AND WHEREAS Section 194 of the Community Charter authorizes municipalities by bylaw to impose fees in respect of a service of the municipality or provision of information; AND WHEREAS Council deems it necessary and desirable to exercise the authority provided by the Community Charter to cover costs of providing services and information; THEREFORE BE IT RESOLVED that the Council of the City of Enderby in open meeting assembled, HEREBY ENACTS AS FOLLOWS: 1. This Bylaw may be cited for all purposes as "CITY OF ENDERBY FEES AND CHARGES BYLAW NO. 1479, 2010." 2. The City of Enderby imposes fees for the provision of services and information as specified in Schedules 1 to 9 inclusive. 3. Fees or charges imposed under this Bylaw for the provision of services or information apply instead of fees or charges imposed under other bylaws for the same services or information. 4. The following Bylaws are hereby repealed. "City of Enderby Schedule of Fees Bylaw No. 1280, 2000" and all amendments thereto, are hereby repealed. "Development Application Fee Bylaw No. 1391, 2007" and all amendments thereto, are hereby repealed. Page 10 of 21 Consolidated Fees and Charges Bylaw No. 1479, 2010 Non-Metered Rates - Where metering is not possible, consumption is based on the average usage for the same property class. - Where metering is possible, but refused, the user fee per period will be based on 500 m³ of consumption for the Jan - Apr and Sep - Dec periods and 1,000 m³ of consumption for the May - Aug period. These consumption amounts will increase by 25 m³ in the Jan - Apr and Sep - Dec periods and by 50 m³ in the May - Aug period each year. - For properties located outside of City limits, an annual flat rate fee will be charged in addition to the User Fee. This flat rate fee will be equivalent to the annual frontage tax rate charged consistent with the City of Enderby Water Frontage Tax Bylaw and will be based on 100 feet of taxable frontage. Late Penalty Where payment is not made on or before the due date established by the Chief Financial Officer for each billing period there shall be payable a penalty of three (3%) percent on the total balance outstanding. For license fees paid by new residents and new dog owners after June 30th in each calendar year, a fifty percent (50%) discount shall apply. 2. Building Permit File Closing Fee (Refundable): In addition to other fees and charges payable in accordance with this Schedule at the time of permit issuance, a file closing fee will apply for all building permits as follows: a. Where construction value is less than $10,000 100.00 b. Where construction value is between $10,000 and $50,000 150.00 c. Where construction value is between 50,001 and $100,000 300.00 d. Where construction value is in excess of $100,000 500.00 8. When all works associated with a building permit are completed and a final inspection has been approved within twenty-four (24) months of the date of permit issuance, the City of Enderby will refund the Building Permit File Closing Fee as follows: a. Where construction value is between $50,001 and $100,000 300.00 d. Where construction value is in excess of $100,000 500.00 9. Building Permit Deposit Liability (Refundable): a. Liability Deposit - refundable (with interest) upon final inspection and with no damage incurred to City infrastructure 350.00 Where the works associated with a permit are not completed within twenty-four (24) months of the date of permit issuance, there will be no refund of the Building Permit File Closing Fee. Any re-inspection fees or fines assessed against the owner/permit holder during the period of construction will also be deducted from the Building Permit File Closing Fee. In addition, if Notice on Title is required, there will be no refund of the file closing fee. Failure to Attend Scheduled Inspection $550.00 Inspections may be either per unit or per structure depending upon the nature of the building and any other occupancies contained therein. All fees and charges unpaid as of December 31st of the year in which they were incurred shall be deemed in arrears in respect of the property and be entered on the real property tax roll in the following year as a special charge.
