: ## CORPORATION OF THE VILLAGE, OF CLINTON ## BY-LAW NO. 209, 1985 The Council of the Village of Clinton in open meeting assembled enacts as follows:- 1. Control By a No. 215, 1985 the "Vilage of Clinton Traffic 2. "Village of Clinton Iraffic By-Law No. 67, 1969" is hereby repealed. 3. 3. "Village" "Highway" "Lane" "Parado" "Peace Officer" shall mean the Village of Clinton and the territory thereof: includes every highway within the Highway Act; shall mean lane, street, alley or public chorought any uning more or 105 land property lines lanes or ways; shall mean any procession or body of pedestrians "except members of the Armed Forces" numbering lore than thirty people, standing, marching, c pon any highway or sidewalk, or ar group of vehicles numbering ten or more "except funeral processions" standing or moving on any highway: shall mean every person as defined as such by-law; "Person" "Playground" "Private Road" or "Driveway" "Skateboard" shall mean and include natural persons of either sex, associations, corporations, bodies politic and co-partnerships, whether acting by themselves be held to mean and include the plural; and the converse thereof; shall mean every parcel of land within the Village of Clinton set aside for the purposes of recreation of any type and shall include school grounds, except vehicles used for maintenance and other vehicles authorized by the Works Superintendent or the School Board; shall mean every road or driveway, the title to or possession of which is not vested in the Crown; means any vehicle upon which a person can ride by coasting, or whereby such vehicle is propelled by gravity on its own momentum; - 3. - "Works Superintendent" ## PARTI - 1. -2- - eace officer in the course of his duty - any accident, in order to expediate traffic or safeguard pedestrians, may direct traffic on any street in the vicinity, and it shall be unlawful for any person to fail to comply with the directions of any such member of the Fire readily identifiable. 4. For the purposes of enforcing this by-law, the Village Council may by resolution, authorize the Village of Clinton as "Officers" who, in addition to the peace officers having jurisdiction within the Village, shall exercise all the necessary powers provided herein, the provisions of the By-Law, by the laying of an information when necessary. ## PART II - TRAFFIC CONTROL DEVICES 1. superintendent to place naintained all such traffic control devices. 2. (a) The Council may designate as "No Parking" zones, or as 'No Stopping" zones areas in which parking or stopping is prohibited or designate as restricted parking or restricted topping zones, areas in which parking or stopping is restricted and may designate certain areas as Loading Zones. 2. (b) Unless when so designating any area as a zone in accordance ith the foregoin subsection, the Council limits the ours or days when the prohibition or restriction shall b in effect, at all timeshe prohibition or restriction shall be in effect 3. (c) stopping zones, or loading zones. ## PART III - PARKING 3. (1) Except when necessary to avoid conflict with traffic or to comply with the law or the directions of a Peace Officer or traffic control device, or in the case of any vehicles so mechanically disabled as to prevent the moving of the same, no person shall stop, stand, or park a vehicle:- - (a) on a sidewalk or boulevard. - (b) in front of a public or private driveway - (d) within fifteen (15') feet of a fire hydrant. - (c) ithin an intersection, éxcept as permitted by i sign. - (e) on a crosswalk. - (9) rithin twena 12 to st upon traffic control signa flashing beacon, located at the side Öf a roadway. - (f) within twenty · (20) feet of the approach side of a crosswalk. - 4- ## PART III - PARKING 6. (1) - (h) - (i) - (i) - (iii) displaying signs. - (ii) repairs are necessitated by an emergency. - (iv) selling flowers; fruit, vegetables, sea foods or other conmodities or articles. - alongside or opposite a street excavation or obstruc when stopping, standing, or parking obstruct (i) - (k) - (1) - (m) - (n) in any lane or alley in such manner as to obstruct the free movement of vehicular traffic in the lane or - (0) in any lane or alley in such a position or manner as to obstruct the free movement of vehicular traffic in or out of any driveway or private road adjoining such lane. - (2) 'xcept when this By-Law permits and otherwise directs o · Police Officer so instructs, no driver shall stop stand, or park a vehicle other than on the right side of a highway and with the right hand wheels parallel to that side and where there is a curb, within twelve (12") inches of the curb. - (3) No person shall move a vehicle that is not lawfully under his control into any of the places mentioned in subsection 7. For the better regulation of traffic, the Council may place or cause to be placed marks or lines upon the surface of any street or streets indicating the spaces or portions of such street or streets within which each vehicle shall be parked, and it shall be unlawful for any driver or person in charge, control or possession of any vehicle to park such vehicle on any street aforesaid unless such vehicle is wholly within the space indicated by such lines or marks. 8. - (a) No trailer of any kind whatsoever shall be parked on any or street of the Village of Clinton, unless attached to a vehicle capable of towing it. - (b) - (c) · ## PART III - PARKING 9. (1) The provisions of this By-Law prohibiting stopping or parking shall not apply:- 2. (a) by this By-Law. ## PART IV - GENERAL STREET REGULATIONS ## SPEED LIMIT IN THE VILLAGE OF CLINTON he speed limit on all highways, lanes or streets throughou the Village f Clinton shall be not more than fifty (50kms kilometres (30 miles per hour) for all traffic unless otherwise posted. ## 1. NOISE MAKING DEVICES ## 2. SCHOOL CROSSINGS - (a) - (b) The Principal of any regular day school in the Village of Clinton may appoint a school patrol to assist pedestrians in crossing highways, lanes or streets at designated school crosswalks during the hours of 8 o'clock in the forenoon and 5 o'clock in the afternoon on any regular school day. - (c) A member of a school patrol may control the movement of traffic at such designated school crosswalks by exhibiting a manual traffic control device of a design approved by resolution of the Village of Clinton Council. - (a) i am or 2 seal patrol as seignatod school crossings. ## 3. DRIVING OVER FIRE HOSE PROHIBITED No person shall drive a vehicle over an unprotected hose of a fire department when laid down on a highway, lane, street or private driveway at a fire or an alarm of fire unless he has received consent of the fire department official in command or a Peace Officer. - 6 - 7 - ## PART IV - GENERAL STREET REGULATIONS ## 4. PROTECTION OF HIGHWAYS, LANES OR STREETS No person shall:- - (1) - (2) saw, break, split, place or pile firewood, lumber, locks, rock, stone, debris, or other materials, or mi: nortar to do any job upon any street or sidewalk which will obstruct or impede traffic thereon or deface or injure - (3) remove a wrecked or damaged vehicle from any street without also removing glass or other injurious substances dropped upon the street from such vehicle. - (4) camp, either by day or night, on any highway, street or lane within the Village of clinton. - (5) make any fire on any highway, lane or street or making fire at any place so as to endanger any installation on any highway, lane or street within the Village of Clinton. - (6) Leave dead animal one inade tony highway, - (7) construct a ditch, the water from which causes damage to any highway, lane or street within the Village of Clinton. - (8) - (9) - (10) convey dirt, sand, earth, brick, gravel, manure, sawdust, pieces of wood or other substances or material along, through, or upon any street to allow or permit the same or any part, piece, or portion thereof to be dropped upon any street or lane or in any case to remain thereon. 5. It shall be unlawful for any person to permit any accumulation snow or ice to remain upon any sidewalk in front of or abutting any premises owned or occupied by him after 10 o'clock in any morning of any day, except Sunday. 6. It shall be unlawful for any person to place, or cause or suffer to be placed by any person in his employment or under his control, any merchandise or wares of any nature on any sidewalk in front or along side any premises occupied by him for the purpose of display on for any purpose except in the actual course of receipt r delivery or to any portion of any sidewalk for the purpose of neasuring or packing or unpacking goods, wares or merchandise. - 8 - ## PART IV - GENERAL STREET REGULATIONS 7. It shall be unlawful for any person to build, construct, place, maintain, occupy, throw, leave, pass, tie, or put or cause to be built, constructed, placed, maintained, occupied, thrown, left, passed, tied or put in any street (except in accordance with the provisions of the by-laws of the Village of Clinton) any structure, fence post, firewood, coal, chattel, rod, chain, rail, wire, box barrel, keg, merchandise, vehicle, animal or any object, substance or construct or re-construct any sidewalk on any street without first obtaining the written permission of the Works Superintendent. 8. It shall be unlawful for any person to break, teax up, or remove any planking, pavement, sidewalk, crossing, curbing, macadam, or other surface on any street or lane, or dig or make any excavation in, on, or under any street or lane within the Village of Clinton for any purpose whatsoever without having first obtained the written permission of the Works Superintendent to do so. shall be the duty of any person having obtained such permission tear up, or remove any such planking, pavement, crossing, curbing, macadam, or other surface of any or having obtained permission to dig or make any excavation on, in or under any street, to relay and fill up the and to put the same in as good repair as before such breaking. removing, digging, and excavation shall be done under the direction and supervision of the Works Superintendent, and the same shall be replaced to the satisfaction of the said Works Every person to whom permission as aforesaid shall be granted, shall erect and maintain a good and sufficient red or amber light during the night, and shall take such further care and precaution and safety of the public and shall indemnify the Village of Clinton against all loss, costs, charges, expenses, the Village of Clinton may be put by reason tearing up, removing, digging or excavation as aforesaid, reason of the permission granted him to do so. It shallalso be the duty of the Works Superintendent before giving any such permission to take from every security that he will perform all the obligations imposed him by the By-Law or any other By-Law of the Village of Clinton relating thereto; such security as aforementioned shall be in a form acceptable by the Village of Clinton Council. 9. Every person who shall make any excavation for any purpose adjoining or adjacent to any street or lane within the Village of Clinton shall build and maintain a good and sufficient fence or other barrier along the line of such street or lane so as to effectually guard such excavation and to protect and guard persons, and vehicles travelling along such street or lane against danger, risk, or accident by reason of such excavation. 10. No person shall erect or maintain any doorstep, porch, railing other projection or obstruction into or on any street or lane in the Village of Clinton without first obtaining a permit from the Council therefore. Awnings shall not be placed or suspended over any part of any highway, street or lane unless the lowest portion of such awnings is at least nine (9') feet above the sidewalk of said highway, street or lane. 11. The Works Superintendent is hereby authorized to remove any obiect or thing which is an obstruction to the treet or lane in the Village of Clinton or which may interfere with the free use thereof or which may encroach thereon. authority as given under this section shall not in any way relieve from responsibility or liability any person guilty of any infraction of any of the provisions of this By-Law or any other By-Law of the Village of Clinton. - 9 - ## PART IV - GENERAL STREET REGULATIONS 12. (a) No person, except by special permit as hereinafter provided, shall drive à vehicle on any street or lane of the Village of Clinton, excluding arterial highways as established under Section 32 of the Highway Act as amended to date, having a greater dimension, gross weight, axleload, or tire load than the limits of weights, loads and dimensions prescribed in regulations 9.02, 9.03 and 9.04 (a) to (e) inclusive of regulations pursuant to the Commercial Transport Act, Chapter 55 as amended to date, and Section 1904 of the Motor Vehicle Act of the Province of British Columbia as amended to date, or consisting of a combination of more than two vehicles coupled together. 3. (a) No person shall operate or use any vehicle having wheels, tires, or treads constructed or equipped with projecting spikes, clouts, ribs, clamps, flanges, attachments or projections which extend beyond the tread traction surface of the wheel, tire or track, upon any street or lane within the Village of Clinton except studded tires are permissible. 14. No person shall remove any earth, rock, boulders, gravel, sand or turf from any street, park, or lot belonging to the Village 7. 15. 16. (a) such a parade be under the direction or control of some one person as marshal or organizer. ## -10 - ## PART IV - GENERAL STREET REGULATIONS ## 17. (3) - (4) The Village of Clinton Clerk Treasurer may issue a permit for a parade subject to any terms he may impose as to time, route or otherwise if any deviation from such direction is made or if such directions be not otherwise compiled with (save as directed by the Village Clerk Treasurer), the permits shall be void and to no effect. - (5) The Canadian Flag unfurled and measuring not less than three (3') feet by six (6') feet in size shall be prominently, properly and continuously displayed at the If any flags or emblems of other nations, organizations or associations are displayed, the same shall be displayed under or behind the Canadian Flag. 18. The Council may from time to time designate streets or lanes or portions thereof as one-way streets or lanes and no driver shall operate a vehicle on a one-way street or lane except in the direction indicated by a traffic sign. For the purpose of this Section a one-way street or lane means a street or lane upon which vehicular traffic shall move only in the direction indicated. 19. No person shall lead, ride, drive or tether any animal or drive or propel any vehicle or bicycle or trailer upon any sidewalk or footpath provided that this section shall not apply to crossing a sidewalk over a crossing which has been especially constructed for that purpose for gaining entrance or exit to or from any premises. 20. No person shall drive a motor vehicle on grounds within the Village of Clinton which are designed, maintained, improved or intended to be used as "playgrounds" either by the School Board or the Village of Clinton. 10. No person shall use a skateboard upon any public road or street within the Village of Clinton. ## PART V - VIOLATIONS PROVISIONS 1. (a) Any chattel, vehicle or obstruction occupying any portion of a highway or public place, where such chattel, vehicle or obstruction interferes with the normal flow of traffic on the highway, street or lane or public place or interferes with the maintenance of the highway, street or lane or public place by men or equipment provided for that purpose or where it is stopped, standing, or parked in contraventior of the provisions of the Motor Vehicle Act as amended to date or this By-Law, or any other By-Law of the Village of Clinton shall be deemed to be unlawfully occupying a portion of the said highway, street or lane or public place as the ## PART V - VIOLATIONS PROVISIONS I. - (b) Any member of the Royal Canadian Mounted Police, the Fire Department or an Officer appointed by the Village of Clinton Council under the provisions of this By-Law, may remove or cause to be removed any chattel, vehicle or obstruction unlawfully occupying any portion of a highway, street, lane, or public place within the Village of Clinton and shall said property to be towed or taken to a place of shall immediately report the matter to ho Rot the padarty and de location of a complete descrip- - (c) (i) All fees, costs and expenses incurred for the towing, the chattel, vehicle or obstruction shall be paid by the owner of the said property and in default of payment by the owner within thirty (30) days from the date of impoundment, the Village of Clinton Clerk Treasurer is hereby authorized to sell the said property at public auction or to take action on behalf of the Village of Clinton in any Court of competent jurisdiction to recover the saia costs and expenses as he may deem necessary and expedient. - Where the impounded chattel, vehicle or obstruction was stopped, standing or parked in violation of the provisions of this By-Law or any other By-Law of the Village and when the owner of the said property has paid all fees, costs and expenses incurred thereof, no further fine, penalty or costs shall be imposed hereby for the said By-Law infraction. - (a) property removed, detained or impounded under the provisions of this section shall be deemed to have come into the custody and possession of the Police Force on behalf of the Village of Clinton, and where the owner of the property has not been ascertained, and no order of a competent court has been made with respect thereto, the property shall be disposed of or soid by the Collector as he may deem proper in accordance with the provisions of section 582 (3) of the Municipal Act. ## PART VI - PENALTIES 1.
