## DISTRICT OF LOGAN LAKE ## BYLAW NO. 631, 2008 ## A bylaw for the control of firecrackers and fireworks. WHEREAS pursuant to the Local Government Act, Council may by bylaw, establish and make regulations for the control and use of firecrackers and fireworks; NOW THEREFORE the Council of the District of Logan Lake, in open meeting assembled enacts as follows: 1. This bylaw may be cited as "District of Logan Lake Fireworks Regulations Bylaw 631, 2008". 2. Bylaw No. 598, District of Logan Lake Fire Department and Regulation Bylaw, 1988 and all amendments thereto, are hereby repealed. 3. This bylaw shall come into full force and effect upon adoption. ## Fireworks &amp; Firecrackers - (a) The manufacture, storage, transportation and sale of fireworks shall conform to the Federal Explosives Act and Explosives Regulations, as amended from time to time. - (b) The handling and discharge of fireworks, low and high hazard as defined by the Federal Explosives Act, shall conform to the "Manual of Display Fireworks", as published by the Ministry of Energy, Mines and Petroleum Resources. - (c) Except as hereinafter provided: - i) Class 7.2.1., low hazard fireworks, as defined by the Federal Explosives Act shall not be sold or discharged except between the dates of October 16 and November 1 in each year. - ii) Class 7.2.1. low hazard fireworks, as defined by the Federal Explosives Act may be sold and discharged other than on the dates specified in clause i) with the written approval of the Fire Chief. - ili) Class 7.2.1. low hazard fireworks, as defined by the Federal Explosives Act shall not be directly or indirectly sold, given or furnished to a person under the apparent age of eighteen (18) years. - (d) No person shall use, detonate, explode, offer for sale, sell or possess firecrackers. - (e) Except as provided in this Bylaw, no person shall: - 1) use, detonate, or discharge fireworks; - ii) offer for sale or sell fireworks. - (f) It shall be unlawful for any person to sell or offer for sale low hazard fireworks except: - i) during the period commencing on the 25" day of October and ending on the 31$t day of October in each year; - to a person who is at least eighteen (18) years of age; - ill) with a valid business license. - (g) No person shall sell or offer for sale a Roman candle or a noisemaker except as part of a family pack. - (h) Except as provided in subsection (e), fireworks shall not be set off, detonated or discharged at any time except on the 31st day of October. - It shall be lawful for a person who is at least eighteen (18) years of age to use, set off or discharge low hazard fireworks on private property with the consent of the owner of the property. - (i) The Fire Chief may issue a Fireworks Permit attached as Schedule "A" and forming a part of this bylaw to a person who is at least eighteen (18) years of age to use, detonate or discharge low hazard fireworks for a special occasion at any time of the year other than the date specified in subsection (c) on such terms and conditions as the Fire Chief may specify. "Bylaw 758" - (K) No person shall set off or discharge fireworks on public property without a permit from the Fire Chief. - (1) No person shall point or direct a firework at any person, animal, motor vehicle, building or improvement where such firework is in the process of exploding or detonating, and where the firework is capable of projecting or discharging a charge or pyrotechnical effect. - (m) No person shall discharge a firework within thirty (30) meters of a gas station or service station, lumber yard, propane tank or other location where flammable materials are stored. - (n) A local assistant under the Fire Services Act or a Peace Officer who observes any contravention of the requirement of subsection (a), (b), (c), (d), (f), (g) or (h) may confiscate the fireworks. - (0) Every person who sells low hazard fireworks to the public shall: - not sell fireworks to any person less than 18 years of age; - only display fireworks in a glass case with a top or behind a counter and where the fireworks are not exposed to the sun, direct heat or any other source of ignition; - have not more than 25 kg (55 Ib) of fireworks on display; - iv) not permit customers or members of the public to handle fireworks prior to a sale of those fireworks; - vi) store fireworks that are not on display in a separate room away from any and all sources of ignition; - V) not store more than 100 kg (220 Ib) of fireworks on the premises; - VIl) maintain a functional ABC dry chemical or pressure water fire extinguisher of at least 5 Ib size in each of the rooms in which fireworks are displayed or stored; - ix) post and keep posted "No Smoking" signs so that they are clearly visible from all parts of the rooms in which the fireworks are displayed or stored - vili) not smoke or permit any other person to smoke tobacco or any other substance in any of the rooms in which fireworks are displayed or sold; and - The Fire Chief may issue a permit to a person to use, detonate or discharge high hazard fireworks or indoor fireworks on such terms and conditions as the Fire Chief may specify, if the permit applicant: - is at least 18 years of age and holds a valid fireworks supervisor card; - iii) provides the Fire Chief a site map, acceptable to the Fire Chief, showing where the fireworks will be used and stored, and the location of fire extinguishers; and - is the person who will supervise the use, detonation or discharge of the fireworks; - provides to the Fire Chief proof of liability insurance coverage for the use of the fireworks with limits and on terms acceptable to the Fire Chief. - (9) i) No person shall conduct a public pyrotechnics display without a permit from the Fire Chief Il) A permit issued under subsection (q) i) shall be on such terms and conditions as the Fire Chief may - specify, including the attendance of members at the display for fire protection and emergency response. No person shall conduct a flame effects display before an audience without a plan and a representative demonstration approved by the Fire Chief.
