## City of Kimberley ## Waterworks Rates and Regulations Bylaw No. 2797, 2025 A Bylaw to Amend 'City of Kimberley Waterworks Rates and Regulations Bylaw No. 2148, 2002' The Municipal Council of the City of Kimberley, in open meeting assembled, enacts as follows: ## 1. TITLE - 1.1 This bylaw may be cited as Bylaw No. 2797, City of Kimberley Waterworks Rates and Regulations Bylaw No. 2148, 2002, Amendment No. 23, 2025. ## 2. SEVERABILITY - 2.1 Except as otherwise provided, words and phrases used in this Bylaw will be interpreted consistently with the Community Charter and the Interpretation Act. A reference to a statute in this Bylaw refers to a statute of the Province of British Columbia, and a reference to any statute or bylaw refers to that enactment as it may be amended or replaced from time to time. Recitals and headings are for convenient reference and must not be construed as defining or limiting the scope or intent of the content. If any section, subsection, paragraph, subparagraph or clause of this bylaw is for any reason held invalid by the decision of a Court of competent jurisdiction, then the invalid portion shall be severed and the severance shall not affect the validity of the remainder of the bylaw. ## AMENDMENTS 'City of Kimberley Waterworks Rates and Regulations Bylaw No. 2148, 2002' is amended as follows: - 3.1 Schedule "A" is repealed and Schedule "A" attached hereto is hereby substituted therefore. - Schedule "B" is repealed and Schedule "B" attached hereto is hereby substituted therefore. - 3.3 Schedule "C" is repealed and Schedule "C" attached hereto is hereby substituted therefore. - Schedule "D" is repealed and Schedule "D" attached hereto is hereby substituted therefore. This Bylaw shall come into full force and effect on the 1st day of January, 2026. Read a first, second and third time on the 24" day of November, 2025. Adopted on the 8'h day of December, 2025. CARRIAGE HOUSE DWELLING means a residential dwelling unit located above a detached garage that is accessory to a principal dwelling unit located on the same parcel. DUPLEX DWELLING means a principal residential building containing two (2) dwelling units that are divided by a fire separation and share a common roof and foundation. DWELLING UNIT means the use of all or part of a building for one or more habitable rooms which constitute a self-contained unit with a separate interior or exterior entrance, used or intended to be used by one or more persons for living and sleeping purposes and containing sanitary and other rooms or facilities but not more than one (1) kitchen or set of cooking facilities. MULTIPLE UNIT DWELLING means a residential building containing three (3) or more dwelling units and includes a townhouse, apartment, seniors housing and supportive housing. SECONDARY SUITE means the residential use of all or part of a building for a self-contained dwelling unit that has been approved and issued an occupancy certificate, is clearly accessory to a principal building located on the same parcel, and may be located within or attached to the principal building. SINGLE UNIT DWELLING means a principal residential building containing one (1) dwelling unit. ## SCHEDULE "A" TO BYLAW NO. 2797, 2025 ## COMMERCIAL RATES: Each business licence issued to an owner or operator of a business located on commercial property shall result in a 1st tap charge. If the business licence is transferred to another location or cancelled, the 1st tap charge for that business shall be deemed to be cut-off from the day the City is notified.
