CORPORATION OF THE VILLAGE OF HAZELTON BYLAW NO. 534, 2024 A bylaw to regulate rates, terms and conditions for the disposal of solid waste WHEREAS the Council of the Village of Hazelton, in accordance with sections 8(2), (3), (7) and (8) and 194 of the Community Charter, may establish a Garbage Collection Service, and impose fees and charges in relation to that Service; NOW THEREFORE the Council of the Village of Hazelton in open meeting assembled, enacts as follows: 1. SCHEDULES: Rates for the collection of Garbage are established as set out in Schedule "A" of this bylaw. Interpretation 2. IN THIS BYLAW: "Chief Administrative Officer" means that person appointed by the Council of the Village of Hazelton; "Council" means the municipal Council of the Village of Hazelton; "Dwelling" means any building or place of residence including apartments and secondary suites, used for the purpose of providing a place of permanent residence therein; "Garbage" means any and all rejected, abandoned, discarded or waste materials normally used in a dwelling, and shall specifically include food waste, containers used for food, drink and other household items, packing, floor sweepings, crockery, ashes, but does not include: grass, tree or hedge clippings or any other garden refuse or wood or metal waste, waste or rubbish from building, renovating or re-modeling; "Owner" means the registered Owner of a property; "Prohibited Waste" includes hazardous wastes, explosives, herbicides, pesticides, poisons, batteries, waste oils and liquids, biomedical waste and all wastes defined under the Hazardous Waste Regulation of Environmental Management Act; "Receptacle" means the standardized 240L or 360L bin obtainable through the Village of Hazelton for use with the Auto-Loading Refuse Vehicle. "Recycling" means cardboard, scrap metal, motor vehicle bodies, propane tanks, mixed recyclables, glass packaging, and any other product included in an approved stewardship plan under the Environmental Management Act, Recycling Regulation BC, as amended; "Village" means the Corporation of the Village of Hazelton. 3. ESTABLISHMENT AND CONTROL OF GARBAGE COLLECTION SYSTEM: a) Except as provided in this bylaw, all persons within the Village shall make use of the system established and provided by the Village for the collection and disposal of Garbage. b) A Garbage collection system is established to collect, remove, and dispose of Garbage from premises within the Village. c) The Village reserves the right to refuse to collect certain types and quantities of Garbage from any premises. d) No person shall throw, sweep or in any way cause refuse or litter of any kind to be placed on any other property or public place or property in the Village. e) No person shall bring Garbage into the Village. f) The Owner of any building or premises in the Village who is not an occupant thereof, shall be guilty of an offence against this bylaw where the occupant has contravened any requirement of this bylaw. 4. RECEPTACLES: a) The Owner of every building or premises shall use and maintain a Receptacle in good repair and sanitary condition. Replacement of lost or stolen Receptacles shall be at the Owner's expense at the rates laid out in schedule A. b) Containers other than the standard Receptacles provided by the Village of Hazelton are not permitted, and the refuse therein shall not be collected. c) A total of one Receptacle per residential household, per pick up shall be permitted. Disposal of Garbage over this limit shall be the responsibility of the occupant. d) Any Garbage that cannot be placed in a Receptacle shall not be collected on regular collection days. e) It is the sole responsibility of the Owner to provide safe storage and/or to make modifications to the Receptacle in order to ensure refuse is not accessible to animals. 5. LOCATION AND COLLECTION: a) Receptacles shall be kept on the Owners premises at all times. No Receptacles shall be placed or kept on any public property or place. b) Residential Garbage shall be placed at the property line on collection day in a timely manner. Receptacles that are not at the curb before 9 a.m. shall not be collected. c) All Garbage shall be placed within two feet of the curb and at least two feet from all other obstacles and obstructions including other bins. Receptacles not meeting these specifications shall not be collected. 6. RECYCLING: a) Recycling shall not be collected as refuse. b) Transport of Recycling to a recycling collection depot is the sole responsibility of the Owner/Occupant of a Dwelling. 7. DISPOSAL REQUIREMENTS AND PROHIBITIONS: a) Wet Garbage and kitchen waste shall be drained and wrapped before being placed in Receptacles. b) Explosive or flammable waste shall not be put out for collection. Ashes shall be completely quenched. c) Noxious, offensive or unwholesome substances shall not be put out for collection. d) Prohibited waste shall not be put out for collection. 8. CONSTRUCTION AND DEMOLITION: No person carrying out building construction, renovation or demolition within the Village shall: a) place or dump the waste accumulating from such activity on any public place or property; b) accumulate waste from such activity on the premises without disposing of it within such time as the Administrator, by written notice, may deem reasonable; or c) use the Village's Garbage collection system to dispose of such waste. 9. RATES: a) All Owners shall be subject to the fees applicable as per Schedule "A". b) The fees shall be due and payable annually at the Village Office for the period of January to December. c) A 5% penalty shall apply to the outstanding amount for each billing if the bill is not paid by the due date. d) Requesting for the stoppage of Garbage Collection Service shall be in written form and subject to approval by the Chief Administrative Officer or the discretion of the Village Council. 10. PENALTY: a) Any person who contravenes this bylaw or who neglects to do or refrains from doing anything required by this bylaw is guilty of an offence and shall be liable on summary conviction to a fine not exceeding five thousand ($5,000.00) dollars plus the costs of each offence. 11. REPEAL: Garbage Collection, Regulations and Rates Bylaw No. 520, 2021 and all other amendments are hereby repealed in their entirety. 12.
