Consolidated: October 7, 2014 City of Chilliwack Bylaw No. 168 A bylaw to Protect Watercourses ________________________________________________ The Council of the City of Chilliwack in open meeting assembled, enacts as follows: (AB#4058) 1. This by-law may be cited for all purposes as the "Watercourse Protection Bylaw 1981, No. 168". 2. That the Township of Chilliwhack Watercourse Protection By-law 1977, No. 56, as amended, is hereby repealed. 3. Interpretation "City" means the City of Chilliwack; (AB#4058) "Person" means natural persons of either sex, an association, a corporation, a co-partnership, whether acting by themselves or by a servant, agent or employee, and the heirs, executors, administrators, successors and assigns or other representative of such a person to whom the context can apply according to law; the singular shall, when necessary, be held to mean the plural, and the masculine the feminine, and the converse thereof; "Watercourse" means stream, creek, waterway, watercourse. 4. No person shall cause or permit the fouling, obstructing, impeding of any watercourse except by permit from the Ministry of Environment, or the filling up thereof, whether or not it is situate on private property; and without limiting the generality of the foregoing, no person who is the owner of livestock shall cause or permit such livestock to foul, obstruct or impede the flow of any watercourse. (AB#422) 5. Every person who contravenes any provision of this bylaw commits an offence punishable upon summary conviction and is liable to a fine not exceeding $10,000.00 (AB#4058) 6. If an offence is a continuing offence, each day that the offence is continued constitutes a separate and distinct offence.
