## THE CORPORATION OF THE CITY OF COURTENAY BYLAW NO. 1709
A bylaw to regulate the planting of street trees in new subdivisions.
WHEREAS, the Council has given due regard to the consideration given in Section 989 of the Municipal Act to regulate the planting of trees on boulevards.
NOW THEREFORE, the Council of the Corporation of the City of COURTENAY in open meeting assembled, enacts as follows:
1. That street trees be planted for all new streets or street extensions. No planting will be required for infill subdivision unless the infill comprises part or all of a street section between two intersecting streets (e.g., a city block), which has not been developed.
2. That street trees be planted in accordance with the Schedules T1, T2 and T3, and be spaced between 15 to 22 metres for the trees in Schedule T4.
3. That all trees be planted within sixly (60) days of the "Notice to Proceed" which will be issued by the City when the majority of the lots have been developed and constructed, and to coincide with the appropriate planting season. No planting shall take place until the "Notice to Proceed"
4. That completion of the works be guaranteed to the City by way of a deposit as provided for in he Municipal Act in a form and amount satisfactory to the approving officer. The deposit shal e based on a planting plan and estimate prepared by the developer's consultan
5. That prior to planting any trees, the developer's consultant shall submit for approval a plantin blan which identifies the tree varieties, sizes and planting locations.
6. That street trees be selected by the developer in accordance with Schedule T4 and Sections 8 anc 9 of this bylaw.
7. That each tree be planted in accordance with the specifications in Schedule T3, Tree Planting and Staking Detail.
8. That each street section separated by intersecting streets be planted with the same variety of trees.
9. That intersecting streets not use the tree variety planted on the streets with which they intersect.
10. This bylaw shall come into effect upon final adoption hereof.
11. This bylaw may be cited as "City of Courtenay Street Tree Planting Bylaw No. 1709, 1993".
