Consolidated December 2, 2010 City of Chilliwack Bylaw No. 2653 A bylaw to prohibit performances involving wild or exotic animals ________________________________________________ WHEREAS Section 680 of the Municipal Act authorizes Council by bylaw to prohibit the operation of a public show, exhibition, carnival or performance of any particular kind or in any particular location; AND WHEREAS Council deems it necessary and desirable to exercise the authority provided by Section 680; NOW THEREFORE the Council of the City of Chilliwack in open meeting assembled, enacts as follows: 1. This bylaw may be cited as "Wild or Exotic Animal Performance Bylaw 1999, No. 2653". 2. For the purposes of this Bylaw "wild or exotic animal" shall be defined as those animals listed in Schedule "A" attached to and forming part of this bylaw. 3. No person shall operate or carry on a circus, public show, exhibition, carnival or other display or performance, whether temporary or permanent, (the "show") in which wild or exotic animals are travelling with or otherwise accompanying the show or are required to perform tricks, fight or participate in performances by the show for the amusement or entertainment of an audience, while the show is within the City of Chilliwack. Offence and Penalty 4. Every person who violates any provision of this Bylaw, or who allows or permits any act or thing to be done in violation of any provision of this Bylaw, or who neglects to or refrains from doing anything required to be done by any provision of this Bylaw, is guilty of an offence against this Bylaw and each day that a violation continues to exist is deemed to be a separate offence against the Bylaw. 5. Every person who commits an offence against this Bylaw shall be liable upon summary conviction to a fine of not less than $500.00 and not more than $10,000.00. Severability 6. If a Court of competent jurisdiction holds any portion of this Bylaw invalid, such invalidity shall not affect the remaining portions of the Bylaw." The list includes all such animals whether bred in the wild or in captivity and also includes all their hybrids with domestic species. The words in parenthesis are intended to act as examples only of a particular group and are not to be construed as limiting the generality of the group. The list includes: 1. Non-human Primates (such as gorillas and monkeys) 2. Felids, except domesticated cats 3. Canis, except dogs 4. Ursids (bears) 5. Elephants 6. Pinnipedia (such as seals, fur seals and walruses) 7. Crocodilians (such as alligators and crocodiles) 8. Marsupials (such as kangaroos and opossums) 9. Venomous or poisonous reptiles 10. Venomous or poisonous arachnids (scorpions) 11. Snakes, except those designated as wildlife by provincial enactment (AB #3723) 12. Ungulates, except domestic horses, mules and asses, goats, sheep, pigs and cattle 13. Hyaenas 14. Mustelines (such as skunks, weasels, otters and badgers) 15. Procyonidae (such as raccoons and coatis) 16. Edentates (such as anteaters, sloths and armadillos) 17. Viverrines (such as mongooses, civets and genets)
