December 10, 2025 THE CORPORATION OF THE CITY OF CRANBROOK Sanitary Sewer Rates Bylaw No. 4133, 2023 (Adopted December 11, 2023) This is a consolidation of the Sanitary Sewer Rates Bylaw and the adopted Amendment Bylaws listed below. The amending bylaws have been combined with the original Sanitary Sewer Rates Bylaw for convenience only. If discrepancies exist between this consolidation and the original bylaws, the original bylaws shall prevail. THIS CONSOLIDATION IS NOT A LEGAL DOCUMENT. CONSOLIDATION FOR CONVENIENCE PURPOSES ONLY TO INCLUDE: Bylaw No. Adoption Date Particulars 4224 December 10, 2025 Replace Schedule A 4133 SANITARY SEWER RATES BYLAW A bylaw to provide for the imposition of a charge against the Owner or occupier of real property for the use of the Sanitary Sewage System of the Municipality. Whereas pursuant to the provisions of the Community Charter, Council may, by bylaw establish and impose fees for the use for all or part of the Sanitary Sewer System of the Corporation of the City of Cranbrook. 1. TITLE 1.1 THAT this bylaw may be cited as "Sanitary Sewer Rates Bylaw No. 4133, 2023." 2. INTERPRETATION 2.1 In this Bylaw, unless the context otherwise requires, the singular shall include the plural and the masculine includes the feminine gender. HEADINGS 2.2 The headings given to parts, sections and paragraphs in this Bylaw are for convenience of reference only and are not to be construed as defining, or in any way limiting, the scope or the intent of the provisions of this Bylaw. SEVERABILITY 2.3 If any portion of this Bylaw is for any reason held invalid by any court of competent jurisdiction, the invalid portion shall be severed and the severance shall not affect the validity of the remainder. SCHEDULE 2.4 Schedule "A" through "D" are attached to and forms part of this Bylaw. 3. DEFINITIONS 3.1 In this Bylaw, City means the Corporation of the City of Cranbrook. Council means the Municipal Council of the Corporation of the City of Cranbrook. Owner means the registered Owner as shown in the records of the Land Title Office in fee simple of real property or a strata lot, and in the event that there is a registered agreement for sale and purchase, Owner means the registered holder of the last registered agreement for sale and purchase. 3.2 Unless otherwise provided in this Bylaw, words and phrases used herein have the same meanings as in the Local Government Act and Community Charter as the context and circumstances may require. A reference to a statute in this Bylaw refers to a statute of the Province of British Columbia and a reference to any statute, regulation, bylaw or other enactment refers to that enactment as it may be amended or replaced from time to time. 4. A monthly sanitary sewer user charge/rate is hereby imposed and levied against the owners or occupiers of land or real property whose property is connected to the sanitary sewer system, classified in accordance with the categories set out in Schedule "A" attached to and forming part of this Bylaw. 5. In addition to the charge/rate in imposed and levied in Section 4 of this Bylaw, an additional monthly sanitary sewer user charge/rate is hereby imposed and levied against the owners or occupiers of land or real property whose property is connected to the sanitary sewer system located within the hatched area of the map set out in Schedule "C" classified in accordance with the categories set out in Schedule "B". 6. In addition to Sections 4 and 5 of this Bylaw, and pursuant to City Sanitary Sewer Connection Maintenance and Responsibility Policy and Procedure No 60-106, if it is determined that a blockage is not caused by a structural defect in the service connection on the City's side of the property line, the property owner will be responsible for the sewer camera fee, and all labour (regular or overtime costs) and equipment charges associated with the clearing of the service connection to be able to complete the camera work in accordance with Schedule "D". 7. TERMS OF CHARGES AND RATES PAYABLE 7.1 All charges/rates payable under this Bylaw, except metered accounts, shall be due and payable every four (4) months on demand. The billing cycles will be as follows: January 1 - April 30 (due last business day in April) May 1 - August 31 (due last business day in August) September 1 - December 31 (due last business day in December) 7.2 Metered accounts shall be billed bi-monthly (every two [2] months). The billing cycles will be as follows: November 1 - December 31 Consumption billed in January Due last business day in February January 1 - February 28 Consumption billed in March Due last business day in April March 1 - April 30 Consumption billed in May Due last business day in June May 1 - June 30 Consumption billed in July Due last business day in August July 1 - August 31 Consumption billed in September Due last business day in October September 1 - October 31 Consumption billed in November Due last business day in December 7.3 As soon as is practicable after each due date, an amount equal to two percent (2%) shall be added to any amount outstanding at the end of the billing period. Any amount so added shall be deemed to be charges/rates due. 7.4 All charges/rates, except metered accounts, prepaid by April 30th for the whole of the then current year, are subject to a five percent (5%) discount. 7.5 When charges/rates due under this Bylaw remain unpaid on the 31st day of December, the same shall be deemed to be taxes in arrears in respect of the property to which the service was provided and shall forthwith be entered on the real property tax roll as taxes in arrears. 8. REPEAL AND EFFECTIVE DATE 8.1 The "City of Cranbrook Sewer Rates Bylaw 3945, 2018" and all amendments are hereby repealed. 8.2 This Bylaw shall come into force and take effect on January 1, 2024. Industrial Surcharges - The City may impose surcharges on the sewer rates for any industry or manufacturing plant which may discharge pollutants into the City's sanitary sewer system. These surcharges shall be based on the City's costs for additional treatment. 13. The foregoing rates shall not apply to users who are receiving water on a metered basis. The sewer rate for these users will be based on the proportionate share of sewer to water rates "For each Residential Unit". Dwelling units above or in connection with stores, offices, or other places of business shall be charged at rates for dwelling units independent of the rates for the place of business except where the licensed storekeeper or business person lives in the dwelling unit, and where the number of water fixtures including hot and cold water do not exceed eight (8) in number, in which case only the business rate for sewer shall be charged. Premises not connected with the City's sewer mains and where permission has been granted by the City to obtain sewer from other premises or stand pipe connected with the City's sewer mains shall be charged at a rate consistent with use shown in this Schedule.
