Facilities Rental Rates Amendment
Bylaw No. 2748, 2023
A bylaw to amend City of Kimberley Recreation Facilities Rental Rates Bylaw No. 2579, 2017.
The Council of the City of Kimberley, in open meeting assembled, enacts as follows:
Title
1.
This Bylaw may be cited for all purposes as the "City of Kimberley Recreation
Facilities Rental Rates Amendment
Bylaw No. 2748, 2023".
Severability
2.
Except as otherwise provided, words and phrases used inthis Bylaw will be interpreted
consistently with the Community Charter and the Interpretation Act. A reference to a
statute inthis Bylaw refers to a statute ofthe Province of British Columbia, and a reference
to any statute or bylaw refers to that enactment as it may be amended or replaced from
time to time.
Recitals and headings
are for convenient
reference
and must not be
construed
as de?ning
or limiting the scope
or intent of the content.
Any section,
subsection,
paragraph, subparagraph
or clause of this bylaw is for any reason held invalid
by the decision of a Court of competent jurisdiction, then the invalid portion shall be
severed and the severance shall not affect the validity of the remainder of the bylaw.
Amendment
3.
City of Kimberley Recreation Facilities Rental Rates Bylaw No. 2579, 2017 is amended as
follows:
3.1
THAT section 3 Definitions be added as follows:
Inthis Bylaw the followingterms shall have the following meaning:
Access Card
means walking track OR shinny, public skate, noon hour;
Adult
means a person 19 years of age to 59 years of age;
Child
means a person 3 years of age to 6 years of age;
City
means the Corporation of the City of Kimberley;
Commercial
means use of a municipal facility by;
Use
(a) any individual,group or organization OR means any individualor
group that is issued a Facility Rental Agreement for the use of a
recreation Facilityfor the purpose of generating a pro?t, whose use
of the facility is primarilyfor ?nancial gain;
Facility Rental
means a written agreement
between a person and the City

authorizing use of a
Municipal Facility;
Family
means one or two parents or legal guardians and their dependent
children;

means use of a municipal facility by;
(a) any individual, group or organization resident inthe City of
Kimberley or whose majority of members are residents of the
City of Kimberley; and
(b) ) whose use of the municipal facility is not for ?nancial gain
except for the purpose of not for pro?t
means 3:00PM to 11PM Monday to Sunday, excluding Statutory
Holidays;
means 6:00 AMto 3:00 PM, Monday to Sunday, excluding Statutory
Holidays;
means use of a municipal facility by;
(a) ) a person who is not a Resident of the City; or
(b) any incorporated entity, group or organization whose
majority of members or shareholders are not Residents of
the City.
means a person whose primary residence or place of business is
withinthe boundaries of the City;
means a person who is a party to a Rental Agreement withthe City
for the rental of a Municipal Facility;
means use of a municipal facility by School District6 (SDG)as per
joint use agreement;
means a person 60 years of age and over;
means an event with an anticipated large attendance level including
but not limited to tournaments, championships, tradeshows, fairs,
large meetings or gatherings, or City sponsored events;
means person 13 years of age to 18 years of age;
Youth
means person 7 years of age to 12 years of age;
3.3
That Section 3 - Imposition of fees be renumbered Section 4.
3.4
That Section 4
-- Repeal of previous bylaw be renumbered Section 5.
3.5
THAT Schedules "A"."B","C","D","E"and "F"be deleted and replaced with
Schedules "",A"",B"",C"",D"E"and "F"attached to this bylaw.
Effective Date
4.
This bylaw becomes effective on November 1, 2023 at 0:01 am.
Read a first and second time on the 21Stday of August, 2023.
Read a third time on the 23rdday of October, 2023.
Adopted on the 30 day of October, 2023.
