traffic control device applicable to that facility or lot; 28. POST OFFICE BOX - Infront of a Post Office Box for more than five (5) minutes; 29. RED CURB - In front of or adjacent to a curb that has been painted red 30. SCHOOL GROUND - on a highway abutting a school ground or playground unless the school ground or playground is separated from the highway by a fence 31. SIDEWALK - on a sidewalk 32. STOP SIGN - within six meters of a stop sign 33. TRAFFIC CONTROL DEVICE - in contravention of a traffic control device; 34. TAXI ZONE - in a zone reserved exclusively for taxis 35. WRONG SIDE, WRONG DIRECTION - On a two-way highway unless the vehicle is parked on the right side of the highway with the right hand wheels of the vehicle parallel to that side (wrong side, wrong direction); 36. YELLOW CURB - In front of or adjacent to a yellow curb; - 9.2. Commercial, Construction, Recreational Vehicles, Trailers, and Unlicensed Vehicles 1. No person shall park, stand, or stop a commercial vehicle: - a. on a highway in the same parking location in the Business District for a continuous period of more than three hours between 6:00 am to 10:00 pm - b. on a highway other than in the Business District between 10:00 pm to 6:00 am of the following day - c. on a highway in a residential area except when actively engaged in loading and or unloading - d. on either side of a highway abutting any school or park, including property zoned P-1, P-1A or P-2 for a continuous period of more than three hours between 6:00 am to 10:00 pm 2. No person shall park, stand, or stop a construction vehicle on any street, highway, District owned parking lot or boulevard; 3. No person shall park, stand, or stop a recreational vehicle on a street, highway, District owned parking lot or other public place between 11:00 pm to 6:00 am the following day; 4. No person shall park, stand or stop, a trailer on any highway unless the trailer is attached to a motor vehicle capable of pulling it 5. No person shall park, stand or stop an unlicensed vehicle trailer or other similar item on a street, highway or public place. ## PART 6 - STREETS, BOULEVARDS, SIDEWALKS, AND MUNICIPAL PROPERTY ## 10. PROHIBITIONS - 10.1. No person shall do any of the following within or upon any boulevard, street, highway or other public space: 1. ADVERTISE WITH SIGN - Erect or maintain any sign, advertisement or guide-post on or over any highway for commercial purposes 2. CONTAMINATE SEWER OR STORM - Allow any oil, grease, gasoline, water or other deleterious material to drop or fall into any municipal storm or sewer system 3. CONSTRUCT - Construct a boulevard, sidewalk, curb or ditch 4. CROSSWALK except as a pedestrian, cross a highway within a crosswalk. This prohibition shall not apply to persons operating bicycles within any portion of a crosswalk containing elephant feel markings. 5. DAMAGE BOULEVARD - willfully or carelessly damage the boulevard, or any wall, rain garden, fence, street light, street furniture or any other improvement upon or within any boulevard; 6. DAMAGE MUNICIPAL PROPERTY - Cause damage to, cut down or remove, trees, grass, shrubs, plants, bushes and hedges, fences, signs, highway lighting, or any other thing erected, planted or maintained by the District on a highway 7. DAMAGE SIGNS - injure, remove, deface, mark, imprint or in any way destroy any notice, sign, or regulation affixed by order or permission of the District; 8. DAMAGE TREE - cut, prune, break, remove or injure or in any way destroy any municipal tree; 9. DAMAGE VEGETATION - cut, prune, break, remove or injure or in any way destroy any vegetation on municipal property; 10. DEFACING - mark, imprint or deface in any manner whatsoever a highway, traffic control device or structure situated upon a highway 11. DEPOSIT ON STREET Deposit any waste, litter, paper, glass, tin cans, offensive matter or any other substance of any kind, except in public garbage receptacles provided for such purposes; 12. DIRECT WATER - Direct or allow any water onto a highway, whether through a hose, drain, or other means 13. DRAG OR SKID - Drag or skid any object along or over a highway in such a manner that the object damages the surface of the highway 14. DRIVE ON SIDEWALK - Drive a motor vehicle, cycle or ride or herd any animals upon a sidewalk or boulevard except on a driveway crossing or as permitted by a traffic control device 15. HORN - while operating a motor vehicle, sound or permit the motor vehicle's horn to be sounded in except 9. (a) as required under the Motor Vehicle Act, or 10. (b) for the purpose of giving reasonable warning to persons using or about to use a street, of a hazard or danger arising out of the presence or approach of the vehicle. 16. EFFLUENT FROM DRAIN - construct or maintain a ditch, sewer or drain, the effluent from which causes damage, fouling, nuisance or injury to any portion of a highway 17. ESCAPE OF GREASE AND OIL - Park a vehicle on a street, boulevard or other public property unless fitted with a proper and sufficient device capable of catching all drippings of oil, grease, gasoline and water falling from the body or engine of such vehicle; and 18. EXCAVATIONS and CUTTING TIMBER - dig up, break up or remove any part of a highway, or cut down or remove trees or timber growing on a highway or excavate in or under a highway 19. EXCAVATION - Leave any excavation, obstruction or works in, on, over or under a highway without placing, erecting and maintain sufficient fencing, barricading and signage to ensure the safety of all other users of the highway 20. GARBAGE BIN COLLECTION - Leave garbage collection bins on a highway except for the day of collection, and only between 6 am to 8 pm on the day of collection ; 21. GARBAGE BIN PLACEMENT - Ensuring the placement of garbage collection bins does not obstruct safe passage of pedestrians, cyclists, vehicles or other users; 22. GARBAGE BIN SECURITY - Place garbage collections bins out for collection where the bin cannot be closed or properly secured with a closed lid; 23. INSTALL A DITCH except as authorized by a permit issued under another bylaw of the - District, install, remove or damage a pipe, culvert, ditch, swale or watercourse. 25. LOOSE MATERIAL IN TRANSPORT - Ensure that any material transported on a vehicle does not become loose or detached, blow or spill or fall from the vehicle onto any highway, and it shall be the duty of the driver of the motor vehicle to immediately take all necessary precautions to safeguard traffic and to remove such material from the highway; 26. MATERIAL FALLING FROM VEHICLE - permit any clay, mud, dirt, or similar substance to fall from a vehicle on to a highway and when any mud, clay or dirt is deposited from vehicles on any highway, the driver or owner of such vehicle shall take immediate steps to remove the same. 27. MATERIAL ON STREET - Track dirt, mud, debris or any other materials onto a highway from private property If this does occur, the property owner or occupant shall have the highway cleaned from those materials within twenty-four hours 28. MISUSE PUBLIC GARBAGE - Deposit household waste in public garbage receptacles; 29. MODIFY OR OBSTRUCT BOULEVARD - Place gravel, rock or other deterrents for any reason on a highway or boulevard; 30. PASS IN A SCHOOL OR PLAYGROUND ZONE - cause a motor vehicle to pass another motor vehicle on the left while travelling in a school zone or playground zone 31. PLANT TREE - plant a tree or other vegetation except as permitted by the District; 32. REMOVE GRASS - remove grass from a boulevard or otherwise modify a boulevard to add hardscaping, or create off street parking except as permitted in this bylaw or another District bylaw 33. SELLING ON A HIGHWAY - use or occupy any highway for the purpose of selling or displaying any goods or wares, including without limitation any flowers, fruit, vegetables, seafood, commodities, articles or other things, except as authorized by a business license issued by the District 34. STOPPING WATER - Change the level of a highway in any manner whatsoever, or stop the flow of water through any drain, sewer or culvert on, through, or under a highway 35. STRUCTURE - Place, construct or store any chattel, material, object, obstruction, container or structure on any highway 36. TRACKED VEHICLE - Operate tracked vehicles, whether equipped with road plates or not, on sidewalks, boulevards, roadways or lanes, other than for the purpose of snow removal or grading 37. VEHICLES AND ANIMALS - Ride, drive, lead, move or propel any vehicle or animal in excess of 270 kg over or across a boulevard including any curb, sidewalk or ditch, unless such has been constructed or improved so as to form a suitable crossing, except when such vehicle or animal is being used to improve or maintain the boulevard. PART 7 - OBLIGATIONS OF OWNERS AND OCCUPIERS FOR MAINTENANCE OF BOULEVARDS ## 11. MAINTENANCE OF BOULEVARDS - 11.1. Every owner or occupier of a parcel shall, with respect to any boulevard abutting the parcel: - Keep grass or weeds mowed and free of debris - b. Remove accumulations of filth, leaves, rubbish, discarded materials, hazardous objects and material which may obstruct a drainage facility; - c. Keep in good repair all driveway crossings; - d. Remove and clear snow or ice from the sidewalks bordering the parcel within twentyfour hours of the accumulation of such snow or ice - e. Not place, construct or store any chattel, material, object, obstruction, container or structure - f. Not install any sprinklering or water system. - g. Not install or use any raised beds or other hard elements ## 12. MAINTENANCE OF BOULEVARD VEGETATION ADJACENT TO MUNICIPAL PROPERTY - 12.1 Every owner or occupant of a parcel shall, with respect to any landscaping or native vegetation within the boulevard, ensure that the landscaping or native vegetation does not obstruct or encroach upon the passage of pedestrians, cyclists, or vehicles, and that sight lines to intersections, driveways, sidewalks, vehicle and bicycle travel lanes, and traffic control devices are maintained. - 12.2 Every owner or occupier of a parcel must trim or maintain vegetation adjacent to municipal property as follows: - i. Maintain clearance abutting a highway for a width of 1.5 m width with a height not greater than 0.7 m from the edge of the paved road, sidewalk or curb of the boulevard; Information Note: The following graphic represents maximum vegetation height abutting a road:  * - ii. Maintain a 2 m diameter around fire hydrants from all vegetation - 12.3 Every owner and occupier of land to which water is supplied by the Districtshall clear or trim, within 1 m diameter around, and 2 m height above the water meter access, any bush, trees, weeds or other forms of vegetation growing on the boulevard or parcel in such proximity to the water meter that it hinders or impedes access to the meter from the boulevard and shall remove any other thing which obstructs access to the meter - Every owner and occupier of a parcel shall on the parcel or the boulevard adjacent to the parcel maintain a 1.5m diameter vegetation-free area around utility poles, traffic contro devices, bus shelters, concrete bus pads, signal control boxes, streetlight poles and all other utilities or municipal infrastructure - 12.5 Every owner and occupier of a parcel shall place within a sight triangle of any building, structure, fence, landscaping, vegetation, or other visual obstruction greater than 0.7 meters in height shall be permitted ## PART 8 - SPECIAL EVENTS AND RIGHT OF WAY PERMITS ## 13. SPECIAL EVENTS - 13.1. No person shall hold any special event on municipal property or highway without a permit. - 13.2. A special events application must be submitted at least four (4) weeks before the event. The application must contain the following: - a. Certificate of insurance, which indicates that your organization is responsible for incidents occurring during or resulting from an event, providing: - i. A minimum of $5 million liability insurance against personal injury and public liability third-party claims. - ii. A maximum deductible no greater than $5,000 - ili. The Corporation of the District of Central Saanich, The Central Saanich Police Board, All their officers, employees and volunteers as additionally insured. - iv. Proof of insurance may be accepted after the application is made and must be submitted directly from the broker. - b. Route Maps, to be provided, indicating: - i. Labelled highway and road names; - ii. Landmarks and/or GPS coordinates labelled where necessary; - ili. Directional arrows depicting the event route; and, - iv. Start/Finish lines and check points. - C. Traffic Management Plan demonstrating: - i. The protection and safety of the travelling public and event participants. The organizers must keep themselves fully informed of, and comply with, all federal, provincial, and municipal safety legislation, regulations, and bylaws. Traffic management must follow the B.C. government's traffic management rules. - ii. "No parking" areas must be identified as part of the Traffic Management Plan and blocked off in timely fashion prior to the event, as well as removed in full after the event. 2. Community Consultation is required for the special event, and includes notifying all authorities and make special arrangements for assistance, as necessary: - i. Central Saanich Police Services, emergency services and/or local service group - ii. Local municipalities, Regional District and/or local rural area director - ili. Adjacent residents with a letter hand delivered - iv. Local First Nations communities - v. Local road and bridge highway contractor - vi. BC Ferries, inland ferries and/or public transit authority 9. 13.3 Failure to obtain a special events permit prior to the event may be subject to bylaw enforcement and legal action. ## 13.4 Special Event Permit exemptions include: - a. A special event highway use permit may not be required for low-risk special events that are compliant with the Motor Vehicle Act. - b. A special event must meet all of the following conditions to be exempt from a special event permit: - i. It will occur entirely outside of the highway; Information Note: Example of "outside of the highway" includes, on a multi-use trail that is not used for vehicular traffic, a sideway, or the extreme shoulder adjacent to the roadway. - ii. If no sidewalk is present, pedestrians on the boulevard adjacent to the event, the event organizer shall ensure that attendees use only the extreme shoulder adjacent to the roadway, and will stand or move facing traffic approaching from the opposite direction - ill. It will not involve pedestrians soliciting rides, employment and/or business from a vehicle occupant - iv. Pedestrians at the event will cross the highway only at designated crossing sites 4. the event will not impact the flow of vehicle traffic, involve lane closures or raffic stops, or impact intersection operation - vi. the event will not require or involve traffic control personnel, CS Police Service pilot vehicles, or parade marshals Information Note: Assembling of people includes supports, spectators and participants; things include tents, porta potties, spectator stands, stages, etc. ## 14. RIGHT OF WAY PERMITS - 14.1 No person shall undertake any construction, excavation, maintenance or other occupancy of public property, including sidewalks, boulevards and roads, without a right of way (ROW) permit - 14.2 A ROW permit application must be submitted to the District no less than thirty (30) days prior to the work commencement date. - 14.3 The permit application submission must include the following: - a. Certificate of Insurance; and, - b. Traffic Management Plan and/or Traffic Control Plan. ## PART 9 - TRUCK AND BUS TOUR ROUTES ## 15. TRUCK AND BUS TOUR ROUTES - 15.1. The highways and portions of highways shown on Schedule C as Truck Routes are designated as Truck Routes - 15.2. The highways and portions of highways shown on Schedule C as Tour Bus Routes are designated as Tour Bus Routes - 15.3. Except where otherwise directed by a bylaw enforcement officer, no person shall drive a Commercial Vehicle upon any highway in the District other than on a Truck Route as shown in Schedule C. - 15.4. Notwithstanding subsection (15.1), a person may drive a Commercial Vehicle upon a highway in the District that is not located on a Truck Route if the Commercial Vehicle remains on a Truck Route until reaching the nearest intersection between the Truck Route and the destination and the Commercial Vehicle returns to the Truck Route from the destination at the nearest intersection back to the Truck Route. - 15.5. Except where otherwise directed by a bylaw enforcement officer, no person shall drive a Tour Bus upon any highway in the District other than on a Tour Bus Route as shown in Schedule C - 15.6. Notwithstanding subsection (15.3), a person may drive a Tour Bus upon a highway in the District that is not located on a Tour Bus Route if the Tour Bus remains on a Tour Bus Route until reaching the nearest intersection between the Tour Bus Route and the destination and the Tour Bus returns to the Tour Bus Route from the destination at the nearest intersection back to the Tour Bus Route. - 15.7. The Municipal Engineer shall cause to be kept and maintained a current map setting out the highways and sections of highways shown as Truck Routes and Tour Bus Routes on Schedule "C", and shall make copies of such map available to the public at no charge. ## PART 10 - EXEMPTIONS ## 16. EXEMPTIONS - 16.1. The provisions of this bylaw shall not apply to: - a. Any emergency vehicles while attending at an emergency call but not excuse the driver of any such vehicle from exercising due and proper care for the safety of other - traffic; or when parked on a stand-by basis for the purpose of being available for emergency use. - b. Government Vehicles, vehicles of a public utility corporation or tow trucks while the operators of such vehicles are engaged in work requiring the vehicles to be stopped or parked in contravention of any of the provisions of this Bylaw, or are parked on a stand-by basis for the purpose of being available for emergency use. - 16.2 Regulations on limited parking time shall not apply to any vehicle so mechanically disabled such that the vehicle cannot be moved for a consecutive period of twenty-four hours from the initial mechanical failure. ## PART 11 - OFFENCE, PENALTIES, AND ENFORCEMENT ## 17. OFFENCES AND PENALTIES - 17.1. A person who contravenes this Bylaw by doing an act that it forbids, or by omitting to do an act that it requires to be done, commits an offence and is liable, on conviction, to the penalties prescribed by this Bylaw or the Offence Act. - 17.2. Each day that a contravention of a provision of this Bylaw occurs or continues shall constitute a separate offence. - 17.3. This Bylaw may be enforced by any means permitted under section 260 of the Community Charter, including by means of a ticket issued in accordance with the Central Saanich Municipal Ticket Information Bylaw, the Central Saanich Bylaw Offence Notice Bylaw, and Section 264 of the Community Charter. - 17.4. No person shall remove a Bylaw Enforcement Offence Notice or a Municipal Ticket Information affixed to a vehicle by a Bylaw Officer unless that person is the owner or operator of the vehicle. - 17.5. The penalty for a contravention of Parts 5 through 10 shall be liable to a fine not exceeding five hundred dollars ($500.00) and not less than fifty dollars ($50.00). - 17.6. A bylaw enforcement officer or a person authorized to enforce this Bylaw or a portion hereof pursuant to a contract or agreement with the District if they have reason to believe that an offence has been committed against any of the provisions enumerated in Parts 5 through 10, may complete and deliver a traffic violation notice to the driver of the vehicle parked in contravention of any one of the provisions so enumerated. - 17.7. Delivery of a traffic violation notice may be effected by leaving it on the windshield of such vehicle, or by handing it to the registered owner of the vehicle at the address shown on the record of registration maintained by the Insurance Corporation of British Columbia, or by sending by mail to the address shown on the record of registration maintained by the Insurance Corporation of British Columbia; - 17.8. A traffic violation notice may indicate the alleged offence and the amount of the penalty which may be paid to the District in respect of it. ## 18. AUTHORITY AND ENFORCEMENT - 18.1. A Bylaw Officer may enter, at any reasonable time, upon any property subject to this Bylaw for the purpose of determining compliance with this Bylaw and any direction issued under it. Information Note: See section 16 of the Community Charter for bylaw enforcement officer authority to enter on or into a property ## 18.2. Removal of Objects or Materials from Streets - 18.3. This Section does not apply to the following persons or objects: - a. Employees or agents of the District while they are acting in the course of their employment; - b. a special events permit issued by the District; or - works for which a permit has been issued under a District Bylaw. - 18.4 The Municipal Engineer or a person authorized by the Municipal Engineer may remove, or cause to be removed, any object, thing or material deposited on a street, boulevard, or public place in contravention of this Bylaw, and may repair any resulting damage. - 18.5 The cost of such removal or repair shall be charged to the person who deposited, caused, or permitted the deposit of the material, or who caused the damage. ## Tow-Away Zones - 18.6 Any of the following vehicles are subject to immediate towing, impoundment, or detention by wheel-lock by the District or its contractors, at any time: - a vehicle, other than a School District bus or a vehicle authorized by the District to provide public transportation, stopped, standing, or parked in a signed bus stop; - b. a vehicle stopped, standing, or parked in a signed fire zone; - C. a vehicle stopped, standing, or parked in a signed no-stopping zone; - d. a vehicle stopped, standing, or parked in an off-street parking facility in contravention of this Bylaw - e. a vehicle stopped, standing, or parked on a highway in contravention of this Bylaw ## Recovery of Impounded Property - 18.7 Any vehicle, chattel, or obstruction removed or detained under this Bylaw may be recovered by the owner upon: - 18.7.1 presenting proof of ownership; and - 18.7.2 paying all applicable fees, costs, and expenses as set out in the Fees and Charges Bylaw. - 18.8 Payment and release shall occur through: - 18.8.1 the District's towing contractor or authorized agent, for vehicles; or - 18.8.2 : the District, during regular business hours, for chattels or other obstructions. ## Notice to Owner - 18.9 If a motor vehicle is removed, detained, or impounded and remains unclaimed for 48 hours, the District shall provide written notice by registered mail to the registered owner, advising of: - 18.9.1 the seizure and impoundment; - 18.9.2 the amount payable for release; and - 18.9.3 the date on which the vehicle will be advertised for sale by public auction if unclaimed. - 18.10 Where a chattel or obstruction (other than a motor vehicle) is removed under this Bylaw and the owner is reasonably ascertainable, the District shall make reasonable efforts to notify the owner prior to sale or disposal, except as provided for low-value property. ## Public Auction and Disposal - 18.11 Any vehicle, chattel, or obstruction not claimed within 14 days of impoundment may be sold at public auction. The auction must be advertised at least once in a daily newspaper circulating within the District or if no newspaper is available, by another method reasonably calculated to provide public notice, including the District's website. - 18.12 The proceeds of the auction shall be applied as follows: - a. first, to the cost of the auction; - b. second, to all unpaid fees, costs, and expenses levied under the Fees and Charges Bylaw; - c. third, any remaining balance shall be held by the District, without interest, for one (1) year for the owner. If unclaimed after one year, the balance becomes District general revenue. - 18.13 If a chattel or obstruction is not purchased at auction, it may be disposed of at the Capital Regional District Landfill or another location approved by the Municipal Engineer. Disposal costs, minus any proceeds, are recoverable as a debt owed to the District by the owner. - 18.14 If a vehicle is not purchased at auction, it shall be disposed of in accordance with the Commercial Liens Act. ## Low-Value Property - 18.15 Notwithstanding the notice and disposal provisions of this Part, if the apparent market value of the garbage, rubbish, a chattel, or an abandoned or unlicensed vehicle of less than One Hundred Dollars ($100.00) is left on any highway, the District may remove and dispose of it without notice. - 18.16 The full costs of removal and disposal shall be charged to the owner. 18.17 Apparent market value shall be determined by the Municipal Engineer. ## 19 GENERAL - 19.4 if any section, subsection or clause of this Bylaw is for any reason to be held invalid by the decision of a court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this Bylaw. - 19.5 "Central Saanich Traffic and Highways Regulations Bylaw No. 2018, 2019" is hereby repealed. 2026 | READ A FIRST TIME this | 25th day of May | | |--------------------------|-------------------|------| | READ A SECOND TIME this | 25th day of May | 2026 | | READ A THIRD TIME this | 25th day of May | 2026 | | ADOPTED THIS | 15th day of June | 2026 |  Ryan Windsor, Mayor Gorman, Corporate Officer   ## SCHEDULE A ## DISTRICT OF CENTRAL SAANICH OFF-STREET PARKING FACILITIES The following parking areas are designated as off-street parking facilities, pursuant to this Bylaw: - HEL,HILE, 7130 West Saanich Rd; - Central Saanich Cultural Centre, 1209 Clarke Road; - Municipal Hall, 1903 Mt.
