G~t!i~N TOWN OF GOLDEN Traffic, Parking & Streets Regulations Bylaw No. 1482, 2024 Page I 1 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations TOWN OF GOLDEN BYLAW NUMBER 1482, 2024 TRAFFIC, PARKING & STREETS REGULATIONS This Bylaw is to regulate traffic, Parking, and the use of all public highways, streets, boulevards, and sidewalks within the Town of Golden. Pursuant to the Community Charter, Local Government Act and the Motor Vehicle Act, which authorize Council to regulate traffic, Parking and the use of all public highways, streets, boulevards and sidewalks within the Town, the Council of the Town of Golden, in open meeting assembled, HEREBY ENACTS AS FOLLOWS: 1. CITATION 1.1 This Bylaw may be cited for all purposes as the "Town of Golden Traffic, Parking & Streets Regulations Bylaw No.1482, 2024." 2. DEFINITIONS AND INTERPRETATION 2.1 In this Bylaw: "All Terrain Vehicle (ATV)" means a Vehicle with wheels or Tracked Vehicle designed primarily for recreational use or for the transportation of people, property, or equipment exclusively on marshland, open country or other unprepared surfaces and includes any Trailer attached to the Vehicle. "Angle Parking" means Parking at a 45-degree angle with the Curb or at a 45-degree angle with the Roadway where there is no Curb. "Automotive Business" means a person engaged in selling, repairing, servicing, storing, washing, Parking or transporting Motor Vehicles or Trailers for a fee or other consideration. "Bicycle" means a device having any number of wheels that is exclusively propelled by human power on which a person may ride astride and not including an E-Bike or an E-Scooter. "Boulevard" means that portion of a Street between the curb lines or the lateral boundary lines of a roadway and the adjoining property or between curbs on median strips or islands but does not include Curbs, Sidewalks, ditches or driveways. "Bylaw Enforcement Officer" means any person appointed or designated to assist in enforcing municipal laws and the regulations as set out in this Bylaw. "Commercial Vehicle" means a Motor Vehicle or a combination of a Motor Vehicle and one or more Trailers that is: a. licensed as a Commercial Vehicle pursuant to the Commercial Transportation Act; or, b. used for the collection or delivery of goods, wares, merchandise, and other commodities for a fee or other consideration. Page I 2 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations "Council" means the Municipal Council of the Town of Golden. "Crosswalk" means: a. any portion of a Roadway that is distinctly indicated for Pedestrian crossing by one or more Traffic Control Device; or b. the portion of a Roadway at an Intersection that is located within the connection of the lateral lines of the Sidewalks on the opposite sides of the Street, measured from the Curbs or, in the absence of Curbs, from the edges of the Roadway. "Curb" means the raised structural element which may be installed at the outside edge of a Roadway or the division point between the Roadway and the Boulevard or Sidewalk. "Director of Public Works" means the person holding the position of Director of Public Works for the Town, or their designate. "Disability Parking Permit" means a valid hanger or decal issued: a. pursuant to the Motor Vehicle Act and the Regulations thereunder by the Social Planning and Review Council of British Columbia (SP ARC BC); or b. by another province or foreign jurisdiction with respect to the Parking of Vehicles owned or operated by persons with disabilities. "Disability Parking Zone" means a Parking Space identified by a Traffic Control Device for the exclusive use of Vehicles displaying a Disability Parking Permit. "Downtown Area" means the area generally shown in Schedule B, and specifically described as the area bounded by the Kicking Horse River, 7th Street North, and Highway 95. "Emergency Vehicle" means an Emergency Vehicle as defined in the Motor Vehicle Act. "E-Bike" - means a device with two or three wheels, a seat, pedals and an electric motor or motors with a power output not exceeding 500 watts in total, but not including any devices with a power output exceeding 500 watts in total or powered using electricity generated by the combustion of gas. "E-Scooter" means: a. a device that is designed to be: 1. solely self-propelled, or 11. self-propelled with the capability to be propelled by human power b. has up to 4 wheels, each of which is not more than 430 mm in diameter, placed along a longitudinal axis, with one to 2 wheels at the front of the device and one to 2 wheels at the rear; c. has a platform for standing along the longitudinal axis between the front wheels and the back wheels of the device and is designed to be operated while the Operator is standing on the platform; d. has a steering handlebar that acts directly on the steerable wheels at the front of the device Page I 3 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations is designed to transport one person is not a motor assisted cycle or another device that has pedals, and does not have a seat, or a surface or structure that could be used as a seat, or a structure that encloses the electric kick scooter. is powered solely by one or more electric batteries, and is not capable of propelling the device at a speed exceeding 25 km/h when the device is being operated on a clean, paved and level surface, and 1. has a continuous power output rating that, in total, does not exceed 500 W. But does not include a regulated motorized personal mobility device as defined in the Motor Vehicle Act, an E-Bike, or a motorized Wheelchair. "Gross Vehicle Weight" means the aggregate weight of an unloaded Commercial Vehicle and either the weight of its load or where the weight of a load cannot be determined, the maximum weight of the load that the Commercial Vehicle is licensed to carry. "Highway" includes: e. f. g. 1. 11. h. a. Provincial arterial Highways designated as such under the Transportation Act, including the Intersection between a Provincial arterial Highway and a Street and interchange between a Provincial arterial Highway and a Street; "Industrial Road" includes Industrial Roads as defined in the Industrial Roads Act, a forest service road as defined in the Forest Act and land designated as a development road under section 139(1) of the Petroleum and Natural Gas Act. "Intersection" means the junction of more than one Roadway, other than a junction that includes a Lane. "Lane" means a Street not exceeding 6 metres in width, which is not designated for general travel, and which is used primarily to provide access to the rear of residences and business establishments. "Loading Zone" means an area on a Street designated for the loading or unloading of materials or passengers. "Motorcycle" means a Motor Vehicle with two or three wheels, foot pegs instead of functioning pedals, and a saddle or seat for the driver to sit astride, including an electric Bicycle or motor- assisted cycle with a power output exceeding 500 watts in total or powered using electricity generated by the combustion of gas, but does not include an E-Bike. "Motorized Mobility Aid" (MMA) means a personal mobility device powered by an electric motor intended for use by persons with physical mobility challenges. "Motor Vehicle" means a Vehicle that is designed to be self-propelled with a source of power other than human power, including a Motorcycle, Semi-Trailer, and Recreational Vehicle, but not including a Vehicle operating on fixed rails or tracks, an electric trolley bus, an ATV, a Trailer, a Snowmobile, a motorized Wheelchair, an E-Bike, or an E-Scooter. Page I 4 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations "Owner/Operator" as applied to a Vehicle means: a. the registered Owner of a Vehicle; b. the registered lessee or renter of a Vehicle; or c. the beneficial Owner of a Vehicle. "Park" means the Standing ofa Vehicle, whether occupied or not, except when Standing temporarily for the purpose of and while engaged in loading and unloading. "Parking Space" means any portion of a Street marked by painted lines or in any other place that is controlled with a Traffic Control Device indicating that it is intended for the parking of a Vehicle, including unmarked parking lots. "Peace Officer" includes any member of the Royal Canadian Mounted Police, a Bylaw Enforcement Officer and any other persons delegated the authority to assist either the Royal Canadian Mounted Police or a Bylaw Enforcement Officer in carrying out their functions under this Bylaw. "Pedestrian" means: a. a person on foot; b. a person in a Wheelchair, whether motorized or not; c. a child in a carriage; or d. a Person with Disabilities on a Motorized Mobility Aid "Permit" means a document issued pursuant to this Bylaw. "Person with Disabilities" means a person whose mobility is limited because of a permanent or temporary disability. "Public Utilities" includes regulated services available to the general public and its related infrastructure such as water, sanitary sewer, storm sewers, electrical, telephone, gas, cablevision lines, fiber lines, and any other buried conduit, pipe or overhead cable. "Recreational Vehicle" includes a Motor Vehicle or a Motor Vehicle and Trailer that is designed or used primarily for accommodation, such as a travel Trailer, tent Trailer, truck with camper or tent, camper van or motor home. "Roadway" means that portion of a Street that has been improved, designed or intended for travel by Motor Vehicles. "Semi-Trailer" includes: a. a Vehicle without motive power designed to be drawn by a Motor Vehicle or Truck Tractor; and b. a pole Trailer; Page I 5 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations but does not include a Motor Vehicle having a Gross Vehicle Weight ofless than 1401kg, when that is licenced under the Motor Vehicle Act. "Sidewalk" includes the area between the Curb lines or lateral lines of a Roadway and the adjacent property lines that has been improved for the use of Pedestrians and any other improved area set apart from the Roadway for primarily Pedestrian use. "Skateboard" means a single platform mounted on wheels on which a person may ride. "Snowmobile" means a Tracked Vehicle that: a. travels on snow or ice; b. has one or more steering skis; c. is self-propelled; and d. has a seat designed for sitting astride. "Special Event" means any event that occurs from time to time with the written permission of the Town, including, without limitation, sports events, religious events, social, cultural or political gatherings and music festivals. "Stop" or "Stand" means: a. when required, stopping completely with no movement; and b. when prohibited, the stopping or standing of a Vehicle, whether occupied or not, except when necessary to avoid conflict with other Traffic or in compliance with the directions of a Peace Officer or Traffic Control Device. "Street" includes land that is vested in the Town pursuant to section 35 of the Community Charter, every right-of-way designed or intended for or used by the public for the passage of Vehicles and Pedestrians, and any other way normally open to the use of the public for travel, including a Roadway, Boulevard, Sidewalk and trail, but not including a Highway, an Industrial Road, or a private right-of-way on private property. "Temporary Licence of Occupation" means legal authority given by the Town for a business, individual, or group to utilize public property to carry out specific activities as per the Town of Golden Temporary Licence of Occupation Policy. "Town" means the area within the boundaries of the Town of Golden. "Tracked Vehicle" means equipment or a Motor Vehicle with a continuous band of treads or track plates that are moved in constant contact with the ground to propel the equipment or Motor Vehicle, including, Snowmobiles, tractors, skid steers, bulldozers, excavators, and tanks. "Traffic" includes Pedestrians, ridden or herded animals, Vehicles, Bicycles, and other conveyances, either singly or together, while travelling on a way open Lo the public. "Traffic Control Device" means a sign, signal, line, marking, painted Curb, space, barrier, or any Page I 6 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations other device, placed or erected by authority of the Minister responsible for the Motor Vehicle Act or the Motor Vehicle Transport Act (Canada), a treaty first nation, Council, or a person duly authorized by the Council to exercise such authority. "Trailer" means a powerless Vehicle that is at any time drawn by a Vehicle, except: a. Vehicles designed and adapted exclusively for use in agricultural operations; b. a side car attached to a Motorcycle, and; c. a disabled Motor Vehicle that is being towed by a tow car, and includes a Semi-Trailer. "Truck Tractor" means a Motor Vehicle designed and used primarily for drawing other Vehicles and not constructed to carry a load other than a part of the Vehicle drawn and of the load of the other Vehicle. "Wheelchair" means a device intended for use by a Person with Disabilities. "Vehicle" means a device in, on or by which a person or thing is or may be transported or drawn, including a Motor Vehicle, a Trailer, an ATV, a Snowmobile, an E-Bike, and an E-Scooter, but not including a device designed to be moved only by human power, a device used exclusively on stationary rails or tracks, mobile equipment, or a motorized Wheelchair. 2.2 Any reference in this Bylaw to a position that is described by using the current title of the position includes the position that: a. is the same position as it may be renamed from time to time; b. assumes responsibility for the subject matter of the position referenced in this Bylaw; or c. is most closely connected to the modified or eliminated position described in this Bylaw. 2.3 Unless otherwise indicated, any reference to an enactment in this Bylaw is a reference to an enactment of British Columbia or the Town, as applicable, as amended from time to time. 3. APPLICATION 3.1 This Bylaw applies to all Traffic and to the activities of persons on Streets and other similar public places in the Town of Golden, other than Highways. In the event of any conflict between the Motor Vehicle Act and the provisions of this Bylaw, the provisions of the Motor Vehicle Act shall prevail. 4. AUTHORITY 4.1 Council may authorize any officer or employee of the Town to make orders in respect of the matters in this Bylaw and thereby to exercise the powers of the Town with respect to those matters under this Bylaw, in accordance with the terms and conditions prescribed in this Bylaw, and in the absence of such authorization, the Director of Public Works is hereby delegated the authority to administer this Bylaw, to make orders in respect of the matters in this Bylaw, and to exercise the powers of the Town in accordance with the terms and conditions prescribed in this Page I 7 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations Bylaw. 4.2 A Peace Officer with grounds to believe that an offence has been committed under this Bylaw may: a. Issue bylaw notices for violations of this Bylaw in accordance with the Local Government Bylaw Notice Enforcement Act; b. Issue municipal ticket information in accordance with the Community Charter and the Bylaw Enforcement Ticket Regulation, BC Reg 425/2003; c. Commence proceedings in accordance with the Offence Act; and d. Impound or detain any Vehicle, Bicycle, or other similar devices Parked, Standing or being operated in violation of this Bylaw. 4.3 A person must comply with any lawful order, direction, signal or command made or given by a Peace Officer for the purpose of directing Traffic. 4.4 A person must not obstruct or impede a Peace Officer in the exercise of performance of their powers, duties or functions under this Bylaw. 4.5 Upon request by a Peace Officer, any person in contravention of any provision of this Bylaw must Stop and provide the Peace Officer with proof of or identification giving their full name, current address and date of birth. 5. GENERAL 5.1 In addition to the other requirements of this Bylaw, a person must operate a Vehicle with due regard for safety, having regard to all the circumstances including but not limited to: a. the nature, condition and use of the Street at the time. b. the amount of Traffic that is on or might reasonably be expected to be on or about the Street. 5.2 Unless otherwise indicated by a Traffic Control Device, no person shall drive any Motor Vehicle within the Town of Golden with a speed in excess of: a. fifty (50) kilometres per hour; or b. thirty (30) kilometres per hour in school and playground zones, or other designated speed zones. 5.3 A person must not at any time drive a Motor Vehicle on a Sidewalk, Boulevard, or trail, except on a permanent or temporary driveway provided for such purpose. 5.4 A person must not at any time operate a Snowmobile, ATV, dirt bike, Snowmobile, or other off- road Vehicle on any Street other similar public place within the Town except in a designated area or when being loaded or unloaded from a Motor Vehicle or Trailer on the Street. 5.5 A person must not at any time use or operate any megaphone, loudspeaker or other sound amplifying device, instrument, or system on any Street for the purpose of broadcasting a message or advertising from a Vehicle, expect with the written permission of the Town. This does not Page I 8 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations apply to an Emergency Vehicle which is in actual use for official duties. 5.6 A person riding an animal or driving an animal-driven Vehicle on a Street has the rights and is subject to the duties of a person operating a Vehicle under this Bylaw. 5. 7 A person must not at any time remove any Traffic Control Device unless authorized by the Town or directed by a Peace Officer to do so. 5.8 A person must not at any time drive a Motor Vehicle through or across any construction zone or Special Event, in a manner that: a. obstructs or impedes the activities being carried out in the construction zone or at the Special Event; b. is contrary to any Traffic Control Device erected for the purpose of controlling Traffic in the vicinity of the construction zone or Special Event; c. is contrary to the directions of a Peace Officer controlling Traffic in the vicinity of the construction zone or Special Event; or d. endangers people. 6. PARKINGREGULATIONS 6.1 Except when necessary to avoid conflict with Traffic or to comply with the law or the directions of a Peace Officer or Traffic Control Device, a person must not, at any time, Stop, Stand, or Park a Motor Vehicle or a Trailer: a. on a Sidewalk or Boulevard; b. so that it is blocking all or part of a public or private driveway; c. within six ( 6) metres of an Intersection unless permitted by a sign; d. within five (5) metres of a fire hydrant measured from that point on the Curb or edge of the Roadway which is closest to the fire hydrant; e. on a Crosswalk; f. within six ( 6) metres of the approach side of a Crosswalk; g. within six (6) metres on the approach to a flashing beacon, stop sign or traffic control signal located at the side of a Roadway; h. within six (6) metres of either side of the entrance to or exit from a hotel, theatre, public meeting place, dance hall, fire hall, school, or playground in a rural area; 1. within fifteen (15) metres of the nearest rail of a railway crossing; J. on a Street or in a Parking Space for the principal purpose of: 1. displaying a Vehicle for sale; or 11. advertising, greasing, painting, wrecking, storing, or repairing any Vehicle, except where repairs are necessitated by an emergency. k. alongside or opposite an excavation in a Street or an obstruction on a Street so as to obstruct Traffic; I. on the Roadway side of a Motor Vehicle or Trailer that is stopped or Parked at the edge of the Roadway, Curb or the areas outlined in section 12.3 of this Bylaw. m. in contravention of a Traffic Control Device that gives notice that Stopping, Standing or Page I 9 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations Parking in that location is prohibited; n. in a manner that obstructs the visibility of a Traffic Control Device; o. adjacent to a painted yellow Curb; p. for a longer period of time than is permitted by any traffic sign applicable to the portion of the Street or the Parking Space where the Motor Vehicle or Trailer is Parked, Stopped or Standing; q. on a Roadway in such a manner as to obstruct or impede the normal flow of Traffic; r. i11 any La11e u1 Loading Zu11e, unless actively engaged in the loading or unloading of goods or passengers; s. in a designated fire Lane; t. on any Street for a period of time in excess of twenty-four (24) hours when mechanically disabled; u. so that it interferes with the removal of snow; or v. in a place contrary to posted parking signage. 6.2 A person must not at any time Park a Motor Vehicle or Trailer on any Street or similar public place within the Town for a period of time in excess of twenty-four (24) hours, except when the Motor Vehicle is: a. Parked in a residential area; b. in operating condition; and c. moved at least once every 72 hours. 6.3 A person must not at any time Park a Motor Vehicle or Trailer on any Street or public place within the Town unless it is validly insured and registered and displaying a license plate or temporary use Permit. 6.4 A person must not at any time Park a Trailer, Recreational Vehicle, or any other similar Vehicle on a Street unless attached to the Motor Vehicle which was used Lu draw it on the Street, 6.5 Where off-Street Parking is available, a person must not at any time Park on the Street or the areas outlined in section 12.3 of this Bylaw. 6.6 A person must Park parallel to a Curb in the same direction as the flow of Traffic, so that the two right wheels of the Motor Vehicle or Trailer are not more than thirty (30) centimetres from the Curb or edge of the Roadway. 6.7 A person must not at any time Stop, Stand, or Park on a Street or in a Parking Space for longer than the maximum period of Parking time posted. 6.8 A person must not at any time Stop, Stand, or Park in a Disability Parking Zone unless the Motor Vehicle displays a Disability Parking Permit. 6.9 A person must not at any time Park within an Angle Parking zone except so that the Motor Vehicle is Parked within the indicated lines or markings, and the right-hand front wheel no more than thirty (30) centimetres from the Curb or Roadway. Page I 10 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations 6.10 Where Angle Parking is permitted but is not marked by lines, a person must not at any time Park so as to create an angle with the Curb or edge of the Roadway that is less than thirty (30) degrees and that is more than forty-five (45) degrees. 6.11 A person must not at any time Park in such a manner that any part of the Motor Vehicle or Trailer extends into the Street: a. From a driveway. b. From a Boulevard. c. Beyond the lines or markings indicating the limit of the Parking Spaces on a section of the Street. 6.12 A person must not Park at any time a Motor Vehicle, including Motor Vehicle with a Trailer, in a Parking Space in the Downtown Area or in a Parking lot owned by the Town: a. exceeding seven (7) metres in length, except at the Town-leased CP Rail Parking lot; and b. for a length of time exceeding twenty-four (24) hours, unless the posted Parking signage permits Parking for longer periods of time. 6.13 An Automotive Business, its owners, staff, employees, and clients, must not Park any Motor Vehicle or Trailer on any Street adjacent to the Automotive Business for longer than twenty- four (24) hours. 6.14 A person must not at any time Park any Motor Vehicle, including a Commercial Vehicle, Truck Tractor, Semi-Trailer, Recreational Vehicle or Trailer, with the front of the unit facing in the opposite direction to the flow of Traffic on the Street or within three (3) metres of the paved portion of the Street or on which the Motor Vehicle is Parked, except in the areas outlined in Schedule C, or specifically referred to as: a. Service Road West; b. Service Road East; c. 10th Ave. North, west of the overpass of Highway 95; d. 11th Ave. North; e. 11th St. North; f. as otherwise posted; or g. in exceptional circumstances such as Highway closures. 6.15 A person must not at any time use a Motor Vehicle or Trailer for the purpose of sleeping while Parked on any Street or in any public place, except in: a. a designated camp site; b. permitted camping spots; or c. on Service Road East and Service Road West. 6.16 A person must not at any time Park a Commercial Vehicle, Truck Tractor, or a Semi-Trailer (commonly referred to as a semi or logging truck), loaded or unloaded, on the Street in any residential zone in Town. Page I 11 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations 6.17 A person must not at any time Park a Commercial Vehicle, Truck Tractor, Semi-Trailer or combinations of the foregoing on any Streets in the Downtown Area. 6.18 A person must not at any time Park a Commercial Vehicle, Truck Tractor, Semi-Trailer or combinations of the foregoing on any Street within the Town for a period exceeding two (2) consecutive hours, except in the areas outlined in Schedule C, or specifically referred to as: a. Service Road West; b. Service Road East; c. 10th Ave. North, west of the overpass of Highway 95; d. 11th Ave. North; e. 11th St. North; f. except as otherwise posted; or g. in exceptional circumstances such as Highway closures. 6.19 All Commercial V chicles identified as carrying dangerous goods must be Parked outside of the Town's municipal boundaries during prolonged Highway closures (in excess of two (2) hours), except where the goods are exempt pursuant to the Transportation of Dangerous Goods Exemptions, including but not limited to Gasoline (UN1203), Turbine Fuel (UN1863), Diesel Fuel (UN1202) and Propane (UN1075). 6.20 A person must not at any time Park an ATV, Snowmobile, or other similar Vehicle on any Street. 7. ANIMAL TRAFFIC REGULATIONS 7.1 A person must not at any time ride, lead, walk, hitch, tie, Park, tether, or otherwise travel with any horse or other large animal on a Street, except with the written permission of the Director of Public Works, or as permitted as part of an authorized parade or procession. 7.2 A person must not at any time leave any animal or animal-drawn Vehicle unattended on any Street. 8. BICYCLES, E-BIKES, E-SCOOTERS, SKATEBOARDS, ROLLER SKATES, & SIMILAR APPARATUS REGULATIONS 8.1 A person must not at any time: a. ride a Bicycle, E-Bike or E-Scooter contrary to a Traffic Control Device; b. use roller skates, Skateboards, roller blades or other similar means of transportation contrary to a Traffic Control Device; c. leave a Bicycle, E-Bike or E-Scooter, Skateboard or similar means of transportation on a Street or other similar public place in a position which obstructs the free movement of Traffic; d. ride a Bicycle, E-Bike, E-Scooter, roller skates, Skateboards, roller blades or other similar means of transportation on the Sidewalks in the Downtown Area; Page I 12 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations e. ride a Motorcycle anywhere other than a Roadway; nor f. ride an E-Bike that has been modified so that it is capable of generating a power output exceeding 500 watts anywhere other than a Roadway. 9. PEDESTRIAN REGULATIONS 9. I A Pedestrian must not at any time: a. Stand on the Roadway or Sidewalk in such a matter as to obstruct, impede or interfere with Traffic; b. leave the Curb, or other place of safety and walk or run into the path of a Motor Vehicle that is so close that it is impractical for the person operating the Motor Vehicle to Stop; c. walk on a Roadway if a Sidewalk or shoulder or other space is available for the use of Pedestrians; d. when crossing a Street with a marked Crosswalk, cross outside the limits of the markings; e. cross a Street in contravention of a Traffic Control Device; or f. when crossing a Street at any point other than within Crosswalk, fail to give the right of way to all Vehicles on the Roadway. 10. SNOW REMOVAL REGULATIONS 10.1 An owner or occupier of a business property must remove any accumulation of snow, ice, or dirt on any Sidewalk abutting the business property no later than 12 p.m. of any day. 10.2 An owner or occupier ofreal property must immediately remove any snow or ice from the roof or other parts of any structure situated adjacent to or abutting on any portion of a Sidewalk or Roadway if the snow or ice may create a hazard or danger to persons using the Sidewalk or Roadway or poses a threat of falling on the adjacent or abutting Sidewalk or Street. 10.3 All owners or occupiers ofreal property must remove all material, unlicensed equipment, or any obstruction that may interfere with the removal of snow from a Roadway no later than November 1 of the current year to March 31 of the following year. 11. PROTECTION OF STREETS, SIDEWALKS AND SIGNS REGULATIONS 11.1 A person must not at any time place, erect, remove or alter any sign, structure or other device on or over a Street. 11.2 A person must not without a Temporary Licence of Occupation conduct commercial activity on a Street, including the Sidewalk or Boulevard, including: a. placing or causing to be placed any merchandise, Vehicle or other chattel of any nature on a Street, trail, park or other similar public place for the purpose of sale or display; or b. operating or causing to be operated a business. 11.3 A person must not at any time mark, imprint, or deface in any manner whatsoever a Street or a structure situated upon a Street. Page I 13 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations 11.4 A person must not operate a Tracked Vehicle, whether equipped with road plates or not, on a Street, including the Sidewalk and Boulevard, without written approval issued by the Director of Public Works or designate who may impose such terms and conditions as deemed necessary or convenient for the protection of the Street or the management of Traffic. 11.5 A person must not at any time excavate in or disturb the surface of any Street without written approval issued by the Director of Public Works or designate who may impose such terms and conditions as deemed necessary or convenient for the protection of the Street or the management of Traffic. 11.6 A person must not at any time destroy or injure any tree, shrub, flower, foliage, or other growing thing on a Boulevard. 11. 7 An owner or occupier of real property abutting a Street, must cause all trees, shrubs or other vegetation on their property to be properly trimmed and cut back, so as to prevent physically or visually obstructing Pedestrian and Vehicle Traffic on the Street, including the Sidewalk and Boulevard, abutting their property. 11.8 An owner or occupier of property abutting a Street, Sidewalk or other similar public place must not at any time allow or permit any earth, rocks, stones, liquids, logs or stumps or other things to cave, fall, crumble, slide, flow or accumulate from such property onto or over such Street or other similar public place. 12. EXEMPTIONS 12 .1 Despite anything elsewhere contained in the Bylaw, the provisions related to Stopping or Parking of Vehicles shall not apply to: a. Emergency Vehicles; b. municipal Vehicles identified by a sign or insignia as belonging to the Town; c. government Vehicles identified by a sign or insignia as belonging to a governmental entity other than the Town; d. Vehicles operated by a Peace Officer; e. towing service Vehicles; or f. armored carriers, while such Vehicles are engaged in work that requires the Stopping or Parking at that location. The exemption does not relieve the person operating such Vehicles from the duty to take precautions to indicate the presence of such Vehicles on the Street while so Parked or Stopped. 12.2 Unless the context otherwise requires, the provisions of this Bylaw do not apply to persons, Vehicles and to other equipment while engaged in Highway, Street or Public Utilities construction or maintenance work on, under or over the surface of a Highway or Street while at the site of such work but do apply while the persons, Vehicles or other equipment is traveling to or from the site of such work. 12.3 Vehicles are not in violation of this bylaw if they are Parked, Stopped or Standing on the Page I 14 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations portion ofland between a Roadway and the adjoining property, also referred to as a Boulevard: a. on a Street with Curbs: at least thirty (30) centimetres from the edge of the Curb, not including: i. Sidewalks, ditches, or the portion land from a Curb to a Sidewalk. b. on a Street without Curbs: at least thirty (30) centimetres from the edge of the Roadway, not including: ii. Sidewalks, ditches. 13. VIOLATIONS OF BYLAW 13.1 Where a Motor Vehicle, Trailer, a Bicycle, E-Bike, E-Scooter, roller skates, Skateboards, roller blades or other similar means of transportation is driven, used, Parked, or left in contravention of the provisions of this Bylaw: a. the registered Owner of a Motor Vehicle or Trailer is guilty of the contravention and liable to the penalty provided in this Bylaw, unless the Owner establishes that at the time of the contravention the Vehicle or Trailer was not being driven, used, Parked, or left with the Owner's consent in which case if the Operator can be identified, the Operator of the Motor Vehicle or Trailer is guilty of the contravention and liable to the penalty provided in this Bylaw; b. the most recently registered Owner of an unregistered Motor Vehicle or Trailer is guilty of the contravention and liable to the penalty provided in this Bylaw, unless the most recently registered Owner establishes that at the time of the contravention the Vehicle or Trailer was not being driven, used, Parked, or left with the Owner's consent; or c. the Operator of any other type of unregistered Vehicle, Bicycle, or other similar device is guilty of the contravention and liable to the penalty provided in this Bylaw. 13.2 The Owner is responsible for establishing that the Vehicle or Trailer was in the possession of some other person without the Owner's consent. 13.3 Every person who violates any provision of this Bylaw, or who suffers or permits any act or thing to be done in contravention of or in violation of any of the provisions of this Bylaw, or who neglects to do, or refrains from doing anything required to be done by any of the provisions of this Bylaw, commits an offence, and each day that a violation continues constitutes a separate offence. 13.4 In addition to all other penalties herein provided, any person causing damage to any Street, Sidewalk, or Boulevard or any person being the Owner or Operator of any Vehicle which causes damage to any Street, Sidewalk or Boulevard shall be responsible for the cost of repairing such damage to the satisfaction of the Town. 13.5 Upon conviction ofan offence under this Bylaw, a person is liable to pay: a. a fine of not less than $1,000 and up to $50,000 if proceedings are brought under the Offence Act; or b. the fine imposed for that offence as set out in the" Town of Golden Municipal Ticket Information Utilization Bylaw No. I 035" or "Town of Golden Bylaw Notice Adjudication System Bylaw No. Page I 15 Town of Golden Bylaw 1482, 2024 Town of Golden Traffic, Parking & Streets Regulations 1475, 2022". 14. IMPOUNDMENT 14.1 A Peace Officer is authorized to remove, detain or impound a Motor Vehicle, Bicycle, or other similar device when found Standing or Parked: a. in violation of any provision of this Bylaw; b. in a position that causes it to interfere with removal of snow, ice or sand from a Street; c. in a position that causes it to interfere with firefighting; d. in a position that causes it to interfere with the normal flow of Traffic on a Street; e. in a position that causes it to interfere with the construction, improvement, alteration, extension, widening, marking repair or maintenance of a Street; f. in a position that causes it to interfere with a Special Event authorized by the Town; g. apparently abandoned on a Street; or h. without valid license plates displayed as required by the Motor Vehicle Act. 14.2 The Town or any of its employees shall not be held responsible for any damage suffered to a Vehicle, Bicycle, or other similar device by vandalism, theft or fire while the Vehicle, Bicycle, or other similar device is being removed, detained or impounded under this Bylaw. 14.3 Prior to the release of a Vehicle, Bicycle, or other similar device that has been removed, detained, or impounded under this Bylaw, the Owner or an agent of the Owner must pay all fees and charges imposed for its removal, care or storage. 14.4 If a Motor Vehicle is removed, detained or impounded, written notice (if possible) shall be given to the registered Owner at the most recent address shown on the records of the Registrar of Motor Vehicles advising the Owner of the seizure, the costs, and the requirement to claim and repossess the Vehicle within thirty (30) days. 14.5 A Vehicle, Bicycle, or other similar device that has not been claimed after being detained or impounded for thirty (30) consecutive days: a. may be sold at a public auction; or b. where a Peace Officer determines at their sole discretion that the value or condition of the property does not warrant a public auction, the property shall be disposed of. 14.6 The Town may apply any of the sale proceeds from an auction to any outstanding fees and charges imposed for the removal, care or storage of the property. 15. SEVERABILITY 15 .1 If any portion of this Bylaw is found invalid by a court of competent jurisdiction, the invalid portion is severed without effect on the remaining portions of the bylaw. 16. AMENDMENTS TO OTHER BYLAWS 17.1 On adoption of this Bylaw, the Town of Golden Bylaw Notice and Adjudication System Bylaw No. 1475, 2022 (the "Bylaw Adjudication Bylaw") is hereby amended by inserting the Schedule attached to this Bylaw as Schedule A as a new Schedule "F" in the Bylaw Adjudication Bylaw. 18. REPEAL 18.1 The following bylaws and any amendments thereto, are hereby repealed in their entirety.
