CITY OF DUNCAN BYLAW NO. 3116, 2014 A BYLAW TO REGULATE FIREWORKS WHEREAS Section 8 of the Community Charter authorizes a Council, by bylaw, to regulate, prohibit and impose requirements in relation to firecrackers, fireworks and explosives; NOW THEREFORE the Council of the City of Duncan in open meeting assembled, hereby ENACTS AS FOLLOWS: 1. Title This Bylaw may be cited as the "Fireworks Regulation Bylaw No. 3116, 2014." 2. Definitions: "Fireworks" means high-hazard fireworks used for recreation, classified in Class 7, Division 2, Subdivision 2 of the Canada Explosives Act and Regulations, and includes Fire Crackers and Roman Candles 3. Administration: 3.1 No person shall sell or dispose of fireworks within the City of Duncan. 3.2 Per person shall set off or discharge fireworks within the City of Duncan. 3.3 Notwithstanding the provisions of this Bylaw, fireworks may be sold to and discharged by a person or organization conducting a public display with the written permission of the Chief Administrative Officer of the City of Duncan. 4. Offence: 4.1 Every person who violates a provision of this Bylaw, or who consents, allows or permits an act or thing to be done in violation of a provision of this Bylaw, or who neglects or refrains from doing anything required by a provision of this Bylaw, is guilty of an offence and is liable, upon summary conviction, to a fine not exceeding $10,000 and not less than $100.00. 4.2 Each day that a violation continues or exists under this Bylaw is a separate offence. 5.
