A Delete s.10 and schedule A March 4, 1991 465 3.1(3) Amends s.5 September 2, 2014 497 5 Amends s.5 December 20, 2016 / January 1, 2017 -2- THE VILLAGE OF LIONS BAY SUBDIVISION BYLAW NO. 141, 1985 A Bylaw to Regulate the Subdivision of Land The Council of the Village of Lions Bay in open meeting assembled hereby enacts as follows: 1. This bylaw may be cited for all purposes as "Subdivision Bylaw No. 141, 1985". 2. This bylaw applies to the whole of the territorial area of the Village of Lions Bay. 3. No person shall subdivide land in the Village of Lions Bay contrary to the provisions of this bylaw. 4. An applicant shall submit his application for subdivision in writing. 5. Fees for services that may be or are provided under this Bylaw or Development Application Procedures and Fees Bylaw No. 431, 2011, as amended, shall be payable as set out in Fees Bylaw No. 497, 2016, as amended. These fees shall be in addition to any fees prescribed under the Land Titles Act¸ RSBC 1996, Chapter 250. [Amended by Bylaw 465] [Amended by Fees Bylaw No. 497, 2016] 6. The application shall be made in writing and shall be supported by that material required by the Land Title Act and this bylaw. 7. A subdivision shall not be approved unless it: (a) is suited to the configuration, topography and natural physical features of the land; (b) is suited to the use for which it is intended; and (c) does not make impractical the future subdivision of the land within the original parcel or of adjacent land. 8. Land shall not be subdivided where taxes levied by the Village of Lions Bay in respect of the land are in arrears or delinquent. -3- 9. For the purpose of determining minimum parcel area requirement the intended use of each parcel to be created by subdivision shall be determined in accordance with the zoning and effect at the time of approval of the plan of subdivision. 10. Any person who violates any of the provisions of this bylaw commits an offence and shall upon summary conviction be liable to a penalty not exceeding $2,000 and the cost of prosecution. 12. The Clerk Treasurer may enter at all reasonable times upon any property to ascertain whether the regulations and directions set out in this bylaw are being observed. -4-
