WHEREAS section 194 of the Community Charter authorizes municipalities by bylaw to impose fees in respect of a service of the municipality or provision of information; AND WHEREAS the Freedom of Information and Protection of Privacy Act provides for the payment of fees to a public body for certain services; NOW THEREFORE the Council of the City of Langley in an open meeting assembled enacts as follows: 1. Title This bylaw shall be cited as the "Fees and Charges Bylaw, 2010, No. 2837". 2. Definitions (1) "City" means the City of Langley. 3. Fees and Charges (1) The City imposes fees for the provision of services and information as specified in Schedules 1 to 15 inclusive as follows: Schedule 1 - Community Standards Fees Schedule 2 - Administrative Fees Schedule 3 - Animal Control Fees Schedule 4 - Building Permit Fees Schedule 5 - Business Licence Fees Schedule 6 - Controlled Substance Property Fees Schedule 7 - Engineering and Filming Service Fees Schedule 8 - Fire Protection and Safety Fees Schedule 9 - Parking Facility Fees Schedule 10 - Parks, Facilities and Special Events Fees Schedule 11 - Planning, Land and Development Fees Schedule 12 - Security Alarm System Fees Schedule 13 - Lawn Sprinkling Permit Fees Schedule 14 - Bylaw Notice Enforcement Bylaw Fees Schedule 15 - Sanitary Sewer Rates Schedule 2 - Administrative Fees Miscellaneous Corporate Document Number: 185395 (2) Fees or charges imposed under this bylaw for the provision of services or information apply instead of fees or charges imposed under other bylaws for the same services or information. A reference to a more specific matter supersedes a reference to a more general matter." 4. Liability Insurance for Facility Rentals (1) In addition to paying the facility rental fee, a person must also provide liability insurance to rent a facility listed in Schedule 10 by: (a) Paying the City an insurance liability premium according to the User Group Rating Schedule provided by the City's insurance provider; or (b) Naming the City as a co-insured on the liability insurance policy, valued at least $2 million, and provide the City with proof of coverage. 5. Severability If any portion of this bylaw is declared invalid by a court of competent jurisdiction, then the invalid portion must be severed and the remainder of the bylaw is deemed valid. 6. Force and Effect This bylaw shall come into force and effect on January 1, 2011. 7. Repeal (1) The City's Fees and Charges Bylaw, 2008, No. 2678 and all amendments thereto are repealed. Refunds for Permit Fees listed in Schedule 4: (a) The City may issue a refund of: (i) 100% if the person who has paid the permit fee applies for the refund in writing before the City has issued the permit; (ii) 50% if the person who has paid the permit fee applies for the refund in writing after the City has issued the permit. The above fees shall be increased on January 1 of each year by the increase in the Statistics Canada Consumer Price Index for Vancouver between August 1 in the year prior to the preceding year and August 1 in the preceding year; 2. The Licence fee shall be pro-rated on a monthly basis for any business licence that is issued for a new business after January 1.
