THE CORPORATION OF THE VILLAGE OF FRUITVALE
BYLAW NO. 967, 2024
A Bylaw to Regulate Traffic and Parking in the Village of Fruitvale
The Council of the Corporation of the Village of Fruitvale, in open meeting
assembled, enacts as follows:
1.
INTERPRETATION
1.1
In this Bylaw, subject to Subsection 1.2, and unless the context
otherwise requires, words shall be defined in the Motor Vehicle Act.
1.2
In this Bylaw, unless the context otherwise requires:
"Administrator" means the Administrator appointed by the Council
for the Village;
"Bylaw Enforcement Officer" means an employee or a contractor of
the Village of Fruitvale, appointed by Council for the enforcement of
Village Bylaws;
"Centre Median" means an area designed for the segregation of
lanes of traffic on a
roadway, designated either by lines or by landscaping;
"Council" means the Council of the Village of Fruitvale;
"Commercial Vehicle" means a vehicle designed primarily for the
conveyance of passengers with a seating capacity greater that 9
persons, or a truck with a licensed gross vehicle weight greater that
5000 kilograms (11,022.93 pounds);
"Curb" means the line of demarcation between the roadway and the
boulevard, or the line of demarcation between the roadway and the
sidewalk;
"Fire Chief" means the Fire Chief of the Fruitvale Fire Department;
"Fruitvale Detachment" means any police force having jurisdiction
in the Village of Fruitvale or the Greater Trail Area;
"Lane" means any highway abutting the rear or sidelines of parcels of
land and intended primarily to give access to the rear of residences or
business establishments;
"Loading Zone" means the area or space on a roadway established
for the loading or unloading of materials or passengers;

"Parking" means the standing of a vehicle, whether occupied or not,
except when standing temporarily for the purpose of, and while
actually engaged in, loading or unloading merchandise, discharging or
taking on passengers, or in obedience to traffic regulations or traffic
signs;
"Police Officer" means any member of a police force serving the
Fruitvale or Greater Trail Area;
"Stopping", when prohibited, means the coming to rest or the state
of being at rest of a vehicle;
"Street" includes public road, highway, bridge, viaduct, lane and any
other way normally open to the use of the public for the passage of
vehicles, every private place or passageway to which the public, for
the purpose of the parking or servicing of vehicles, has access or is
invited;
"Traffic Control Device" means a regulatory or warning sign, signal,
line, meter, marking, space, barrier, or device placed or erected by
authority of the Council or person
duly authorized by the Council to exercise such authority;
"Trailer" means every vehicle without motor power designed for
carrying persons or property, and for being drawn by a motor vehicle,
and includes a semi-trailer as defined in the Commercial Transport
Act;
"Village" means the Village of Fruitvale;
"Village Solicitor" means the Solicitor appointed by Council for the
Village.
PART I - EXTRAORDINARY TRAFFIC
1.
DEFINITIONS - PART I
1.1
In this part "extraordinary traffic" includes any carriage of goods or
persons over a street, at either one or more times, and whether in
vehicles drawn by animal power or propelled by some other means,
which taken in conjunction with the nature or existing condition of the
street is so extra ordinary or improper in the quality or quantity of the
goods or the number of persons carried, or in the mode of use of the
street, or in the speed at which the vehicles are driven or operated, as
to, in the opinion of the Council, substantially alter or increase the
burden imposed on the street through its proper use by ordinary
traffic, and to cause damage and expense in respect of the street
beyond what is reasonable or ordinary.

2.
REGULATION OF EXTRAORDINARY USE
2.1
Where, in the opinion of the Council, any street is liable to be damaged
through extraordinary traffic thereon, Council may by resolution
regulate the time of operation, speed of vehicle, weight restriction and
route and further limit, or prohibit the use of the street by any person
operating or in charge of the extraordinary traffic, or owning the goods
carried thereby, or the vehicles used therein.
2.2
Every person driving on or using the street in contravention of a
regulation, limitation, or prohibition, passed pursuant to Subsection
2.1, shall be guilty of an offence.
2.3
Any person to whom this section might otherwise apply may, with
the approval of the Council, enter into an agreement for the payment
to the Village of compensation in respect of the damage or expense
which may, in the opinion of the Council, be caused by the
extraordinary traffic, and thereupon that person shall not in respect of
that traffic be subject to any prohibition or penalty prescribed by this
section.
2.4
The Council may by resolution close to traffic or use any street at such
time and for such period of time and in respect of such classes of
traffic or use as in its opinion may be necessary for the construction or
protection of any street.
3.
APPLICATION AND POWERS
3.1
This part shall not apply to arterial or secondary highways within the
meaning of the Highway Act.
3.2
The powers in this part exercisable by the said Council in respect of
extraordinary traffic may be exercised by the said Council or by such
person as may be appointed for that purpose by resolution of the said
Council.
PART II - TRAFFIC PASSING IN THE VICINITY OF SCHOOLS
4.
SCHOOL PATROLS
4.1
The principal of any regular day school in the Village may appoint from
among the students a School Patrol to assist pedestrians in crossing
streets at designated school crosswalks.
4.2
A member of a School Patrol may control the movement of traffic at
such designated school crosswalks by exhibiting a manual traffic
control device of a design approved by resolution of the Council.

4.3
Drivers of vehicles and pedestrians shall obey the instructions of any
approved traffic control device exhibited by a member of a School
Patrol at designated school crosswalks.
PART III - TRAFFIC UNDER SPECIAL STREET CONDITIONS
5.
WORK IN PROGRESS
5.1
On any street in the Village where construction, reconstruction,
widening, repair, marking, or other work is being carried out, the
Village Works Foreman shall erect traffic signs indicating that crew and
equipment are working on that street.
5.2 On any street in the Village where construction, reconstruction,
widening, repair, marking, or other work is being carried out, the
Village Works Foreman may erect traffic signs to limit the rate of
speed of vehicles, or to restrict the manner in which a vehicle shall
proceed upon such a street, or to prohibit vehicles from proceeding
thereon.
5.3
Where traffic signs are erected or placed on a street pursuant to
Subsections 5.1 and 5.2, no person shall drive or operate a vehicle at
a speed greater than, or in a manner different from, that indicated on
the signs.
5.4
The Council hereby approves the appropriate designs set out in the
"Traffic Control Manual For Work on Roadways - June 1991", as
published by Highway Engineering Branch of the Provincial Ministry of
Transportation and Highways, as signs to be used by the Village Works
Foreman when acting pursuant to Subsections 5.1 and 5.2 of the
Bylaw.
5.5
Where the Village Works Foreman deems it necessary to close to
traffic temporarily any street in the Village, he may, in addition to
erecting signs pursuant to Subsection 5.2, place and maintain or cause
to be placed and maintained a good and sufficient barrier or barriers at
all entrances to the said street to indicate such closure.
5.6
Where a barrier has been erected by the Village Works Foreman
pursuant to Subsection 5.5, no unauthorized person shall remove,
interfere with, or pass beyond such barrier, or enter such closed area
in a vehicle.
PART IV - SIZE AND WEIGHT OF VEHICLES
6.
DIMENSIONS OF VEHICLES AND LOADS
6.1
Subject to the provision of Section 11 of the Bylaw, no person shall
drive or operate on any street:

a) a vehicle having a total outside width, unladen or with load, in
excess of 2.6 metres (8.53 feet);
b) a vehicle having a height, unladen or with load, in excess of 4.12
metres (13.56 feet);
c) a single vehicle having a length, inclusive of front and rear
bumpers and load, in excess of 10.7 metres (35.11 feet).
6.2
Subject to the provisions of Section 11 of the Bylaw, no person shall
drive or operate on any street a bus or stage having a length, inclusive
of front and rear bumpers and load, in excess of 10.7 metres (35.11
feet), provided that any vehicles operated on any transit route as part
of the passenger transportation system of the Village or as part of any
inter-city or other long distance passenger transportation system
operating on routes approved by the Council shall not exceed an
overall length of 12.5 metres (41.01 feet) inclusive of front and rear
bumpers, if so equipped.
7.
WEIGHTS OF VEHICLES
7.1
Subject to the provisions of Section 11 of this Bylaw, no person shall
drive or operate on any street:
a) a vehicle, any axle of which is carrying a gross weight in excess
of 9,100 kilograms (20,061.73 pounds), provided that any
motor-vehicle operated on any transit route as part of the
passenger transportation system of the Village may have a gross
axle weight not exceeding 10,000 kilograms (22,045.86 pounds);
b) a vehicle or combination of vehicles having a gross weight on any
group of axles, having reference to the distance between the first
and last axles in any such group, measured longitudinally to the
nearest metre, in excess of that shown in Schedule "A" to this
Bylaw;
c) a vehicle so loaded that the gross weight on any wheel thereof is
in excess of 110 kilograms per centimetre (242.51 pounds per
inch), of width of pneumatic tires or 55 kilograms per centimetre
(121.25 pounds per inch) of width of metal or solid rubber tires;
d) a vehicle having a gross vehicle weight in excess of the licensed
gross vehicle weight for which the vehicle is licensed under the
Commercial Transport Act.
7.2
Nothing contained in Subsection 7.1 regarding the weights of vehicles
shall relieve the driver or operator of any vehicle from complying with
the load limits applicable to or posted on any street.

8.
TYPES OF VEHICLES AND TIRES
8.1
Subject to the provisions of Section 11 of this Bylaw, no person shall
drive or operate on any street:
a) a combination of vehicles consisting of more than two vehicles;
b) a vehicle, other than a horse-drawn vehicle, the wheels of which
are not equipped with rubber tires in good order. This subsection
shall not apply to vehicles used in connection with construction
work when drawn by another vehicle, nor to agricultural
implements;
c) a vehicle equipped with solid rubber tires, the thickness of which
is less that 32 millimeters (1.26 inches) between the rim of the
wheel and the surface of the street;
d) a vehicle having wheels, tires, or tracks constructed or equipped
with projecting spikes, cleats, ribs, clamps, flanges, lugs, or other
attachments or projections which extend beyond the tread or
traction surface of the wheel, tread or track, provided that
nothing in this clause is intended to prohibit the use of snow
chains during the period from October 1st to March 31;
e) a straddle truck, unless such vehicle conforms to all Provincial
laws and Village regulations and complies with the following
conditions:
i)
the length of load carried shall not exceed 8.6 metres (28.22
feet)
ii) the load carried shall not extend more than 185 centimetres
(6.07 feet) in front of the vehicle;
iii) wheels and chains shall be equipped with guards approved by
the police officer in charge of the Fruitvale Detachment;
iv) the straddle truck shall be equipped with a signal device
approved pursuant to the regulations under the Motor Vehicle
Act, and mounted on the vehicle at a height not exceeding
127 centimetres (50 inches) from the ground and in a manner
satisfactory to the police officer in charge of the Fruitvale
Detachment;
v) the straddle truck is so designed that the driver has a clear
view of the roadway at and beyond a point 9.0 metres (29.53
feet) in front of the vehicle measured from the foremost
portion of the front of the vehicle;

f) A vehicle equipped with a boom, crane or similar projection:
i)
extending a distance greater that 1 metre (3.28 feet) beyond
the foremost portion of the vehicle when the projection is less
than 3 metres (9.85 feet) above the ground:
ii) extending a distance greater that 3.7 metres (12.14 feet)
beyond the foremost portion of the vehicle when the
projection is 3 metres (9.85 feet) or more above the ground;
and
iii) that is more than 4.3 metres (14.11 feet) above the ground;
g) a vehicle with a boom, crane or similar projection unless such
projection is equipped with lights that light up the forward end of
such projection so that it may clearly be seen from both the front
and side of the vehicle. Such lights shall be lit at all times in
accordance with regulations pursuant to the Motor Vehicle Act
regarding headlights.
9.
SPEED OF CONSTRUCTION VEHICLES
9.1
No person shall drive or operate on any street:
a) a solid rubber-tired vehicle at a greater rate of speed than 15
kilometres (9.32 miles) per hour;
b) a vehicle having an axle load, tire load or gross load in excess of
the limits prescribed by this Bylaw at a greater rate of speed than
that set out in the permit issued pursuant to Section 11;
c) subject to the provisions of Section 10 and 11 of this Bylaw, a
vehicle equipped with a boom, crane or similar projection
extending a distance greater than 1 metre (3.28 feet) beyond the
foremost portion of the vehicle, at a greater rate of speed that 30
kilometres (18.64 miles) per hour.
10.
EXEMPTIONS
The provisions of this part of the Bylaw governing size, weight, load, speed, or type
of vehicle shall not apply to vehicles operated by the Fruitvale Fire Department or
other emergency services vehicles, or to vehicles operated by the Village.
11.
PERMITS
11.1 No person shall drive or operate a vehicle on any street, either
unladen or with load, exceeding any of the limitations contained in this
Bylaw unless a permit in writing has been issued pursuant to this
Section by the Administrator.

11.2 Any owner or operator of a vehicle who desires a permit required
pursuant to Subsection 11.1 shall make an application in writing to the
Administrator and shall provide such particulars in the application as
the Administrator may require.
11.3 Notwithstanding the provisions of this Bylaw and subject to the
provisions of Subsection 11.6, the Administrator may, by special
permit in writing, authorize the operation and driving of vehicles which
are otherwise prohibited by this Bylaw from being operated or driven
on streets.
11.4 The operating and driving of any vehicle for which the permit has been
issued shall at all times be subject to the conditions stated therein.
11.5 A permit shall be carried in the vehicle whenever it is being driven on
streets and shall be produced to any police officer or Bylaw
Enforcement Officer for inspection upon request.
11.6 The Administrator may grant:
a)
a permit authorizing a single trip for any vehicle which exceeds
the limitations set out in the Bylaw regarding size, weight or load.
An application for such permit shall be made not less than 24
hours in advance of the time the trip is to be made;
b)
a permit authorizing more than one trip for any vehicle which
exceeds the limitations of this Bylaw regarding size, weight, or
load, subject to the following conditions:
i)
such permit shall not be valid for a period exceeding 12
months and, in any event, shall terminate on the 31st day of
December in every year;
ii) if the vehicle, or the vehicle and load together, do not exceed
3 metres (9.84 feet) in width, 4.5 metres (14.76 feet) in
height, or 23 metres (75.46 feet) in length, there shall be no
limitation of the number of trips to be made unless considered
necessary by the Administrator;
iii) if the vehicle, or the vehicle and load together, exceed 3
metres (9.84 feet) in width but are not greater than 3.6
metres (11.81 feet) in width, or exceed 23 Metres (75.46
feet) in length but are not greater than 24.4 metres (80.05
feet) in length then the holder of such permit shall apply to
the Administrator for approval of each trip being made by
such vehicle;
vi) all trips are confined to a route or routes approved by the
Administrator;

v) the permit may include the days of the week, time of day, and
maximum number of trips per day.
11.7 A permit issued pursuant to this Section may, in addition to any other
limitations, prohibit the operation or driving of the vehicle concerned
on any street during the periods from 7:00 a.m. to 9:00 a.m. and 3:30
p.m. to 6:00 p.m.
11.8 When a permit is issued for more than one trip with respect to the
weight, height or width of a vehicle, such permit may specify the
maximum rate of speed at which such vehicle may travel and no driver
or operator of a vehicle under permit shall drive such vehicle in excess
of the speed specified.
11.9 Any permit issued pursuant to this Section shall be subject to
immediate cancellation in the event of any condition of the said permit
being violated or in the event of false information being given by the
applicant.
11.10 If the vehicle or the vehicle and load together exceed 4.3 metres (14.1
feet) in width, 24.4 metres (80.05 feet) in length or 4.6 metres (15.09
feet) in length, the Administrator may require that such vehicle or
straddle truck be preceded and/or followed by a pilot car suitably
identified with red flags and/or flashing lights satisfactory to the
Administrator and police officer in charge of the Fruitvale Detachment.
11.11 Before any permit is issued pursuant to this Section the applicant shall
deposit with the Village a bond of indemnity or a copy of an insurance
policy to secure payment to the Village of the cost of repairing or
reconstructing any highway or other property of the Village damaged
by reason of the driving or operating of the vehicle for which the
permit is granted. Such bond or insurance policy shall be in the
amount prescribed by the Administrator and shall be in a form
satisfactory to the Village Solicitor.
12. WEIGHING AND INSPECTION OF VEHICLES
12.1 Any person driving or operating a vehicle on any street, when so
directed by a police officer shall:
a) stop such vehicle at such time and place as directed for the
purpose of weighing, measuring, or inspecting the vehicle or load
carried;
b) drive the vehicle to the nearest public scales for the purpose of
weighing such vehicle;
c) re-arrange the load upon the vehicle or remove the whole or any
part of the load from the vehicle as may be necessary to comply

with the provisions of this Bylaw before continuing to drive or
operate such vehicle.
13. SPILLING OF VEHICLE LOADS ON STREETS; SECURING OF LOADS
13.1 The driver of any vehicle and also the owner of any commercial vehicle
shall take all necessary precautions to ensure that no articles,
substance or material transported or carried thereon shall blow, drop,
spill or fall from such vehicle on to any street.
13.2 In the event that any article, substance or material shall, due to any
cause whatsoever, blow, drop, spill or fall from any vehicle on to any
street, the driver of such vehicle shall forthwith take all reasonable
precautions to safeguard traffic using such street and shall also
remove such material from the street.
13.3 No person shall drive, ride or propel any vehicle containing any
sawdust, or garbage on any street in the Village unless such vehicle
shall be kept tightly and securely covered in such manner as to
prevent any of the sawdust or garbage from being blown, dropped or
spilled from the vehicle.
13.4 The driver or operator of any vehicle carrying loads of lumber or loads
of a similar nature shall:
a) securely chain the load using at least two chains for a load not
exceeding 3.2 metres (10.5 feet) in height measured from the
ground, and at least three chains for a load
exceeding 3.2 metres (10.5 feet) in height, provided that the
driver or operator of a straddle truck shall be deemed to have
complied with the provisions of this clause when the load is
mechanically clamped and secured in position;
b) place the load so that two-thirds of the bulk length thereof shall
be forward of the rear axle;
c) strip all lumber loads in conformity with the stripping regulations
contained in the "General Accident Prevention Regulations" of the
Provincial Worker's Compensation Board;
d) Not permit such loads to exceed the following height restrictions
measured from the ground:
i) for a vehicle weighing 2,700 kilograms (5,952.38 pounds) or
less, a maximum height of 2.7 metres (8.85 feet);
ii) for a vehicle weighing over 2,700 kilograms (5,952.38
pounds) but not exceeding 3,600 kilograms (7,936.5 pounds),
a maximum height of 3.2 metres (10.5 feet);

iii) for a vehicle weighing over 3,600 kilograms (7,936.5 pounds),
a maximum height of 3.8 metres (12.46 feet).
13.5
Subject to the provisions of Subsection 8.1 (e)(ii), (f)(i) and (ii), the
load upon any vehicle or combination of vehicles shall not extend more
than 1 metre (3.28 feet) beyond the front wheels or bumper of the
vehicle.
13.6
The load upon any privately owned passenger vehicle shall not extend
beyond the line of the fenders on the left side of such vehicle nor more
than 15 centimetres (5.9 inches) beyond the line of the fenders on the
right side thereof.
PART V - GENERAL
14. PARKING PROHIBITIONS
14.1
Except as directed by a Peace Officer or Bylaw Enforcement Officer or
as permitted by a traffic control device, no person shall stop or park a
vehicle:
a) 48 HOURS: on a street for a continuous period of time for more
than 48 hours within the same block;
b) BRIDGE: on a bridge or other elevated structure on a street;
c) BUS LOADING ZONE: in any designated bus loading zone;
d) CROSSWALK: on a crosswalk or within 6 metres of the approach
side of a crosswalk;
e) DISTANCE FROM CURB: on a street more than 30 centimetres from
the curb of such street if a curb has been constructed;
f) DOUBLE PARKING: on the street side of a vehicle that is stopped or
parked at the edge or curb of a street;
g) DRIVEWAY: partially or fully in front of a public or private
driveway;
h) HYDRANT: within 5 meters of a fire hydrant measured from a point
in the curb or edge of the street which is closest to the fire hydrant
to the nearest wheel of the vehicle;
i)
INTERSECTION: in an intersection;
j)
LANES: in any lane in such a manner or under such conditions as
to leave available less than 3 metres of the usable traveled portion
of such lane for the free movement of vehicular traffic;

k) OBSTRUCTION: alongside or opposite a street excavation or
obstruction when stopping, standing or parking obstructs traffic;
l)
OVERTIME: on a street where the length of time allowed for
parking is controlled by a traffic control device, in contravention of
the length of time indicated on the applicable traffic control device;
and where a vehicle has been parked at a time-controlled parking
space for the maximum period of time, the owner or operator of
such vehicle shall not permit the parking of such vehicle in the
same or any other parking space on either side of the same block
within the same twenty-four hour period;
m) PARKING PROHIBITION: in a place that contravenes a traffic
control device that gives notice that stopping, standing or parking
there is prohibited;
n) PARKING STALLS: in contravention of painted lines or markers
indicating single parking stalls parallel to the street or angled from
the street;
o) PATHS: on a bicycle path, pedestrian walkway or equestrian trail;
p) SALES: on a street for the purpose of
i)
displaying a vehicle for sale;
ii)
advertising,
greasing,
painting,
wrecking,
storing
or
repairing a vehicle, except where repairs are necessitated by
an emergency;
iii)
displaying signs; or
iv)
selling flowers, fruit, vegetables, or other commodities or
articles;
q)
SIDEWALK: on a sidewalk, either completely or partially;
r)
SIGN: within 6 metres of the approach to a flashing beacon, stop
sign or traffic control signal located at the side of a street;
s)
VISIBILITY: in a manner that obstructs the visibility of a traffic
control device;
t)
WITHOUT CURBS: on the paved portion of any street without a
curb, unless the pavement of the travel lane is at least 3.65
metres in width measured from the edge of pavement to the
centerline of the road;
u)
WRONG SIDE: upon a two-way street, other than on the right
side of the street and with the right-hand wheels parallel to that
side;
v)
UNLICENSED VEHICLE: on any street without valid license plates;

w)
OVERNIGHT OCCUPANCY: on any street for the purpose of taking
up temporary residence or overnight accommodation between the
hours of 9:00 P.M. and 6:00 A.M.;
x)
IMPEDE CITY MAINTENANCE: in a manner that impedes,
prohibits, or obstructs a city maintenance function including but
not limited to snow removal and street sweeping;
y)
DOWNTOWN: on any street within the area shown outlined in red
on Schedule "B" of this bylaw, between the hours of 1:00 a.m.
and 6:00 a.m. on any day, a:
i)
Commercial vehicle;
ii) Trailer; or
iii) Any recreational vehicle with gross vehicle weight greater
than 5000 kilograms.
15. BYLAW OFFENCES
Except where otherwise specifically provided for, every person contravening or
committing any offence against any of the provisions of this Bylaw, or of the
resolutions pursuant thereto, or refusing, omitting, or neglecting to fulfill, observe,
carry out, or perform any duty or obligation imposed by this Bylaw, or by the said
resolutions, is liable to a fine of not more than $2,000, or to imprisonment for a
term of not more than 2 months.
16. MEASUREMENTS IN METRIC UNITS
Metric units are used for all measurements and standards in this Bylaw. The
approximate equivalents of the metric standards in the Imperial System of Weights
and Measures, shown in brackets following each metric standard, appear for
convenience only and do not form part of this Bylaw.
17.
SEVERABILITY
If any Section, Subsection, Paragraph, Clause or Phrase of this Bylaw is for any
reason held to be invalid by the decision of a court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this Bylaw.
18.
REPEAL
That Traffic Regulation Bylaw No. 778, 2007 and amendments thereto be repealed.
19.
CITATION
